Nordyke – Incorporation of the Second Amendment to Apply to the States

Most, but not all, of the Bill of Rights have been held by the U.S. Supreme Court to apply to the states through the doctrine of "selective incorporation" under the 14th amendment due process clause. As I've argued here previously, it is improper that not ALL of the Bill of Rights have been applied to the states through the 14th amendment privileges or immunities clause ever since the amendment's 1868 ratification, since that was in fact the clearly-stated intent of the framers of the 14th amendment.

Yesterday, in Nordyke v. King, the Ninth Circuit Court of Appeals correctly held that the Second Amendment is incorporated to apply to the states - but it did so using the same "selective incorporation" process instead of the privileges or immunities clause. (Professors Michael Kent Curtis, Richard Aynes, William Van Alstyne and I argued in an amicus (friend of the court) brief in the case in favor of the privileges or immunities clause approach.) Actually the court's use of selective incorporation is not surprising; it will take a decision from the U.S. Supreme Court to re-invigorate the privileges or immunities clause - which has lain dormant since the egregious 1873 Slaughter-House Cases opinion which buried it alive. On another positive note, however, the Ninth Circuit did acknowledge our argument in footnote 5 (citing to my Missouri Law Review article):

"We are aware that judges and academics have criticized Slaughter-House’s reading of the Privileges or Immunities Clause. See, e.g., Saenz v. Roe, 526 U.S. 489, 527-28 (1999) (Thomas, J., dissenting) (“Because I believe that the demise of the Privileges or Immunities Clause has contributed in no small part to the current disarray of [the Supreme Court’s] Fourteenth Amendment jurisprudence, I would be open to reevaluating its meaning in an appropriate case.”); id. at 522 n.1 (collecting academic sources); Michael Anthony Lawrence, Second Amendment Incorporation Through the Fourteenth Amendment Privileges or Immunities and Due Process Clauses, 72 Mo. L. Rev. 1, 12-35 (2007); see also Akhil Reed Amar, The Bill of Rights 163-230 (1998) (arguing that the Privileges or Immunities Clause applies against the states all “personal privileges” of individual citizens, whether enumerated in the Bill of Rights or not, but not the rights of the states or the general public)...."

For its part, the Seventh Circuit Court of Appeals in McDonald v. Chicago will soon decide whether the second amendment is incorporated to apply to the states. We have also filed an amicus brief in McDonald, arguing again for incorporation through the privileges or immunities clause. In all likelihood, the Seventh Circuit also will play it safe and find the second amendment is "selectively" incorporated through the due process clause.

Both of these cases are sure to be appealed to the U.S. Supreme Court - and that will be where our privileges or immunities clause arguments will be truly considered (we HOPE). As I claim in my earlier works, a judicial reinvigoration of the privileges or immunities clause can have profound effects on how we view individual liberty vis-a-vis government in America.

GOP Congressional candidate Alan West says Fort Hood tragedy "proof" Jihadists infiltrating our Military

The Hill reported earlier in the day, that Alan West, a candidate for US House from Florida for 2010, and long a favorite of Libertarian Republicans, made the following remarks:

"This enemy preys on downtrodden soldiers and teaches them extremism will lift them up," West said in a statement. "Our soldiers are being brainwashed."

The release added that West claims "the horrible tragedy at Fort Hood is proof the enemy is infiltrating our military."

West went on to comment:

[The Military should find ways] "to prevent Islamic extremism from penetrating our bases."

West said "it is imperative that we take steps to make sure this does not happen again" and that it is important to "objectively assess this situation."

West will be challening liberal Democrat Ron Klein in a Broward County district. In 2008, an off Election Year for the GOP, West polled 45% against Klein.

West gained major media attention in 2003 during the early months of the Iraq War, when he was called before a Military Tribunal to answer questions over a combat incident. West pulled his weapon and threatened an Iraqi insurgent POW for information regarding the detenion of men in his unit.

More recently, West has co-hosted functions in South Florida for Dutch libertarian Parliamentarian Geert Wilders, and is a friend and close political ally of libertarian blogger Pamela Geller of Atlas Shrugs.

Republican Party of Texas Welcomes State Rep. Chuck Hopson to the GOP

Austin - The Republican Party of Texas is pleased to welcome State Rep. Chuck Hopson (HD-11, Jacksonville) to the GOP. The now former Democratic State Representative, first elected to his office in 2000, is announcing today that he is switching to the Republican Party. Hopson's switch follows a wave of Democrats in Hardin and Palo Pinto Counties who switched to the GOP earlier this week.

“The wave of Republican strength rolls on,” said Republican Party of Texas Chairman Cathie Adams. “Texans see how the Pelosi Democrats are behaving in Washington, insulting the Tea Partiers and locking our state out of the health care bill negotiations, and they no longer want to be associated with the Democratic Party. There are more party switches to come, as more conservative Texas Democrats make the choice to become Republicans. Dozens of Democrats across Texas are known to be considering switching or are already in the process of doing so.

Rand Paul questioned on his Libertarian ties, Father’s controversial Foreign Policy views

Rand Paul has pulled ahead of main rival Trey Greyson. From SurveyUSA:

Bowling Green eye doctor Rand Paul has no political experience, but with the support of the same people who backed his Dad, Texas Congressman Ron Paul, when he ran for president. Rand Paul has now at least pulled even with Secretary of State Trey Grayon in the GOP U.S. Senate primary.

Libertarian "RINO" wins County Council seat in Erie, Pennsylvania

Bill Beeman is a former Libertarian Party member. He recently switched parties to Republican, and became the non-establishment GOP nominee for County Council District 6 in Erie, Pennsylvania. He was staunchly opposed by the local establishment. From GoErie.com, Nov. 4:

The county executive contest may be the marquee race, but we repeat our concerns about Ebert "Bill" Beeman, the Republican-in-name-only candidate running for Erie County Council's 6th District seat. Beeman's radical anti-government views would make it difficult to achieve consensus on any projects to improve the region. Write-in candidate Dave Mitchell, the incumbent, has worked with the rest of Erie County Council for the common good. He deserves your support.

Beeman runs a local Notary business in Erie. He is also a known Tax Protester. In the 1980s, Beeman spent some time in jail for refusal to pay back taxes and local fines for violations of various ordinances he believed to be unjust. From the Pennsylvania Notary Blog:

During his campaign, he stated his desire to eliminate mandated county goverment services, including the Erie County Public Library. Beeman also advocated the release of nonviolent offenders from the Erie County Prison and a 10 percent pay cut for all non-bargaining county employees.

Republicans sweep Westchester County, New York on Anti-Tax message

Fiery Fiscal Conservative Republican Rob Astorino crushed 3-term incumbent Democrat Andrew Spano for Westchester County Executive. Astorino is described as a "relative unknown."

The day after his win, Astorino commented to WNYC radio:

"This is a very big message to Albany that they cannot keep taxing and spending the way they are."

LoHud.com (Lower Hudson Valley) reports:

It wasn't quite a red wave that washed across northern Westchester Tuesday, but it certainly wasn't a bad night to be a Republican.

Voters ousted Democratic supervisors in Yorktown and Lewisboro and elected GOP majorities in both towns, as they did in North Castle,?North Salem and Somers. A 24-year-old Republican even cracked the all-Democratic Ossining Town Board.

As one specific example, Yorktown shifted from a Town Board of 4-1Democrat to 3-2 Republican.

The issues that caused the stunning GOP Wins? Taxes and the Economy. LowHud interviewed two local Voters:

Taxes are out of control in Yorktown, voter and mother of two Lisa Starkey said.

"It's a great community to live in, but they're making it unaffordable," she said.

That's what brought John Lemke out to vote for the Republican slate.

"Rising taxes are creating a real hardship on the residents here," Lemke said.

Democrat elected officials have become such a pariah in this heavily Blue New York City suburb that one Democrat even got beat by a Libertarian. Continuing:

Republican Barbara Comstock defeated Democratic incumbent Margi Vanderhye in the race for that seat by the razor-thin margin of 50.6 percent to 49.2 percent.

Meanwhile, Republican Scott Garrett nipped incumbent Democrat Shannon Valentine in Lynchburg, 50.5 percent to 49.5 percent, with the race called by the Associated Press Wednesday morning.

"A lot of the pickups were in urban areas," said Republican Del. Dave Albo of Fairfax. "It's really going to help us out in Richmond."

Seven Hardin County Elected Democrats Switch to the Republican Party

Austin - The Republican Party of Texas is pleased to welcome several Democratic officeholders who switched parties today and became Republicans. Today in Hardin County, seven Democrats announced that they are switching parties to become Republicans. The new Republicans include Sheriff Ed Cain, County Judge Billy Caraway and Precinct 4 Commissioner Bobby Franklin. And at noon Tuesday in Palo Pinto County, Precinct 5 Justice of the Peace Bobby Hart switched his party affiliation and became a Republican. Three other Palo Pinto County Democratic officeholders indicated a strong interest in switching parties. The Republican Party of Texas has been working to build Republican strength at the local level, by working with county parties, recruiting candidates for the GOP primary and by recruiting conservative Democrats to switch parties.

“The wave of Republican strength continues to build,” said Republican Party of Texas Chairman Cathie Adams. “Americans are simply fed up with the Washington Democrats’ failing leftwing policies and government power grabs. The elections in Virginia and New Jersey Tuesday prove that Republicans are gaining momentum as the voters tell Democrats 'Enough is enough!.' We welcome these newly minted Republicans and anyone else who will stand with us for more freedom, lower taxes and smaller government.”

There are more party switches to come, as more conservative Texas Democrats make the choice to become Republicans. Libertarian Dan Halloran wins City Council Seat in New York City

Dan Halloran was elected to the Queens City Council in District 19. He was nominated by the Republican, Conservative, Independent and Libertarian parties. Dan is simultaneously a Libertarian Party member and a registered Republican. He serves as State Chairman of the Republican Liberty Caucus.

Note - Dan Halloran has just become the highest elected official for the Libertarian Party in the entire Nation. He also has the distinction of serving on the largest city council as a Libertarian Councilman in the entire 36 year history of the Libertarian Party. Previously Libertarians have been elected to City Councils in Flagstaff, AZ, Juneau, AK, Moreno Valley, CA, and Birmingham, AL. Currently, LPers serve on city councils in Springfield, MO and Indianapolis.

In Iowa two Libertarians were elected:

Roger Fritz was elected Mayor of Roland.

Bill Lynn was elected as an Alderman in Davenport.

Meanwhile, Nick Taiber got 46% running for City Council in Cedar Falls. He advances to a runoff on December 1.

In Georgia Libertarian Party members racked up 1 victory and a number of high percentage near misses. From the LPGA:

Chris Neill, running for Mayor of Marietta, got 14%.

Richard Segal, running for City Council in Douglasville, got 41%.

Jeffrey Sexton, running for City Council in Leesburg, got 22%.

Kellie Weeks, running for School Board in Gainesville, got 32%.

Dr. Thomas Smoot, running for School Board in Valdosta, got 24%.

In North Carolina, Matt Drew (photo) got 27% in a runoff election for City Council in Durham. He was running against a longtime Democrat incumbent, and had beaten 3 other candidates to advance to the run-off.

Michigan:

Mark Byrne narrowly missed re-election to the Port Huron City Council.

Tom Hren got 8% running for City Commission in Big Rapids.

Andy LeCureaux was re-elected to the Hazel Park City Council.

Besides Matt Drew's race in Durham, Libertarians ran for Mayor of two other major US cities:

Joseph Dobrian got 0.2% running for Mayor of New York City. (5th place out of a field of 8).

In Minnesota, Christopher Clark got 3.0% running for Mayor of Minneapolis.

This is all very exciting. I almost can't sleep because I'm so thrilled. This victory, and all of the GOP victories last night, are a repudiation of the direction Obama is taking us in.

I was very young when Whitman was elected Governor, so this will be the first Republican Governor I will really remember.

The RNC owes us supporters of Governor Christie quite a debt. This was an exhausting and Herculean effort to elect a Republican Governor in this very utlra- liberal state. They also owe us for taking out Corzine. He has always been a billion dollar thorn in the side of the national Party in DC.

Republicans should recognize this electoral tsunami for what it is, a harbinger of a Republican surge in the coming midterm elections. They should remember where the first 'shot' was fired, and the candidate who led the way.

Thank you, Eric for all of your help in tirelessly promoting the Christie campaign. Once again, your extraordinary talents were needed, and you were there offering your help in any way you could. Your urging on of moderate and libertarian Republicans to back Christie made a difference. This victory is yours tonight, even if you do live just south of New Jersey.

Races to Watch for Libertarian Republicans 2009

Last night, Dave Nalle, National Chairman of the Republican Liberty Caucus joined myself and fellow RLCer Dan Sheill of Michigan, on a special election edition of "Libertarian Politics Live." For a good 50 minutes we looked at all the various races around the US from a libertarian perspective. You can listen to the show on the side right bar at the Blog Talk Radio button.

To recap:

Bob McDonnell and Chris Christie are of course, in the two most important races in the Nation. While both men are solid conservatives, McDonnell has a pro-growth/pro-jobs libertarian streak on economics. Christie has tapped a "fiscally conservative/socially tolerant" running mate in Kim Guadagno.

For Attorney General in Virginia, Ken Cuccinelli comes from the social conservative side of the spectrum. However, Cuccinelli has called himself a "libertarian" on occasion, and was slammed by the Democrats and the liberal media in Virginia for having once supporte a "Cato Institute" inspired plan to privatize Social Security.

Note - Both states also have races for state legislature to watch.

For New York City Mayor a colorful and flamboyant Libertarian Party member Joseph Dobrian, is the "real Republican," in the race against liberal nanny-stater Michael Bloomberg on the Republican line. Dobrian is in favor of repealing Bloomberg's city-wide smoking ban on bars and restaurants, and promises to "make NYC fun again."

Also, Republican Liberty Caucus State Coordinator Dan Halloran is running for City Council in Queens, and is given at least even odds of winning in this heavily Democrat City.

Of course, the most talked about New York race around the country is Doug Hoffman for US Congress CD 23. While not a libertarian, Hoffman is a fan of Glenn Beck and is the "Tea Party" candidate.

In southern Michigan, Greg Merle is running in a special election for State Senate. Merle is running on the Libertarian line, though, he's a former, and maybe even future Republican. He says no matter the outcome of the election, he plans to run for Congress in 2010 as a Republican in the GOP primaries.

Also in Michigan, Mike Byrne, Libertarian City Councilman in Port Huron, is running for reelection. Mike recently received the endorsement of the local paper in town.

Libertarian Matt Drew is the underdog in the race for Mayor of Durham, NC against an ultra-liberal establishment Democrat Howard Clement. There is no Republican on the ballot. Regardless of the final outcome, Drew may have already won in many respects. He made it to the run-off in a 5-person field; a first for a Libertarian Party candidate in North Carolina.

Other races include: Mayor of Atlanta where Mary Norwood is the "fiscally conservative," choice; King County Executive (Seattle) where Susan Hutchison is the budget hawk anti-establishment candidate.

Two ballot initiatives of great interest to libertarians include the TABOR (Taxpayer Bill of Rights) in both Maine and Washington State. Both are expected to pass.

HUGE NEWS OUT OF TEXAS!! Scores of Democrat County Officials Switch to Republican

Libertarian Republican has just learned that GOP officials believe that as many as 50 to 70 elected officials on the county level throughout Texas could be switching from Democrat to Republican by the filing date for the 2010 elections. The news comes to us from Bryan Preston, Communications Director for the Republican Party of Texas out of Austin. Preston hosted an exclusive conference call for Right bloggers earlier this afternoon, including LR, and libertarian Republican Stacy McCain of The Other McCain.

The special guest for the conference call was newly appointed RPT Chair Cathie Adams. Ms. Adams made the official announcement.

Details are still not available at this time. They should be released later this evening and into tomorrow.

What we do know is that the Party Switchers appear to be mainly within 4 Counties: Palo Pinto, McColloch, Hardin, and another yet to be named. Hardin has 8 expected Party Switchers. A Judge has already switched in Palo Pinto and another 3 or 4 are expected within the coming days. By the end of the week said Preston, there could be as many as 10 County elected officials who have switched parties from these 4 Counties.

Commented Preston on the main reason for the Switching: Today's election results with Republicans on the verge of a blow-out and the fact that "Obama's name is becomming poison here in Texas."

Chris Christie Wins!!!

"Chris Christie has won in Gloucester County which is the first time a Republican has won since Tom Kean in 1985" - Mike Symons, Gannett Newspapers

Final Results still not in... But Christie holding on to consistent lead.

With near 70% of the total NJ precincts in, Statewide Christie winning with 50% to Corzine's 44%, with Dagget hovering around 5%.

But results from all-important swing Bergen County indicates Christie did better than expected.

Christie is leading Corzine 49% to 48% in Bergen. NJ Pundits saying a win for Corzine by healthy margins in Bergen is critical for Democrats.

Christie has 43% in hardline Democrat Camden County.

52% for Christie in Democrat-leaning Union County.

60% for Christie in heavily Democrat Middlesex County.

Atlantic County (Atlantic City) Christie leading 48 to 45%.

Sarah Palin blasts Biden over Energy Hypocrisy

Biden one of only 5 Senators to vote against the Alaska Pipeline back in '73

Vice-President Joseph Biden was up in upstate New York campaigning for Democrat for Congress Bill Owens on Monday, against Sarah Palin-endorsed Doug Hoffman. He had some choice words for his former rival, accusing her of knowing only the simple phrase "Drill Baby, Drill," when it comes to energy policy.

Palin's response was swift and severe.

The vice president’s extreme opposition to domestic energy development goes all the way back to 1973 when he opposed the Alaska pipeline bill. As Ann Coulter pointed out, “Biden cast one of only five votes against the pipeline that has produced more than 15 billion barrels of oil, supplied nearly 20 percent of this nation’s oil, created tens of thousands of jobs, added hundreds of billions of dollars to the U.S. economy and reduced money transfers to the nation’s enemies by about the same amount.”

This nonsensical opposition to American domestic energy development continues to this day. Apparently the Obama-Biden administration only approves of offshore drilling in Brazil, where it will provide security and jobs for Brazilians. This election is about American security and American jobs.

Murder in Arizona: Father runs over Daughter in so-called "Honor Killing," she had become "too Westernized"

On this election day here in the United States, where we celebrate freedom, democracy and human rights, there's some very sad news to report. On Sunday Libertarian Republican headlined a story by our own Denise Clark, "Abuse of Young Girls by Radical Muslims now at alarming levels in US: Politicians, Big Media and Law Enforcement side with Political Correctness." The article focused on the case of Rifqa Bary forced to return to Ohio from Florida, after having fled her Muslim father who threatened violence against her for converting to Christianity. Denise also reported on a case from Arizona:

Just last week, an Arizona man of Muslim belief tried to kill his daughter (photo right) by running her over with his SUV... Faleh Hassan Almaleki, 48, was reportedly angry at his daughter, Noor Faleh Almaleki, for becoming ‘too westernized’ and not living according to their traditional Iraqi values.

This morning, it's being reported that young Ms. Almaleki has died of her injuries. She was being treated for severe trauma to the spine.

The father was caught fleeing at the London airport and returned to the United States.

Noor Almaleki of Surprise, Arizona, died Monday from injuries sustained after her father hit her and her boyfriend's mother in a parking lot on October 20...

Prosecutors have called the incident an "honor killing".

In some cases of such killings, relatives convene a so-called family council and task a clan member to murder a female relative accused of staining their honor, usually by having an affair outside marriage.

"By his own admission, this was an intentional act and the reason was that his daughter had brought shame on him and his family," county prosecutor Stephanie Low told a Maricopa County judge over the weekend.

Obama will own a Corzine loss

PPP: Christie now leads Corzine 47 - 41

Even a jaded political observer such as myself has to admit that Obama skates on a Virginia loss. He threw Creigh Deeds to the side. He avoided last minute campaigning in Virginia. He sent signals out, along with other top Democrats that Deed was toast.

But not New Jersey. A Garden State loss is an Obama loss. Obama spent the entire weekend criss-crossing the State for Corzine. The DNC has pumped in millions in last minute dollars. TV ads are running with a warm Corzine/Obama embrace.

And now we learn this morning it looks like Republicans may be poised for a knock-out Victory.

Chris Christie leads Jon Corzine 47-41 in PPP's final poll of the New Jersey Governor's race, with Chris Daggett at 11%.

Corzine had pulled to within a point of Christie on our poll three weeks ago after trailing by as many as 14 points over the summer, but his momentum has stalled since then and Christie's built his lead back up to 4 points last week and now 6.

Christie's advantage is due largely to his support from independents and because he has Republicans more unified around him than the Democrats are around Corzine.

Note - PPP is regarded as a Left-leaning Pro-Democrat polling firm. Also note, a 6 point lead is outside of the margin of Democrat voter fraud, particularly important for any New Jersey race.

Virginia's loss for the 'D's will be largely ignored and explained away tomorrow night. A New Jersey loss, will send shockwaves through the entire political community throughout the Nation, and will be an outstanding portend for Republicans 2010.

EAST RUTHERFORD (Nov. 2, 2009, 12:45 p.m.) — A Paramus man who claimed to be the assistant deputy director of Gov. Jon S. Corzine’s re-election campaign was arrested by East Rutherford police Friday, Oct. 30 for possession of Ecstasy.

Jason Shih, 25, was arrested and charged at 11:28 p.m. with possession of Ecstasy, possession of drugs with intent to distribute within 1,000 feet of a school, possession of drugs with the intent to distribute, talking on a cell phone while driving and possession of drugs in a car.

East Rutherford Police Officer Mark Mehegan, who was on patrol, stopped Shih after observing him talking on his cell phone while driving on Route 17 South near Riggin Memorial Field. Mehegan described Shih as extremely nervous and reported his hands were trembling as he reached into the glove box for his information.

During the motor vehicle stop, Mehegan said he observed 19 Ecstasy pills in the center console cup and $661 in cash folded up in the ashtray. Police also reported locating several hundred clear plastic bags commonly used to package drugs.

Throughout the course of the investigation, Shih said he was the assistant deputy director for Corzine and that the campaign rented the 2008 Toyota he was driving.

East Rutherford Police Lt. Paul Cece also responded to the scene and located several tickets for the Sunday, Nov. 1 event where President Barack Obama and Corzine were to appear.

Shih also reportedly had 10 paychecks from the Middlesex County Democratic Committee in his possession. One paycheck for $1,500 was payable to Shih from the MCDC, according to reports.

“Mr. Shih stated the vehicle he was operating was rented for him by the ‘Corzine for Governor’ camp to distribute tickets and paychecks for the Middlesex County Democratic Committee,” stated Cece.

Judge George Savino set bail at $15,000 with a 10-percent option. Shih posted $1,500 and was released on summonses.

Calls to Corzine’s campaign office and MCDC were not returned as of press time.

Note - numerous other sources have confirmed that Shih has worked in the past as a field coordinator for the Democrat Party. He was paid $470.00 in 2006 according to financial records, by the Democrat Party of New Jersey.

Libertarian City Councilman Mark Byrne, Port Huron, MI wins endorsement of Local Paper for Reelection

Practical Proposals helping local constituents

The Libertarian Party has over 400 elected and appointed officials serving in public office nationwide. In addition to city council seats in Indianapolis and Springfield, MO, the Party has held a seat on the Port Huron Council for 4 years. The city's population is roughly 40,000. It is located in the "thumb" of Michigan. It's economy is mostly old Rust Belt industrial-based.

Now Councilman Byrne is up for reelection. And he seems to have impressed the editors of the hometown newspaper for his new, innovative ideas.

Port Huron is weathering what many regard as the nation's worst recession since the Great Depression. It is not enough only to survive. Port Huron needs leaders to guide it toward prosperity.

Tuesday's election offers voters the chance to assess the City Council's quality of leadership in the past two years and to improve it.

Mark Bryne: A Libertarian, Byrne has introduced common-sense ideas. The two-meter system he proposed allows customers to install second meters to track water that doesn't go to the sewer system. The potential savings could encourage Port Huron businesses to remain in the city.

WASHINGTON STATE: Race for King County Executive one to watch

Perhaps I am a little biased, but as a resident of King County, I am very encouraged by the possibility about this race. Ostensibly, this is a non-partisan race, pitting King County Councilmember Dow Constantine (a far left liberal associated with failed county economic and budgetary policies) against conservative-leaning former TV anchor Susan Hutchison.

In 2008, King County went for Obama over McCain by a margin of 70% to 28%. At this time, the race looks close, and Hutchison has been leading in the polls (though not by much). Constantine has waged a very aggressive, negative, and divisive campaign, and has made a strong point of emphasizing his support for President Obama, unrestricted abortion, and so-called "environmentalism."

A victory for Susan Hutchison would open up an important opportunity for political change in one of the most liberal Democratic-leaning counties in the nation.

Closeted Republican could be elected Atlanta’s next Mayor

The city of Atlanta has never had a Republican Mayor. That could change on Tuesday with the election of Mary Norwood. She is currently leading two other candidates in the polls, and the very latest poll numbers suggest she's expanding that lead. Norwood is at 45%, and her nearest rival at 25%.

Norwood, a "fiscally conservative white City Councilwoman" as described by the local government-run NPR, is challenging two Democrat opponents; Sen. Kasim Reed and Atlanta City Council President Lisa Borders. The State Democrat Party is worried that they're splitting the vote. They've opened up the attacks on her for her Republican ties, and background, even claiming she's a "Reaganite."

From Narbosa.com, Nov. 1:

"As far as we’re concerned, Mary Norwood’s a Republican. She’s been trying to dodge the issue of her partisan allegiance," Kidd said. "We’re concerned that she’s not being truthful about her party affiliation. We think that she should be called out on that."

Meanwhile, the Reed campaign is slamming Norwood for her Republican values.

And the State Democrat Party just sent out a citywide flyer linking Norwood to libertarian-leaning Republican Sarah Palin. See a copy of the flyer at AJC.

Norwood for her part, claims to be completely affiliated as an Independent. And offers that she voted for Ross Perot in 1992. Though, records show she's voted in the GOP primaries, more so than in Democrat elections. In fairness, when asked by a TV interviewer if she "ever voted for Reagan," she avoided giving a straight answer, pivoting to another subject.

Since 1990, Norwood has chosen the Republican ballot in primaries 12 times. She’s chosen the Democratic ballot just six times, mostly in recent years.

She also lives in the only Republican section of town - Buckhead. She admits to having attended Republican conventions in the past. And she has received support from prominent Republicans in the business community.

Atlanta pundits view the "Republican" label as the kiss of death in citywide elections.

The Democrats could turn things around if they keep Norwood under the critical 50% mark, which would cause an automatic run-off.

Countering the Democrat attacks, Norwood just received a huge endorsement: Dominic Wilkins of the Atlanta Hawks. Over the weekend Robo calls from Wilkins hit households all over Atlanta.
