FDA on mission to explain its animal biotech approval process – Agri-Pulse

The Food and Drug Administration, facing increased criticism of its regulatory process for gene-edited animals, is mounting a new effort to defend its policies to farmers, researchers and developers, but the industry is backing the Agriculture Department's push to take over some of FDA's oversight role.

FDA regulates as animal drugs any intentional genomic alterations in animals, achieved through gene editing or older genetic engineering technologies,a position roundly criticized by the animal ag and biotechnology industries. The subject has gained more attention recently with statements from FDA defending its oversight role as necessary both for the safety of animals and humans.

We havent announced most of them yet, but were going to have a series of meetings, said Laura Epstein, senior policy adviser in FDAs Center for Veterinary Medicine. FDAs presentations will include case studies examining hypothetical products.

One of the primary goals of the presentations will be to explain the process and FDAs regulatory intentions to farmers, an audience FDA acknowledges it has not communicated with very much, Epstein said.

As a result, theres a lot of confusion and misinformation out there about what we plan on doing, she said. We got word back that farmers seemed to think were going to require them to register them as drug manufacturers. We want to assure them thats absolutely not the case.

One meeting FDA will definitely be attending is the Large Animal Genetic Engineering Summit in Utah in June, said Heather Lombardi, director of FDAs Division of Animal Bioengineering and Cellular Therapies.

FDAs effort follows publication of a commentary in Nature Biotechnology by Steven Solomon, director of FDAs Center for Veterinary Medicine, asserting the importance of regulatory oversight of intentional genomic alterations in animals, even when the intended modification seeks to replicate a naturally occurring mutation.

Solomons piece accompanied an FDA analysis on how the agency was able to detect unintended alterations in genome-edited bulls, Solomon said in a statement on FDAs website.

The biotech and conventional animal ag industries have been pushing for years to get FDA to loosen its regulatory reins, arguing that FDAs development of disease-resistant animals, for example, has been unduly delayed.

Agriculture Secretary Sonny Perdue made that point at USDAs Agricultural Outlook Forum last week, stating at a press conference that USDA is "in the process of working with FDA currently to help divide up the responsibilities, hopefully with an agreeable type of consensual memorandum of understanding with the agency over new breeding techniques. Perdue said FDA could handle oversight of food animal breeding, with FDA handling any other animals.

He pointed to the example of the nearly year-old agreement between USDA and FDA on cell-cultured technology, used to create meat that has been described as clean by supporters and fake by its opponents.

Under that agreement, the agencies said FDA would handle cell collection, cell banks, and cell growth and differentiation, with the Food Safety and Inspection Service overseeing the production and labeling of human food products derived from the cells of livestock and poultry.

Without an easier path to commercialization, new breeding techniques are going to go to Argentina, Brazil, Canada, China, or other countries, Perdue said, making the U.S. a follower rather than a leader in the new technologies.

Representatives of both USDA and FDA were reluctant to discuss the interagency communications. A USDA spokesperson said only, We are always in discussion with various FDA officials on a number of issues dealing with American agriculture. FDAsaid the agency "continues to engagewith our federal partners in the regulation of agriculture biotechnology products.

Referring to USDA and EPA, its other participants in the governments effort to modernize biotech regulations, FDA said each agency has a role to play within its existing statutory structure.

USDAs Flickr account shows Perdue did meet with new FDA Commissioner Stephen Hahn only nine days before his appearance at Ag Outlook, along with Anna Abram, FDAs deputy commissioner for policy, legislation and international affairs, and Frank Yiannas, FDAs deputy commissioner for food policy and response.

The description on the Flickr site doesnt say what they talked about, but one longtime observer and participant in the animal biotech space said, I would be shocked if they had not discussed the issue. The meeting came two days after publication of Solomons commentary and the release of a statement from Hahn touting the potential of gene-editing technology for animals.

It is paramount, however, that as we move forward, we maintain standards of safety and effectiveness, Hahn said.

The Center for Food Safety agrees. The FDA has scientists that better understand genetic engineering of animals given that it has been working for more than 20 years on both GE animals for research purposes and drug testing, and now GE animals for food, CFS Policy Director Jaydee Hanson said.

USDA, he said, has refused to develop regulations for its review of GE animals and insects, despite having agreed to do so in 2011 after a review by its own inspector general.

Perdues suggestion of an MOU was welcome news to the biotech community. Dana OBrien, the Biotechnology Innovation Organizations executive vice president of food and agriculture, called Perdues words encouraging. In an opinion piece posted on Agri-Pulses site Feb. 12, OBrien said BIO had shown the White House how the President could move animal biotechnology oversight to USDA an approach championed by key livestock and scientific stakeholders.

Im all for it, Acceligen CEO Tad Sonstegard saidof Perdues remarks supporting a division of responsibilities. Acceligen is a subsidiary of Recombinetics, which uses gene editing to develop animals for the agriculture and biomedical markets.

I agree with what BIO said, Sonstegard said. We need to get FDA to come to the table.

Jack Bobo, a food industry consultant who is a former vice president at biotech company Intrexon, said Perdues statement may lead to things moving a little more quickly on the animal biotech front. However, he added, Its not clear to me that this is a detailed proposal.

Intrexon owns Aquabounty, developer of genetically engineered salmon that was approved by FDA in 2015 after a 20-year process the only GE animal to be approved thus far. Sold in Canada since 2017, the fish will be available commercially in the U.S. later this, year according to Aquabounty.

Their record stands for itself one approval, Sonstegard said.

But FDA wants to improve its process. It is touting its Veterinary Innovation Program, which Hahn said encourages development and research and supporting an efficient and predictable pathway to approval.

The latest developments on the animal biotech front were triggered by FDAs publication of a paper detailing its discovery of unintended alterations in the progeny of a gene-edited, hornless bull. That paper was published in Nature Biotechnology the same day as the commentary by FDAs Solomon.

The bull was developed by Recombinetics and its calves were monitored by Alison Van Eenennaam, who runs the Animal Genomics and Biotechnology Laboratory at UC-Davis.

Van Eenennaam responded to the FDA paper and commentary by saying she was "disappointed that the FDA failed to mention that the genome-edited bulls and their offspring were followed for years by researchers at UC Davis and were hornless (polled) and healthy.

The unintended alteration, a plasmid, was not transmitted to half of the offspring, so in one generation there were animals with just the targeted edit, she said, then wondered why her explanation of the project, also published in Nature Biotechnologyback in October, was not referred to in FDAs analysis.

Alexis Norris, a bioinformatician in FDAs Division of Animal Bioengineering and Cellular Therapies, said there was no deliberate attempt to ignore Van Eenennaams paper. FDA submitted its paper to Nature Biotechnology before hers was released, she said. Hers was in revision when ours was submitted to Bio. It was just a timing issue.

Van Eenennaam has been critical of FDAs process. There is nothing fundamentally hazardous about genetic variation in food, and suggesting intentional alterations are equivalent to drugs will frighten consumers who might logically infer the presence of drugs in their food, she wrote on the Nature Research Bioengineering Community blog in a piece entitled Responsible Science Takes Time.

Fifth National Young Biotechnologists Congress 2020 held at Dhaka University – The Daily Star

To create a scope of networking among young biotechnologists and engage them into biotech related activities outside of structured curriculum, Network of Young Biotechnologists of Bangladesh (NYBB) organised National Young Biotechnologists Congress for the fifth time. This year, the event was held on February 22 in the Nabab Nawab Ali Chowdhury Senate building of University of Dhaka. The Department of Genetic Engineering and Biotechnology of University of Dhaka hosted the congress. 744 participants from 34 different universities and institutions took part in the event.

The inaugral session started with the welcome address of Md Arif Khan, Chief Executive Officer of NYBB and Lecturer of University of Development Alternative, where he stated the limitations of job opportunities for biotechnologists. To solve this issue, he drew the attention of Dr Kazi Shahidullah, Chairman of University Grants Commission. The special guests, Independence award winner, Dr Haseena Khan, Chairman and Professor of Biochemistry & Molecular Biology, Department of University of Dhaka, Dr Zeba Islam Seraj, Director General of National Institute of Biotechnology, Dr Md Salimullah expressed their thoughts on this initiative of NYBB and appreciated young biotechnologists for their active participation. The chief guest of the event, Dr Kazi Shahidullah shared his views on biotechnology and its need in our country. Dr Nazmul Ahsan, Chairman and Professor of Genetic Engineering and Biotechnology Department of University of Dhaka, chaired the inaugral session. The first Plenary Lecture titled "Professor Ahmed Shamsul Islam Biotechnology Speech 2020" was from Sir Walter Bodmer, renowned human geneticist and cancer researcher of University of Oxford. More than 500 students and professionals were present at the event.

At this stage, Esco Lifescience Private Ltd presented "10 Minutes on Biosafety" after which the competitions began. The first contest was an oral presentation, in which 13 selected works were presented among 80 submitted abstracts. The champion, first runner up and second runner up of this competition were Lecturer Afrin Sultana from Noakhali Science and Technology University, Afroza Akter from University of Chittagong and Rakib Wazed Nayon from Shahjalal Science and Technology University, respectively.

150 abstracts were submitted in the research and Idea-based poster presentation competition, from which 80 were selected for the showcase. The champion of this competition was Md Sadek Bachu. The first place was occupied by both Topu Rayhan & Anti Islam and the second prize winner of the competition was Anjasu Paul.

Student combined their skills of photography and understanding of biotechnology in the Biotech Photography Contest. In this competition, 'The First Triumph', a picture taken by Md Thosif Reza, 'Microtuber formation in cell culture of Solanum tuberosum', a picture taken by Sheikh Sanjid Ahmed from University of Dhaka and 'Fungus for my Valentine', a picture taken by Rocktim Barua from University of Chittagong won the first, second and third prizes, respectively.

In 3 Minute Biotech Contest, students got the opportunity to explain their research work in Bangla. With 15 contestants, the semifinal took place on February `9 in Star Labs, from which 6 were selected for the final presentation in the congress. With the votes of audiences, the people's choice award was won by Drishty Badhon Sarker from University of Dhaka. The champion and runner up of this competition were Anti Islam from Khulna University and Md Thosif Reza from University of Chittagong.

After that, a biotechnology hackathon, the first of its kind in Bangladesh, was arranged. Team Super Bug 2.0 of Chittagong University, Team Sanryu of Dhaka University and Team Biotech of Khulna University won the first, second and third prizes at the event. The judges were: Iqbal Bahar Chowdhury (President, E-Commerce Association of Bangladesh), Reza Chowdhury (Radiant Pharmaceuticals) and Dr S M Mahbubur Rashid (DU).

Dr Senjuti Saha, Microbiologist of Child Health Research Foundation presented the speech, titled "Bill and Melinda Gates Foundation Heroes of the field 2020" on her journey in the field of science. 22nd L'Oral-Unesco For Women in Science Award winner Dr Firdausi Qadri, Emeritus Scientist of icddr,b and Founder of ideSHi gave the speech, "Professor Naiyyum Chowdhury Memorial Speech 2020", which inspired the young biotechnology students.

Professor of University of Dhaka Dr Sharif Akhteruzzaman guided students on how to succeed in the path of their biotech careers in his speech, "Research Excellence in Biotechnology: Obstacles to Overcome".

At the last stage of the event, Dr Md Tofazzol Islam, Professor and Director of Institute of Biotechnology and Genetic Engineering, Bangabandhu Sheikh Mujibur Rahman Agricultural University, spoke about biotechnology. Dr Md Abul Kalam Azad, Professor of Shahjalal Science and Technology University and Dr Abdul Haque, Assistant General Manager and Head (Biotech plant) of Aristopharma Ltd, shared their views on research opportunities in biotechnology in their respective speeches.

The event ended with a speech from Dr Md Adnan Mannan, Member of Board of Directors of NYBB and Professor of University of Chittagong. He conveyed his best wishes to young biotechnologists.

New lease on life for Forever 21 with acquisition out of bankruptcy – syracuse.com

Forever 21 has been bought out of bankruptcy in a deal worth over $81 million and its new owners plan to keep the brand alive.

Authentic Brands Group, Simon Property Group and Brookfield Property Partners are jointly acquiring the retailer, which filed for bankruptcy protection in September, according to NPR. Authentic Brands owns retail brands including Aeropostale and Nine West while Simon and Brookfield are both real estate firms whose holdings include numerous malls, outlet centers and other retail properties.

Forever 21 currently has 593 stores worldwide. It has a major presence in many U.S. malls, including Destiny USA in Syracuse and other properties owned by Syracuse-based Pyramid Management Group.

The sale to the new owners closed Wednesday.

When Forever 21 first filed for bankruptcy, it said it would close up to 178 U.S. stores along with stores in Asia and Europe. The new owners now want to grow in Europe, Asia, the Middle East, South America and elsewhere, NPR said.

Destiny USAs Forever 21 and several others stores in New York appeared on a list of possible closures the chain released in the fall after filing for bankruptcy. The company didnt necessarily expect to close all the stores on that list and was trying to negotiate new leases and rents.

But the list did represent the chain's least profitable locations.

The Destiny location remains open. It previously underwent a major renovation that dropped its footprint from two levels in the mall to one.

Most remaining U.S. Forever 21 stores will stay open under the new ownership, according to the BBC. The chain is now seeking a new CEO and plans to launch new lines of jewelry, footwear and handbags.

Boy Scouts of America bankruptcy expected to have little local impact – Parkersburg News

MARIETTA Although the national organization of the Boy Scouts of America filed for Chapter 11 bankruptcy last week, it shouldnt affect the operations of the local council.

We are locally controlled and operated, and unrelated financially to the Boy Scouts of America, said Ed Mulholland, executive director of the Muskingum Valley Council of the BSA. It really should not have any impact on our local programs.

Mulholland said the BSA filing for bankruptcy allows it to compensate victims of sexual abuse equally.

There are a lot since theyve lifted the statute of limitations, he explained. Some 90 percent of cases are from 30 years or before.

Thousands of Scouts have come forward alleging sexual abuse by their Scout leaders. According to the U.S. News and World Report, nearly 8,000 leaders in Boy Scouts had been accused of sexually abusing children dating back decades. Victims have come forward accusing hundreds more in the last year.

Mulholland said that in the 1980s, the organization started learning the Scouts were being abused, so it developed a two deep leadership in which a leader could not be alone with a Scout.

It protected the leader and the Scout, he said. There had to be more than one leader if they were alone with a Scout.

He said there were leaders who were kicked out of the organization over the years because children might not be safe around them. If there were serious allegations, the leader was reported to the police or children services.

We kept a list of them so if they wanted to join somewhere else, the other council will know they couldnt be in a leadership position, Mulholland added.

Bob Sheridan, River Trails District commissioner, which covers Washington County, excluding Belpre, said there have been casual discussions about the bankruptcy, but no real concerns have been raised locally. He said he doesnt see an immediate impact on local packs and troops.

They are the national council and they do a lot in program content. We have four national camps that we send a lot of boys to during the year, Sheridan said. They fall under national jurisdiction, so thats a concern. We hear a lot of the Boy Scout assets are landreal estate. If we dont have those camps, you really hurt scouting.

He said the local camps such as Camp Kootaga in Wirt County and the Muskingum Valley Scout Reservation near Coshocton are locally owned.

The local district hasnt heard a big outcry about the BSA declaring bankruptcy, he said.

When you get down to the troop and pack levels, they dont realize national exists, Sheridan said. They are focused on their packs and kids. The general conclusion isare we doing the right things for the kids. Thats where we try to keep our focus.

Mulholland explained that the local council applies to the national organization to be the ones who implement the scouting program in this area, much like a franchise.

We apply to do that each year. We collect a membership fee and that goes right through our hands to the national trust, Mulholland said. But everything we do locally, we raise our own funds.

When filing for Chapter 11 bankruptcy protection in September, Forever 21 had stated that it planned to reorganize the business and would likely close up to 178 U.S. stores.

Forever 21, the fast-fashion mall standby that filed for bankruptcy last year, will live on. Three companies announced Wednesday that they are jointly acquiring the retailer aimed at young shoppers and that they plan to continue to operate its U.S. and international stores.

The buyers are Authentic Brands Group, which owns major brands such as Barneys New York, Aeropostale and Nine West; and real estate companies Simon Property Group and Brookfield Property Partners.

"Forever 21 is a powerful retail brand with incredible consumer reach and a wealth of untapped potential," Jamie Salter, CEO of ABG, said in a statement. Forever 21 currently has 593 stores globally.

The deal is valued at $81.1 million, according to court records, and officially closed on Wednesday. When the company filed for Chapter 11 bankruptcy protection in September, Forever 21 had stated that it planned to reorganize the business and would likely close up to 178 U.S. stores.

But while the company said at the time that it planned to shut down stores in Asia and Europe, the new owners say they hope to expand in "South America, Western and Eastern Europe, China, Southeast Asia, Middle East, and India."

Forever 21 was founded by Korean immigrants in Los Angeles more than 30 years ago and, until now, has described itself as a "family-owned business." It enjoyed rapid expansion in the 2000s but has struggled as mall customers have dwindled. Other companies that were common sights in malls during the 1990s and 2000s such as Wet Seal and American Apparel have faced similar struggles.

"Consumers are not spending like they used to, and that has made things more competitive," NPR's Planet Money recently reported. "And in this more competitive environment, Forever 21 has been losing ground to the new crop of online retailers companies like boohoo, ASOS, Revolve and Lulus."

ABG and Simon will each own 37.5% of the company's intellectual property and operating businesses, while Brookfield will own 25%. The new owners plan to keep the company's headquarters in LA.

ABG says it plans to seek out young customers "by introducing refreshed creative, targeted digital campaigns, and influential collaborations."

Pier 1 files for bankruptcy; hundreds of stores to close, 1 on the Peninsula – Williamsburg Yorktown Daily

Pier 1 Imports, the home decor and furniture chain, is filing for bankruptcy, the company announced Monday.

The business plans to close up to 450 stores, including all of its stores in Canada.

The Peninsula has three store locations in Williamsburg, Hampton and Newport News.

Todays actions are intended to provide Pier 1 with additional time and financial flexibility as we now work to unlock additional value for our stakeholders through a sale of the Company,said Robert Riesbeck, chief executive officer and chief financial officer for the company in a Feb. 17 news release about the Chapter 11 bankruptcy. We are moving ahead in this process with the support of our lenders and are pleased with the initial interest as we engage in discussions with potential buyers.

WYDaily called all three stores on the Peninsula to see which locations were closing and when.

The Pier 1 location in Newport News, 12551 Jefferson Ave., is closing, according to an employee.

The Newport News location no longer shows up on the retail chains website store locator, according to Pier 1 Imports website.

The stores Williamsburg, 4625 Casey Blvd. Ste. 110, and Hampton, 1045 West Mercury Blvd., will remain open, according to the assistant store manager in Williamsburg and a store employee in Hampton.

WYDaily reached out to Jennifer Engstrand Reeder, spokeswoman for Pier 1 Imports as well as Leigh Parrish and Andrea Rose fromJoele Frank Wilkinson Brimmer Katcher, a public relations firm based in New York City.

Reeder, Parrish and Rose were not immediately available for comment.

Pizza Hut’s largest US franchisee is reportedly weighing options, including bankruptcy – CNBC

Pizza Hut's largest U.S. franchisee is weighing restructuring options, including bankrutpcy, Bloomberg reported Wednesday.

NPC International, which has about $1 billion in debt, operates nearly 400 Wendy's restaurants and more than 1,200 Pizza Huts.

People familiar with the matter told Bloomberg that the franchisee has begun negotiating with its lenders. The company is trying to keep the restructuring out of court but is considering the possibility of filing for bankruptcy with a pre-negotiated plan in place, according to the outlet.

In 2019, the franchisee saw its debt slide further and further into junk territory after credit downgrades from S&P Global Ratings and Moody's. Both ratings agencies downgraded NPC's debt this week after it did not make interest payments due to lenders on Jan. 31.

Yum Brands' Pizza Hut, historically known as a dine-in restaurant, has struggled because more consumers want their food delivered. High food and labor costs have eaten into profits. Same-store sales at U.S. restaurants fell 2% during the pizza chain's fourth quarter.

"There is potential for choppiness in near-term results of Pizza Hut U.S., primarily related to our largest franchisee," Yum CFO Chris Turner told analysts earlier in February.

Shares of Yum, which has a market value of $31.3 billion, were trading down 1% on Thursday morning. The stock of rival Domino's Pizza, which has a market value of $15.1 billion, surged 24% after its fourth-quarter earnings topped estimates.

Is a Bankruptcy Stay Violated by Creditor Doing Nothing? – The National Law Review

If a creditor wants to continue a lawsuit against a debtor outside of bankruptcy, repossess collateral, terminate a lease, set off debts, or pursue other collection efforts, it first must obtain stay relief from the bankruptcy court. The "automatic stay" is a command to halt action, and creditors violate it at their own peril.

But what about inaction? If a creditor began collection activity before the bankruptcy, must it unwind its actions when notified of the filing? Can a creditor violate the automatic stay by doing nothing? A recent decision by a bankruptcy court in Virginia says "yes," but other courts have said "no." The United States Supreme Court is likely to resolve the uncertainty this summer. Meanwhile, creditors may want to err on the side of caution.

Attorney Griffin represented Randi Nimitz in her divorce before she filed for bankruptcy. Griffin did not pay all her legal fees, and Griffin obtained a judgment against her for $10,000. Virginia allows wage garnishment, so Griffin obtained a garnishment order against Nimitz. The state court was holding $1,000 in wage deductions, and a hearing on turning over the funds to Griffin was scheduled when Nimitz filed Chapter 7. Her bankruptcy petition listed Griffin's judgment as debt and claimed an exemption in the $1,000. Nimitz's counsel notified Griffin and demanded he terminates the garnishment. Griffin refused. He claimed that he could do nothing because he had no legal obligation to take affirmative action to terminate the garnishment.

Nimitz moved for Griffin to be held in contempt for a willful violation of the automatic stay. The bankruptcy court agreed. To prove a stay violation, a party must establish that (1) a violation occurred, the violation was committed willfully, and (3) the violation caused actual damages. The automatic stay prohibits any act to obtain possession of property of the estate or to exercise control over estate property. The bankruptcy court reasoned that property seized pre-petition, but not yet liquidated, remains property of the bankruptcy estate. The debtor's bankruptcy estate includes a possessory interest in property not held at the time of filing.

The bankruptcy court concluded that Griffin's refusal to terminate the garnishment amounted to the improper exercise of control over the debtor's property. Griffin did not assert an ownership interest or lien in the garnished funds, which did not help his argument. The bankruptcy court awarded Nimitz attorneys' fees of $2,400 to prosecute the contempt motion.

The United States Supreme Court should rule definitively on this issue sometime this summer. It is possible they will rule that mere inaction does not violate the automatic stay. But unless that happens, creditors who fail to unwind collection efforts when demanded to do so by a debtor in bankruptcy risk being held in contempt and liable for damages.

Its frustrating, if you were alive during part of the 20th century,to see humanity circle back around to the century-old argument between socialism and fascism, both stupid philosophies seemingly discredited by the most memorable,horrible experiences of that centurybut in its first few decades passionately defended by street-fighting gangs of young ideologues on German streets.

How did thisrecurrencehappen? Its like were walkinga philosophical Mobius stripor worse, since we barely seem to be moving, sitting in a Mobius chair somewhere beyond time and space, surveying 100years of pointless crisis and conflict yielding no real learning.

One thing Ive learned, though, is that if yougive government an inch, itlltake a mile, sometimes a mile of paved road. As Ive lamented before, ironically, both the left and elements of the far right (includingsome purporting to be my fellow anarcho-capitalist libertarians) point to the expense of road maintenance as justificationfor government taking on other duties.

Who will buildthe roads? ask the leftistsas if the private sector doesnt get that task donewith great frequencywhile some who (inaccurately, I think) call themselves anarcho-capitalists ask, Shouldnt we be able to stop people at the border if the alternative is them using roads at the expense of innocent taxpayers?as if theres no way to get people to pay for roads (hint: tolls) besides deploying fascistic border patrols with the legal authority toharass everyone within 100 milesof the border in numerous ways that (obviously) go far beyond defraying road-maintenance expenses.

Given the obvious and very long history of governments mission creep whenever it can find an excuse to act, whether byadding a welfare agency or a police function, the last thing we should do is come up with more rationales for its existence, especially those of us claiming to be libertarians of some sort.

I was thus alarmed to see an editor at the Mises Institute, Ryan McMaken, taking the borders-are-libertarian argument one perverse step farther, arguing that whats good for the U.S. taxpayer (mainly because it excludesuntaxedMexicans from roads, in theory)is in fact good for the taxpayers ofevery individual U.S. state, sowhy not have 50enforceable borders?

If Brexit makes England freer than EU membershipdoes, and over time theresreason to believe individual European countries are likely less prone to impose crazy regulations than would be a Brussels super-state, goes the argument, you can hardly tell New Jersey it has no right to enforce its border against possibly untaxed interlopers from Pennsylvania or New York. A single small state such as Jersey might even be less intrusive and wide-ranging in its entry requirements than the enforcers at a big national border tend to be. And if not, you can always go around it more easily than you can the country as a whole. So, a newly-hardened New Jersey border could be the key to fostering freedom!

But everything we know about the history of government means we must at least consider the obvious ways this plan might go wrong, and an honest reminder how uglyand burdensomeenforcement is at the national border is a good place to start. They dont just check for violent criminals and invading armies there, after allwhich in principle, I think virtually everyone would consider reasonable, absent the complete dissolution of nationsbutinsteaduse the national border as both an excuse and an opportunity to mold trade, population demographics, drug use patterns, internal employment trends, and more.

Nowadays, given the rights near-total obsession with immigration, one must assure them that one is not dismissing any of the thingsin that list as unimportantbut one is, iflibertarian, insisting that the important things are the last things one should want controlled by government. You insist on a border? Keep it simple, mostly-porous, and limited in its functions, more or less like government itself, if wemust have one at all (for now).

By contrast, I suppose the border-lovers should look with a certain amount of admiration at the (understandably) more-policed-than-average city boundaries of New York. Its almost like paying to enter Disney World driving into this place, and rest assured youre constantly being surveilled in the processmusic to the border-enforcers ears, I suppose. But consider the possibility that its no coincidence this city spawned authoritarians such as (Brooklyn-born) Bernie Sanders and a man who recently endorsed him, his fellow communist Bill de Blasio.

Occasionally, circumstances will make a border or even a siege mentality a necessity, but its hardly something torevel in. Given the tendency of the authoritarian elements of any political plan to come to fruition while the libertarian elements get perpetually delayed, I think its a safe bet 50hardened state bordersif put in placebeforethe welcome day the federal government ceases to exist, and especially if put in place by the federal government itself rather than, say, fiercely freedom-loving state-by-state secessionistswould just yield astill-vastnation at first annoyed and in time inured to constant checkpoints alongonesslowedtrek across what wouldstill be the United States of America, with most of its federal regulations still intact.

(By contrast, long story short, a Brexited UK can fairly easily resume thinking of itself as and behavinglike an independent countrysome of these distinctions must be more a matter of contingent history than pure philosophical idealism.)

Constant government checkpointscant be what a reasonable-approximation-of-liberty (or private property) looks like, any more than a ring ofgovernmentcops around every town or block is (and New York has come close to trying that, too, given all the barricades put up in the Bronx at certain hours).In theory,yes,that system mighteventuallyfortuitously decay into mere parcels of private propertytheultimate win for libertarianismbut you know damn well it might more easily decay into a system in which you must constantly present your papers to go across town, one morelayer of very palpable tyranny.

Most of that will sound rather far-off and speculative, but one crude,practical litmus test right now for separating the libertarians-in-spiritfrom the mereborder-lovers/Trumpers-in-spiritis seeing how people react to the news of Greyhoundannouncing it will not comply with searches of its vehicles by immigration agents who do not have warrants. The same people aghast at the independent-mindedness of sanctuary citieswill want Greyhound punished, I suppose, but since I still remember the days when non-leftists preferred capitalist enterprises and individual rights to latitude for government goons, I say: Go, Greyhound!

How New Is the Oren Cass Approach? – National Review

(Pixabay)The public-policy expert has some interesting ideas. But they arent necessarily new ones.

Oren Cass, formerly a domestic-policy adviser to the 2012 presidential campaign of Mitt Romney and a senior fellow at the Manhattan Institute, has launched a new organization, American Compass. Cass told the Washington Post that its goal is to think about what the post-Trump right-of-center is going to be. This debate is ongoing; Casss contributions to it will be familiar to readers of National Review.

Yet some of Casss immediate claims are worth questioning. Cass bemoans a purported domination of conservatism and the Republican Party by a market fundamentalism in many cases, held entirely in good faith; in some cases, more as a matter of political convenience. He also accuses conservatives of having for decades outsourced their economic thinking to libertarians such that libertarianism is now part of the prevailing orthodoxy (along with a progressive economics that is, he says, its mirror image).

The notion that libertarians have largely controlled the Right probably comes as a surprise to libertarians, who have watched helplessly over the past few decades as government has grown, debt and deficits have expanded, and the Federal Register accrues more pages (even as one of the consistent priorities of what Cass calls the inchoate earthquake of the Trump administration has been a concerted effort to fight this last trend).

Market fundamentalism, then, is a curious choice of villain. Few could survey the actual policy achievements of elected Republicans over the past few decades and claim they reflect that wholesale. Republicans during George W. Bushs presidency may have cut taxes, but they also increased spending (as have Trump-era Republicans), added a new federal agency, expanded an existing federal entitlement, and increased federal involvement in education. Bush himself proclaimed that we have a responsibility that when somebody hurts, government has got to move, imposed unilateral tariffs (as President Trump has done), and spearheaded the TARP bailout of the financial industry, sacrificing free-market principles to save the free-market system, in his words.

President George H. W. Bush famously raised taxes and was never fully on board with what he had called President Reagans voodoo economics. The degree to which Reagan himself was on board with what became known as Reaganomics is the subject of some debate, largely due to his utility as a totem for both sides of this argument. But he did intervene in the economy specifically in behalf of Harley-Davidson. And libertarian economics had very little sway in the actual policy of the Republican Party before Reagan. If Casss dispute is instead with conservative rhetoric irrespective of its purported practitioners actions, then he ought to make that clear. (Few would contest that many elected Republicans have been hypocrites in this regard.)

Some of the participants on Casss side of this argument, which is ongoing, sometimes act as though the very idea of government involvement in the economy were both brand new and some incredible panacea for our ills. The truth, toward which Cass gestures when he writes that he seeks to reassert ideas like these [that he proposes] for a conservative coalition that once understood them intuitively, is that skepticism of the free market has a long history within the conservative tradition. Before neoconservative became a dirty word, neoconservatives, such as Irving Kristol, were offering Two Cheers for Capitalism. As far back as 1957, National Review itself dissented from the market fundamentalism of Ayn Rand in Atlas Shrugged, via Whittaker Chamberss famous review. Just a decade ago, there were the reformocons, who sounded a lot like Cass and company do now in arguing for modest federal support for families and middle-income earners. When these groups made arguments in public, John Galt did not take over the transmission, nor did some Cato Institute grandee keep them from making their points. What Cass seeks to reassert never really left, even if its perceived relative strength has waxed and waned.

This may all seem like angels-on-the-head-of-a-pin stuff. Indeed, much of this debate has the character of a think-tank panel that has spilled out into the real world (Casss specific chosen antagonist in his National Review article is a vice president of the Heritage Foundation). But it is easier to act as though we simply havent tried certain things instead of admitting that we have tried some, and that sometimes they do work, but sometimes they dont. Cass would have a better case that our existing government policy has been inadequate than that we do not have one at all. And why has it been inadequate? Libertarian-leaning economists have had plenty to say about that: in public choice (Buchanan), the distribution of economic information (Hayek), monetary theory (Friedman), and more.

I do not invoke the celebrated insights of some libertarians merely to reject the very idea that the government has a place in the modern economy. I happen to agree with the argument Cass makes in his book The Once and Future Worker that it is foolish to devote immense federal resources to promoting higher education while leaving all other post-high-school paths to a hodgepodge of mostly state-based and private programs. No matter where you are in the world, the topic of Donald Trump and his impulsive phrases and decision are a divisive topic. It must be said that the prediction by those fearing that the U.S President was going to have the same fiery approach and eventually bring the whole country down with his has turned out to be largely untrue. But not necessarily because Trump has changed since his original campaign, but mostly because there are complex mechanisms at work in the white house that wont allow for complete chaos, and for one person to be fully in charge of everything. Trump has made many drastic changes to the U.S economy but has any of it actually paid off?

According to the president himself, the U.S economy is currently on historic high and is stronger than it has ever been. And of course, there are many who continue to challenge Trumps claim and amidst the influx of different opinions and contradictory facts it has become difficult to trust anyone outlet. Trumps entire political campaign and his actions as an already chosen president, has always been focused on the pro=growth attitude that prioritized this trend over many more, arguably more important topics. The main issue that most democrats have with Trump is that even though he is focused on growth, his policies often offer the gains for the price that most democrats and their supporters arent willing to pay. So when Trump says that his policies have actually helped the U.S to get its economy to where it was at an all-time high, he is definitely not lying. Although the methods used to get there can be quite controversial and often the main reason why the benefits of economic growth often get swept under the rug in the name of the sacrifices made for the said growth.

To claim that the U.S economy is the strongest it has ever been is a simple exaggeration that the historic data will dispute in no time, but it has definitely been doing well.

America does not like to admit it but its never-ending feud with China has affected the currency market. Just recently the president has set out to make some changes that would make up for the damages caused by the trade war and wants to help cryptocurrency bounce back to its better days. Even though the damages have not been all that harsh and China definitely has it much worse, the forex trading has definitely been more unpredictable for the U.S citizens and for those who trade in USD. This is why most trusted brokers in the USA have managed to keep the equilibrium as much as possible, but its difficult to remain unfazed when the entire world is feeling the effects of the trade war on their currencies and their economic lives as well. Trump is now trying to improve the situation by introducing new regulations. The new rule will allow Washington to levy tariffs on countries that are undervaluing the U.S currency, We dont know much about what criteria the white house will use to determine whether some countries qualify as underminers but this new rule has already raised some question about whether it will actually do some good or damage the currency further.

The stock market has actually been doing exceptionally well, meaning that Dow Jones Industrial Average has never been this high before. Coronavirus outbreak has changed the set up a bit but this doesnt take away from the fact that the President has improved the stock market situation by a lot. Trump has been consistently voicing his concern with the taxes for corporations and has not only cut down on the taxes but also implemented a much more U.S based approach to the stock market which has definitely paid off. This is one of those few cases where the success of his policies cant be argued against, and while for many this move is interpreted as Trump ensuring that the big and powerful companies keep growing and increasing their income, something that might not necessarily be the priority for the majority of the U.S population but the fact is that the stock market has greatly benefited from it and has allowed for more stability. But the complicated relationship with China has also managed to tempt with that even though the U.S does not want to admit that they are affected by their tensions with China.

The epicenter of all these developments and setbacks is tied to the Trade War. The dispute that has affected the entire world and has changed the setup of the world economy. What is worse is that two countries cant seem to communicate well enough to actually bring an end to this dispute that actually is not benefiting anyone all that much, even though the U.S and specifically Donald Trump would have you believe that it is largely unaffected by it. It is true that the country most affected by it is China, Huawei specifically. The telecommunications giant was forced to completely rethink their business model after the ban from the U.S and has since then tried to stay afloat and offer their services and products to other powerful countries While after the two years the company has managed to live in a new reality it is still an unnecessary one.

The two countries have tried to meet up and find a solution that would please everyone but the problem with having China and the U.S represented in the same room means that both want to be superior and dont want to seem weak under any circumstances.

The U.S has managed to find alternatives, mostly from the local productions and close partners but as both players are growing tired of endless talks and inconclusive discussions the pressure from the world to end this conflict is growing. Since the U.S, Trump specifically has proven that the can sustain the U.S economy without help from other major countries there might be higher chances of collaborative work since China is also growing tired of the burden of the bans and increased taxes.

Elizabeth Warren Is Here To Be Queen of the Ashes – Reason

Sen. Elizabeth Warren (DMass.) is a fan of Game of Thrones' heroine-turned-villain Daenerys Targaryen, and the presidential candidate did her best impression of the Dragon Queen during Wednesday night's Democratic primary debate in Las Vegas.

Warren came out swinging at the opening bell. She interrupted New York City Mayor Michael Bloomberg's first response with an absolute slobber-knocker.

She was just getting started. She would torch Bloomberg again and again during the two hour debateincluding one particularly effective broadside on Bloomberg's history of requiring employees to sign non-disclosure agreements about sexual harassment, which Warren said effectively silences women who have been subjected to workplace misogyny.

But she saved plenty of fire for the rest of the field too. She cremated former Vice President Joe Biden for having the audacity to work with Senate Majority Leader Mitch McConnell (RKy.) to pass legislation. She burned Pete Buttigieg for daring to offer an alternative to universal government-run health care, which he calls "Medicare for all who want it." Warren accused him of having nothing more than "a slogan that was thought up by his consultants." Even Sen. Amy Klobuchar (DMinn.), with whom Warren had previously shared some debate state camaraderie, took a turn in the barrel for having a health care plan that wasnot long enough, I guess?

Some of those attacks were more legitimate than others. (Realistically, the fact that Biden had good relationships with some Republican senators was a benefit for the Obama administration, as Warren would quickly discover if she managed to win the White House.) Still, it was a fiery and energetic performance from a candidate who seems to know she has nothing to lose at this point. The fundraising boost will help too.

Once Warren threw the first punch, everyone wanted a piece of the action. Buttigieg and Klobuchar sniped at one another throughout the night. Bloomberg torched Sen. Bernie Sanders (IVt.) for being a socialist who owns three houses. Even Biden showed a bit of life!

Bloomberg had the worst night of all. One that mightif debates matter, and I'm not sure they doraise serious questions about his viability going forward. "If the argument for Bloomberg's candidacy is that he's more electable than Sanders and Warrenand more energetic than Bidenthen that argument has suffered a significant setback. Maybe a fatal one," offers Reason's Robby Soave.

Even when he wasn't under attack from Warren and the other candidates, Bloomberg suffered from being "a stiff, incompetent political performer with a record in office that's so-so at best and who is aware that what seem to be his authentic policy views are too politically toxic to run on," as Vox's Matt Yglesias put it.

Bloomberg's presence on the stage likely helped Sen. Bernie Sanders (IVt.), who would otherwise have drawn the majority of the other candidates' fire after winning (or nearly winning, depending on how you count Iowa's results) the first two states. It's becoming clear that Sanders is the frontrunner now, but the bigger question is whether he can get an outright majority of the delegates. When asked last night, he was the only candidate on stage to say that a candidate with the plurality of the delegatesthat is, the largest pile but not an outright majorityshould be the nominee. Everyone else is now angling for a brokered convention, an outcome that the forecasters at FiveThirtyEight say is the most likely outcome of the race right now.

That brings us back to Warren. Her "Dracarys" approach to last night's debate could be seen as a way to say "if I can't win the nomination, no one will"or maybe "let's take this all the way to Milwaukee." On the other hand, it was notable that she didn't go after Sanders with the same venom she brought for the others. Might that be a sign that she's playing fullback for Sanders?

Regardless, Wednesday's debate was evidence that the Democratic presidential race has entered a new, more dramatic phase. One that will last for (checks calendar) a whole six days before we get to do this all over again.

As the Democratic presidential candidates prepare to debate Tuesday night in Charleston, S.C., voters in Florida should pay heed to the numbers and remember what they do and dont mean. Only three small states have voted so far, and the total votes cast in Iowa, New Hampshire and Nevada come nowhere near the combined population of just Tampa and St. Petersburg. Those who either welcome or fear that Sen. Bernie Sanders, a self-described democratic socialist, could become the Democratic nominee should keep the tiny scale of those numbers in mind. The best thing for Florida Democrats to do right now is keep paying attention and wait to vote until the picture becomes clearerand the numbers become big enough to be meaningful. The South Carolina primary is Saturday, and Democrats in 14 states, including California and Texas, vote on March 3.

Take a deep breath. Sanders vote totals so far are so small that they are eclipsed by the number of votes Hillary Clinton got just in Pinellas County in the 2016 general election, and she lost the countyand the electionto President Donald Trump. The other four top vote-gettersformer South Bend, Ind., Mayor Pete Buttigieg, Minnesota Sen. Amy Klobuchar, Massachusetts Sen. Elizabeth Warren and former Vice President Joe Bidenhave only 15,000 more votes combined than the number of registered Democrats in Hillsborough County. And former New York Mayor Mike Bloomberg has not been on the ballot anywhere yet.

Here are the combined total votes each candidate received in the Iowa caucus, the New Hampshire primary and the Nevada caucus.

The numbers dont really become big enough to begin to clear the landscape until Super Tuesday, March 3, when the outcomes will award more than a third of all delegates for the Democratic National Convention. That day is also the first time Bloomberg will appear on the ballot.

As Florida Democrats watch and wait, after Saturdays South Carolina primary they would do well to remember Winston Churchills words after the first British land victory in 1942 in World War II: Now, this is not the end. It is not even the beginning of the end. But it is, perhaps, the end of the beginning.

City votes to put $10,000 toward sexual assault prevention at Beaches ahead of spring break – FirstCoastNews.com WTLV-WJXX

JACKSONVILLE, Fla. Sexual assault is in no way an easy topic to discuss. As spring break approaches, the Jacksonville City Council has appropriated funding for the Women's Center of Jacksonville to educate on prevention and how to report an assault.

Ordinance 2020-0111 will allocate $10,000 to Women's Center of Jacksonville by March 2, which will be used to distribute content like posters and flyers at bars, restaurants and hotels in Jacksonville Beach, Atlantic Beach and Neptune Beach.

"We essentially are hosting a big party every weekend, from spring break all the way through the summer," Councilman Rory Diamond said. "It's something we don't love to talk about but we have to talk about: sexual assaults are happening at the beaches. We want to stop them."

The educational programs would correspond with high school and college spring breaks when additional foot traffic is expected at businesses in the Beaches.

"What you'll see is myself and the three Beaches mayors going to every bar and restaurant at the beaches," Diamond said. "We're going to put up posters, put out coasters, we're going to all the police departments to ensure we have training."

Meanwhile, there are signs of possible sexual assault that anyone should be on the lookout for when out with friends.

Sheila Spivey is the Senior Director of the University of North Florida's Women's Center, a resource on campus for students who have survived sexual assault. In an interview with First Coast News, Spivey said the narrative around reporting sexual assaults is progressing.

"The survivor and the perpetrator are typically the two people that the narrative has historically focused on," Spivey said. "But now the narrative is really focused on the entire culture: what within our culture might allow sexual violence to occur."

Spivey pointed out that there are methods of intervention in a situation where someone may be at risk of sexual assault. Methods include approaching a situation with other friends to diffuse tension and pull someone away, as well as direct intervention by calling out negative behavior and habits.

"The shift with bystander intervention is really taking the onus of responsibility for sexual violence away from the victim," she said. "It's not the victim's fault or the victim's responsibility to stop violence from occurring."
