PHOENIX An appeals court has thrown out a ruling that barred the public from watching the first witness called by Jodi Arias at the convicted murderer's sentencing retrial.
The decision Wednesday by the Arizona Court of Appeals overturns the Oct. 30 ruling by Maricopa County Superior Court Judge Sherry Stephens and suggests that the previously unidentified witness may have been Arias herself.
Stephens had said the ruling was necessary because Arias' first witness, whom the judge refused to publicly identify, wouldn't testify unless the hearing was closed to the public. Some of the testimony by Arias' first witness was conducted in private. The Arizona Republic and three Phoenix TV stations KPNX, KPHO and KTVK protested the closure of the courtroom, arguing the First Amendment allows reporters to attend the trial.
Arias was convicted of murder last year in the 2008 death of former boyfriend Travis Alexander, but jurors deadlocked on whether she should be sentenced to life in prison or death. A new jury has been picked to decide her sentence.
The appeals court didn't offer an explanation in its ruling Wednesday at how it arrived at that decision. A more detailed ruling is expected in the future.
But the court suggested an answer to a question that stumped trial watchers: Who was the skittish witness who was allowed to testify in private?
The appeals court said Stephens order closed the courtroom to the public during "any testimony by Jodi Arias," though it's unclear whether the testimony was made by Arias herself or someone else on Arias' behalf.
"It underscores the importance of the public's right to attend criminal trials, particularly the testimony of a defendant in the sentencing phase of a capital trial," David Bodney, an attorney representing the news organizations, said of the ruling.
A call to Arias attorney Jennifer Willmott wasn't immediately returned Wednesday afternoon.

That was Citigroup analysts, laying into gold in a note that came out a day ahead of Thanksgiving, as the investment bank opened the debate on golds value ahead of a crucial decision by Switzerland on whether the central bank should more than double its gold holdings.
The Save Our Swiss Gold campaign aims to force the Swiss National Bank to hold a fifth of its assets in gold within five years and prohibit the bank from selling gold in the future, as well as repatriate any gold overseas. Organizers accuse the bank of mismanaging the nations wealth property.
While gold bugs are hoping for a yes vote, most analysts dont see that happening. December gold GCZ4, -0.57% which traded around $1 lower to $1,195.60 an ounce on Thursday in electronic trading, with U.S. physical markets closed for Thanksgiving Day, has seen a choppy year, which has left prices more or less flat.
In the note, Citis global chief economist, Willem Buiter, said the Swiss vote doesnt even make sense. Requiring a central bank to put 20% of its balance sheet in any single commodity, even if that commodity had meaningful intrinsic value, represents a highly unorthodox and risky investment strategy he said.
And its also a custodial riskholding all of a nations physical assets in one place and preventing the SNB from ever selling gold again would in short make those holdings worthless, he added.
Another reason central banks shouldnt be dropping a chunk of reserves into gold? The price is volatile. The below chart shows gold on a nominal basis, which show its money values in different years, and real value, which adjusts for price levels in those years. As far as real prices are concerned, if someone had held on to gold in 1971 and held it up to 2013, the annual real return would be 4.3%, said Buiter. Reasonable given the riskiness of the asset.
Gold is like Bitcoin: Buiter says gold is unlike any other commodity, and the only thing that comes close to it is Bitcoin and other virtual currencies. Gold is costly to extract from the ground and refine to a degree of purity, its also costly to store and has no real use as a producer good, and other alternatives are out there for industrial uses.
Gold has become a fiat commodity or a fiat commodity currency, just as the U.S. dollar, the euro, the pound sterling and the yenare fiat paper currencies and as Bitcoin is a flat virtual currency, said Buiter. The main differences between them are that gold, like Bitcoin, is very costly to produce, while the production of additional paper money has an extremely low marginal cost.
Count up the deposits of commercial banks with the central banks, which together with currency in circulation make up the monetary base, as fiat money, then the incremental cost of fiat base money creation is zero, he said.

The Missouri Comets are an indoor soccer team based in Independence, Missouri, near Kansas City. They joined the Major Indoor Soccer League as an expansion team in the 20102011 season. They play their home games at the Independence Events Center and are currently members of the Major Arena Soccer League.
The Comets have the same ownership group as FC Kansas City of the NWSL, in which Andonovski serves in the same position as manager of the club.
The team is named after the original Kansas City Comets, who played in the original Major Indoor Soccer League from 19811991. Kim Rntved, a former Kansas City Comets star, was named the head coach on August 16, 2010.[1] Assistant Coach Vlatko Andonovski was promoted to Head Coach on August 29, 2013, succeeding Rntved.[2]
In all four seasons as members of the MISL the Comets reached the playoffs, and won the championship on their fourth playoff appearance. This would be the final MISL championship.
After the 2013-2014 season, the team announced that it was leaving the MISL along with five other teams and join the MASL.[3]

November 26, 2014 - American Hockey League (AHL) Syracuse Crunch UTICA, N.Y. - Four days after the teams played in front of 30,715 fans at Syracuse University's Carrier Dome, the Syracuse Crunch (10-6-3-0) fell, 5-4, to the Utica Comets (13-4-2-0) tonight at the Utica Memorial Auditorium.
The Crunch tied the game with two goals in the third period, but Darren Archibald scored his second goal of the night with less than five minutes remaining to give the Comets the victory, knotting the season series at one win apiece.
"Even when we are down, we are not a team that quits. We battled until the end. That's the way we roll," said Philippe Paradis who collected two points in the game.
Yanni Gourde opened the scoring by burying a feed from Paradis inside the left post and past Utica netminder Joacim Eriksson 1:23 into the second period.
The Comets tied the game four minutes later with Brandon DeFazio sneaking the puck under Andrei Vasilevskiy from the right wing circle. Archibald then doubled the Comets lead halfway through the period. DeFazio and Will Acton were credited with the assists on Utica's second goal.
With Dylan Blujus in the box for tripping, Alexandre Grenier extended the Comets lead to 3-1 at the 15:42 mark of the second period. Grenier's power-play goal was assisted by Nicklas Jensen and Alex Biega. The Crunch answered back less than a minute later with a bouncing shot from Paradis that skipped by Eriksson's glove hand. Jake Dotchin and Gourde collected assists on Paradis' second goal of the season.
The Comets regained their two-goal lead with just over a minute left in the second period. Ronalds Kenins converted on Utica's fifth power-play opportunity of the game. Henrik Tommernes and Hunter Shinkaruk assisted on the play.
Syracuse scored two quick goals in the third period to even the score. Jonathan Marchessault struck first with a power-play goal at the 11:29 mark of the final frame that was assisted by Nikita Nesterov. Just over a minute later, Tanner Richard tied the game with his fourth goal of the season. Paradis and Gourde had assists, their second and third points, respectively.
Archibald's second goal of the game and third of the year, assisted by Jensen and Acton, proved to be the game winner.
The Crunch next return home to face the Binghamton Senators on Friday.

Workington Comets have added a third Danish rider to their 2015 line-up.

Comets have reached an agreement to sign 25-year-old Odense-born Nicki Barrett, who joined Peterborough Panthers midway through last season and guested for the West Cumbrians last season.
Barrett has been loaned to Comets from parent club Berwick Bandits and joins on a 3.93 average, which means he will occupy one of the reserve spots.
He joins fellow countrymen Rene Bach and Kenneth Hansen in agreeing to ride at Derwent Park next year, as well as Australian Mason Campton who re-signed for the club at the clubs end-of-season do.
Owner Laura Morgan said: We would like to offer Nicki a warm welcome to the Comets and we hope that he has a good season with us.
Co-promoter and team manager Tony Jackson added: When he visited Derwent Park with the Panthers last season he proved to be very impressive at reserve and he clearly enjoyed the track.
However, there was some bad news for fans as it was also announced that last seasons number one Josh Grajczonek and popular reserve Simon Lambert wont be returning to the club.
The Comets management met with Grajczonek in October and he made it clear that while he wanted to come back to Workington in 2015, he needed to press on with his career and commit to riding in Poland, which meant until these deals were sorted he could not commit to Premier League racing.
