UH settles First Amendment suit

A pair of University of Hawaii at Hilo students is claiming a victory for free speech after the school agreed Tuesday to settle a First Amendment lawsuit filed in April.

Merritt Burch and Anthony Vizzone sued the university after an administrator stopped Burch from passing out copies of the U.S. Constitution and another told them to restrict a protest of the National Security Agency to a free speech zone on campus.

In line with the settlement, the university revised its speech policies systemwide to allow free speech and the distribution of literature in all areas generally available to students and the community without requiring that students seek permission first. UH also agreed to pay $50,000 in attorneys fees and damages. It also creates a dispute resolution process for students who think their First Amendment rights have been violated.

The students filed the suit with the help of the Foundation for Individual Rights in Education (FIRE) as part of its Stand Up For Speech Litigation Project.

Im so happy that the University of Hawaii has revised its policies, and Im grateful for the help from FIRE and our attorneys, Burch said. Now, students across the University of Hawaii system can exercise their First Amendment rights without fear that they will be disciplined.

Her co-plaintiff agreed.

It is great to see these changes and to know that we can express ourselves freely throughout campus, Vizzone said.

In a press release issued Tuesday morning, FIRE President Greg Lukianoff praised the students for standing up to the university system.

The lawsuit led to a constructive conversation with UH, and today President David Lassner has set an example by implementing policies that guarantee free speech to the 59,000 students enrolled in the UH system, he said.

In an emailed press release issued Tuesday afternoon, the UH system confirmed settling the federal lawsuit, saying it expects the case to be dismissed with prejudice in the next several weeks, meaning it cannot be re-filed.

Supreme Court tests limits of free speech online with case on social media threats

JUDY WOODRUFF: When writing in social media, like Facebook, what is defined as a threat and what is protected by free speech? That was the question at the center of a case before the Supreme Court today.

Jeffrey Brown has the story.

And a warning: This case contains some graphic language.

JEFFREY BROWN: In 2010, Anthony Elonis began writing Facebook posts about his ex-wife, angry rants filled with violent language. She filed a restraining order. And eventually Elonis was charged with threatening to injure another person and sentenced to four years in prison.

Now the Supreme Court must decide were indeed threats under the law or an exercise of his First Amendment rights.

And Marcia Coyle of The National Law Journal was of course at the court today to hear the arguments.

Marcia, first, give us a little bit more details, a little bit more background on this case.

MARCIA COYLE, The National Law Journal: All right.

Mr. Elonis was obviously having difficulties after he separated from his wife and his children. He was unable to do his job at an amusement park outside of Allentown, Pennsylvania. He was sent home from work several times by his employers because he was crying at his desk.

And also he was accused of sexual harassment by a co-worker, at least one co-worker. Ultimately, he was fired by his job, and he did do a post involving his co-workers at the amusement park that wasnt a very good one, but he wasnt charged under that. It was the posts that he made involving violent statements against his wife, against law enforcement officials in particular, an FBI agent who visited his home after the FBI began monitoring his posts, and also against elementary schools, threatening possibly to go in and have a major mass shooting.

This week in Bitcoin shows a growth happening in the community as well as the pains associated with it.

On the grim front theres some friction happening with that growth. Fraud continues to be an issue, as it is with any industry, with The Bitcoin Foundation warning about copycat websites attempting to defraud users out of their bitcoins. MasterCard has gone to lengths in Australia to badmouth Bitcoin and request regulations be saddled to protect consumer interests.

On the other hand, greater adoption and better policies are appearing amid movers-and-shakers as well. Blockchain.info has now implemented a proper TOR .onion address to reduce the possibility of hijacks when people anonymously browse the popular Bitcoin wallet. NCR Silver customers show a clear preference for Bitcoin over Apple Pay. And an executive from the Ronald McDonald House charity went on Reddit to do an AMA about accepting bitcoin donations.

Finally, ChangeTip has been having an amazing few months (with a bitcoin tipping revolution hitting its stride) that have culminated recently in $3.5 million in seed money.

Bitcoins market value popped up a little bit lately from a low around November 20 at $350 and now resides in a band around $375. The price point has been relatively stable for a few days idling between $375 and $380. It hard to tell from the historical price index, but Black Friday produced a little volatility but otherwise theres been several days of near plateau.

Numerous users have been contacting the foundation about this problem over the past week and as a result

Currently the best-known clone websites include bitcompensation.com and bitsecuretransfer.com. Neither of these domains has any connection to the Bitcoin Foundation whatsoever and the Foundation warns that any contact from these domains should be met with skepticism and not to visit these pages.

The Bitcoin Foundation asks anyone who comes across a website cloning the Foundations site, image, or trademark to forward the web address to webmaster@bitcoinfoundation.org with the subject line SCAM SITE.

ACT Comets collapse, lose to Tasmania by 217 runs

The ACT Comets crumbled in their second innings for an outright loss to Tasmania as players from both sides remembered Phillip Hughes.

The Comets were rolled for 151 in just 52.3 overs on Thursday to deliver Tasmania a 217-run victory in the Futures League match at Manuka Oval.

Tasmania's left-arm orthodox spinner Clive Rose claimed 6-61 in the innings and match figures of 10-128 in a disappointing batting display from the home side.

Comets captain David Dawson was the mainstay of the first innings on Wednesday, scoring 111 in a total of 7-256 (dec).

Having played alongside Hughes with NSW, Dawson dedicated his century to him, making it on the same day as the Hughes funeral.

"It was a really tough day and cricket pales into insignificance with the tragic events that we've had," Dawson said.

"In some small way it was something I could do to try to honour Phil in a sense.

"Cricket takes a back seat in the big scheme of things.It was a sad day for everyone but especially the cricket family."

Comets Face Chicago and Tulsa in Double Header

December 3, 2014 - Major Arena Soccer League (MASL) Missouri Comets INDEPENDENCE, Mo. (December 3, 2014) - The Missouri Comets will try to extend their best ever five-game winning streak to start a season this weekend as they host the reigning PASL Champions Chicago Mustangs for the second time in the season on Friday before heading to Tulsa to face the Revolution on Saturday night.

Tickets are still available for Friday's "Clash of Champions Part 2" at the Independence Events Center. Also, fans that are interested in traveling to Tulsa on Saturday can visit the Comets Nation table on Friday get more information on the road trip to the Cox Business Center.

Head Coach Vlatko Andonovski's team will return home after defeating the Harrisburg Heat 24-10 at the Farm Show Arena, which meant its fifth straight victory after wins against Dallas, Chicago, Milwaukee and Wichita.

After falling to the St. Louis Ambush and the Comets, Chicago hosted the Milwaukee Wave last weekend and came away with a signature 5-4 win. Goalkeeper Jesus Flores returned to form recording 26 saves after going 16-0 in the first three games.

Both teams met for the first time in history last Saturday, November 8 at the Sears Centre in a match that saw the Comets pull out a 12-6 victory and a motivated Leo Gibson who scored four goals.

The Comets stand at the top of the MASL Central Division with an overall record of 5-0 while Chicago sits in third place with a two wins and two defeats.

On Saturday night, the Comets will travel to Tulsa, Oklahoma where they will visit the Tulsa Revolution for the first time in history. The Revolution haven't had the best start to the season and are last in the Central Division with an overall record of 1-3.

Last Saturday, Head Coach David Yates' team fell at home against the Wichita B-52s for the second time this season after losing to the Dallas Sidekicks. Tulsa's only victory dates back to November 14 when they defeated Texas 8-5.

With 23 points (12 goals and 11 assists), Gibson will try to remain at the top of the MASL standings followed by Monterrey's Loureno Andrade and San Diego's Nick Perera both with 20 points.

Reddit users name worst travel destinations in the world

If you're someone that values the opinion of strangers, it might be best to avoid these popular travel destinations.

A thread on social media service Reddit asked userswhere they went that was "a total disappointment."

Five most popular responses include Paris, Jamaica, Stonehenge, the pyramids of Egypt and Los Angeles, Calif.

Users disliked Paris because people there were "rude" and didn't like L.A. due to the amount of homeless people. Stonehenge was unpopular because it's located in "the middle of nowhere," while Jamaica and the pyramids of Egypt simply didn't live up to expectations of some Reddit users.

Walt Disney World and Florida in general were mentioned several times in comments, but didn't rank in the top responses. Back in April, Walt Disney World was named one of the 10 "most disappointing" destinations in the world by travel website SmarterTravel.com.
