As is often the case with these briefings, however, Trump's scripted message eventually devolved into a series of false and misleading claims about the state of the pandemic. At one point, Trump claimed that "large portions" of the US are "corona free" (not true). He also claimed that protests in Seattle and Portland were leading to spiking cases there (also not true).

Trump again touted what he claims are the benefits of hydroxychloroquine as a successful drug to fight the coronavirus, despite numerous studies that fail to bear that out. Despite warnings from the Food and Drug Administration, Trump even claimed that the drug was completely safe to use.

"It's safe. It doesn't cause problems," Trump said, anecdotally noting that he "had absolutely no problem" when he took the drug earlier this year. "Felt no different. Didn't feel good, bad or indifferent."

Facts First: The FDA has said there are many safety issues with using hydroxychloroquine against the coronavirus, including kidney injury, heart rhythm problems, liver problems, and more.

Downplaying the spread of the virus

Trump tried to paint a rosy picture of how well the country is responding to the coronavirus by downplaying its spread and saying that the virus has been eliminated in large parts of the country.

"We're seeing improvements across major metro areas, and most hotspots, you can look at large portions of our country, it's corona-free. But we are watching very carefully California, Arizona, Texas and most of Florida, it's starting to head down in the right direction. And I think you'll see it rapidly head down very soon."

Facts First: This is misleading. No areas of the country have eliminated the virus, and the only places that are "corona-free" have no human population, or are rural areas that have an extremely small population.

Every state in the US has reported new Covid-19 cases in the past week, according to the Centers for Disease Control and Prevention, and13 statessaw their highest 7-day averages for new daily cases yesterday, per data from Johns Hopkins University.

There is some truth to the President's claim that some states are heading in the right direction, and in the past week several of the states he's mentioned have begun to flatten the curve of new cases, but they're still exponentially higher than where they were two months ago and show no signs of "rapidly head down very soon."

Tribal communities

Trump touted his administration's work serving tribal communities by noting that "under the CARES Act we provided $8 billion" to tribal communities who are "very vulnerable to this horrible plague." He also claimed it is the "largest investment in Indian country in US history. There has never been an investment that big in Indian country."

Facts First: It's not true that the Trump administration has provided $8 billion to tribal communities. While the CARES Act did allocate $8 billion in funding to tribal communities, only 60 percent of it has actually been disbursed so far, and that only happened after a lawsuit was filed against the Trump administration to release the money. It's unclear if and when the rest will be released.

Protests in Portland and Seattle

Trump claimed that coronavirus cases in both cities have increased as a result of these recent protests.

"In the wake of the recent mass gathering Americans have witnessed in the streets of Portland and Seattle, we are also tracking a significant rise in cases in both metropolitan areas because of what's been going on," Trump said.

Despite these gatherings of sometimes large amounts of people, the protests have had a limited impact on coronavirus cases so far, possibly in part because the protests took place outdoors, where the virus is transmitted less efficiently than in indoor spaces; possibly in part because a significant percentage of protesters wore masks; and possibly because some non-protesters may have reduced their in-person interaction as they tried to avoid the protests.

Trump says he will accept Republican nomination in North Carolina after all – POLITICO

Trump told WRAL he would announce the exact location of his acceptance speech in the coming week.

Before the coronavirus pandemic, the Republican National Convention was set to take place in Charlotte. But as cases and deaths mounted in North Carolina over the spring, Democratic Gov. Roy Cooper insisted a scaled-down convention was necessary.

Trump bristled at the possible denial of a blockbuster event and wrote on Twitter on June 2 that he would be moving the main action of the convention away from North Carolina.

Nine days later, the Republican National Committee picked Jacksonville as its new destination, with Trump scheduled to deliver the keynote acceptance address as part of a multinight event. But the shift to Jacksonville proved to be too fraught with complications as Floridas Covid-19 caseload spiked, straining the state's resources.

As recently as July 21, Trump campaign officials were assuring the public the event could go on safely, even as local law enforcement sounded warning signs. Trump called off the Jacksonville event on July 23.

It's just not the right time, Trump said.

Trump Is Now Openly Defying the Supreme Court – Slate

The Trump administration announced on Tuesday that it will continue to defy a federal court order compelling the full restoration of DACA, the Obama-era program that allows 700,000 immigrants to live and work in the United States legally. By doing so, the administration has chosen to flout a decision by the Supreme Court, effectively rejecting the judiciarys authority to say what the law is.

Donald Trump first attempted to rescind the Deferred Action for Childhood Arrivals program in September 2017, a move that wouldve stripped its beneficiaries of work permits and subjected them to deportation. But his administration continually cut corners, failing to explain the basis for its decision and refusing to consider the impact of DACA repeal on immigrants, their communities, and their employers (including the U.S. Army). This June, the Supreme Court ruled that the administrations actions were arbitrary and capricious under federal law and therefore set aside DACA repeal.

To implement that decision, U.S. District Judge Paul Grimm compelled the administration to restore DACA to its pre-repeal condition on July 17. Grimms order required the Department of Homeland Security to let DACA beneficiaries renew their status for two years, accept new applicants, and restore advance parole, which permits travel outside the country. But DHS did not do that. Instead, the agency maintained that it would reject new DACA applicants. It also declined to accept DACA renewals or reinstate advance parole.

At a hearing Friday, Grimm tore into Justice Department attorneys for flouting his order. The governments actions, he explained, created a feeling and a belief that the agency is disregarding binding decisions from the Supreme Court. DOJ attorneys insisted that DACA applications were merely on hold, or placed into a bucket, while the administration decided how to proceed. But, as Grimm retorted, it is a distinction without a difference to say that this application has not been denied, it has been received and it has been put in a bucket. The judge once again directed DHS to comply with the law by accepting new applicants and processing renewals.

Incredibly, the agency has decided to disobey this order, as well. On Tuesday, acting DHS Secretary Chad Wolf declared that it would not accept new applications and would only grant one-year extensions to current beneficiaries on a case by case basis. This tactic will make it easier for Trump to deport DACA beneficiaries if he wins reelection, since their status will expire sooner. The agency will also deny advance parole absent exceptional circumstances. This new policy is nothing less than brazen defiance of a federal court ruling. Grimm, and the Supreme Court itself, ordered DACAs full resuscitation, which requires the acceptance of new applicants and the conferral of two-year renewals. There is simply no legal basis for DHSs zombie version of the program.

The administration has tried this malfeasance before with a different policyand it didnt work then, either. After the Supreme Court blocked Trumps addition of a citizenship question to the 2020 census, Trump insisted they would find a way to do it anyway. That court decision, too, found that the government had violated the law through dishonest incompetence. And in its aftermath, the administration scrambled to work around SCOTUS and snatch a victory from the jaws of defeat. It failed, though not before tiptoeing up to the line of defying the Supreme Court.

Now the administration has crossed that linesprinted past it, really, without any apparent hesitation. It is true that SCOTUS allowed the Trump administration to take another stab at rescinding DACA. But Wolfs memo does not purport to initiate a new process of winding down the program. Rather, Wolf presented these new rules as interim changes while DHS decides how to repeal DACA legally. Certainly, the agency can go back to the drawing board and devise a new method of killing the program. But neither the Supreme Courts decision nor Grimms order gave Wolf the power to limit [DACAs] scope in the interim.

It is no surprise that DHS, whose agents are unconstitutionally kidnapping and brutalizing peaceful protesters in Portland, Oregon, would disregard the law. Trump is doubling down on his smash-and-grab approach to governance. While the president demands law and order and Attorney General William Barr complains about mass disrespect of authority, the administration is intent on getting its way even when it means ignoring a federal court order. The presidents men are restrained only by their own sense of what they can get away with.

For the salaried class, the WFH facility was initially thought to be a great idea as it was required to work in the comfort and convenience of ones own home. All the non-IT employees who envied their IT counterparts of the perk of WFH were finally going to experience it themselves. However, less than two months down the line, people were longing to go back to office.

With our homes not built to accommodate lavish and comfortable office spaces, with not-so-effective Wi-Fi connectivity, non-ergonomically designed chairs, jostling for space and some seclusion with a working spouse and two children in 2BHK flats (mostly), people were stressed and how. Visuals of couples working with laptops perched on the bed, women cooking while participating in a zoom meeting (with audio/video off), children popping up in official meetings on MS Teams, etc., went viral on social media.

For the salaried class, this was not a holiday. It was BAU in an utterly unknown WFH format which they grappled with. We lead a mundane life and need to show up in front of our laptops and meet deadlines, especially with the threat of job losses and paycuts looming large.

With no access to the maid the lifeline of an Indian family, life became a never-ending cycle of cooking, cleaning, working, caring for kids and elderly. Further, in a bit to stay visible while WFH, people were becoming overzealous and trying innovative ways to showcase their productivity.

Between witnessing people uploading videos of exotic baked dishes and jaw-dropping workout sessions, and deciding to pick and choose from the never-ending supply of webinars (dubbed as Death by Webinar), picking up the motivation to do office work, while trying to remain safe and healthy, sanitising the veggies, groceries and hoping that you will not be given the pink slip has caused anxiety pangs among the employees.

The Covid-related WhatsApp forwards that keep inundating your phone and brain and the gyan thrown at you by people on the best ways to keep yourself occupied and be productive has become mentally exhausting with no predictable end date in sight.

As we navigate this unprecedented once-in-a-lifetime experience, we are finding it difficult to focus. We didnt sign up for this and we are at our wits end, just hoping that we will all sail through this without any mishaps. We are facing extreme emotions and sometimes even overlapping emotions. As per psychologists, feelings of inadequacy, listless stupor, uselessness and guilt for not doing enough are likely to impact people.

Different people process thingrently. People have different coping mechanisms. There is no right way. So, although your OTT friend or neighbour appears to be super-productive by attending back-to-back online activity classes, dont get tempted to join the bandwagon.

For some, binge-watching movies is a way to unwind. For some, it is playing Ludo (why not?), for some it is crochet, gardening, music, gymming, etc. Find out what helps you calm down and indulge in it. There is no right or wrong formula. For some a timetable works, some prefer to go with the flow, depending on their mood.

Sometimes, doing nothing is so liberating. Try it! Life does not need to be an endless completion of to-do list. Take a break if you must. Clear the cobwebs of your mind. This could be the time for deep introspection and reflection.

You would have realised the benefits of home-cooked food. Exercise regularly. For those who have lost their jobs or about to lose one, dont panic. It is difficult, no doubt. But it is not the end of life, maybe end of a lifestyle that you were used to.

Our self-worth and self-esteem are being dictated by the number of accomplishments and accolades we have received. Not everyone is designed to thrive under adverse circumstances. Be kind to yourself.

The unplanned downtime can be used in several ways, to bring a smile to your face. There are several ways to unwind, which are not necessarily Facebook or Instagram worthy.

When you look back, do not look at this time with regret. Use this for some course correction not only in your professional lives but also personal lives.

As long as you come out unscathed from this pandemic, having done even a wee bit to enhance your life, it would be a time worth spent. Remember, its more important to be positive than productive.

Garmin outage: Garmin Connect is recovering, so did Garmin pay a ransom? – T3 (US)

After almost a week of suspense, it seems the Garmin outage story is finally over with Garmin Connect in recovery. In the Garmin Connect app, instead of the ominous 'Server Maintenance' warning window, Garmin watch users are relieved to see a different message (below), and data is now visible that hasn't been since last Thursday.

As relieved as we all are, we can't help but wonder: did Garmin pay the $10 million ransom, as requested by the 'Evil Corp', or have the developers found a way to eliminate the threat somehow without paying the money? The Times suggests "Garmin must have paid a large ransom to recover computer files stolen by hackers", but until any official communication is received from Garmin, we can't be sure.

As a company listed on the stock exchange, Garmin will presumably have to confirm or refute this at some stage, unless the amount involved can be buried under 'miscellaneous sundries', like when we do our expenses.

The Garmin outage has been the hottest topic last weekend in running and cycling circles but it seems like the panic is over and everyone can calm down finally as Garmin announced on Twitter that "many of the systems and services affected by the recent outage, including Garmin Connect, are returning to operation".

However, the company also added that "some features still have temporary limitations while all of the data is being processed".

The ransomware attack on Garmin thought to be the work of 'Evil Corp', a group of Russian hackers who allegedly mainly targets US corporations, The Guardian reports. Garmin services started to go offline Thursday 23 July 2020 and many of the most popular services, including Garmin Connect and most of the Strava integrations, were unavailable to users over the weekend period.

As reported by The Independent on Monday morning, Garmin Connect was supposedly coming back to life, although at that point most users still reported issues with Garmin Connect. The website and the Garmin webshop was available, however.

Garmin issued a few statements on Twitter, stating the outage also affected its call centers and that they were unable to receive any calls, emails and also couldn't fire up online chats either, making a lot of Garmin watch users rather anxious.

In case you are worried about your personal information being leaked due to the attack, on its FAQ page, Garmin reassured users that there has been "no indication that this outage has affected [the users] data, including activity, payment or other personal information." That is not the same as saying your data definitely hasnt been stolen, but its a lot better than nothing. But never mind that, what about your run and cycle data? Is it lost forever?

As many people also pointed out, workouts can be directly uploaded to Strava using a USB cable but we wonder how many people actually went through the hassle of manually uploading their workouts this way when they could have just waited five days for the issue to be resolved.

Despite the fact you can't upload data to Garmin Connect, most Garmin watches have the ability to store training data on the device so you can still log exercises and sync them with Garmin Connect once you can.

The Garmin Fenix 6 Pro, for example, has 32GB of internal memory, plenty of space to store hundreds of workouts. Cheaper Garmin watches have way less, of course, so maybe dont try for any personal bests until this gets fixed.

The Garmin Outage has been going on since last Thursday when initially users noticed that certain Garmin online services are unavailable (making my life harder too as I was halfway through writing up my Garmin Instinct Solar review). Since then, Garmin issued the following statement on its Garmin outage FAQ page:

"Garmin Ltd. was the victim of a cyber attack that encrypted some of our systems on July 23, 2020. As a result, many of our online services were interrupted including website functions, customer support, customer facing applications, and company communications. We immediately began to assess the nature of the attack and started remediation.

We have no indication that any customer data, including payment information from Garmin Pay, was accessed, lost or stolen. Additionally, the functionality of Garmin products was not affected, other than the ability to access online services. Affected systems are being restored and we expect to return to normal operation over the next few days.

As our affected systems are restored, we expect some delays as the backlog of information is being processed. We are grateful for our customers patience and understanding during this incident and look forward to continuing to provide the exceptional customer service and support that has been our hallmark and tradition."

In his monumental Fourth of July address at Mt. Rushmore, President Trump said: Our nation is witnessing a merciless campaign to wipe out our history, defame our heroes, erase our values and indoctrinate our children."

I couldnt have said it better myself. Its difficult to witness the dangerous and lawless direction that some in our country have chosen to pursue over these last few weeks. Amidst the violent protests, the liberal mob wants to remove our statues, monuments, holidays - erasing our history. They want to change the National Anthem. They even will go as far as to burn the American flag. They want to get rid of statues and depictions of Christ. Its sickening, dangerous and patently un-American.

In a recent tweet, Joe Biden said his election would mean the transformation of America. Lets be clear - if the American people send Joe Biden to the White House, our nation will be transformed into a socialist country. Everything were seeing from the left is a part of their march toward socialism.

As a father of seven precious children, I am concerned about the country that we will be leaving to them if the radical mob continues down the path it is on unchecked.

The last thing we need in the U.S. Senate are weak-kneed Republicans, who lack the courage to stand up for whats right. How are they any different than the liberal mob when they side with them to remove our statues, to replace holidays like Columbus Day, and even to impeach our President? That is not what Tennesseans want; its not a representation of our values. The good people of our state want an unwavering true conservative representing them, a conservative who will stand against this nonsense and the progression towards socialism.

President Trump has endorsed Bill Hagerty not once, but twice, for the U.S. Senate - thats a far cry from being the establishment choice as some have claimed about Bill. The President can see establishment candidates a mile away, and he not only does not support them, he endorses their opponents - look to the Alabama U.S. Senate Race and Coach Tommy Tubervilles commanding win for clarity on that topic!

The President does not give his endorsement lightly, and after working closely with Bill Hagerty for years now - you know it holds water. I know Bill will stand firmly beside President Trump to implement his America First agenda and fight for the country we love that is far too close to slipping away.

Ive known Bill for over almost a decade, and he has also earned my endorsement. Bill Hagerty is a Christian, a fine husband and father, a dedicated public servant, and a freedom-loving patriot. In the Senate, he will work tirelessly to defend our conservative values from those trying to undermine them. Like me, he is gravely concerned with the direction of our country, and will not stay silent while the radical liberals attempt to destroy our country. Liberal MP Nicolle Flint wears a bin bag to call out ‘sexist rubbish’ after column describes her clothing choices – ABC News

A female politician has donned a garbage bag to call out what she says is the sexist "rubbish" women in politics are forced to put up with.

In the minute-long video, posted to Twitter, South Australian Liberal MP Nicolle Flint lists off a series of incidents she's endured since entering federal politics, including being targeted by a male stalker and having her campaign office defaced with "skank" and "prostitute".

She also criticises male commentator Mike Carlton who, during an episode of Q+A, tweeted that panellist and singer Jimmy Barnes had "shown great restraint by not leaping from his seat and strangling [Nicolle]".

But Ms Flint appears to have drawn the line on Sunday when another commentator, and ABC radio host, Peter Goers, wrote a column criticising the glossy brochures issued by MPs, at taxpayers' expense, to their constituents.

Mr Goers mentioned other South Australian Liberals, including "king of the open-necked shirt, David Basham", but reserved his most detailed observations for Ms Flint, her "pearl earrings and a pearly smile" and "vast wardrobe of blazers, coats and tight, black, ankle-freezing trousers and stiletto heels".

Wearing those very stilettos and black, ankle-freezing trousers, Ms Flint ends the video by posing the question: "So Mr Goers, what should a woman in politics wear?"

"How about a garbage bag to match your rubbish views," she says, while removing her black coat to reveal a grey bin bag cinched with a black belt.

Federal MPs are given tens of thousands of dollars each year, some of which can be used for printed material.

Almost immediately, her post drew praise from female politicians across the aisle, including Labor's Anika Wells who tweeted "I'm with Nicolle Flint".

"The standards expected of women politicians are garbage," she said.

"Be authentic but appeal widely. Be charming but don't try too hard. Confident, but modest ya know?"

Another Labor MP, Madeline King, also took to Twitter to declare: "I stand with Nicolle Flint," saying the kind of sexist rubbish she had copped belong "in the bin".

Women in politics have long complained about the double standards to which they are held particularly when it comes to appearance but many are reluctant to, or tired of speaking out about it.

Ms Flint is from the conservative wing of the Liberal Party, which is typically even more hesitant to discuss their experience as female MPs, fearing they'll either be defined by it, or raise eyebrows among often male-dominated pre-selection committees.

But the public examples of sexism in politics are endless.

From Greens Senator Sarah Hanson-Young's "slut-shaming" defamation case against former senator David Leyonhjelm, to former Prime Minister Tony Abbott pointing out the "sex appeal" of then-candidate Fiona Scott and Liberal Don Randall accusing then-Democrat Cheryl Kernot of "having the morals of an alley cat".

Australia's first female prime minister Julia Gillard suffered years of negative commentary about the fit of her jackets, her hairstyle, the tone of her voice, even her decision to not have children.

One of her fiercest critics, right-wing commentator Alan Jones, suggested putting Ms Gillard into a "chaff bag" and throwing her out to sea and after the death of her father, claimed he had "died of shame".

Mr Jones also appeared at anti-carbon tax rallies outside Parliament House where protesters held up placards which read "Ditch the Witch" and "Bob Brown's bitch".

In the years since, the ranks of women in Parliament have been bolstered mainly on the Labor side which has helped shift the tone of debate but it has certainly has not settled it.

Ms Flint, who is 42, and Ms Wells, 34, are from different states and different parties, and sit on opposite ends of the ideological spectrum, but their intervention strongly suggests the next generation of women in politics won't cop such "sexist rubbish" silently.

With nearly four months remaining before release, the hype for Cyberpunk 2077 is now at its boiling point. Fans cannot wait to enter into and run rampant across the bustling streets of Night City, with that tinge of electric neon swirling all around them and the occasional voice of Johnny Silverhand weaving into the back of V's consciousness. Though, with ample time on hand until its fated debut, fans across the world and among various artistic subsets have begun imbuing their own Cyberpunk fandom into feats of immense and mesmerizing engineering, like designing custom LEGO min-figs and building an entire Cyberpunk 2077 platform database.

One such Cyberpunk die-hard has brought to life a Game Boy in the guise of CDPR's magnum opus utilizing Blender and a lofty artistic ability.

From Frying Pan to Fire: Strategic Issues When Reimbursement Disputes Turn Into Criminal Investigations – Lexology

Early on the morning of June 13, 2017, over one hundred federal agents raided facilities across southern California belonging to behavioral health provider Sovereign Heath. The agents provided search warrants indicating that they were seeking evidence of fraudulent billing and kickbacks. The items sought suggested a potential connection to a civil lawsuit that Sovereign had filed against insurer Health Net for bad faith denial of insurance claims, as well as cross-claims for fraud and kickbacks that Health Net had filed in response. Sovereign eventually collapsed. On May 5, 2020, it filed a federal racketeering lawsuit against Health Net, its parent company Centene Corp., and several of Health Nets outside counsel, accusing them of providing false information to the government in order to induce the investigation and force Sovereign out of business. Dual Diagnosis Treatment Center, Inc., et al. v. Centene Corp., et al., Case No. 2:20-cv-04112 (C.D. Cal.).

While perhaps a dramatic example, the Sovereign case is hardly the only one in recent years in which a private insurer has allegedly encouraged law enforcement to pursue a provider, sometimes while the insurer and provider are engaged in a dispute. For example, beginning in 2016, insurers sued several dialysis providers for paying kickbacks through a charity, while a related DOJ investigation was underway. In October 2018, Blue Cross Blue Shield of Tennessee confirmed that it was cooperating with the Department of Justice in the prosecution of various individuals and companies allegedly involved in a $174 million telemedicine fraud against private insurers. And earlier this month, the Eleventh Circuit affirmed the convictions of two Alabama doctors for defrauding private insurers and others; a Blue Cross Blue Shield employee testified in the trial as a government witness. See United States v. Ruan, Case No. 17-12653.

Criminal cases involving commercial health insurers often proceed in parallel with civil litigation between the payer and provider. In some cases, the payer asserts an overpayment and initiates litigation including fraud claims. In others, the provider sues for non-payment or underpayment, and the insurer either defends or countersues by alleging fraud. However the dispute arises, insurers have become increasingly aggressive in referring fraud claims to law enforcement agencies, including DOJ, in connection with the civil litigation. Often, these referrals are made through the insurers Special Investigative Units and counsel, sometimes with the hope of gaining additional leverage in the dispute. As in any situation featuring overlapping criminal and civil cases, such collaborations between insurers and prosecutors are rife with strategic and procedural landmines for both sides.

One of these critical issues that often arises for the provider in the civil case is whether to assert the Fifth Amendment and refuse to testify. If a provider does so in federal civil court, it can result in the judge or jury drawing adverse inferences that can be devastating to the providers case. Even in the state courts of California or other jurisdictions that prohibit such adverse inferences, asserting the self-incrimination privilege can make it harder for the provider to introduce helpful evidence. But waiving the Fifth Amendment and testifying can provide valuable fodder for the government in the criminal case, which may prove even more dangerous. For that reason, the provider may seek a stay of the civil case until the criminal matter is completed, which may delay resolution of the payment issue but can avoid the self-incrimination dilemma.

On the other side of the coin, the civil proceeding may offer the provider certain advantages in the criminal case. In particular, civil litigation allows for much broader discovery than is generally afforded to criminal defendants. A provider facing parallel cases can use depositions, document requests, and other discovery devices to pin down testimony from key witnesses, extract exculpatory admissions, and obtain documents useful for his defense, all of which might be unavailable in a criminal case. For that reason, the provider might choose risk defeat in the civil case by not pursuing a stay, while the government might instead ask to suspend the civil proceeding. In other cases, the government may not seek a stay, but instead ask the court for a protective order barring discovery of witnesses communications with the government, or other information the disclosure of which could undermine the criminal investigation. See State Compensation Ins. Fund v. Drobot, 2016 WL 3546583 (C.D Cal. Feb. 29, 2016).

The government and payer, too, must be careful in pursuing a coordinated attack. Courts have held that the government may not secretly use a civil proceeding to obtain information for a criminal case. See United States v. Stringer, 521 F.3d 1189 (9th Cir. 2008). In other cases, they have found that the governments excessive direction of a private actors dealings with a criminal defendant render that private actor a government agent, whose actions can violate the defendants constitutional rights. See United States v. Connolly, et al., Case No. 16-cr-370 (S.D.N.Y.) If the government and insurer appear to be working too closely, and one seems to be taking too much direction from the other, a court could find misconduct or perhaps order additional discovery from the insurer in a criminal case. At a minimum, close involvement between the two could provide a line of defense in the criminal case regarding the bias or improper motives of the government. A similar defense was successful in the recent acquittal of a Fitbit executive on criminal trade secrets charges apparently prompted by a competing companys advocacy.

Like anyone who provides information to law enforcement, insurers referring matters to the government must also be both scrupulously accurate and reasonably thorough in their disclosures. If an insurer give false or misleadingly incomplete evidence to the government in order to persuade it to pursue charges against a provider in order to gain a litigation advantage, it could be subject to a claim of malicious prosecution, or even criminal false statements charges under 18 U.S.C. 1001. Such allegations of false accusations provided part of the basis of Sovereign Healths RICO lawsuit against Health Net, discussed above.

While civil disputes and criminal investigations may sometimes mix, particularly in the case of provider-insurer reimbursement disputes, they raise both the stakes and the complexity in both proceedings. Navigating such parallel proceedings requires careful planning and counsel with experience in both the civil and criminal realms.

Three patients of Pioneer Health Care Center in Rocky Ford who tested positive for COVID-19 (one test is awaiting confirmatory results) have died, Crowley / Otero Health Departments Director Rick Ritter told the Tribune-Democrat Friday. Ritter said the health department gives its condolences to their families.

"Any time this happens we are certainly sorry that they lost a loved one," Ritter said.

COVID-19 cases in Otero County totaled 36 as of Saturday, according to Colorado Public Health and Environment, although Ritter said in a news release that numbers reflected by the state were not up to date. In the same statement, Ritter confirmed that three coronavirus patients at Pioneer Health Care Center in Rocky Ford had died and at the nursing home two staff and a total of 13 patients tested positive for the novel coronavirus. Ritter noted that results of confirmatory tests for some patients were still awaiting results as of Saturday.

Following Gov. Jared Polis's executive order mandating mask use in indoor public facilities July 16, businesses and services have had to crack down on enforcing mask use. Although many businesses and public buildings have posted signs alerting prospective patrons to their mandated enforcement of mask use, others have posted notices that state they will not enforce mask use.

In some instances, the notices make questionable references to the Health Insurance Portability and Accountability Act, the 4th and 5th Amendments, or other facets of the U.S. Constitution or U.S. law.

Thaxton's Market in Fowler, for example, posted a sign in their window that read, "Due to HIPPA and the 4th Amendment, we cannot legally ask you what your medical condition is."

The sign continued to state that store employees would assume anyone entering without a mask was exempted from the statewide mandate. The Tribune-Democrat called Thaxton's Market last week to inquire about the store policy, but it did not hear back in time for publication.

Arkansas Valley Lumber outside Rocky Ford stirred up controversy when a sign it had posted in its entrance made rounds across local social media groups. The sign declared Arkansas Valley Lumber was no longer a public company and would only accept business from "United States citizens that believe in their constitutional right of freedom from oppression."

A day later, Arkansas Valley Lumber apologized on its official Facebook page and clarified that it would not discriminate against anyone, although it maintained that it would not enforce the use of masks.

Ritter isn't sold on Thaxton's claims or those of others, however.

"There's a lot of information I'm just going to come out and say it disinformation out there," said Ritter.

Ritter noted the statewide mask order makes exemptions for people with health conditions that complicate their breathing, such as asthma or COPD.

But contrary to what some businesses are claiming, a store is not legally prevented from offering patrons masks, nor is a store prohibited from asking someone who claims to have a medical condition that prevents mask use what that condition is, according to attorney to Otero County Nathan Schultz.

"I've seen a lot of people saying they're not going to ask about masks due to HIPPA," said Schultz. "The Fourth Amendment, then one store that says they're not going to ask about masks because of the Fifth Amendment. HIPPA is designed to protect information from covered entities, like doctors and hospitals, from disseminating that information without a release. That has absolutely no bearing on a grocery store. The Fourth Amendment and Fifth Amendment, both, any time you're trying to claim you have constitutional protection, there has to be government action."

Schultz agreed it was possible that some business owners might have conflated HIPPA with the American Disabilities Act, which prohibits discrimination based on disability. But even the American Disabilities Act allows for what Schultz called reasonable inquiry if someone doesn't have an obvious disability.

"I think the stores still have the duty to ask someone to wear a mask," Schultz said. "If they're saying they don't cause of health reasons, you can ask what the health reason is because then the store needs to establish what reasonable accommodations they can make."

Schultz said allowing someone to not wear a mask would probably not be a reasonable accommodation. Instead, though, a store could implement curbside service in such an instance, Schultz suggested.

Schultz said seeing misinformation circulate on social media has been frustrating. Counter to more claims from those opposed to mask use saying the governor's mandate was unlawful or does not have the same effect as law, Gov. Polis's executive order carries the full weight of law, Schultz said.

"Earlier this week, the public health order 20-31 came out, also mandating masks. Public health orders are enforceable by local law enforcement under 25-1-506," said Schultz. "Those can be punished civilly, they can do it administratively where they can pull your business license, or they can do it criminally up to a first degree misdemeanor."

Otero County Sheriff Shawn Mobley said his office will not enforce the mask mandate. Mobley referenced his short staffed department and ongoing criminal investigations. Schultz said he thinks Mobley's decision is okay, but that he was angered by sheriffs from other counties who claimed Polis's law was unconstitutional or did not carry legal weight.

Bent County Sheriffs Office also said in a joint statement with Bent County Public Health that the sheriffs office there would not be enforcing the mask mandate, although they did not provide additional reasoning with their statement.

Otero County will try to utilize civil and administrative means to regulate the mask mandate as opposed to pursuing criminal charges, Schultz said, noting it doesn't do anyone any good to start jailing more people right now.

Another piece of disinformation Schultz wanted to address was that of masks versus the size of COVID-19 particles. Schultz made the distinction that the novel coronavirus that causes COVID-19 is not airborne in the stirctest sense: The viruss primary mode of transmission from host to host is through respiratory particles in other words, spit.

"I'm still seeing a lot of misinformation about the cloth masks themselves," Schultz said. "A lot of people are pointing out micron sizes and all that. This virus has never been airborne, it's transferred through saliva droplets. So the cloth mask does nothing to protect the wearer, it's designed to protect the community from the wearer. So if everyone's wearing a mask, the saliva's less likely to spread to others.

In other words, posts on social media claiming that cloth masks dont stop COVID-19 from passing through them are missing the point, because COVID-19 travels primarily in much larger respiratory droplets that are stopped by a cloth face covering.

Health Director Rick Ritter stressed that many businesses have been compliant with the mask order and that the health department receives numerous calls daily from people looking to improve the safety of their establishments.

Ritter said hes seen people be dismissive of social distancing guidelines and mask use because they dont believe others are taking it seriously.

"To the people saying, 'Well nobody's doing it," that's absolutely wrong," said Ritter. "And that is disrespecting the businesses that are working hard to do what's right, to protect customers, employees, and this is not a hard thing to do, my gosh, we put on pants to cover our lower torso, we put on shirts, and that's not a violation of our constitutional rights.

"If I went out naked on the street, and you can print this, the police would be called. If I said, You can't make me put on pants, that's against my constitutional right to be naked, that wouldn't cut any ice. We're just covering our face and if somebody says, Well you put on pants for decency's sake, I say you put on a mask for decency's sake because you're protecting others.

"A mask is primarily worn to protect others, and that's what I'm saying. These cloth masks, if we all wear them like we're supposed to, it's a kindness to others, it's a consideration for others, and we're going to reduce risk."

Schultz added the health department is working around the clock to try to achieve the best outcome for the community.

Watershed White Collar Decision? Assessing the Impact of U.S. v. Connolly One Year Later – JD Supra

A year ago, the talk of the white collar bar was the decision in United States v. Connolly, 2019 WL 2120523 (S.D.N.Y.). Presiding over the case in the Southern District of New York on May 2, 2019, Judge Colleen McMahons decision discussed the boundaries between the role of independent counsel and the government in internal investigations and led some to speculate that it might fundamentally alter how companies conduct internal investigations, particularly as it pertains to cooperating witnesses.

In 2010, Deutsche Bank retained a law firm to conduct an internal investigation into its role in London Inter-bank Offered Rate (LIBOR) manipulation, which was under investigation by the Commodity Futures Trading Commission (CFTC), Securities and Exchange Commission (SEC) and the Department of Justice (DOJ). From the beginning, the government made clear to independent counsel that it expected regular updates on the internal investigation. The firm met the governments expectations and provided detailed, weekly updates, and allegedly interviewed specific individuals at the governments request. One such individual was Gavin Black. Black later claimed he had no choice but to agree to the interview, as he was forced to choose between termination by Deutsche Bank and cooperating with the investigation.

The information developed during the firms investigation eventually was submitted to the government in a White Paper, which laid out the findings and what amounted to a roadmap of a case against Deutsche Bank. Deutsche Bank later entered into a deferred prosecution agreement, earning extensive cooperation credit for the breadth of information provided to the government.

In 2016, a grand jury indicted Black on charges of wire fraud, conspiracy to commit wire fraud, and bank fraud in connection with the LIBOR manipulation. Before trial, Black argued that his statements to investigators could not be used against him because they were compelled by the government. The government did not end up using his statements at trial. Black was convicted and then challenged the conviction. Black argued that the banks independent counsel compelled him to answer their questions and, because of its close working relationship with the government, the government in essence compelled his statements in violation of his Fifth Amendment right against self-incrimination. Black argued that his prosecution was predicated on and infected by those statements because the firm and the government relied on his statements for investigatory leads.1 Judge McMahon agreed that the statements were compelled by conduct attributable to the government. Nevertheless, Judge McMahon upheld the conviction on the basis that the government did not use his statements and they had no effect on the course of events leading to his indictment and conviction.2

Despite the fact that the conviction was ultimately upheld, this ruling sent shockwaves through the white collar bar. In seminar after seminar, panelists questioned whether the decision changed how to seek out information during an internal investigation and, perhaps more importantly, how to coordinate with the government while seeking cooperation credit on behalf of corporate targets.3 Legal publications have suggested the decision could lead to meaningful changes and a shift in the way companies conduct internal investigations.

So far, Connolly has not turned out to be such a watershed decision. To date, no other court has reached the same conclusion Judge McMahon reached in Connolly concerning statements given by an employee in an internal corporate investigation. To the contrary, other courts have rejected similar arguments.4 And, corporate targets have continued to coordinate with the government in order to seek cooperation credit. The government has continued to demand such cooperation. Although there is no doubt that cooperation with federal enforcement authorities remains a thorny issue, the Connolly decision has not materially impacted this balancing act.

Cooperation with federal authorities can yield substantial concessions and benefits in reaching a resolution. The Justice Manual, which guides the Department of Justices enforcement principles, contains an entire section on The Value of Cooperation. At the same time, though, the goal of the independent investigation should be to uncover the truth and identify a root cause so that a company can make the right decisions about remediation and, yes, even whether to cooperate with the government. Ultimately, while there can be value to cooperation, the goal is not simply to act at the governments behest. Billionaire investor Michael Novogratz said global liquidity pump from stimulus packages will keep driving bitcoins price higher. He expects the price of bitcoin to reach $20,000 this year, fueled by retail investors shifting to the cryptocurrency.

Galaxy Digital CEO Michael Novogratz said on Tuesday that bitcoin and gold have more room to grow and will continue to rise due to global liquidity pump, afforded by governments stimulus packages, coupled with an influx of retail investors.

The liquidity story isnt going to go away. Were going to get a big stimulus, the billionaire investor told CNBC, adding that it doesnt look like the Federal Reserve is going to raise rates. After the CARES Act, the $2.2 trillion coronavirus aid stimulus package which President Donald Trump signed into law in March, Republicans and Democrats have both proposed further stimulus packages. The Democrats proposed the $3 trillion HEROES Act while the Republicans introduced the $1 trillion HEALS Act on Monday.

Furthermore, Bitcoin still has a lot of retail interest in it, Novogratz described, adding that he sees stock investors shifting back to gold and bitcoin.

Novogratz expects bitcoins price to be at $14,000 in the next three months, emphasizing that it could easily reach $20,000 by the end of the year. His year-end price prediction agrees with several others, including a comprehensive analysis by Crypto Research Report.

Bitcoin is currently trading at about $11,258, up approximately 17% since last week and 54% since the beginning of the year. Meanwhile, the price of gold hit an all-time high on Monday, climbing more than 7% since the beginning of the month.

Novogratz said most of his investments have been in bitcoin, gold, and silver. Noting that an estimated 20% of his net worth is in bitcoin, he added: I want it to go a lot higher. As for gold, he said it is more of a 5% position for him.

The billionaire investor further emphasized that he is starting to see institutional investors move into bitcoin. However, unlike gold investing, they face a learning curve when trying to invest in cryptocurrency. Bitcoin is still hard to buy. If it was easier to buy, it would be a lot higher, he previously said. Gold has been around for 3,000 years, its pretty easy to buy, Novogratz opined. Theres an adoption game in bitcoin that you dont have in gold. But I like them both.

Others have also reported seeing increased institutional demand for cryptocurrency, particularly bitcoin. Grayscale Investments said that in the second quarter, 84% of its almost $1 billion inflow into crypto investment products were from institutional investors. Moreover, famed hedge fund manager Paul Tudor Jones recently confirmed that he has almost 2% of his assets in bitcoin.

Bitcoin is doing that thing again.After a 50% slump in the cryptocurrencys price toabout $4,000 in mid-March,whenCovid-19 panic was grippingthe financial markets,it has bounced back to tradeat about $11,200.Veteran crypto-watchers have seen this rapid shift from fear to greed many times before, and know it can have painful consequences.

The first time Bitcoins price went past five figures in 2017, it fueled a speculative frenzy that ended almost as soon as it began, leading to an80% slumpover 12 months. And when Bitcoin rose above $10,000 in February this year, any hope for a rally was snuffed out by Covid. The subsequent mad rush to trade digital coins for cashwas made worseby the fact that many people were using large amounts of debtto back their trading. Several crypto hedge funds closed.

Is anything different this time? Bitcoins wild price swings undermine its case as a reliable store of value or safe haven.Its still 43% below its high of almost $20,000. But as a store of fear Warren Buffetts description of the short-term pessimism that pushes investors into cryptocurrencyit has its fans.

As with gold, whose price has soared as central banks and governments spend trillions of dollars to fight the pandemic recession, some big New York names are talking up Bitcoin as a hedge against an inflationary spiral or currency crisis.Citing its algorithmically-controlled supply cap of 21 million, billionaire investor Paul Tudor Jones praised Bitcoins scarcity premiumin May and said between 1% and 2% of his assets were held in the digital currency as protection ina low-interest-rate world. Medallion, the flagshipfund of quant specialistRenaissance Technologies, got the go-ahead to invest in Bitcoin futures in April.

This market narrative of insurance against the financial apocalypse (almost like a grown-up version of the money printer go brrr meme)has some logic to it.

The recent stimulus-fueled stock-market rally has left 71% of fund managers thinking equities are overvalued, according to a Bank of America July survey. Diversifying into gold might make sense, particularly in a world where Covid-19 cases are flaring up once more. And for the fund manager forced to find winners in a market where everythings up, a bit of Bitcoin might also work as schmuck insurance if the tenfold price rise it experienced in 2017 were ever to repeat itself. Bitcoin is more volatile than and less correlated to gold and equities these days, according to research firm Kaiko. Thats what makes it attractive to some risk-hungry hedge funds, who make their living from market swings.

The snag is just how dangerously unpredictable Bitcoin is even when compared with gold, which has a habit of not doing what bankers expect. Demand for Bitcoin is speculative and emotional, rather than tied to fundamentals such as adoption of virtual currencies as an everyday payment method. And supply is squeezed artificially, not just algorithmically. An estimated 60% of Bitcoinsupply is hoardedand 20%lost or untouched, according to research firm Chainalysis.

As more hedge-fund sharks (and day-trader minnows who want to keep up with Tudor Jonesand his ilk) head back into the murky waters of Bitcoin, theyll be swimming alongside the whales, the big crypto investors who hold their fortunes in digital coin.The market moves of these individuals tend to thrashthe price around.

Some whales will probably be looking for opportunities to cash out after life-changing gains.Investors holding between 1,000 and 1 million Bitcoin account for 42% of all Bitcoin supply.

As my Bloomberg Opinion colleague Aaron Brown put it last year: I doubt they (the whales) have infinite patience, and without significant growth in actual use, I would expect them to quietly withdraw to chase other promising technologies. So far, the market moves have been pretty noisy. Last year, a single large Bitcoin sale knocked 10% off its price. When the next sell-off hits, some of the harshest hedge fund critics of central-bank stimulus might wish for a bailout of their own.

Forget gold and Bitcoin. I’d buy bargain UK shares today ahead of a bumper recovery – Yahoo Finance UK

The chances of a bumper recovery for UK shares may seem slim at present. Although indexes, such as the FTSE 100 and FTSE 250, have rebounded strongly over recent months, many stocks continue to trade significantly below their previous highs. And risks, such as rising coronavirus cases, are set to persist over coming months.

However, buying bargain stocks now for the long term could be a better idea than purchasing other assets, such as Bitcoin and gold. Undervalued shares have the potential to produce high capital returns as the wider stock market recovers.

The recent market crash, and the potential for a second decline this year, is contributing to bargain valuations among many UK shares. Many investors feel that wide margins of safety are currently required due to heightened risks. And, while there could yet be more volatility and even declines ahead, the reality is that a long-term recovery is very likely.

Fiscal and monetary policy stimulus enacted by policymakers in the UK, and in other major economies, could boost asset prices and the wider economy. Although this process may take time, previous economic downturns have always been followed by a return to strong growth.

This time may feel different, due to an unprecedented scenario thats not been experienced for many years, if ever. But major stimulus programmes are already in place and the stock market has a solid track record of recovery. So a return to growth for UK shares is likely to occur in the coming years.

Therefore, continuing to invest in UK shares while they offer bargain valuations in some cases could prove to be a profitable move. It may allow you to reduce overall risks through obtaining a wide margin of safety. Potentially, you may also benefit from relatively high capital returns as the wider stock market recovers.

This means that shares could offer a more favourable outlook than other assets, such as gold and Bitcoin. Certainly, theyve enjoyed sharp growth of late. However, golds price rise may be inhibited by a likely return to more bullish investor sentiment. That makes defensive assets seem less appealing. Furthermore, its price is currently close to a record high, which is in contrast to the low valuations on offer among UK shares.

Meanwhile, Bitcoins role in the world economy continues to be difficult to predict. Its limited size means it may fail to replace traditional currencies. Meanwhile, regulatory concerns could weigh on its performance in the long run.

Therefore, building a portfolio of high-quality stocks while their valuations are low could be a more profitable move for investors. They may yet experience further volatility. But theyre likely to deliver impressive capital returns as the world economy recovers.

Bitcoin fees have spiked 500% this month – Decrypt

Bitcoin's price may be soaring, but so are transaction fees. In the past month, the average cost of sending Bitcoin has risen by more than 525%.

Per data from Bitinfocharts, Bitcoin's transaction fees currently average $5.80 a pop. The vast majority of the spike was realized in the last three days, coinciding with Bitcoin surpassing $11,000. Fees have doubled in just the last three days.

Fees typically spike with higher network usage and given Bitcoin's recent rally above $11,000 as well as the added demand it's generatedits not a big surprise.

The high fees correspond with the jamming of Bitcoin's transaction queue, known as the mempool. Mempool data peaked on July 24, with around 80 megabytes worth of transactions waiting to be processed on the network. When theres a backlog, those wanting to send Bitcoin raise fees so that theyre processed quicker (because miners are more likely to process transactions with higher fees).

The last time Bitcoin transaction fees rose this high was back in May. After Bitcoin's quadrennial halving, the average Bitcoin fee observed a two-year high of around $6.60. It dropped back down afterwards, which should happen this time around too.

Network fees on Bitcoin's closest rival Ethereum are also spiking, up 180% this month, and hitting $1.4 on average. And its having a knock-on effect on the decentralized finance (DeFi) industry. With higher transaction fees, DeFi apps, such as Compound and Uniswap, end up becoming much more costly to use.

Steve Wozniak sues YouTube over ongoing bitcoin scams – The Verge

Steve Wozniak is suing YouTube for allowing scammers to use his name and likeness in phony bitcoin giveaways.

According to the lawsuit, filed in the Superior Court of the State of California, crooks have been posting videos on the platform claiming that Wozniak is hosting a bitcoin promotion. They convince users that if they send bitcoin to a provided address, Wozniak will return double the amount.

YouTube has featured a steady stream of scam videos and promotions that falsely use images and videos of Plaintiff Steve Wozniak, and other famous tech entrepreneurs, and that have defrauded YouTube users out of millions of dollars, the complaint reads.

The lawsuit includes screenshots of videos advertising 5,000-BTC and 10,000-BTC giveaways from Wozniak, which include images of the Apple co-founder. There appear to be videos using the likeness of other tech leaders as well, including Elon Musk, Bill Gates, and financial self-help guru Robert Kiyosaki.

The plaintiffs, which include Wozniak and 17 other individuals, allege that YouTube is aware of these scams but has nonetheless not taken the videos down.

Despite Plaintiffs and legions of other users repeated pleas that YouTube take timely action to end this bitcoin giveaway scam, YouTube repeatedly delayed or refused to do so, reads the lawsuit. As a result of defendants egregious failures to act and affirmative misconduct in promoting this criminal enterprise, Plaintiff Wozniak has suffered, and continues to suffer, irreparable harm to his reputation, and YouTube users, including plaintiffs, have been defrauded out of millions of dollars. Among other relief, Plaintiffs seek an order requiring YouTube to finally end its outrageous practice of hosting, promoting, and profiting from these criminally fraudulent videos and promotions.

We take abuse of our platform seriously, and take action quickly when we detect violations of our policies, such as scams or impersonation, said a YouTube spokesperson in a statement to The Verge.

Fraudulent giveaways have long been a feature of the bitcoin world, but they are getting more attention after a network-wide hack on Twitter that leveraged account access to perform the scam on a massive scale. Last week, hackers accessed the accounts of a number of high-profile users, including Barack Obama, Joe Biden, Elon Musk, Bill Gates, Kanye West, and Michael Bloomberg. Hackers used the breached accounts to announce fraudulent giveaways, claiming users who sent bitcoin to a provided address would receive double the amount in return. The scam is believed to have earned its creators nearly $120,000. (The Youtube scam, while also targeting bitcoin owners, does not appear to involve compromised account information.)

Twitter acknowledged that situation about an hour after it began, tweeting from its support handle, We are investigating and taking steps to fix it. The company eventually locked all verified accounts from tweeting while it looked into the incident, a measure that was in place for over two hours.

We all feel terrible this happened, Twitter CEO Jack Dorsey wrote later in the evening. Were diagnosing and will share everything we can when we have a more complete understanding of exactly what happened.

Steve Wozniak sues YouTube over ongoing bitcoin scams - The Verge

Silvergate’s Bitcoin-Backed Lending Product Grew 80% in the Last Quarter – CoinDesk – CoinDesk

Silvergate Bank continued to add a steady drip of cryptocurrency customers in the second quarter and its portfolio of bitcoin-collateralized loans nearly doubled, dwarfing the growth of its traditional real estate loan book.

According to its latest earnings report, released Monday morning, the banks vanilla loans about $1.1 billion of the type of assets George Bailey would have recognized increased by only 0.1% from the first quarter. Bitcoin-collateralized loans through the banks SEN Leverage product surged 88% in the same period, to $22.5 million.

The bank continues to have a steady pipeline of more than 200 customers waiting to be onboarded, Silvergate CEO Alan Lane said on an earnings call Monday.

Its a great time to be a bitcoin banker, Lane said. The publicly traded, La Jolla, Calif.-based bank is one of the few U.S. banks willing to openly serve crypto-related businesses and gets most of its deposits from the crypto sector.

Each of the SEN Leverage loans has performed according to the banks expectations, Lane said.

In response to analysts questions, Silvergate EVP of Corporate Development Ben Reynolds projected that SEN Leverages growth would be dominated by institutional customers taking out credit lines from anywhere between $1 million to $10 million. While Silvergate is tempering SEN Leverage growth by the speed at which it can safely underwrite the loans, the customer demand for the product, which is part of the Silvergate Exchange Network (SEN). is strong, Reynolds added.

The bank went public on the New York Stock Exchange in November. With $2.34 billion in total assets, Silvergate is less than 1% the size of JPMorgan Chase.

Money makers

Despite outpacing growth in the banks traditional loan book, the bitcoin-collateralized loans have a long way to go before they affect the banks net interest income (NII), or profit from loans.

If you assume 7% yield on the $22 million, it suggests less than 3% of NII as it stands today, Mike Perito, a bank stock analyst at investment bank Keefe, Bruyette & Wood, said in an emailed statement.

The SEN Leverage product is used for many kinds of trading strategies, beyond just a long position, Reynolds said. Demand for bitcoin-backed loans tends to decrease as the market becomes less volatile.

The crypto space continues to be a rich source of non-interesting bearing deposits for the bank: $1.6 billion, or 94% of total deposits, comes from the sector.

While deposits decreased from calling outstanding brokered certificates of deposit (CDs) and from a decrease of deposits from digital currency customers, the latter category now makes up 90% of total deposits, up from 84% in the first quarter.

As a result, the banks cost of deposits dipped to 0.37%, from 0.87% in the first quarter. Crypto firms deposits are an attractive source of funding for Silvergate because they dont pay interest, whereas brokered deposits are expensive because they need high rates to attract investors.

The bank signed on 31 new crypto firms in the second quarter. Out of its digital currency client growth, 25 were new institutional investors, three were crypto exchanges (including ErisX), and another three were in the miscellaneous bucket. Deposits across all customer types decreased in the second quarter.

For the second half of 2020, Martino said he expects interest in the SEN from institutional investors to increase given bitcoins recent rise above $10,000, and does not expect to see Silvergates rivals continue to bid aggressively for deposit business in a zero-interest-rate environment.

Activity on the SEN increased by 28% since last quarter to more than 40,000 transactions, Lane said.

The volume running over the SEN increased by 29% quarter-over-quarter to $22.4 billion, a 160% increase from the same period last year.

Silvergate reaped $2.4 million in fee income from digital currency customers, a 41% increase from first quarter 2020 and the largest quarterly increase the bank has had so far from this revenue source. Silvergate CFO Antonio Martino noted the bank saw the highest volume of wire transfers ever as more crypto exchanges used the banks cash management products.

Crypto banking competition

Even with the Office of the Comptroller of the Currency (OCC) announcing that nationally chartered U.S. banks can now custody crypto, building out custody services for digital assets is different from building out custody products for the existing financial market, Lane added.

Even though the California Department of Business Oversight and the San Francisco Federal Reserve has been OK with banks safeguarding digital assets for some time, state-chartered Silvergate has no plans to jump into crypto custody anytime soon, the CEO said. In June, Silvergate partnered with crypto custodian Anchorage to custody assets for SEN Leverage customers.

While Silvergate hasnt announced any crypto prime brokerage plans, it is focused on ways in which it can help reduce the friction on the digital asset side of trades as its done for the fiat side through the SEN, Reynolds said. The bank is considering building new products, forming new partnerships and even targeted acquisitions in the field of digital asset settlement.

The most prime brokerage-esque product the bank is focused on now is offering lines of credit, Lane said.

What prime brokerage means for the digital currency industry is still being developed, he added.

In response to an analysts question about JPMorgan Chase banking Coinbase and Gemini, Lane said Silvergate had anticipated that competition would come into the space for some time.

We know for a fact that our exchange partners desire to have multiple banking relationships, he said. As you can see from the results in the quarter, we didnt see any direct impact from the [JPMorgan] announcement. We continue to grow.
