Colombia loses swath of sea but keeps islands in dispute with Nicaragua

BOGOTA, Colombia Colombia lost a large swath of the Caribbean but kept a series of far-flung islands that had been at the heart of a long-running dispute with Nicaragua.

The International Court of Justice on Monday redrew the maritime boundaries of the two nations in a decision that's likely to have a long-ranging impact on fishing, mineral and petroleum rights in the region.

The new map gives Colombia access to its tourist-haven islands of San Andres and Providencia through a wide channel that juts into Nicaragua's new maritime boundaries. But it also leaves two smaller uninhabited keys, Quitasueno and Serrana, as Colombian enclaves in Nicaraguan waters.

Colombian President Juan Manuel Santos praised the court for recognizing the nation's sovereignty over the islands but "emphatically rejected" the new maritime boundaries.

"We are not going to rule out any resource or mechanism available to us through international law to defend our rights," Santos told the nation Monday night. "The government respects the law but believes the court has incurred in a series of errors."

While the dispute goes back to at least 1913, Nicaragua brought the case to The Hague in 2001. In its filing, the country asked for control of some of the islands and to have its maritime rights extended east of San Andres. Colombia maintained that its maritime boundary was well west of the archipelago, along the 82 meridian.

In the short-term, the decision may have the biggest impact on Colombia's fishing fleet, which will now have to ply through Nicaraguan waters to reach the fishing grounds around Quitasueno and Serrana.

Despite not having all its demands met, Nicaragua hailed the ruling as a victory.

"Colombia was acting like it was the owner of these islands and like it was owner of all the maritime territory, and the court told them 'No, that's not how it is,' " Nicaragua's court representative Carlos Arguello told the country's national television channel, according to The Associated Press. "We've been given very important maritime territory."

The ruling gave Nicaragua "incredible potential wealth and future exploitation of fisheries and other resources, such as minerals," he said. "That's what we were seeking and that's what resulted."

The International Court of Justice ruled Monday that a group of tiny islands in the western Caribbean belongs to Colombia, but also granted Nicaragua control of a large swath of the surrounding sea and seabed that could hold oil reserves.

Based on evidence presented by lawyers for both nations, "Colombia and not Nicaragua has sovereignty over the islands," the court's President Peter Tomka told delegations from both sides.

But the decision not to grant Colombia full sovereignty over the waters connecting all the archipelago's islands drew a vehement objection from Colombia.

President Juan Manuel Santos told Colombians in a national speech that the court had "committed grave errors" by ignoring the terms of the very treaty it had declared valid and that the decision would hurt the archipelago's fishermen.

The decision effectively cut off four small islands from the rest of the archipelago and Santos said he could not accept the court's "omissions, errors, excesses and inconsistencies."

While Santos said he recognized that the court's decision is final and legally binding, he said Colombia "emphatically rejects this aspect of the decision" and "we don't rule out any recourse or mechanism that international law gives us to defend our rights."

He said he would fly to San Andres immediately.

President Daniel Ortega called it a "day of national victory, victory for all Nicaraguans," and called on Santos to respect the court's ruling.

Police and rugby take message to islands

New Zealand Police, Cook Islands Police and New Zealand rugby are teaming up to promote the Break the Silence End the Violence message.

A group of 10 representatives from different New Zealand rugby clubs leave for Rarotonga on Thursday for a week-long tour visiting schools and community groups with the message that "violence is not OK".

The group consists of players and coaches who have agreed to support NZAid's Pacific Prevention of Domestic Violence Programme (PPDVP).

Head of the PPDVP in New Zealand, Cam Ronald, said one of the best ways of preventing violence was for young men and women to see role models promoting the message that violence is not OK.

The PPDVP began working with NZ rugby four years ago. Since then more than 40 players have visited countries in the Pacific as part of the programme.

"It is very positive that so many of our young sportsmen, many of them with connections to the Pacific want to take a stand against violence," Mr Ronald said.

Hurricanes Professional Development Manager, Steve Symonds says that each year he has to turn players away who want to be part of programme.

"The boys are excited to be part of the PPDVP project and the work that both the New Zealand and Cook Islands' Police do to prevent violence in the Pacific.

The programme is in its fourth year with visits to Samoa, Tonga and now the Cook Islands by players who are prepared to extend their role-model status beyond New Zealand.

Mr Ronald said the Cook Islands Police was one of the first Pacific countries to open a dedicated Domestic Violence Unit (DVU) in 2006 and had continued to build its capability to deal with domestic violence since then.

THE HAGUE, Netherlands The International Court of Justice ruled Monday that a group of tiny islands in the western Caribbean belongs to Colombia, rejecting Nicaragua's claim in a long-running territorial dispute between the two Latin American nations.

Based on evidence presented to the judges by lawyers for both nations, "Colombia and not Nicaragua has sovereignty over the islands," the court's President Peter Tomka told delegations from both sides.

Nicaragua first went to the world court, the United Nations' highest judicial organ, in 2001 arguing that Colombia had no legal claim to the islands.

The court partially rejected that argument in 2007, saying a 1928 treaty between the two countries established that Colombia owned the English-speaking islands of San Andres, Providencia and Santa Catalina.

Those volcanic islands, 720 kilometers (450 miles) from Colombia's coast and 110 kilometers (70 miles) from Nicaragua's mainland, are popular among tourists for their pristine white beaches and coral reefs.

In Monday's ruling, the court's 15 judges said that several other smaller islands and cays in the region also belong to Colombia and set the maritime borders based on Colombia's ownership of the islands.

The new borders give Colombia control of the waters and seabed immediately surrounding its islands and cays and give Nicaragua a large horseshoe-shaped area of the sea and seabed stretching from its mainland coast around the Colombian islands.

International Court of Justice rulings are final and legally binding.

BOGOTA, Colombia In a ruling that gave each side some of what it wanted, the International Court of Justice in The Hague on Monday upheld Colombia's sovereignty over seven Caribbean islands but ordered that Nicaragua's maritime boundary be redrawn to give it more offshore territory.

Ending a case that first came before the court in 1999, the ruling gives Nicaragua additional access to fishing grounds and potentially huge reserves of natural gas that Colombian government studies say reside below the ocean floor in the disputed area.

In a reading broadcast over Colombian television, the court in the Netherlands announced that Colombia had adequately "shown its right to the archipelago," which includes the islands of Roncador, Quitasueno, Serrana, Serranilla, Bajo Nuevo, Cayo Bolivar and Albuquerque, turning down the Nicaraguan petition that they revert to its control.

But the judges found that Nicaragua's eastern maritime boundary should be extended several miles in a jagged diagonal line east of the current limit, the 82nd meridian, producing a significant gain in offshore territory.

"We are very satisfied," said Nicaraguan attorney Carlos Arguello in The Hague, deferring further comment to President Daniel Ortega.

The Colombian reaction was more subdued. Chief attorney Julio Londono Paredes hailed the retention of the islands but added that he would have to study the redrawn maritime map before his government commented on that aspect.

The slow-moving case saw the court issue a preliminary ruling in 2007 confirming Colombian control over the disputed archipelago's main islands, San Andres and Providencia. But it left the issue of 12,000 square miles of maritime territory and seven smaller islands in abeyance until Monday.

Although the ruling upholds Colombia's control over all the islands and a 12-mile radius around each, it expanded Nicaragua's territory significantly, although the exact number of square miles gained by Nicaragua was not immediately specified.

Enrique Serrano Lopez, an international relations professor at Bogota's Rosario University, described the ruling as "Solomonic," applying opposing criteria in territorial disputes: treaties agreed to in the past versus modern concepts of what constitutes equitable division of territory.

Nicaragua signed a treaty in 1928 agreeing to Colombia's territorial claims, even though the islands lie about 400 miles or more northwest of Colombia but only about 100 miles at the closest point off Nicaragua's Caribbean shore. Nicaragua subsequently claimed the 1928 treaty was invalid because it was signed under the duress of a U.S. military occupation.
