European Court of Human Rights doesn't get their appeal

On Wednesday, the Pirate Bay co-founders Fredrik Neij and Peter Sunde lost an appeal to reverse charges that they violated Sweden's Copyright Act by giving Internet users a (still quite active) forum for illegally sharing files. In late 2010, the pair were sentenced to a year in prison and hit with a fine of over $4 million. On a later appeal, the time behind bars was reduced, but the amount increased to around $6.5 million.

The latest appeal was made in June to the European Court of Human Rights in Strasbourg, France, says the Hollywood Reporter. The TPR creators argued that the previous court's ruling represented an attack on their freedom of expression that the site's users violated copyright law, and that Neij and Sunde shouldn't be punished for receiving and providing information about those crimes. But the court wasn't having it.

The ECtHR upheld the original ruling, explaining that the protection given to Neij and Sunde "cannot reach the same level as that afforded to political expression and debate ... Since the Swedish authorities were under an obligation to protect the plaintiffs property rights in accordance with the Copyright Act ... the Court finds that there were weighty reasons for the restriction of the applicants freedom of expression."

In related news, according to TorrentFreak, the Pirate Bay have officially filed charges of copyright infringement against the copyright-enforcing organization that ripped off their logo last month. Freedom comes to Indian convict too late

The 16 years Sulaiman Kutty lived in the Kingdom, he spent in a prison.

After years of attempting to gain his freedom following a drug trafficking conviction, he lost all hope to see his native Kerala state in India. He slipped into mental illness and prepared himself to die in prison.

But Saudi authorities, recognizing his condition, awarded him a compassionate release from the Dammam prison.

Yet, just moments from complete freedom as he prepared to board a flight late last night for India, it all fell apart. Kutty was returned to his prison cell, his future uncertain.

According to Sulaiman Kuttys brother, Mohammed, Sulaiman became violent in the queue when Mohammed greeted him at the airport. Sulaiman attacked his brother and became violent with passengers in the queue waiting to board the flight.

Airport and airline officials, fearing that he could become violent while in flight and become a danger to his fellow passengers, demanded that Sulaiman be returned to the Dammam prison.

Kutty came to Saudi Arabia in 1997 for work, just like thousands of his fellow countrymen. Before he left his country someone had asked him to hand over a small package, containing important medicine. He was to hand this over to a sick person in Saudi Arabia. In those days it was a routine custom in India to bring packages for fellow Indians, Kutty believed.

This kind gesture made for a disastrous turning point in his life. On arrival in the Kingdom, it was found the parcel contained deadly narcotics. Kutty, then 19 years old, was detained by Saudi customs authorities for carrying drugs and later convicted and sentenced to prison for a 15-year term and a fine of SR 100,000.

A shocked Kutty, now 36, heard about the death penalty for drug traffickers. He was certain his days were numbered and became a psychiatric patient two years later in 1999.

Other inmates who spent a long time in prison are in good health. Some were able to memorize the Holy Quran, earning remission of their sentences. However, two other Indian convicts in a drug trafficking case Shaikh Mastan and Hamza received the death penalty and were executed.

Freedom students put their training to the test on Feb. 25, practicing the evacuation of their building and their reunification with parents.

"Our students, teachers and staff did a tremendous job during our evacuation drill," says Freedom Principal Mike Morriss. "Within minutes, every one of our 888 students were safely inside Drury University and the St. Robert Municipal Building."

In an orderly and quiet fashion, third, fourth and fifth graders departed Freedom Elementary for the nearby building. Color-coded signs helped ensure students remained with their teachers as they entered the temporary shelter. Once inside, teachers and students moved to specific locations, based on grade level. After all students were accounted for, checkout stations began releasing students to parents who volunteered to test the reunification process.

"When parents arrived, runners delivered children directly from their teacher to the reunification station for their parents," Morriss says.

At the reunification site, parents were required to complete paperwork and show proof of their identification before their children were released to them.

"We hope that we never need to implement our training in a real situation, but we know that we are all prepared should the need ever arise," Morriss says.

Each school within the Waynesville R-VI School District has an evacuation plan so that in the event of an emergency, students have a specific place to go. Parents of Freedom students were notified in advance about the drill.

"Our parents were very supportive of this reunification drill and we appreciate the opportunity to test our plan," Morriss says. "With every drill, you learn more about what we can do better, and nothing is more important than student safety."

USS Freedom Makes Port Visit In Hawaii (Video)

Video Reporter Interviews USS Freedom Crew In Hawaii

Crew members from the San Diego-based USS Freedom are getting a chance to stretch their sea legs during a port visit to Hawaii that began March 11.

Honolulu television station KITV4 sent journalist Ryan Kalei Tsuji to report live from both the deck and inside the Freedom yesterday morning. He interviewed several members of the crew. I've posted that video up top.

The Freedom is the Navy's first littoral combat ship, and she's on her maiden deployment. Cmdr. Timothy Wilke, USS Freedom commanding officer, explained to Public Affairs Support Element West exactly what makes a littoral combat ship so unique:

"This vessel, the littoral combat ship, is really designed for operating in the littoral shores of the land, what we commonly refer to as brown water. It does have a capability to operate in blue water, but it's mainly focused on bridging that gap of what we have in our ship class right now."

After her stop in Hawaii, the Freedom will continue on to an eight-month deployment in the Asia-Pacific region.

The Navy plans to keep the Freedom in the region for eight months, though its San Diego-based crew will rotate out after four. Another crew will serve the rest of the deployment and take the ship back home to California.

ABOARD THE FREEDOM The U.S. Navys hottest new ship and the centerpiece of its renewed focus on Asia isnt its largest vessel, or its most technologically advanced. But it has advantages that its bigger siblings lack.

The 388-foot Freedom is small enough to move among the many islands and shallow waters of Southeast Asia, a trait that allows the Navy to train alongside similar-sized vessels in the regions navies and build relationships with them.

All this, the Navy believes, will help it make sure the regions critical waterways stay open to the trillions of dollars in oil and other trade that passes through each year. Its an objective so important the Navy is sending the Freedom to Singapore this month even as automatic federal spending cuts carve into its budget.

We hold our commitment to them, to our area, our theater, so highly that this deployment has not been affected, said Rear Adm. Hugh Wetherald, the U.S. Pacific Fleet deputy chief of staff for plans, policies and requirements.

The Navy and the Pacific Fleet are still on watch, he said.

Freedom on Monday sailed to Pearl Harbor, into the prime mooring spot the Navy often reserves for ships it wants to show off. The blue and gray camouflage painted on its sides designed to confuse hostile small boats and make it less visible from shore stood out amid the plain gray hulls of the other surface vessels in port.

Until now, most U.S. ships visiting Southeast Asia have been aircraft carriers, destroyers, cruisers and other large boats well equipped for jobs such as firing cruise missiles or defending against fighter jets.

But they dwarf smaller ships U.S. partner navies from other countries such as Singapore, Malaysia, Brunei and Thailand use for missions such as patrolling the seas, catching pirates, and stopping human and drug trafficking.

Freedom -loving motorcyclists renew fight against NC helmet law

RALEIGH Motorcyclists who love the wind in their hair are pushing again for the freedom to ride without safety helmets in North Carolina, and they found support Tuesday from members of a state House committee.

North Carolina is one of 19 states where safety helmets are mandatory for all motorcyclists. Studies credit helmets with reducing deaths and serious brain injury in crashes, and a recent survey by the Governors Highway Safety Program found that 78 percent of motorcycle riders support the state law.

But opponents have tried to weaken or repeal the helmet rule in nearly every legislative session since the mid-1990s. This year their cause is led by a motorcycle-riding Republican from Gaston County.

Rep. John Torbett of Stanley enjoys the chance to ride across the state line into South Carolina, where helmets are required only for bikers 20 and younger. He parks his motorcycle and pulls off his full-face helmet.

Thats my choice, Torbett said Tuesday at a House Transportation Committee meeting. Thats what I choose to do. South Carolina provides that opportunity.

Torbetts bill would require helmets only for the youngest riders. He proposed to let motorcyclists ride bareheaded when they turned 18, but he accepted a committee amendment that would match the South Carolina standard: helmets mandatory until age 21.

Personal freedom is the chief argument for opponents of the helmet law.

Torbett warned legislators that they would hear arguments about lives saved and insurance costs reduced by helmets, but the only safety statistics considered by the committee Tuesday came from Torbett himself.

Using data he attributed to the U.S. Department of Transportation, Torbett distributed a chart that depicted slightly higher death rates for motorcyclists in states with mandatory helmet laws, when compared with those in other states. That was welcome news for a couple of committee members who wanted to support his proposal for relaxed regulation.

I agree with the bill sponsor on the freedom aspects, said Rep. Frank Iler, a Republican from Oak Island, the committee co-chairman. I had some safety concerns, but, apparently statistically, that may not be a problem.

Disgraced pol Monserrate gets month of freedom to fix diseased teeth

It seems that Hiram Monserrates teeth are as rotten as his reputation.

The prison-bound ex-pol has won an extra month of freedom for desperately needed dental work on his diseased choppers, court papers reveal.

Monserrate who was sentenced to two years in the slammer for corruption went to his dentist in mid-January complaining of recent, severe pain, defense lawyer James Neuman wrote.

Tooth doc Louis Shapiro performed repeated root canal procedures, but Monserrate still needs four more crowns installed, according to the Manhattan federal court filing.

Dr. Shapiro opines that this treatment is necessary and must be done expeditiously in order to avoid additional damage, Neuman said.

Upon information and belief, it is very unlikely that this type of work would occur while Mr. Monserrate is in custody.

Judge Colleen McMahon gave Monserrate until April 11 to start serving his time behind bars.

The disgraced Democratic lawmaker from Queens pleaded guilty last year to scamming nearly $100,000 in slush funds while serving on the city council in 2006.

He was booted from the state Senate in 2009 after getting convicted of roughing up his girlfriend, Karla Giraldo, for which he was sentenced to probation.

However, freedom does not give me the license to do anything I want, whenever I want. With freedom comes responsibility. Freedom allows me to make choices in my life, and those very choices come with consequences. These consequences may affect my life as well as the lives of others. When the consequences of my choices become negative, I may lose some of my freedom, including what activities I do throughout the day, what I wear and who I spend time with, or something as simple as losing the privilege of my cell phone.

Many people in America take freedom for granted. The view freedom as a right, but it is not. Soldiers ultimately pay the price for everyone's freedom. Without freedom we wouldn't be able to obtain an education, find the job of our choice,vote, have a family, or live our everyday lives. Freedom is a privilege we must honor.

Freedom allows all citizens to have the right to pursue an education of their choice, to work hard, and to succeed in their communities and lives. We, as free people, also have a responsibility to protect our communities and the people who live there. This freedom spreads beyond me and my community. This freedom is so important to me that I must preserve it for future generations. The greatest display of appreciation for my freedom is to become the best individual I can be. Because of the freedom to dream and turn the dreams to realities, I will become that individual.
