CPA board chair disappointed after colleagues refused to hear legal counsels opinion

Freedom Air can continue using Commonwealth Ports Authority facilities for its operations despite having $1.23 million in outstanding arrears incurred the past three years.

This after the Commonwealth Ports Authority board of directors yesterday delayed the enforcement of the eviction notice supposedly due today, Sept. 19.

By a vote of 4-3, the board gave Freedom Air a 90-day extension to settle its arrears with CPA. Board vice chair Benigno Sablan and members Barrie Toves, Fermin Sakisat, and Michael San Nicolas voted in favor of the extension, while chair Jose Lifoifoi and members Thomas Kiyu Villagomez and Frances Mafnas opposed it.

Lifoifoi in particular was disappointed that majority of the board thumbed down his request to have them hear first the opinion of CPA legal counsel Robert Torres before conducting the voice vote.

So as it stands now, Freedom Air has until Dec. 31, 2013 to settle its unpaid obligations to CPA, especially the passenger facility charges as required by the U.S. Federal Aviation Administration. The board said failure to do would force them to kick out the company from its premises, with finality.

CPA board last August unanimously voted to terminate and issue an eviction notice to the airline due to its long overdue account with the ports authority. It was earlier revealed that Freedom Air, in many occasions, was issued termination notices which none were actually implemented.

Minutes before yesterdays board meeting, Freedom Air general manager on Saipan Dennis Cruz was seen in the gallery but left as soon as the meeting started.

After adopting the days agenda, Sablan immediately made a motion to stay the eviction notice for Freedom Air and to delay its enforcement for 90 daysor until the end of the yeara motion immediately countered by Villagomez who described the 90-day recommended extension as too much.

Internet freedom coalition seeks data

An internet freedom coalition backed by US technology giants has asked for 21 countries to release information on national security and law enforcement data requests.

The Global Network Initiative, which includes Google, Facebook, Yahoo and Microsoft, has asked the countries to 'report on the requests they make for electronic communications surveillance and to make it legally possible for companies to report regularly to the public on the government requests that they receive from law enforcement as well as national security authorities'.

Letters have been sent to senior government officials responsible for foreign affairs, justice, and security, with copies to data protection authorities, the group says.

Copies were sent to representatives at the UN offices in Geneva, in advance of discussions on human rights and communications surveillance at the 24th session of the Human Rights Council, the organisation said.

The move comes with US tech firms in a battle with the US government to release more information on the role of companies in surveillance programs revealed in recent months by intelligence leaker Edward Snowden.

The tech firms say they are not allowed to reveal the number of national security requests, and that more transparency would boost the confidence of their users.

The Global Network Initiative, which seeks to promote freedom of expression and privacy in the digital age, sent the requests to the 21 countries in the Freedom Online Coalition, which have committed to collaborating to advance internet freedom.

The countries are Austria, Canada, Costa Rica, Czech Republic, Finland, France, Estonia, Georgia, Germany, Ghana, Ireland, Kenya, Latvia, the Republic of Maldives, Mexico, Mongolia, The Netherlands, Sweden, Tunisia, Britain and the US.

MMA Veterans Cyborg and Cosmo Victorious at Lion Fight 11

MMA fighters earned Muay Thai wins on the night as Cristiane Cyborg and Cosmo Alexandre won their respective bouts.

It took Cristiane "Cyborg" Justino three rounds to dispatch of the late replacement Jennifer Colomb via technical knockout stemming from a flurry of body shots.

Cosmo Alexandre won his bout via anticlimactic decision over Thai fighter Nampon in five rounds. A veteran of the sport himself, it did not take long for Alexandre to find his rhythm in the ring. In the end, Cosmo was able to land the better strikes and avoid damage. The victory is No. 42 in his Thai boxing career.

The Lion Fight 11 event was held under the dazzling lights of Fremont and Third Street in front of The D Hotel and Casino in Las Vegas Friday night. Three amateur fights and eight pro bouts entertained approximately 1,000 fans. However, there was no secret who fans were waiting for as Cyborg's name and image brought out continuous ovations on queue.

Cyborg's opponent seemed to be attempting to implement much the same strategy as Marloes Coenen did in Cyborg's last MMA bout. She looked to tire Cyborg and to keep her distance in order to pick her openings for attack. But just like Marloes, Colomb learned that Cyborg leaves little in the way of opportunity, and the French fighter wilted in the third after being battered against the ropes.

To be fair to Colomb, it was a strong effort given there was a 10-day notice and a trip from France involved in her preparation to take on one of the most intimidating women in combat sports. Colomb kept her poise prior to her almost inevitable demise and did not show fear as she took on the Brazilian juggernaut.

Still, her gutsy showing was enough to show Lion Fight she deserves a follow-up bout.

Kevin Ross and Tetsuya Yamato gave Fight of the Night performances in the co-main event. The two gave as good as they took for five full rounds. In the end, Yamato took the appropriate win via split decision.

Invicta FC Champ Cris Cyborg Crushes Jennifer Colomb in Lion Fight 11 Muay Thai Bout

Recognized as one of the top female fighters on the planet for her exploits in mixed martial arts, Invicta FC featherweight champion Cris Cyborg Justino on Friday night stepped into the Lion Fight ring to put her pure Muay Thai skills on display.

Fighting at the Freemont Street Experience in Las Vegas at Lion Fight 11, Cyborg stepped into the ring with a single professional Muay Thai fight on her record. She squared up against French champion Jennifer Colomb, who entered the fight 10-0 with all 10 victories coming by way of knockout.

The fight was utter domination by Cyborg.

As she often does in MMA, Cyborg stormed her opponent with aggression, letting Colomb immediately feel the power in her punches and the relentlessness of her attacks.

Cyborg only increased her pace as the fight wore on, mixing in a wide variety of punches, kicks, knees, and elbows. As Cyborg began landing kicks high and low in the second round, Colomb had no answer. She looked confused and hesitant.

Cyborg took full advantage, adding insult to injury with an ever-wider array of attacks, landing a spinning hook kick and then driving Colomb into the corner with a front push kick before mauling her with punch combinations.

The end couldnt have come soon enough for Colomb. And it did come, mercifully, at the 54-second mark of the third round, when Cyborg folded her over with a crushing right hand to Colombs ribs. The referee immediately stepped in and waved off the fight.

It was an impressive performance and could lead to future Muay Thai exploits for the Invicta champ.

Hey why not? I train every day, said Cyborg when asked if she would fight Muay Thai again. If its for a belt for sure I come back.

Her next fight, however, will be in a cage.

Hawaiian Beaches man takes plea deal in attempted-murder trial

A 73-year-old Hawaiian Beaches man who shot a Panaewa woman four times on Mothers Day 2012 after she had broken off a relationship with him has taken a plea deal almost three weeks into his attempted murder trial.

Joseph Amormino Sr., a retired Hawaii Community Correctional Center guard, pleaded guilty Thursday to first-degree assault, use of a firearm in the commission of a felony and two counts of terroristic threatening. The charges stem from the May 13, 2012, shooting of June Shirshac, a 57-year-old greeter at the Hilo Walmart store, and a road rage incident on Highway 130 as Amormino drove from Hawaiian Beaches to the Auwae Road home where Shirshac lives.

Numerous other charges, including attempted first-degree murder and two counts of attempted second-degree murder were dropped in exchange for Amorminos plea, and prosecutors have agreed to seek a maximum sentence of 25 years for all charges combined. If convicted on the attempted first-degree murder charge, Amormino would have faced a mandatory life sentence without the possibility of parole.

Sentencing is scheduled for Nov. 21 at 8 a.m. before Hilo Circuit Judge Glenn Hara.

When Hara asked Amormino to briefly describe the events that resulted in the charges he pleaded to, Amorminos lawyer, Deputy Public Defender Michael Ebesugawa, asked the judge for a bench conference. Afterward, the judge asked Deputy Prosecutor Mike Kagami to state the evidence supporting the charges.

Mr. Amormino, while driving on the Keaau-Pahoa highway, threatened three members of the (Samson) Peneku family with a firearm while driving on that highway, Kagami said. He then drove to the residence of June Shirshac and Francis Makaiwi, where he shot June Shirshac four times, resulting in serious bodily injury to her. He also intentionally shot approximately four to five rounds into the bedroom door of Francis Makaiwi when he (Makaiwi) was within the bedroom in a bathroom area.

Shirshac sustained gunshot wounds to both legs, and to her right hand and shoulder. She was hospitalized for approximately four months and has undergone numerous surgeries the latest, she testified on Aug. 19. She testified in court while sitting in a wheelchair.

Makaiwi, an ex-husband of Shirshac, was uninjured in the shooting.

Shirshac testified that Amormino arrived at the home owned by Makaiwi at about 5:30 p.m. the evening of the shooting, brandishing a handgun as he got out of his pickup truck. She said that Amormino repeatedly said youre not effing leaving me before shooting her and attempting, unsuccessfully, to shoot Makaiwi.

Amorminos defense was that despite the shooting, there was no intention to kill Shirshac or Makaiwi.
