ALBUQUERQUE, N.M. A state court has overturned a Portales teens 2011 murder conviction and ordered a new trial, according to court documents.
The New Mexico Court of Appeals ruled in an opinion posted Friday that statements DeAngelo Montoya made to investigators were inadmissible because his age precluded him from waiving his Fifth Amendment rights.
Montoya was convicted of second-degree murder in the July 2010 shooting death of 21-year-old Eastern New Mexico University student Angel Vale.
Montoya was 13 at the time of the shooting. He was remanded to a Children, Youth and Families Department group facility until he is 21, the maximum punishment allowed for a child.
The state ruling overturns a pre-trial ruling by District Court Judge Drew Tatum that allowed Montoyas statements.
District Attorney Andrea Reeb said Monday it is her understanding that the state Attorney Generals Office plans to ask the state Supreme Court to review the lower courts decision.
She said if the trial is returned to her district, her office plans to present additional evidence to allow Montoyas statements, and regardless of that decision, plans to retry Montoya.
In his opinion for the court, Chief Judge Rodrick T. Kennedy wrote:
We conclude that the evidence presented by the State through answers to a significant number of leading questions did not amount to clear and convincing evidence of Childs ability to waive his legal rights.

First Connecticut, and then New York passed gun control laws this year - that many people believe are unconstitutional - turninghundreds of thousands of AR-15 owners into felons simply for not registering their guns. Now, Washington state gun owners intend to take things to a new level in response to Washington's new gun control law. At least 5,500 are planning to openly violate the heavy-handed law, I-594, during a rally at the state capitol in Olympia on December 13th. The law goes into effect on December 4th, after the Secretary of State certifies the election results. Not a single so-called mainstream media source has mentioned the unprecedented event, even though RSVPs continue to increase every day.
This is practically unheard of in the modern era; not only will 5,500 people deliberately violate the law through civil disobedience, but will violate felony gun laws. Washington is one of few remaining blue states that has remained friendly to gun owners, and so gun owners are furious that a handful of billionaires were able to come in and buy the election, contributing about half the $10 million poured into the race to support I-594, almost 10 times as much as the opposition. Unsuccessful at getting the legislature to pass the law, gun control proponents resorted to billionaires to push it through instead as an initiative. Their money provided the resources to afford to run continuous misleading ads on TV.
The Facebook pagefor "I-594 I Will Not Comply" states, "We will rally at the capitol, openly exchange guns, unveil and plan to break apart the entire legislation and violate I-594 in every possible way We will buy and sell guns from whom we please, we will not submit to background checks, we will not give up our rights, WE WILL NOT comply."
Under I-594, transferring a gun to someone in most situations - such as loaning your gun to a family member or friend at the range - will constitute a felony. Most gun owners have transferred their gun at one point to a friend or relative to try shooting. One-third of Washington state residents are gun owners. Considering the population of Washington is about 7 million, that means as many as 2.3 million gun owners could now be felons for doing what they have commonly done in the past. And that is only the tip of the iceberg; the 18-page law contains many other poorly written, vague and onerous restrictions, too many to list here.
The number of RSVPs for the protest is stunning. A rally against I-594 that took place in downtown Seattle last month only attracted around 300 people.
What are the police going to do if 5,500 gun owners all commit felonies transferring their guns to each other at once? It would be impossible to try and arrest all 5,500. Rank and file law enforcement opposes I-594, as do more than two-thirds of the elected county sheriffs in Washington. A recent candidate for Yakima County Sheriff is helping set up the rally.
The point of the rally is to show that the law is so ridiculous, burdensome and convoluted that it is unenforceable. Unlike much prior civil disobedience, the protest will be nonviolent, and there is no reason to believe otherwise. At the rally against I-594 in downtown Seattle last month, where most protesters came armed, the only law enforcement agent visible who showed up to monitor the event was a Washington Park Ranger who was unarmed. This is because gun owners are some of the most law-abiding people in the country, and law enforcement knows this. The fact they have been provoked to civil disobedience - felony civil disobedience - is very disturbing.
Hungry with the taste of victory, gun control advocates in Washington are now moving on to get more legislation passed that will ban assault weapons, require trigger locks, and more infringements upon the Second Amendment.
Fortunately, opponents such as Washington's Second Amendment Foundation, and likely the NRA as well, are intending to file a lawsuit to challenge I-594, and will be lobbying the legislature to change or rescind it.

How much is that handgun in the window?
Thats a question Californians cant ask, thanks to a law that states handguns, or even pictures of them, may not be visible from outside of gun stores. Four Golden State gun dealers are challenging the law, saying its their First Amendment right to advertise their wares.
I run one of the most heavily regulated and inspected businesses in existence, but its still illegal for me to show customers that I sell handguns until after they walk in the door, said Michael Baryla, the owner of Tracy Rifle & Pistol. Thats about as silly a law as you could imagine, even here in California.
While most federal lawsuits involving gun rights invoke the Second Amendment, the gun dealers are claiming it is their First Amendment right to freedom of speech that is violated by California Penal Code section 26820. That law, first enacted in 1923, bans gun stores from putting up signs advertising the sale of handguns but not shotguns or rifles.
The First Amendment prevents the government from telling businesses it disfavors that they cant engage in truthful advertising, said Bradley Benbrook, the lead attorney on a legal team that also includes UCLA Law Professor Eugene Volokh.

Controversial goods and services, such as abortion and contraceptives, are clearly protected under the First Amendment, Benbrook added.
The suit was filed Monday in the Eastern District of California, in Sacramento. It names California Attorney General Kamala Harris and Stephen Lindley, who heads the state Department of Justices Bureau of Firearms, as co-defendants.
Tracy Rifle and Pistol, a gun store and firing range in San Joaquin County, was recently cited by state authorities for having pictures of three handguns in window signs that could be seen from outside the store. A photo of an AR-15 rifle in an adjacent window, part of a display ad for which Baryla paid a total of $3,000, did not draw a citation. He has until February to take down the photos.

Risen, a Pulitzer Prize-winning journalist for the New York Times, is being honored for championing the First Amendment and press freedoms, the foundation said in a statement.
Risen is under threat of imprisonment by the federal government for refusing to reveal the names of sources used for a 2006 book. His book, State of War, reported on CIA efforts to sabotage Irans program seeking to build a nuclear bomb.
BMV offers siteto check refund
The Indiana Bureau of Motor Vehicles has a new website designed to help customers determine whether they are eligible for an Excise Tax refund.
In early October, the Bureau of Motor Vehicles began sending out claim forms to customers who were affected by the Excise Tax misclassification, said Don Snemis, commissioner of the Indiana Bureau of Motor Vehicles, in a statement. All of those letters have been mailed. In case someone did not receive their letter, the BMV has created a website that allows Hoosiers to verify their eligibility and print a claim form that includes mailing instructions.
To date the Bureau of Motor Vehicles has received more than 131,000 claim forms and has processed more than 92,700 claims totaling $14.9 million.
To avoid any potential fraud during the claim process, residents are encouraged to access the refund eligibility page at http://www.mybmv.com by clicking on the Check Your Excise Tax Refund Eligibility icon.
Users will need to input either their Social Security number or drivers license number.

Firefox 1.0 was released10years ago yesterday, and as a celebration of sorts, Mozilla released a new version of the browser that's intended to help users control their privacy online as well as a new developer-oriented version of the browser.
The main feature of the new Firefox release, 33.1, is a "Forget" button on the toolbar thatcaninstantly wipe the last five minutes, two hours, or one day of browsing history, cookies, and tabs. This isn't a new capability itselfthe Privacy panel of the options dialog has long offered this abilitybut in Firefox 33.1, it's now instantly accessible.
The new release also adds DuckDuckGo as a search engine. DuckDuckGo positions itself as a more private search engine, one that tracks less user data while recording no search history and having no identifiable user accounts.
On top of all that, Mozilla launched the Polaris Privacy Initiative, an effort to develop technology to enhance browser privacy. Two Polaris experiments were announced today. First, Mozilla is working more closely with the Tor Project. The Tor Project uses Firefox as the browser in its Tor Browser Bundle, and the Tor engineers have suggested a list of changes to Firefox that would make using Firefox and Tor together better. Mozilla is investigating whether these changes can be incorporated into Firefox. The browser developer is also going to host Tor servers of its own, increasing the capacity of the anonymous network.
Second, Mozilla istakinganother stab at preventing advertisers from tracking user activity across the Web. This will use blacklists that prevent access entirely to certain domains used by third-party trackers. This feature is currently being tested and developed in Firefox's Nightly builds.
Firefox Developer Edition is a new variant of Firefox that replaces the Aurora channel running two versions ahead of the stable release (so currently, Firefox stable is version 33, Beta is 34, and Aurora/Developer is 35). It's designed to both give developers an early look at forthcoming features and to be a better platform for Web development in general.
Firefox already includes extensive developer features,including a development environment.Firefox Developer Edition makes these things easier to use by, for example, including Mozilla's add-in that lets Firefoxdebug Web content on iOS and Android. It alsocomes pre-configured to support remote debugging.
The new offering even has a fancy dark theme that makes it look visually distinct from the regular Firefox edition.
