DEP reaches new deal over Freedom Industries site

State regulators are proposing a new agreement with Freedom Industries that the bankrupt company hopes will pave the way for it to enter a voluntary toxic cleanup program, a move that could reduce the amount of contaminated material they have to remove from the site of Januarys Elk River chemical spill.

The state Department of Environmental Protection on Thursday morning released a copy of its new seven-page consent order worked out between Freedom officials and the DEPs Division of Water and Waste Management. The deal is subject to a public comment period before final approval by DEP.

Under the agreement, the DEP would lift the terms of previous enforcement orders that would require Freedom Industries to cleanup and remove all contaminated soil and groundwater from its Etowah Terminal site, located just 1.5 miles upstream from the West Virginia American Water Company regional drinking water intake.

Freedom would then be eligible to apply for the DEPs Voluntary Remediation Program. If accepted into that program, the company could use a risk-based approach that Freedom officials hope reduce the amount of contamination they would have to dig up and remove from the site.

In recent bankruptcy court filings, Freedom chief restructuring officer Mark Welch has touted the voluntary program route as effective and less expensive, saying that cleaning up the site to the point that no Crude MCHM -- the coal-cleaning chemical that spilled in January -- could be detected was not practical nor scientifically possible.

But DEP Secretary Randy Huffman said in an interview this week that even if Freedom gets into the voluntary program, the company will have to convince his agency that any risk-based cleanup standards would eliminate any risk that MCHM would ever again contaminate the drinking water supply for hundreds of thousands of people in Charleston and surrounding communities.

I havent backed down from my zero-risk obligation, Huffman said. How scientifically and from an engineering perspective they could get to that through the Voluntary Remediation Program, I dont know yet.

Complicating the issue for the DEP and Freedom is that, with little scientific research about MCHMs potential health effects, there are no established guidelines for proper cleanup of soil or groundwater.

At the end of the day, there can be no risk, Huffman said. We just cant have it. We cant have any risk. If they can figure out how to do that [in the voluntary program], it is something we would consider.

Freedom has been eying the voluntary cleanup program for months as a way to ease its costs and the time involved in remediating the Elk River chemical storage facility. But previous DEP enforcement orders, issued unilaterally by the agency in the days and weeks after the Jan. 9 spill would block the company from the program.

Senate poised to vote on USA Freedom Act as early as next week

The Senate is poised to vote as early as next week on the USA Freedom Act, legislation that would end the National Security Agencys bulk collection of records about Americans phone calls.

If passed, it may be voted on by the House and signed into law by years end, fulfilling one of President Obamas major asks of Congress: that it adopt such legislation.

Passage would also clear the decks for incoming Senate Majority Leader Mitch McConnell (R-Ky.), who has an ambitious legislative agenda, including trade, taxes and building the long-delayed Keystone XL pipeline.

The bill, after months of tense negotiations, won the support of the intelligence community and civil liberties organizations a rare consensus by groups that are normally at odds with one another.

Introduced in July, it stalled for months as advocates, including Sen. Patrick J. Leahy (D-Vt.), the Judiciary Committee chairman, sought to overcome concerns that the bill either hindered the intelligence community or did not provide adequate privacy protections.

If it becomes law, the bill would close a chapter in a vigorous, year-and-a-half-long debate over how far the government should go in gathering data on Americans to thwart terrorism and obtain foreign intelligence.

That debate began in June 2013, following a leak of a classified court order to The Guardian newspaper, which revealed that the NSA had been secretly collecting millions of Americans call detail records each day from U.S. phone companies for counterterrorism purposes. The agency gathers times, dates and durations of calls, but not their content.

The story was followed by a series of more disclosures about NSA surveillance activities, which were based on documents leaked by former NSA contractor Edward Snowden.

Snowden, who is living under temporary asylum in Moscow, said he shared the classified material with journalists, including at The Washington Post, to shine light on what he considered to be a system of mass surveillance that was growing unchecked.

The American people are wondering whether Congress can get anything done, Leahy said Wednesday, after Senate Majority Leader Harry Reid (D-Nev.) filed a procedural motion for the Senate to consider the bill. The answer is yes. Congress can and should take up and pass the bipartisan USA Freedom Act, without delay.

Poll puts Wilders far-right party on par with Liberals

A new opinion poll in the Netherlands shows Geert Wilderss anti-Islam, anti-EU Freedom Party neck-and-neck with the Liberals, led by prime minister Mark Rutte, as the threat posed by returning Islamic State jihadists replaces the MH17 air disaster at the top of the national agenda.

A weighted average of the countrys four main political polls shows the Liberals losing three seats compared with a month ago, and the Freedom Party gaining three. The poll has the Liberals and the Freedom Party each taking between 25 and 29 seats, an outcome a long way from Mr Ruttes high of 41 seats in the 2012 general election and from the lacklustre 15 won by Mr Wilders.

The public reacted very well to the way the Rutte government handled the aftermath of the MH17 crash and managed to get the vast majority of the bodies repatriated, says political scientist Tom Louwerse of pollster Peilingwijzer.

The Rutte approval factor predictably benefited the Liberals more than the junior coalition partners, Labour, and so there was a spike in the Liberal support that lasted into September but that has now, apparently, worked itself through.

The beneficiary of that working through has been Mr Wilders and the Freedom Party, which, despite approaching the European elections in May on a high, fared not as well as expected after an uncharacteristic gaffe that saw Mr Wilders leading anti-Moroccan chants at an election rally.

The commotion surrounding that chanting, and the Freedom Party resignations that followed, has now died down, Mr Louwerse says. The popularity of the government is dwindling again and the threat of attack posed by returning jihadists with connections to Islamic State gives Wilders a stronger profile.

What is most interesting about this poll, he adds, is the degree to which conservative voters routinely switch allegiance between the Liberals (centre-right on economic matters) and the Freedom Party, depending on topical issues.

For the junior coalition party, Labour, there is little change in the unimpressive 13-17 seats, compared with the 38 seats they took in 2012. By contrast, centre-left D66 again did well, with 20-24 seats, .

As the poll was published, there was more unpopular news as finance minister Jeroen Dijsselbloem confirmed that a 642 million EU surcharge based on gross domestic product growth is probably correct, according to an initial analysis.

Ruling prohibits vehicles on Treasure Island beaches

TREASURE ISLAND Ruling in favor of three beachfront hotel owners, a judge has ordered the city to prohibit vehicles from driving and parking on its beaches.

Circuit Judge Pamela Campbell signed a summary judgment order prohibiting vehicular traffic and parking on Treasure Island's beachfront except for cleanup, repair and public safety reasons.

Last week's ruling came less than two weeks before one of the city's major annual beach events, Sanding Ovations a four-day event beginning Wednesday where sand sculptors across the country and world gather to create sculptures using sand, water and their imaginations.

The event for a city that bills itself as the sand sculpture capital of Florida draws thousands to Treasure Island and, in the past, participants and event attendees alike have parked on the beach.

In light of the judge's ruling, the city is making preparations to move parking offsite this year.

"The event is still on, but I'm not sure in what shape or form," Mayor Robert Minning said Monday.

City Manager Reid Silverboard referred questions to City Attorney Maura Kiefer, who did not respond to a request for comment.

The City Commission held an executive session last week and a second one this week to discuss its options in the case, which could include appealing the ruling.

Meanwhile, the owners of the Thunderbird Hotel, the Page Terrace Motel and the Windjammer Resort are celebrating their victory.

"Our beach is the main economic driver of the island and it needs to be protected," said Thunderbird general manager David King said. "We are very happy with the judge's ruling and look forward to trying to work with the city to continue to have events that protect the beach and not destroy it."
