From the moment that a state lawyer stood up in the Supreme Court to arguethat messages on license plates are governmentspeech, it seemed that the Justices went forward for the rest of the hour assuming that itwas not at least not always. A strange hearing thus unfolded on when the First Amendment puts curbs on government regulation of expression, and how tight those curbs can be.

The Court previously had made it absolutely clear that, if it is the government that speaks out on any issue, the First Amendment does not apply at all: it can say what it likes, and it can refuse to say what it opposes or even simply what it finds a bit unpleasant. In other words, as speaker, it can act as total censor.

That is the simple approach that Texas was seeking to have the Court embrace in Walker v. Sons of Confederate Veterans, a case that gives the Court its first chance in nearly four decades to address the nature of license plate messages, beyond simply numbers and state names.

The states solicitor general, Scott A. Keller, opened by arguing that, becausethe state exercises total control over the making and display of auto and truck license plates, it has absolute authority to refuse toplace its imprimatur on any message that a tourist might want to put on a vanity, or specialty, plate.

But he had hardly finished his opening sentences when members of the Court began acting as if the First Amendment did apply to that system. Justice Ruth Bader Ginsburg said the state used a nebulous standard for disapproving plate designs which, of course, would be beside the point if the state had absolute freedom to choose; it would not need any standard at all, and could act on whimsy.

Justice Samuel A. Alito, Jr., quickly offered a hypothetical about government billboards that contained the states message, but left room at the bottom for people to put up a message of their choice. He was, of course, hinting at a hybrid display: some government, some private. Keller responded that, if the government had final approval authority, it still would be government speech.

Justice Sonia Sotomayor suggested that, almost anything that the governmentdoes, it has final authority over, but that would not be true if the government had not createdthe words in other words, if some of the speech was privately initiated. She, too, was talking about a hybrid situation and that, again,would seem to bring the First Amendment at least partly into play.

When Justice Elena Kagan took a turn at suggesting a hypothetical, with a state allowing a license plate that said Vote Republican but turned down one that would say Vote Democratic, the states lawyer said that might run into other constitutional provisions but not the First Amendment.

It was perhaps inevitable that, sooner or later, someone would start pondering whether a license plate program was, in fact, a kind of public forum one, to be sure, that would have to conform to the First Amendment. Justice Anthony M. Kennedy was the first to do so, wondering if a specialty license plate program did amount to a new kind of public forum. Again, though, that begged the question whether it was, as Texas insisted, a program of government speech.

When is our next Great Comet?

Should we complain? Two Great Comets have garnished Southern Hemisphere skies within the past 8 years Comet McNaught in 2007 and Comet Lovejoy in 2011 while a generation of northerners have had just photos. We are now treated to a near constant barrage of magnificent comet photos, but be aware that most are from highly experienced amateur astrophotographers using telescopes and solid-state sensors, or from professional astronomers using big telescopes, or even from the International Space Station, above Earths obscuring atmosphere. Meanwhile, from the ground and with the eye alone? Not since Comet Hale-Bopp in 1996-97 has the Northern Hemisphere seen a magnificent comet. Whats more, some skygazers would not classify Hale-Bopp as a Great Comet. In that case, we northerners have to look back to Comet West in 1976 nearly 40 years ago to find a Great Comet.

Lets consider some of the incredible comets of recent times and historic records, to find out when the Northern and Southern Hemispheres might expect to see the next Great Comet.

First, how are we defining a Great Comet? Theres no official definition. The label Great Comet stems from some combination of the comets brightness, longevity and breadth across the sky.

For purposes of this article, to consider the question of Great Comets of the north and south and their frequency, well define Great Comets as those that achieve a brightness equal to the brightest planet Venus (magnitude -3 to -4) or brighter with tails that span 30 degrees or more of the sky.

We can consider some other major comets, too, those that reached magnitude 1 or brighter in other words, they became as bright as the brightest stars with tails spanning 15 degrees or more. These major comets would have been visible long enough for Earths citizenry to take notice (some impressive comets have such extreme orbits that they arent visible long, and hardly anyone besides astronomers notices them).

Consider, also, how humanitys ability to view the heavens has completely changed in the last 50 years.

In that time, space travel has become a reality and solid-state electronics have revolutionized photography. Space probes have been sent to comets beginning with the European Space Agency (ESA) Giotto spacecraft sweeping past Halleys Comet in 1986, and, most recently, ESAs Rosetta spacecraft which is currently spending many months orbiting and becoming intimately acquainted with 67P/ChuryumovGerasimenko.

But Italian parents have the "freedom of education for their children," which is permitted not as a "favour" but instead is a "fundamental right". Meanwhile, he told the CEI's ruling council that honest people "can and must react against corruption" after the latest in a long line of graft scandals. Corruption, the cardinal said, is "a very grave offence for the poor and the honest. That is intolerable". As well, Bagnasco warned that Europe must consider why its citizens are joining Islamic State (ISIS) extremist death squads. The problem is not because of unemployment but due to a culture at home that is found to be "empty of its own spiritual, moral, anthropological" guidelines, said Bagnasco.

Couple charged with Super Aggravated Sexual Abuse of a Child

Harris County Sheriff's Office deputies, along with Harris County District Attorney's Office investigators, have filed charges of Super Aggravated Sexual Assault of a Child and Sexual Performance by a Child Under the Age of 14 against Ashley Dack, and Patrick Schuneman.

Dack is currently being held on a $350,000 bond, while the court declined bond for defendant Schuneman.

The defendants were charged after authorities found video and photos depicting the sexual assault of a child on Schuneman's mobile phone and on his personal computer.

According to investigators, defendant Dack took photos of the infant-aged victim and provided them to Schuneman to download.

The ICAC Task Force was created to help federal, state and local law enforcement agencies enhance their investigative responses to offenders who use the Internet, online communication systems, or computer technology to sexually exploit children.

Type 2 diabetes is marked by insulin resistance, or the bodys inability to store sugar and convert it into carbohydrates for energy. Overcoming that resistance is the main hurdle scientists face in creating new treatment for the condition, but researchers in Canada have found a promising means for doing so: combining stem cell therapy and antidiabetic medication.

Type 2 diabetes accounts for nearly 95 percent of the 400 million diabetes cases worldwide. Current treatment often involves imprecise insulin injection, and can produce side effects like unwanted weight gain, gastrointestinal issues and low blood glucose levels. Eighty percent of Type 2 diabetes patients are overweight.

In the study, published Thursday in the journal Stem Cell Reports, scientists observed that transplanting pancreatic stem cells derived from human cells into mice with Type 2 diabetes symptoms, then administering common antidiabetic drugs, improved the mices glucose metabolism, body weight and insulin sensitivity three hallmark problems associated with the condition.

There have been similar reports looking at treatment of type 1 diabetes by stem cell-based replacement, and there are many people around the world who are interested in that, lead study author Timothy J. Kieffer, a molecular and cellular medicine professor at the University of British Columbia, in Vancouver, told FoxNews.com. Until this point, nobody to our knowledge had tested such a stem cell-based transplant study in a Type 2 diabetes model.

Many people have predicted this approach to fail because one of the characteristics of Type 2 diabetes is insulin resistance and so it was generally thought that simply replacing insulin wouldn't be effective, Kieffer added.

Researchers fed four separate groups of immunosuppressed mice a different diet to try to emulate humans diagnosed with Type 2 diabetes. One group of mice received a 45 percent fat diet; one a 60 percent fat diet; one a high-fat, Western diet; and the last a low-fat diet. No single group of mice developed a phenotype that exactly mimicked a Type 2 diabetes human patient, but all three high-fat groups ended up exhibiting characteristics that mirrored the hallmark features of the condition.

Study authors transplanted human embryonic stem cell (hESC)-derived pancreatic progenitor cells into the mice after they began exhibiting symptoms. These cells are programmed to expand and differentiate when transplanted and to subsequently secrete insulin.

To transplant the human cells, researchers used a macroencapsulation device, a mechanism that is meant to prevent the body from detecting nonnative material as foreign and subsequently rejecting it. Because the mice were immunosuppressed, the device wasnt necessary, but Kieffer said his team used it so their findings would be more relevant for future clinical trials, wherein the patients would not be immunosuppressed. Researchers opted to induce Type 2 diabetes symptoms in immunosuppressed mice with diet instead of using a mouse model genetically engineered to assume Type 2 diabetes for that same reason.

The hope in the field is that some sort of device will eliminate the need for immunosuppression when cells are transplanted, Kieffer said.

Stem cell therapy could reverse Type 2 diabetes, UBC study finds

VANCOUVER -- University of B.C. scientists appear to be one step closer to reversing diabetes using stem cell therapy.

The latest study, published last week in the journal Stem Cell Reports, found that Type 2 diabetes can be eliminated in mice using a combination of conventional diabetes drugs and specially cultured stem cells. Similar methods have already been used to reverse Type 1 diabetes, which usually begins in childhood.

The team simulated Type 2 diabetes in mice by feeding them a high-fat, high-calorie diet for several weeks. In humans, Type 2 usually begins in adulthood and can be a result of obesity, poor diet and lack of exercise.

Like diabetic humans, the diabetic mice treated only with drugs experienced spikes in their blood sugar levels after eating sugary meals.

But the mice that were surgically implanted with pancreatic-like cells grown from human stem cells didnt have those drastic swings and were able to regulate their blood sugar like healthy animals.

Being able to reduce spikes in blood sugar levels is important because evidence suggests its those spikes that do a lot of the damage increasing risks for blindness, heart attack, and kidney failure, said Timothy Kieffer, a professor in UBCs department of cellular and physiological sciences.

So far, the researchers have followed the mice for up to seven months, and theyve remained healthy.

When we removed the transplanted devices and analyzed the cells within, they still appear very healthy so we believe they will function much longer. Ultimately the duration of cell function will need to be assessed in humans, Kieffer said in an email.

Human trials are already underway for stem cell therapy on Type 1 diabetes; the first patient was implanted with cells in October.

The treatment also had a surprising side-effect: weight loss. The mice all returned to the same, healthy weight as the animals in the control group.
