A fatal wrong turn suspected at NSA

The overnight tryst began in Baltimore, with three men, two dressed as women. It continued at a motel on U.S. 1, and when one of the men woke up Monday morning, his two cross-dressing companions, and his Ford Escape, were gone.

The dark-colored Escape was headed south on the Baltimore-Washington Parkway. Its driver, in what authorities believe could have been a mistake, took a restricted exit leading to a security post at the sprawling campus of the National Security Agency at Fort Meade, Md.

An NSA statement said the driver ignored police commands to stop and instead accelerated toward a police vehicle as at least one officer opened fire. The stolen SUV crashed into the cruiser. One man died at the scene, and the other was taken to a hospital for treatment. An NSA officer also was injured, though officials did not say how.

What had first appeared to be an attempt to breach security at the listening post that eavesdrops on communications throughout the world now appears to be a wrong turn by two men who police believe had robbed their companion of his vehicle and perhaps didnt stop because there were drugs inside.

A spokeswoman for the Baltimore office of the FBI, Amy J. Thoreson, said early in the investigation that authorities do not believe [the incident] is related to terrorism. A law enforcement official said: This was not a deliberate attempt to breach the security of NSA. This was not a planned attack.

Police have not released the identities of the people involved, or the conditions of the man who survived the incident and the injured NSA officer. The NSA statement did not say whether either person in the car was struck by gunfire or was injured as a result of the crash.

Details about how the incident began were pieced together with information from several law enforcement officials and others familiar with the case, who spoke on the condition they not be named in order to discuss a pending case.

A Howard County police spokeswoman confirmed that the men involved stayed at a Jessup motel and that the owner of the SUV called police Monday morning to report it stolen.

Supreme Court Reinforces Jones Conception of 4th Amendment

In a per curiam opinion this week, Grady v. North Carolina, the U.S. Supreme Court reinforced recent 4th Amendment decisions in holding that when the government physically occupies private property for the purpose of obtaining information, it engages in a search under the 4th Amendment.

The State of North Carolina subjects certain repeat offenders to a lifetime of satellite-based monitoring (SBM) after they complete their sentences. The plaintiff, Torrey Dale Grady, argued that such a program represents a violation of his 4th Amendment rights under recent U.S. Supreme Court opinions, including a 2012 case called United States v. Jones (installing a GPS tracker on a suspects car represents a search) and a 2013 case called Florida v. Jardines (using a drug-sniffing dog on a suspects porch represents a search).

The Supreme Court agreed with Grady that such monitoring constitutes a search. In light of these decisions, it follows that a state also conducts a search when it attaches a device to a persons body, without consent, for the purpose of tracking that individuals movements.

In concluding otherwise, the North Carolina Court of Appeals apparently placed decisive weight on the fact that the States monitoring program is civil in nature. See Jones, ___ N. C. App., at ___, 750 S. E. 2d, at 886 (the instant case involves a civil SBM proceeding). It is well settled, however, that the Fourth Amendments protection extends beyond the sphere of criminal investigations, Ontario v. Quon, 560 U. S. 746, 755 (2010), and the governments purpose in collecting information does not control whether the method of collection constitutes a search. A building inspector who enters a home simply to ensure compliance with civil safety regulations has undoubtedly conducted a search under the Fourth Amendment.

The court also rejected North Carolinas somewhat strange argument that its monitoring program is not meant to collect information:

The satellite-based monitoring program shall use a system that provides all of the following: (1) Time-correlated and continuous tracking of the geographic location of the subject . (2) Reporting of subjects violations of prescriptive and proscriptive schedule or location requirements. N. C. Gen. Stat. Ann. 14208.40(c).

The States program is plainly designed to obtain information. And since it does so by physically intruding on a subjects body, it effects a Fourth Amendment search.

The Court did not, however, examine whether the program constitutes an unreasonable, and therefore unconstitutional, search. The case was remanded to a lower court to sort through that issue.

Notwithstanding the reasonability issue, this ruling reinforces a heartening trend in 4th Amendment jurisprudence away from the nebulous reasonable expectation of privacy standard and toward a more concrete common-law trespass standard, at least insofar as searches of private property are concerned.

The Comets in 2014 had possibly one of the most productive offense in coach Frank Monica's 14 years at the helm.

Erron Lewis earned River Parish Player of the Week in September 2014 after he rushed for 150 yards and four touchdowns in a 49-14 win over East Jefferson - just one highlight of Lewis' high school career.

Quarterback Austin Weber had about 2,000 all-purpose yards in the 2014 season - that alone leaves some big shoes to fill.

But Patrick Ratlin has been waiting in the wings.

"He's a different type of quarterback than Austin -- he's a pocket guy but he can run a little bit," Monica said. "We've got a couple of possibilities --Justin Loupe at running back, hopefully he can fill that spot."

The Comets have advanced deeper and deeper into the playoffs the past two years - can they continue the streak while rebuilding?

St. Charles doesn't have an easy district schedule -- and the playoff bracket isn't any easier.

Getting to the postseason in the select group means building a strong non-district schedule. St. Charles has three Class 5A schools on the 2015 schedule, opening with Thibodaux and later facing Central-Baton Rouge and East Ascension.

'World travel,' reading to Delilah, author visits highlight reading month in East Jackson schools

LEONI TWP., MI - A visit from an author who took them to places around the world, and dropping everything to curl up with a good book were among the festivities enjoyed by East Jackson students during March is Reading Month.

Students at Memorial and Bertha Robinson elementary schools spent the month enjoying a variety of activities.

Jackson veterinarian Jason Galicki brought his therapy dog Delilah to Memorial Elementary School for a day of reading. Students read to Delilah and learned about dogs and being a veterinarian.

Joel Tacey, Michigan's Family Funnyman, also took Memorial students on a "trip around the world," introducing them to zany characters.

At Bertha Robinson Elementary School, Principal Heather Jacobs surprised students and staff with DEAR - Drop Everything and Read - times. When this happened, everyone stopped what they were doing and found a comfortable spot to read a book.

Jackson author D.L. Price also visited the school, as did East Jackson High School students, who dropped in to read to students.

Bertha Robinson Elementary classes also decorated their room doors to celebrate the month.
