ABA endorses requirement to consider poverty, flight risk when immigration courts set bond – ABA Journal

By Lorelei Laird

An ABA amicus brief filed March 8 argues that immigration courts should be required to consider ability to pay and flight risk before deciding on bond.

The brief (PDF) was filed to the 9th U.S. Circuit Court of Appeals in Hernandez v. Sessions, a class action that argues that the federal government violates the Fifth and Eighth amendments as well as the Immigration and Nationality Act when immigration judges set bond without consideration of the noncitizens ability to pay, flight risk or dangerousness.

When bonds are imposed without consideration of less restrictive conditions or the noncitizens financial resources, they may inadvertently cause a noncitizen to be detained solely because of his or her inability to pay, the brief says. That outcome violates bedrock constitutional protections.

The underlying lawsuit was filed by the American Civil Liberties Union of Southern California. According to the complaint (PDF), bond for lead plaintiff Xochitl (so-chee) Hernandez was set at $60,000 in March 2016, even though her sole crime during more than 25 years in the United States was shoplifting. Hernandez came to the United States without authorization as a teenager and is eligible for processes that could legalize her status. But she cannot afford the bond and remains jailed at an Immigration and Customs Enforcement detention facility.

Another lead plaintiff, Cesar Matias, is a Honduran national seeking asylum in the United States because he was persecuted at home for his sexual orientation. He has been detained for more than four years in a city jail in Orange County, the complaint says, because he cannot afford the $3,000 bond set by an immigration court.

The ACLU noted that immigration judges and ICE agentsboth of whom may set bondrequire the full amount of cash bond before release and often set five- or six-figure bond amounts without considering the noncitizens ability to pay. This is not authorized by the INA, the complaint says, and violates the Eighth Amendments excessive bail clause and the rights to due process and equal protection under the Fifth Amendment. A Central California district court issued a preliminary injunction that required consideration of ability to pay and less restrictive conditions of release before imposing bond.

The ABA asked the San Francisco-based 9th Circuit to affirm that ruling. The U.S. Supreme Court has held that pretrial detention violates noncitizens of their fundamental right to liberty, the brief says, and this is permissible only when theres a legitimate law enforcement purpose for the detention. When decision-makers dont take ability to pay into account, the brief says, they violate constitutional principles. They also hurt detained peoples abilities to defend their cases, deprive citizen children of their parents, and overburden the immigration detention and court systems, at a substantial cost to the public.

The ABA has expressly opposed routine detention of noncitizens in the 2006 Report 107E, the brief notes, and has recommended bond or bail only as a last resort in its Criminal Justice Standards and Civil Immigration Detention Standards.

Hawaii V. Trump: A Legal Nothing-Burger – Daily Caller

5524836

This replaced his order from January which was challenged in courts everywhere. The 9th Circuit Court of Appeals ruled the January order should be stayed indefinitely rendering the order unenforceable while in litigation. The court got it wrong completely. Rather than fighting in the liberal 9th Circuitwhich has a staggering 80% reversal rate the second highest in the nation the Administration issued a new more narrow order andavoided the confusing implementation of the January order.

Now we are back in court the 9th Circuit naturally. Thats where the activist judges are. 72% of the judges in the 9th Circuit Court of Appeals were appointed by democrats.Hawaii along withIsmail Elshikh Imam of the Muslim Association of Hawaiisued to block the revised order. The 38 page lawsuit is assigned to US District JudgeDerrick Watson a 2013 appointee of former President Obama. It was no accident it was brought in Hawaiiwhere two of the three federal judges are Obama appointees.

Lets discuss Hawaiis verbose-yet-meritless lawsuit. Theres 29 pages of policy arguments not legal ones.

Its a litany of reasons why Hawaii and the Imam think the order is a big scary monster thats embarrassing and keeps the Imams Syrian mother-in-law from visiting even though she hasnt come to visit since 2005.Theres only 7 pages of legal claims. Lets look at the 29 pages of irrelevant material first. They lay out some policy reasonswhy the executive order, they say, isnt a good idea.

Lead counsel is Neal Katyal former Solicitor General of the US.Professor Katyal is a brilliant lawyer whom I have met several times and is as nice a guy as you could ever meet.Reasonable minds can disagree and we disagree.

Pages 1-2. Hawaiians cant receive visits from or be reunited with people affected by the order. Universities cant recruit as well. The Imam has to live in a country where people think the government disfavors a religion. The order hurts Hawaiis economy.

Response: Theres no constitutional right to receive visits from foreigners. Those words arent in the Constitution. So what if universities cant recruit from 6 nations for a while. National security is more important. What would a terrorist attack do to recruiting? If the Imam thinks the government has established a disfavored religion hes entitled to his opinion but this order affects ANYONE of any religion from a mere six nations. Muslims from every other country remain unaffected by the order. The Hawaiian economy is booming and its speculative at best to think a handful of affected people will change that.

Pages 7-10. These are campaign speeches and other cherry-picked remarks where Trump advocated ideas about immigration and a relationship between terrorism and immigration.

Response: His campaign remarks arent relevant. He wasnt President, the order doesnt mention Muslims and doesnt apply to any single religion.

Pages 11-15. These describe the January Order.

Response: Thats irrelevant. This is a new order. We arent litigating the first.

Pages 16-19. These describe the rollout of the first order, chaos at airports, and confusion in its implementation.

Response: Its true that the rollout couldve been smoother but this is a new order. We arent litigating the first.

Pages 20-25. These quote and describe the new order.

Response: Millers comments are irrelevant because the new order didnt exist then. It doesnt matter what Miller says. It matters what the order says.

Pages 25-30. These rehash in more detail the initial claims. The Imams mother-in-law cant visit, other residents cant receive certain visitors, it makes people feel bad, it harms the economy etc. This is a policydebate. If the Imams mother-in-law cant visit Hawaii for now and her last visit was in 2005 one wonders if this is a real or pretend problem.

Pages 31-37. The legal arguments. They arelegallyincorrect for astonishingly simple reasons:

COUNT 1. First Amendment-Establishment Clause

Hawaii and the Imam allege The Establishment Clause of the First Amendment prohibits the Federal Government from Officially preferring one religion over another. They also allege the order has the effect of disfavoring Islam.

Heres what the Constitution actually says: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof. Ive given you both the Establishment Clause AND the Free Exercise Clause. Read them together.Executive orders are not acts of Congress. Theres no language in the order that mentions Islam. The order does disfavor unfettered entry into the US from the six nations (temporarily) regardless of religion. Muslims fromaround the globe enter the US daily and will continue to despite the order. The Establishment Clause claim islaughable.

COUNT 2: Fifth Amendment-Equal Protection

Hawaii and the Imam allege The Due Process Clause of the Fifth Amendment prohibits the FederalGovernment from denying equal protection of the laws, including on the basis of religion and/or national origin, nationality, or alienage.

The Fifth Amendmentdoes not mention the words Equal Protection. Thats the Fourteenth Amendment. I agree that all peoplewho have rightsunder the Constitution are entitled to equalprotection. Thats simple. But heres the big problem for the plaintiffs: Non-citizens outside of the US have no constitutional rights whatsoever. The peopleto who have constitutional rights are the people of the US or those present within the US. We dont export US Constitutional Rights. Otherwise, the Navy Seals wouldve needed a search warrant to enter Bin Ladens house. There is no constitutional right that belongs to any alien to enter the US. Permanent residents and visa holders have statutory and otherpermissions.

COUNT 3: Fifth AmendmentSubstantive Due Process

Plaintiffs claim The right to international travel is covered by the Due Process Clause of the Fifth Amendment.

Really? Letslook. No person shall be held to answer for a capitalcrime, unless on a presentment or indictment of a Grand Jury, nor shall any person be subject for the same offence to be twice put in jeopardy nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law

I dont see any mention of international travel there. Maybe Hawaii has special reading glasses and can see it.

COUNT 4: Fifth Amendment-Procedural Due Process

Plaintiffs claim citizens may assert liberty interests with respect to noncitizen relatives who are deprived of due process

Wrong. It isnt possible to deprive someone of something they dont already possess due process rights.

COUNT 5: Immigration and Nationality Act

Plaintiffs claim the order exceeds the Presidents authority under 8 U.S.C 1182(f) and 1185(a).

Wrong.Article 1, section 8, clause 4 gives plenary (absolute) power over immigration to Congress. Congress has delegated that authority broadly to the President.Section 1182(f), states: Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate

Click here to read 1185(a). It begins with Unless otherwise ordered by the President .

COUNT 6: Religious Freedom Restoration Act

Who knew the left liked RFRA? They claim RFRA grants citizens the right to welcome visitors from anywhere in the world. It does not.

Count 7: Substantive Violation of the Administrative Procedure Act through Violations of the Constitution, Immigration and Nationality Act, andArbitrary and Capricious Action

Thats the run everything up the flagpole and see if someone salutes approach. This fails for the same reason:Non-citizensoutside the United States have no US constitutional rights. Thats why we have borders and why Article 1 specifically grants plenary power to the Federal government over immigration.

The line must be drawn somewhere and its at the border. We know where it is. Thats where US constitutional rights evaporate. This is common sense stuff that shouldnt stand a chance in court. But its the 9th Circuit. If Hawaii wins it will land in the full US Supreme Court and the 9th Circuit should get reversed again.

House to debate gun bill on IFC’s ‘Second Amendment Day’ – Radio Iowa

Its the Iowa Firearms Coalitions Second Amendment Day at the state capitol and gun rights advocates are ready to watch the Iowa House debate a bill that includes many of their priorities. Kurt Liske, vice president of the Iowa Firearms Coalition, called ita show of appreciation from House Republicans.

The fact that we have a day that we scheduled months out in advance, to have them essentially tailor their schedule to ours is almost unheard of, Liske said this morning. The fact that theyre doing this is a real testament to you guysthe fact that youre out there helping with campaign work, things like that.

More than 70 members of the Iowa Firearms Coalition crowded into a capitol committee room thismorning for a briefing on the bill. Members wore orange stickers that read: I support the Second Amendment and I vote.

Representative Matt Windschitl, a Republican from Missouri Valley who is floor manager of the gun bill, spoke to the group.

A lot of things in this bill, including the stand your ground provisions, have been a long time coming, Windschitl said, and it looks as though weve finally got an opportunity to push this down to the governors desk.

Windschitl is a trained gunsmith and his family runs a gun store in Missouri Valley. He uses the word phenomenal to describe the bill as currently crafted.

With the make-up of the legislature the way it is, we have gotten this bill to a place where I didnt even expect us to as far as the freedoms we have in here, Windschitl said. This sets us up for future successes. This sets us up so we can come back next year and get our freedoms back that have been encroached upon over generations.

Windschitl, whohas received death threats becauseof his advocacyfor the legislation, said theres some hate and discontent out there about the bill. He urged Iowa Firearms Coalition members to lobby theirSenators today.

Weve still got our work cut out for us when we move this over to the senate, Windschitl said. There are a lot of senators that are very eager to get all of this done, but the majority in the senate is new and so some of them have not faced the challenges that go into running bills like this, because they can get kind of controversial.

House debate of the bill is expected to get underway early this afternoon.

Bitcoin May Go Boom: A Guide to This Week’s Big SEC Decision – Fortune

Bitcoin is at a critical juncture. Any time now, the Securities and Exchange Commission will issue a decision that could throw open the door to a flood of new capital, and change how many investors regard the digital currency.

The SEC's bitcoin decision, which is over three years in the making, is due by Friday. Here's a plain English guide to what might happen, including why the decision is so important and how it could affect the price of bitcoin.

The agency must decide if the BATS stock exchange can change its rules to offer a bitcoin ETF (exchange traded fund), which would let people buy bitcoin like a common stock. The ETFcalled the Winklevoss Bitcoin Trust ETFis the creation of the Winklevoss brothers, who once fought Mark Zuckerberg for control of Facebook, and now own a large stock of bitcoins.

It's all about liquidity. While there are plenty of places to buy bitcoin, many investment funds can only hold assets that meet certain regulatory standardssuch as approval from the SEC. If the agency approves the ETF application, money managers who want to include bitcoin in their portfolio are likely to jump in. Meanwhile, millions of ordinary people will have an easy new way to buy the digital currency. I can't really phrase it any better than this quote from BitMex , a bitcoin analysis site:

If the SEC approves the Bats rule change, all manner of American muppet retail investors can yolo into Bitcoin via a regulated ETF. The pool of eligible money that can easily obtain exposure to Bitcoin will dramatically rise. There are various predictions about the amount of money that could flow into Bitcoin. In short, it will be Yuge.

The SEC is obliged to make the decision by March 11, which is this Saturday. That means the ruling is almost certain to come out on Thursday or Friday.

According to Blake Estes , an alternative asset expert at the law firm Alston & Bird, the decision will appear on this SEC web page , and everyone will find out at the same time.

Get Data Sheet , Fortune s technology newsletter.

People are calling this a coin toss. Those who think the SEC will approve the ETF point to the skillful work carried out by the Winklevoss lawyers, and to the fact that bitcoin is far more mainstream than it was even two years ago. Today, many more peopleincluding regulatorsare familiar with digital currency and how it works. There is also a sense that a bitcoin ETF is sooner or later inevitable.

Pessimists, on the other hand, can point to two sets of concerns that could lead the SEC to give the thumbs down. The first of these relates to how the Winklevoss intend to run the operation. Some people are uneasy that the proposed ETF would use Winklevoss-controlled businesses to source and store the bitcoins that would back the shares. The other set of concerns lie with bitcoin itself. The digital currency has been subject to wild price fluctuations, driven in part by heists and insider antics. According to Estes, the SEC may worry the agency's approval of an ETF could lead to a bubble inflated by bitcoin novicesa bubble that could then pop.

"Some fear it could be a g ood opportunity for legacy players to find the next sucker to take it off their hands," said Estes.

Bitcoin has been on another tear of late, nudging a record of $1,300 per unitmore than an ounce of gold. Some of this likely reflects investor optimism the SEC will approve the ETF, meaning a future price rise is partly baked-in. Nonetheless, there are broad expectations the short term price of bitcoin will go crazy if the SEC says yes.

If the SEC says no, it will have a negative effect, though probably not a very dramatic one. The reason is there are two other ETF application before the agency. One is called the Bitcoin Investment Trust, and was developed by Barry Silbert, a well known figure in the digital currency world. The other, called SolidX, is distinct in that proposes to insure its bitcoin assets.

As noted above, there is a general feeling that approval for a bitcoin ETF of one type or another is inevitable, and so a rebuff by the SEC to the Winkelvoss proposal would only be a temporary setback.

That's something only you can decidepreferably after a lot of research. Today, many people see bitcoin as another alternative asset class to add to a diversified portfolio. But bitcoin has an extremely volatile history , and has been prone to spectacular crashes, so if you're averse to risk, it's probably not for you.

Bitcoin ‘mining’ is big business in Venezuela, but the government wants to shut it down – Washington Post

By Mariana Zuiga By Mariana Zuiga March 10 at 6:00 AM

CARACAS, Venezuela Venezuela has become widely known as an economic basket case in recent years. But with its cheap electricity and volatile national currency, the country has at least one competitive advantage: Its a good place to make the digital cash known as bitcoin.

Bitcoins are increasingly accepted online for buying real-world goods and services. And, unlike the Venezuelan bolivar, the virtual currency has been going up in value.

Making bitcoins is known as mining, but it requires a powerful computer instead of a pick and shovel. Those computers produce bitcoins by creating elaborate algorithms, but they also suck up a lot of electricity. In many countries, the cost of running a mining terminal can run higher than the value of the actual bitcoins.

Thats not the case in cash-poor, oil-rich Venezuela, where state-subsidized electricity is so cheap its virtually free. But Venezuelas government isnt pleased. Its cracking down on bitcoin mining, even though the country has no laws on the books outlawing the currency or its manufacture.

In November, Venezuelas secret police raided the house of two brothers in Caracas and found more than 90 mining terminals. The agents demanded $1,000 in bribes for each machine, according to the brothers, who spoke on the condition of anonymity because they fear arrest. The brothers said they paid the bribes to stay in business.

This isnt an isolated case and such operations appear to be expanding. In January, Venezuelan federal police arrested four bitcoin miners in the town of Charallave. They were accused of Internet fraud and electricity theft. According to an Instagram post published by Douglas Rico, the director of the federal police agency CICPC, the miners were endangering the stability of the towns electrical service. During that same week, Edward and Erick Tapia Salas were also arrested in Caracas for selling bitcoin-mining machines through a Venezuelan e-commerce site.

Miners have taken to websites such as Reddit to share their fears of being caught. Miners are getting jailed and accused of terrorism, money laundering, computer crimes and many other crimes, read one commentfrom a user who claimed to be Venezuelan. It's getting crazy here and I really don't want to waste my life for money.

Those who keep mining in Venezuela said they have started taking extreme precautions to hide their activities. Luis Len, 25, a business student and bitcoin miner, said miners have learned not to keep all of their computers in one place. If they do, the state power corporation can detect the abnormal amount of electricity the mining terminals use.

That was [the brothers] big mistake, Len said. They were consuming 20 times the normal level of electricity for that house.

Venezuelas crackdown on the bitcoin industry started in March 2016 with the arrest of two miners in the city of Valencia. According to news accounts of their arrest, Joel Padrn, 31, and Jos Perales, 46, were charged with electricity theft and possessing contraband computers.

But miners and bitcoin users are not the only ones at risk. When Padrn and Perales were detained, Daniel Arraez, a 30-year-old economist who was working as a consultant for a Venezuelan bitcoin market called Surbitcoin, was called by the secret police to testify in their case. Padrn had told the agents that he and Perales had exchanged money through Surbitcoin.

Arraez was asked to come to the secret police offices in Valencia. To my surprise, I never returned home, he said. He was placed in the same cell with Padrn and Perales and charged with making illegal transactions and criminal association.

Arraez said his arrest was a way for the government to blame someone else for its ruinous policies, including chronic mismanagement of public utilities. We were only the scapegoats of the disastrous situation in the countrys electricity sector, he said.

After eight months in jail, Arraez was released in October. Hes awaiting a pretrial hearing. Despite having to share a small cell with eight other men and seeing the sunlight only twice a week, he said Venezuelan miners should keep making bitcoins to advance technologically like other countries.

The crackdown has not stopped Venezuelans from using the currency, either. The continued decline of the Venezuelan bolivar has fueled a growing internal demand for bitcoins. According to Surbitcoin, the number of bitcoin users in the country rose from 450 in 2014 to 85,000 last year.

In a country with the worlds highest inflation rate and strict controls on currency exchange, users see bitcoins as a safe alternative to protect their savings. People have also used bitcoins to buy basic products online that have disappeared from Venezuelan shelves.

But the widespread adoption of the currency seems unlikely any time soon: nearly one-third of the population doesnt even have a bank account.

Who is Moving 750 BTC Worth of Coins on the Bitcoin Network Every 5 Seconds? – newsBTC

Further investigation into the matter by one Reddit user shows this activity dates back to December 2016.

Network congestion has been a significant problem for the bitcoin network in recent months. As a result, transaction fees continue to rise, It appears someone is deliberately sending 750 bitcoin back and forth every 5 seconds. This process has gone on for quite some time, albeit no one knows for sure what is going on exactly.

More transactions on the bitcoin network result in higher average fees. In that regard, it makes no sense for anyone to spam the network with unnecessary transactions right now. For some reason, one individual is doing exactly that, as a 750 BTC transaction keeps moving back and forth every five seconds. This adds more strain on the bitcoin network as it fills up necessary transaction space in network blocks.

It appears this ping-ponging transaction has been going on for some time now. While no one knows for sure who is behind it, this is definitely a deliberate attempt to push up bitcoin fees. The Bitcoin Core client uses a smart fee estimate, for most bitcoin transfers. However, with this transaction going back and forth, that TX fee is slowly pushed higher and higher. This 750 BTC transaction comes with high fees which affectthe estimate fee on the network.

It is possible a specific miner is responsible for doing so. Not only will they recuperate part of their own fee, but they also force everyone else to pay higher fees. A very elaborate scheme if this is the case, that much is certain. Rest assured there will be a lot of speculation as to who is behind this transaction spree. Pushing up fees is not helping the bitcoin ecosystem at all right now.

Another option is how a mining pool or a group of particular bitcoin supporters is responsible for this behavior. Driving up the fees benefit miners, yet it might be pools purposefully conducting this behavior. Considering the tension between Core and Unlimited is rising, such an attack is not unthinkable. Then again, it goes to show the people behind this attack dont have bitcoins best interest at heart. It is an expensive way to destabilize bitcoin, but to the right people, it may be worth it.

Further investigation into the matter by one Reddit user shows this activity dates back to December 2016. High-fee transactions are sent back and forth without pause for an unknown reason. So far, it is estimated US$30,000 worth of bitcoin has been spent on transaction fees alone. It is a baffling development that raises a lot of questions no one can answer right now.

Comets Faceoff – Joe LaBate – WUTR WFXV CNYhomepage

Video One: It's hard not to smile after the week the Utica Comets just had. The home town team swept their three game stint, and are currently in the middle of a five game win streak. This current run has the team back in the fourth spot in the North Division, and a magic number of just 34.

Video Two: Comets forward Joe LaBate dropped his gloves, and his afternoon plans to come by the studio. While you might want to call him an enforcer, the 24 year old forward doesn't see himself that way.

Video Three: We jumped into the time machine to relive what draft night was like for Joe LaBate. Plus, we looked back at his four year college career, including his major of choice during his four years at Wisconsin.

Video Four: It's a look at the Comets' upcoming schedule. Blue and green have another three games in three days. They first host Bridgeport (Fri - 03/10), then head out to Lehigh Valley (Sat - 03/11), and finally return home to take on Binghamton (Sun - 03/12). Finally, it's nice to see Utica back in the playoff picture.

Rendulic, Comets on a hot streak – Uticaod – Utica Observer Dispatch

Ben Birnell

Borna Rendulic has had some recent success.

And the forward is among the reasons the Utica Comets have gotten hot as they battle for a North Division playoff spot. The success has come at a perfect time, he said.

All year, I was cold and I was like, When am I going to gethot? I have to get hot at some point, Rendulic said. It just happened. I scored a couple goals and I got so much confidence. Every time Im on the ice I feel like I can make a difference.

Utica has won five consecutive games and is 6-0-1-0 in the last seven, which is the second-best streak in the American Hockey League. The Comets are 26-23-7-2 (61 points) as they head into another three-game weekend that begins Friday with a second matchup in less than a week against the Bridgeport Sound Tigers at the Utica Memorial Auditorium. The Comets play Saturday at Lehigh Valley before hosting Binghamton on Sunday.

We just stuck with our system and knew we would turn it around, Rendulic said Thursday. Were doing it right now. Its going good.

Comets coach Travis Green said the teams recent success is a positive.

I think confidence is one thing that goes a long way when you win a couple games, Green said.

Rendulic has contributed, totaling six goals and adding two assists in his last 11 games. Included was a one-timer from the slot that served as a sort of exclamation point in a 3-0 win over Albany last Saturday. That total comes after Rendulic totaled eight points in his first 43 games this season.

Hes played with a few different linemates this season, including veteran Pascal Pelletier, Mike Zalewski and rookie Michael Carcone. Rendulic, who was born in Croatia, has good size at 6-foot-2 and 200 pounds, speed and a big shot. His recent success helped him earn a short call up to the Vancouver Canucks.

I feel good on the ice, said Rendulic, who had 16 goals and 22 assists in 68 games with Colorado's affiliate, San Antonio, last season.

Green said he thinks Rendulic who he refers to as a power forward is playing better than he was at the beginning of the season. He said Rendulic was trying to too cute in certain aspects of his game.

I think the details of his game have gotten a lot better, Green said. Now, hes starting to get pucks to the net and hes starting to get rewarded for it.

With 18 regular-season games remaining, the weekend could have a big impact on the North Division standings. Utica trails St. Johns by a point in the standings, but has a better points percentage (.526 to .517) with help from two games in hand. The top five teams are separated by nine points with Syracuse (70 points), Albany (66) and Toronto (65) in the top three spots. The top four teams qualify for the playoffs. Depending on what happens, the gap between the teams could tighten up.

Every game matters, Rendulic said. You have to keep winning because if you lose a couple games, you could be out of the playoffs.

Clark ready to help

Emerson Clark, who the Comets obtained as added forward depth before Wednesdays AHL trade deadline, joined the team ahead of the weekend.

It was nice to get back into it, said Clark, who will wear No. 13.

The 24-year-old Clark said he arrived in Utica late Wednesday after a 12-hour drive from Chicago. Clark, who is 5-foot-10 and 180 pounds, said he heard good things about Utica from former Comets player Alex Friesen. He knows about the teams hardworking style and is excited.

I just want to help the team and bring good energy, said Clark, who also played on the same junior team as Comets forward Cole Cassels.

He described his playing style as gritty, high-energy and physical. He said can mix it up, if it comes to it. This season, he has one AHL fight and seven in the ECHL.

Clark has a pair of goals and assists in 10 games with Chicago this season. In 38 games with ECHL Tulsa, he totaled 15 goals and 158 penalty minutes.

Green said they will try to get a look at him over the weekend.

Im hoping he fits into the style of hockey we play, Green said. Ive heard a lot of good things from our scouts about him. Well see where it goes.

Injury updates

The Comets will be without assistant captain Wacey Hamilton, who Green said is week-to-week. Hamilton, one of the teams best players on the penalty kill, was injured in the second period Sunday.

Jordan Subban, who missed the last two games with an upper-body injury, practiced Thursday without restriction. The Comets top-scoring defenseman (a career-best 14 goals and 30 points) said he feels good. John Negrin, who has missed the last 25 games with an upper-body injury, also skated Thursday and is available, Green said. Those additions give the Comets nine healthy defensemen.

Derek Hulak remains out. Hulak has missed 38 consecutive games with an upper-body injury and is not close to returning.

I hope that he gets back and plays at some point whether it is this year or next year, Green said.

In total, 14 players have combined to miss 187 games this season.

Comets girls netters top JF, GW | Prep Sports | yourgv.com – YourGV.com

The Halifax County High School girls tennis team produced a sweep of their two pre-season scrimmages this week, topping GW 9-0 Monday and edging Jefferson Forest High School 5-4 Wednesday in a match that was decided in the last doubles contest of the night.

Wednesdays scrimmage was a big confidence booster for the Comets as the Comets lost to Jefferson Forest 9-0 in last years scrimmage.

We are so very proud of the job this team did tonight, said Comets Head Coach Donna Hudson in the wake of her teams win over Jefferson Forest High School.

We won games on all courts, a tremendous improvement over our performance against this group last year. Our top two girls, Alyssa Conde and Savannah Reaves, played respectably against superb players, and learned a thing or two in the process. They faced two of the strongest players we will see all year in JFs Madison Hansen and Lauren Pascadlo. At that level, as well as further down the courts, we took note of some techniques we can work on and will do so in the coming week.

Conde lost her first set to Hansen 6-0 and was rallying in the second set with a 2-1 lead when Hansen was forced to stop the match due to an injury, giving Conde a forfeit win.

Reaves lost 6-1, 6-2 in straight sets, but played well against a tough opponent, making some strong returns and getting good ball placement with her shots.

Kassidy Irby, playing the number three singles, faced JFs Abbie Edmonds, who had beaten her last season, and came up with a win in straight sets by scores of 6-2 and 7-5.

The Comets RaeAnn Winegar, playing the number four singles match, dropped her first set to JFs Kelsey Shotwell 7-5 on a tiebreaker after having played the first set to a 6-6 tie. Hampered by a knee injury, she lost the second set 6-3.

Halifax County High Schools Amber Roane lost to JFs Jamie Smoot in straight sets by scores of 6-3, 6-2 in the number five singles match. Yasmine Ferrell picked up a win for the Comets in the number six singles contest, topping her opponent in straight sets by scores of 6-2, 6-4 to deadlock the match after the singles round.

Former Halifax County High School Coach Brady Taylor made some lineup adjustments for the doubles round due to Hansens injury. Hudson adjusted the Comets lineup as well, bringing a couple of fresh players into the mix.

The Comets number three doubles team of Ashley Day and Ashley Collins were the first doubles team to start and the first to finish. The duo won their match 8-4, giving the Comets a 4-3 lead in the overall match.

Taylor used his number eight player to partner with his number two player, Pascadlo, and the JF duo won the close number one doubles match 8-6 to deadlock the overall match at 4-4.

Hudson paired Irby, the number three Comets player, with number seven player Kendall Foushee, for the number two doubles contest. It proved to be a winning combination as they came up with a series of well-played shots in clutch situations to score a 9-7 win and give the Comets the overall 5-4 match win.

We are very lucky this year to have a really deep team, Hudson pointed out.

From position six down, our girls play at almost the exact same level, and that level is just a bit away from that of the top five. That depth allows us to put fresh players in at doubles without any risk, and that is a great strength we plan to take advantage of as we move into our regular season.

The Comets had a pretty easy time of things in Mondays match against GW, scoring 8-0 wins in every match.

Conde, Reaves, Irby, Winegar, Roane and Ferrell all posted wins in the singles matches.

Hudson went with positions seven through 12 on the teams ladder for the doubles matches, with Foushee and Dejah Britton playing the number one doubles match, Day and Collins playing the number two doubles contest and Summer Martin and Elizabeth Janicijevic competing for the Comets in the number three doubles match.

Comets drop scrimmage at Jefferson Forest HS – YourGV.com

Owen McAbee won at the No. 4 singles spot, and Brent Edwards-Jacob Wenzel and Gordon Taylor-McAbee won doubles matches, but the Comets fell 6-3 at Jefferson Forest High School in a scrimmage played on Wednesday.

Edwards, Wenzel, Taylor, Gabe Outlaw and Ben Irby all lost singles matches for the Comets, Taylors loss coming in a tie-breaker.

Outlaw also played a close match before falling.

You always hate to come out of any situation with a loss, but considering this was a scrimmage this was good for us, said Comets Head Coach David Riddle.

Jefferson Forest has a solid group of players, and that will certainly help us in the long run.

This is a young team that does not have a ton of experience in matches at the top of the ladder.

We saw some nerves out there today, and also quite a few unforced errors, but there were a bunch of good moments as well.

The Comets rallied from behind to get two of their three wins, Riddle noted.

They all fought hard, and several of the losses also came down to the last few points, noted Riddle.

This group is working hard everyday to get better, and we will take what we saw today and prepare for the start of the regular season next week.

Catonsville girls basketball advances to state championship game – Baltimore Sun

Thirty years after the last Catonsville High girls basketball team played in the state championship game, the Comets aregoing back.

After defeating North Point, 64-40, in the Class 4A state semifinals at Towson Universitys SECU Arena on Thursday, Catonsville (25-2) advances to play Walt Whitman in the finals at the same venueon Saturday, March 11 at 3 p.m.

Catonsville, making its eighth trip to the state tournament, has never won a girls basketball state title.

Junior Jamelia Barrett (26 points), sophomore Gabby Douglas (18) and junior Jasmine Dickey (14) led the scoring for the Comets.

Necole Hope (13 points) and Aliyah Bullock (12) led North Point (23-4).

Barrett was 10 of 15 from the field and 6 of 6 from the foul line.

Barrett scored most of her points on layups off fast-breaks.

The game plan every night is really to push the ball, make good passes and get it up the court and I think Gabby did a really good job of pushing it, so that was really good and I think my teammates were really good at facilitating tonight, Barrett said.

The Comets outscored the Eagles 34-15 in the second half when Barrett scored 18 points.

We said at halftime, guys dont stop running. We can get the easy buckets. Weve just got to be smart with it, Catonsville coach Mike Mohler said.

Douglas scored 11 points in the second half, including makingthe Comets only two three-pointers of the game.

Her first three-pointer came just before the third-quarter buzzer and she admitted it was surprising.

I knew we didnt have a lot of time and I carried the ball a little bit and it didnt get called, so I just kind of threw it up there, but I got lucky, said Douglas, who was 5 of 6 from the field and 6 of 6 from the foul line.

That buzzer-beating heave gave the Comets a 49-34 lead heading into the fourth quarter.

That was a huge momentum boost, Mohler said.

The Comets got a more subtle momentum boost in the first quarter, after Dickey and Jen Gast both were on the bench with two fouls and reserves Amber Lally and Maddie McLean came in and gave quality minutes.

Dickey departed with 5:33 left in the second quarter and Gast was benched with 3:59 remaining and the Comets leading, 5-4.

We are pretty resilient. I had my two leading scorers on the bench with two fouls in the first quarter and we had a long way to go to try and get out of it, Mohler said. I thought the girls that came in off of the bench actually get most of the credit for hanging us in there and keeping us close until we could get them back in and then they played the rest of the first half without getting their third foul.

The Comets also switched from a man-to-man to a 2-1-2 zone after Dickey and Gast left.

At that point, we had to buy time and the only way were going to do it was be in the zone, Mohler said.

Hopes three-pointer with one second left in the first quarter gave the Eagles a 12-8 lead at the break.

Dickey, who averages 23.8 points and 9.7 rebounds per game, and Gast returned 20 seconds into the second quarter.

After Stashia Daniels canned a free throw, Dickey scored on a putback and the Comets led 12-11.

A basket by Camille Robinson and two buckets from Bullock keyed a 6-2 run for the Eagles and they led, 18-13, with 5:42 left in the half.

Catonsville answered with eight straight points in 85 seconds and took a 21-18 lead.

Gasts layup started the scoring and Dickeys chippie made it 18-17.

Two free throws by Dickey put the Comets ahead, 19-18, and Daniels blocked a shot that started a breakaway that ended with Dickey feeding Barrett on a long bounce pass for a 21-18 lead with 4:18 left in the half.

Synia Johnson made a basket with 4:03 left and the lead was one, 21-20, but the Comets scored nine of the next 10 points.

Dickey had four points and Douglas made a conventional three-point play with 1:36 left in the half and the Comets led, 30-21.

Baskets by North Points Bullock and Hope cut the deficit to 30-25 at intermission.

In the third quarter, Hopes layup with 4:57 left cut the deficit to three, 34-31, but Dickey answered with a layup, followed by a block, rebound and assist to Barrett for a fast-break layup and the lead was up to 38-31.

Catonsville outscored North Point 26-6 the rest of the way and shot 46.9 percent overall (23-for-49) from the field.

North Point shot 25.4 percent (16-for 63).

We knew they were going to be tough so hats off to them, they came out and they played ball and they took care of business, North Point coach Michael Serpone said. There is nothing you can do when there is a lid on the rim and today was one of those days.

Catonsvilles defense, that included three blocked shots from Dickey and two each from Daniels and Douglas, was also relentless.

We came out from the jump with the idea of we are going to run this team, we are going to get up and down the court and we are going to make good passes, hustle and thats what I tried to do for the team and I was very successful at that and everybody was successful at that, Dickey said.

Mohler also praised the all-around play of junior Daniels, who led the Comets with eight rebounds.

That was, in all honesty, the best she has played in three years, Mohler said. That just shows what kind of player she can be. She really went after it.

Gast, who will play at UMBC next season and is the lone senor starter, wasnt ready for the season to end.

Its really exciting. I cant even put it into words, honestly. This has been our goal all year and Im just excited that we are finally here, Gast said.

Mohler also knows the climb to the top is not finished.

What I told the kids is you dont climb Mount Everest and stop 200 feet short of the summit, lets finish the job. We know Saturday we are going to play a quality opponent. We just hope we are ready to get to the summit.

Janssen Research & Development LLC, part of Johnson & Johnson (JNJ) Pharmaceutical Research and Development, reported last March 3 through the PRNewswire the results from two Phase 3 clinical trials, VOYAGE 2 and NAVIGATE.

During the studies the pharmaceutical company assessed its guselkumab for the treatment of adult patients affected by severe plaque psoriasis.

The patients treated with Janssen Research & Development's guselkumab achieved meaningful improvement in terms of skin clearance and other disease activity's measures versus the placebo and AbbVie's (ABBV) Humira (adalimumab).

At the end of the VOYAGE 2 clinical trial, in 84.1% of patients affected with severe plaque psoriasis and treated with Janssen Research & Development's guselkumab, a clear or minimal disease at week 16 was observed versus 8.5% of patients under placebo and versus 67.7% of patients taking Humira.

During the NAVIGATE clinical trial, the patients experienced a significantly greater improvement in skin clearance. These patients failed to respond adequately to an IL-12/23 monoclonal antibody (Stelara) and switched to guselkumab.

Results from VOYAGE 2 and NAVIGATE trials were presented at the 2017 American Academy of Dermatology Annual Meeting in Orlando, Florida, from March 3 to March 7.

Ditching convention, the Greens pursue a career of world travel … – Bryan-College Station Eagle

In 2007, Dusty and Nikki Green did what many have fantasized about but few have actually done: They quit their jobs to pursue a life of travel.

"We once led respectable lives with respectable careers, and we ditched it all to pursue a career of world travel," Dusty said.

Royal Caribbean Will Break Its Own Record for World’s Largest Cruise Ship – Travel+Leisure

Royal Caribbean announced plans to build the largest cruise ship in the world on Wednesday.

The cruise lines next ship, Symphony of the Seas, is expected to be the largest in the world when it premieres next year.

In a phone call with journalists, Royal Caribbean International president and CEO Michael Bayley said that the new ship was the latest, greatest, newest, most beautiful baby thats coming soon, according to Skift. On their website, Royal Caribbean also referred to the ship as a mic drop.

Symphony of the Seas will have a capacity of 5,494 passengers when it debuts in April 2018. The ship is already under construction at a shipyard in France. Upon completion, it will weigh a record-breaking 230,000 tons. Bayley said that the ship was slightly longer and a tad wider than Royal Caribbeans current Oasis ships.

The ship is teased to have a whole new variety of features that have not yet been premiered aboard a Royal Caribbean cruise. Although its yet unclear what these new features are, the cruise line has confirmed that a multi-deck water slide area and a Bionic Bar (where the drinks are made by robots) will have a place on Symphony of the Seas. The ship is slated to sail for the Caribbean and Europe once put into operation.

The record for worlds largest cruise ship currently belongs to Royal Caribbean for its Harmony of the Seas ship, which premiered in 2016. That ship is capable of accommodating 5,400 passengers and weighs 226,963 gross tons. It has 28 less rooms than the Symphony of the Seas.

FIFA president: Trump travel ban could mean no World Cup in USA in 2026 – CBS sports.com (blog)

President Donald Trumps travel ban could have a big impact on international soccer. According to FIFA president Gianni Infantino, Trumps executive order from Monday could hurt a World Cup bid by the U.S. for the 2026 cup.

Trumps ban, which suspended the refugee program and entry into the U.S. for people from six mostly-Muslim countries, has put a future bids credibility into question.

When it comes to FIFA competitions, any team, including the supporters and officials of that team, who qualify for a World Cup need to have access to the country, otherwise there is no World Cup,Infantino said per The Guardian. That is obvious.

We are now in the process of defining the bid requirements. The requirements will be clear. And then each country can make up their decision, whether they want to bid or not based on the requirements. Its general sporting criteria.

The countries listed in the ban are Syria, Libya, Somalia, Sudan, Yemen and Iran. Though it is supposedly temporary, if it is still around in years to come or if more countries are added to the list, its probably going to be hard to convince voters to pick the U.S.

It is still too early to tell how much something like this could hurt the USAs chances, but in the early stages, it certainly doenst help the countrys pursuit to land its first mens World Cup since 1994.

Man merges with machine – SunLive (blog)

Some science-type bods are getting a bit excited because they believe mankind may be on the brink of merging with machines.

Transhumanism, they call it. Not to be confused with trannie-humans. The theory is that we'll soon have some machine parts implanted in us, to keep up with the relentless march of technology.

Innovative billionaire Elon Musk says humans must merge with machines. And Elon would know, he's the clever bugger who built a rocket that not only blasted off last week, but then reversed back into its parking space. Amazing that someone can do with a space rocket, what most Tauranga drivers can't manage with a Corolla.

Anyway, he reckons a direct brain/computer interface is an absolute necessity for humans to evolve as a species and keep up with the machines.

If we don't merge with the machines, we will become useless and irrelevant, reports New Atlas. At RR, we worry that this may have already happened to Winston Peters.

Although there is a General Election coming up and with his particular system of cryogenics, anything is possible.

Science documentaries

Transhumanism sounds very much like science fiction, and I am well qualified to speak on this subject of future science because I've seen a lot of science documentaries, such as Cherry 2000' at least five times and various other films featuring robots, androids and Mr Vader. Of course, we grew up with Space Family Robinson every afternoon on a black-and-white television. From this vast study of science spanning many decades, I can tell you, humans generally lose in the end. But they get a small consolation, such as living happily ever after with Melanie Griffith.

Personally, I came very close to merging with machines on several occasions in my younger years. Once, while venturing too close to the wringer washing machine, part of my fashionable sixties clothing was inexplicably drawn into the double wringer roller mechanism. My short and precarious life flashed before my eyes as I was about to be interfaced with the Whiteway. Or was it a Maytag?

Previous columns have also delved into character-building experiences with the bean slicer; although these incidents tended to be more like the bean slicer attempting to rid the planet of humans with digits, rather than any peaceful symbiotic bonding.

We all have those crisis moments in life when we've thought: What would Steve Austin do?' Most of us failed, because we did not have the slow-motion function installed. Any attempts to re-enact The Six Million Dollar Man' stunts soon ended up in a shambles more closely resembling the closing sequence of The Benny Hill Show'.

Androids among us

The closest thing we've seen to transhumanism in real life would have to be Michael Jackson, who, until his untimely expiration, was a human perfectly blended with a Tupperware set.

I've long suspected there are already androids walking amongst us and they're doing a darn good job of keeping it a secret, except for Mike Hosking, of course. He was interfaced with Encyclopaedia Britannica from an early age, because he knows everything.

Then there's a musician who has so many piercings and rings in his face, he can double as a shower curtain.

Peter Dunne is rumoured to have survived a brush with a crop duster and Gareth Morgan must have at some point suffered a close encounter with a six-pack of Energizer batteries, because he just keeps going and going and going.

Built-in compass

Lepht Anonym is a Berlin-based biohacker who advocates cybernetics for the masses, says New Atlas. Lepht [who identifies as genderless] has performed numerous body modifications over the past decade, including implanting neodymium metal discs under his/her fingertips to enable the physical sensing of electromagnetic fields, and several internal compass implants designed to give a physical awareness of north and south magnetic poles. Here at RR, we hope Lepht has joined Scouts or Guides, because he/she would be well ready to go for his/her Map Reading and Orienteering Badge.

The new generation of kids may as well have machines grafted into their brains. They already walk around with mobile devices planted constantly in their faces, they experience virtual lives; nothing is true or proven until it's been shared on instabook or facegram and nothing accepted as a true record of history until it has reached 20 likes and a minimum of four smiley faces.

In fact it's a gas

Transhumanist thinking goes beyond the mere fusion of human and machine. It includes genetic modification to help us live longer and be smarter, till eventually we transcend our physical bodies with the aid of technology.

Little do these scientists know, that level of transhuman longevity has already been achieved by a pioneer in the field; not by implants of computer or machinery; but with select drugs, decades of liquid infusion, excessive noise application and being born in a cross-fire hurricane. Long live Keith Richards.

I fear the day that technology will surpass our human interaction. The world will have a generation of idiots Albert Einstein.

If you cry at work, pretend it’s because you’re very passionate about … – Boing Boing

Research has shown that crying at work comes off as unprofessional and weakens your promotion prospects -- and surveys suggest that people cry at work a lot, anyway. So how can you balance your human emotional needs with the necessity of presenting yourself as a productive unit of gut-flora for the transhuman, immortal artificial life form that has absorbed you?

In a 2016 paper published in Organizational Behavior and Human Decision Processes, a group of business-school researchers led by Harvard doctoral candidate Elizabeth Baily Wolf present the results of a study on how people perceive their co-workers' tears, and which emotional explanations are most favorably perceived.

They evaluated five notional explanations for crying at work -- fighting with co-workers, being assigned undesirable work, being discriminated against, negotiating for higher pay, and being overcome with passion for your job -- and found that subjects viewed the final explanation (overwhelming workplace passion that spills over into tears) as reflecting the most workplace competence.

Of course, this strategy only works for work-related tears, and sometimes people cry at work for personal reasons (though if spotted, you could try to pawn it off on the job). Nevertheless, this dynamic tends to truly crystallize in the performance review, the best known venue for workplace crying. If involuntary tears start welling up during harsh criticism from the boss, instead of apologizing for getting emotional, blame them on passion for your job. The boss might perceive the tears as noble, even endearing, rather than weak.

Workers are generally told to leave their tears at home. Jennifer Porter, a managing partner at the Boda Group, an executive coaching firm, advises clientsparticularly womennot to cry on the job.

If you can find strategies to not cry at work, it's in your career best interests, she said. Wolfs research confirmed that holding back tears still beats all other options. In one of her experiments, when given three options for a potential project partner, participants chose the person who hid distress over someone who admitted to cryingno matter what the reason.
