‘How can you be an artiste and not reflect the times?’ The inside story of Arivu’s fight against oppression – Firstpost

How can you be an artiste and not reflect the times? asks Nina Simone in the Netflix documentary What Happened, Miss Simone? The 2015 documentary was recommended to me by Arivu. We are on our way to Guindy in his car and hes passionately talking about Simone. I learned about her only recently, he says.

He is not talking about Simones music. He is talking about her politics, how she was married to an abusive capitalist Andrew Stroud, later her manager who only wanted to milk her talent for money and fame, but her concerns lay elsewhere. In the stage, she found a place she could use to speak out for her people, says her daughter Lisa. As response to the 1963 Birmingham church bombing, where four black children were killed, Simone wrote Mississippi Goddam, her first civil rights song. She sang the song in front of thronging crowds at the end of the Selma to Montgomery marches.

The day before our meeting, Arivu had just returned from Kochi, Kerala, after performing at a We The People protest event against the Citizenship Amendment Act and National Register of Citizens. As we are driving, he remembers Rohith Vemula, for the day of the march coincided with Rohiths death anniversary, and Arivu tells me he became emotional on stage while performing Snowlin from his album, Therukural, with OfRo in the protest. Snowlin is named and written for J Snowlin, the 19-year-old girl who was shot dead during the Sterlite protests in Thoothukudi in 2018.

A cursory look at Arivus shelf more than hints at his voracious appetite for books. A Malcolm X autobiography (I like him a lot!), a book on Tupac Shakur and Stormzys Rise Up, a Tamil translation of Woman and Socialism by August Bebel, Brian Senewiratnes Sexual Violence Against Tamils in Sri Lanka, Eleanor Zelliots From Untouchable to Dalit, and Tamil Prabhas Pettai. He says this is only a sample of his stash, the rest are in boxes for lack of space.

The reading habit was one imbued in childhood thanks to his parents, both educators. Arivus father is a recently retired college professor and mother a government school teacher, back in Arakkonam. Both moved from Kaganam, Cheyyar in Tamil Nadu in search of a better life. They value education; both were part of the Tamil Nadu governments Arivoli Iyakkam back in the 90s. That work has rubbed off on their son. Art has always been on his mind, for that is the prism through which he both views and receives life. He says music is what taught him about society and politics, he had relatives who played the parai and sang oppari; special functions on Ambedkars birth anniversary or remembrance days were centres of learning for him. These events reflected and reiterated a lifestyle that while he recognised, he also had a lot to learn from.

His parents strove hard to send him to a school that was beyond their means at that time, the cognisance of which was never lost on Arivu. He had friends who mingled at school but were aliens outside the walls. They never visited the cheri where he lived. Even playgrounds neatly marked the divide. The kind of cricket bat on either side will tell you the difference between the two groups, he says.

Arivu wanted a government job, but music found him in college where, again, he was sidelined. In his college in Coimbatore, there were bands with panoply of trained musicians Carnatic, western, instruments who were the gatekeepers.

He took it upon himself to shine a light on his work, he had no other way.I was always a kid with inferiority complex but anything that affects me emotionally, I channel it in my writing, in my poems, Aruvi says. In his second year in college, he self-published a book of his poems, not for profit, but just for the satisfaction of having created something and putting himself out there. It was called Gunindhu Varaverkum Gudisaigal (in Arivus own translation: Huts that Welcome You Humbly). It was an extremely uncharacteristic thing to do in an engineering college! Look at this guy writing poems instead of attending seminars or publishing papers, he laughs.

There has been an inflection point in the last decade in Tamil Nadu where political awareness and rationalism espousing roots of early Dravidian politics have strengthened with vigour. The political side itself has only been further dumping its effluvia on the public but as if in response, the changes have come through other means pop culture, music, literature, and, well, memes.

A resurgence can be spotted in areas of Dalit history, caste consciousness and Ambedkar-Periyar politics. In popular consciousness, it began with several films directly or indirectly placing the anti-caste narrativeat the forefront and either introducing characters rarely seen before in popular cinema, or reshaping the way those characters were depicted by an older generation of filmmakers.

The breaking of the mould occurred on both sides. People writing about cinema learned better to spot everything from caste pride to misogyny as a result, questioning their own biases and checking privilege providing context for the subaltern assertion that was happening right in front of their eyes. It is nothing short of a revolution and a huge face of this movement is director Pa Ranjith, who has not only been creating space in the fictional worlds he imagines, but also the much-needed space for this conversation in the real world.

Pa Ranjiths oratory skills awed Arivu. It had nothing to do with Ranjiths cinema or directorial abilities. I rarely watched cinema growing up and television was frowned upon at home. Studies were the focus. Ranjiths speeches gave him the opportunity to interrogate his own past. I liked Ranjiths speeches and his personality. He spoke about the life that I have lived, it was so relatable. Only after his speeches did I start respecting my grandparents. Till then, I was fairly ignorant.

Those speeches ledArivu to a window to his own past, what his grandparents had been through, [re-examining] the violent ways in which caste manifests. He says he read stories of untouchability assuming they were fiction but as he grew older, his knowledge from books and experiences around him began to interject. Pa Ranjith was a major influence in making this happen.

It was during such a visit to listen to Ranjith speak that Arivu met Udhaya of Neelam Cultural Centre, a different flank of Ranjiths multifaceted efforts in the revolution. At the Neelam Cultural Centre office in Triplicane, I met Udhaya. The office projects an air of egalitarianism; there is no hierarchy with a separate office for the branch head. There is reading table with four chairs and three other rooms, the main one filled with Ambedkar paraphernalia including a life-size cut-out.At the entrance is a shelf stacked with copies of the new books published by Neelam Publications.

Udhaya recalls meeting Arivu by pure chance, having missed his original train. (This was a time when Neelam Cultural Centre had representatives in about 32-33 districts in Tamil Nadu, and it was one such event that Udhaya was travelling to.) He said that Arivu wrote a poem during that event and was keen to present it on stage but due to various reasons, it wasnt to be. But they kept in touch and Arivu even attended the press meet called by Ranjith at Chepauk Press Club when Prakash (a student from Govt. Fine Arts College) committed suicide.

Around the same time,during the Naanum Oru Kuzhandhaiphoto exhibition at the Lalit Kala Academy, some gaana artistes performances gave Ranjith the idea of changing the perception of the genre and using it as a tool to bring about change. Thats how the idea of The Casteless Collective came to be. Ranjith anna wanted this taken to a higher league, make these artistes mainstream, and therefore we started auditions to form a collective," Udhaya says. "I recalled Arivu and wanted him to be part of it. He hesitated because he was in Arakkonam and didnt want to travel all the way. Arivu made it on Udhayas insistence and arrived almost at the last minute to perform 'Android Yugathu Ambedkar Perargal'.

Concept albums are dime a dozen but what about a concept band? A uniform, collective significance informs a concept album but here is a conceptually united band, ecumenical in its approach to annihilation of caste. The Casteless Collectives first album underlined several issues and even registered protests. Titled Magizhchi, the songs ranged from 'Beef' and 'Naanga Platform' to 'Quota' and 'Vivasayam', majority of them penned by Arivu.

Music has been a part of protests for ages, right from 'Bella Ciao', famously used to fight fascism, both against the Nazis and Italian Social Republic, to Faiz Ahmad Faizs 'Hum Dekhenge', an anthem against Zia Ul Haqs regime made iconic by Iqbal Banos version in Alhamra Hall, Lahore. The echoes of 'Hum Dekhenge' crossed over to India in the end of December when the protests over the Citizenship Amendment Act and NRC erupted countrywide, especially following the violence in Uttar Pradesh. History is witness to a long lineage of art created for this very purpose but in the Indian zeitgeist that was exploding with awareness and fighting to sustain an artistic revolution against the privileged and the establishment, a space for a new idiom had to be carved out and thats exactly what Pa Ranjith and friends did. As Tenma says, For some artistes, their music is politics. For some, their existence is itself politics.

Tenma, the independent musician who is at the forefront of the collective, expands on that story. I just liked being with and around Ranjith, first, he says. Having been an independent musician for close to 15 years, Tenma has seen it all. For him, independent music is a lifestyle choice, its a life with all its ups and a lot of downs that one has no option but to make peace with. He was already on a quest to create a musical scene thats more socio-politically aware, with his Madras Indie Collective and events like Madras Medai. So when Ranjith got in touch with him, their visions coincided. Tenma was there at all the auditions and he selected and trained the members who would go on to form the collective.

The day Tenma and I met was also the day Kalakshetra withdrew their permission to host the release event of TM Krishnas book Sebastian & Sons. Tenma guffaws. This is fear. There is comfortable art and uncomfortable art. For almost 200 years, weve gotten so used to comfortable music and the conversations on who owns classical music that we ignored the implications of shying away from that uncomfortable art. Kurangan [an erstwhile band Tenma was associated with] has performed in Kalakshetra but, so far, The Casteless Collective hasnt.

He has observed the reception of The Casteless Collective in various places. While the performances have been acclaimed and written about, the conversations have indeed been uncomfortable. For example, there have been problems in engaging with a member, due to language barrier for instance. Tenma has seen the English media respond with typical refrains, Local pasangala?.

Tenma and Neelam Cultural Centre as an organisation took it upon themselves to undertake not just musical training but also classes on politics, sexism, Ambedkar-Periyar etc. Social commentators and activists took part in them, such as Nityanand Jayaraman, who talked to the collective about the environmental issues he has been actively working on. Nobody comes armed with knowledge, so it is important to cover their blind spots, Tenma says.

It comes through that for Tenma, training independent musicians is his lifes mission, and has been for several years now. Right now, he is working with other artistes on songs on climate change. He sees the collective as a platform from where these artistes can expand and become independent musicians with their own body of work. Like Arivu, a lot of them have already done that. Its a collective. As we go, it will have new members, and soon, it must be able to run without me too.

The independent artiste tag is something Arivu takes pride in, even though he has now written and performed several film songs. With a few other artistes, he performs in public parks around the city every week. Recently, they even performed in the rains, to protest the sudden slum clearance of 3,500 people living along the Cooum river in Chintradipet. His single Sandai Seivom, a protest song against the Citizenship Amendment Act, was entirely self-produced. He wrote it on a whim, his friend shot it right where Arivu is seated across from me, and another friend did the subtitles. Arivu doesnt qualify protestors Some peoples protest ends with Facebook and Twitter, some get on the road, and some get arrested. All of it matters.

On the subject of CAA-NRC, he says, Everyone is an immigrant. Nobody knows what their great-great-grandfathers name is. According to Arivu, CAA-NRC is just legal sanction. In its implementation, the practice has existed for ages. Getting a community certificate is something you need to jump hoops for, and you are left to the whims of the bureaucrat. He knows who you are, where you are from, that you dont own a house or land, but he still wont give the certificate. But he is confident that things are changing rapidly.

There is definitely a cultural war afoot, youngsters are speaking up and there are people breaking their privilege and coming out to dissent.

Its only 70-odd kilometres but Arivu has his hands fullfor a trek home. When he visited recently for Pongal, he met several youngsters who were familiar with him through his music, videos and interviews. I stressed on the importance of talent and artistic skills. And that such talents shouldnt be ignored by the parents. He expresses sadness over the fact that children in his town still dance to devotional beats. Or that installing an idol of Ganesha is a matter of pride for teenagers around town. I did make some sarcastic remarks, he admits.

When he was honouredat a small event, he took to the stage. I asked all the kids who danced to those songs to raise their hand. And told them that there is someone else above all this. Someone who strove for us, who got educated so that he can teach us the importance of education and social awareness. He is not a god. He is a mortal, Dr BR Ambedkar, who must be remembered. Not what you are dancing in the name of.

‘I have a right to speak up’: Congresswoman McCollum not backing down to AIPAC – Middle East Eye

Congresswoman Betty McCollum is not backing down from her criticism of AIPAC.

After issuing a daring statement lambasting the pro-Israel group, the US legislator vowed to continue advocating for the human rights of Palestinian children and push against attempts to silence her.

In an interview with Middle East Eye, McCollum said AIPAC's attacks on Israel's Democratic critics in Congress prove that the organisation is not "inclusive or non-partisan" as it claims to be.

McCollum's remarks come as dozens of her Democratic colleagues gear up to attend the annual AIPAC conference that opens on Sunday. She said she did not ask anyone to skip the event. "Everybody has to make their own decision," but she herself will boycott the gathering.

"I choose not to attend. Why would I go to an organisation that thinks I'm a terrorist, thinks I'm worse than ISIS... I am not going to look the other way and not acknowledge speech that is hateful which was directed towards me," said McCollum, a Minnesota Democrat.

The controversy started last month, when AIPAC - formally known as the American Israel Public Affairs Committee - ran inflammatory social media ads against legislators it called "radical Democrats". One of the posts featured McCollum along with Muslim-American congresswomen Rashida Tlaib and Ilhan Omar.

The post was accompanied with a petition suggesting that Congress members who oppose Israel are "more sinister" than the Islamic State militant group, known as IS or ISIS.

On 12 February, McCollum issued an unflinching response accusing AIPAC of acting like a "hate group" that is using incitement to silence debate.

"Hate speech is intentionally destructive and dehumanising, which is why it is used as a weapon by groups with a stake in profiting from oppression," her statement said.

The congresswoman, who was elected to the House of Representatives in 2000, appears to have zero regrets about confronting the pro-Israel organisation head-on.

"I live in a country which values freedom of speech and freedom of opinion," she told MEE, adding that it was important for her to reject attempts to "bully" and "belittle" those challenging governmental policies.

AIPAC's recent attacks against McCollum seem to stem from her introducing a bill that would ban US aid to Israel from being used to detain Palestinian children.

How AIPAC is losing bipartisan support in Washington

"I am free to criticise the actions of my government here as a member of Congress who supports the safety and security of Israel as well as the Palestinian people," she said.

"If I think that there's a policy decision that's detracting from the safety and security of people,I have a right to speak up and speak out about it."

The congresswoman also rejected accusations of antisemitism levelled against her, saying that making sure children are protected from the trauma of arrests and interrogations is the opposite of bigotry.

"To say that it's antisemitic to stand up for children's rights and human rights, that has nothing to do with antisemitism," she said. "Antisemitism is wrong, but it's not wrong to criticise a government's policy of detaining children."

McCollum's bill is currently in the Foreign Affairs Committee, which will decide whether to hold a hearing on it. The committee is chaired by Elliot Engel, a staunch Democratic supporter of Israel.

McCollum said legislators take many factors into consideration before proceeding with a proposed piece of legislation, including its chances of passing.

"We will, of course, be following up and asking for a hearing because we would love to shed light on to what's happening to these young Palestinian children in detention," the congresswoman said.

The bill has 23 co-sponsors, so far. Still, two legislators who initially backed it have withdrawn their support.

"A lot of people, when it comes to Middle East politics, they are hesitant to get involved because it is so complicated, and we have seen sometimes when you take a stand or make a step forward, there are people out there who are ready to vilify your action," McCollum said.

The Israeli military arrests as many as 700 Palestinians between the age of 12 and 17 annually, prosecuting them militarily "in violation of international standards",the bill states.

The congresswoman introduced a similar measure in 2017, but after it failed to advance in the House, she reintroduced it to the new Congress last year.

"As someone who trained as a teacher, I think children are important and if we want to have peace in future generations, that means we need to invest in education and health care and opportunitiesfor children," she told MEE.

"When it was brought to our attention in 2015 what was happening to the Palestinian children, I wanted to make sure that my country, my government, was good enough to protect children. And that's how I started getting involved."

From her early days in the House, McCollum has shown willingness to oppose AIPAC, leading her to cast some lonely votes.

In 2006, she was one of 36 House members to oppose a bill that would have cut aid to the Palestinian Authority. The proposal passed in the House with the backing of 361 legislators.

Her first run-in with AIPAC dates back to that vote. At the time, the congresswoman demanded an apology from the pro-Israel group after she said an AIPAC representative told her chief of staff that "support for terrorists will not be tolerated".

"This response may have been the result of extreme emotion or irrational passion, but regardless, it is a hateful attack that is vile and offensive to me and the families I represent," McCollum wrote in an open letter to AIPAC at the time.

Sixteen years later, the congresswoman is still as fierce in rejecting AIPAC's tactics.

After the latest episode, McCollum said her colleagues from both sides of the aisle were outraged by the ads, and so were the people in her district. "My constituents have been absolutely marvelous," she said.

"And I acknowledge and appreciate the support I've received from the Jewish community both nationally and at home in Minnesota.

"They may disagree with me on policy, but they don't disagree that I have the right to criticise the policies of a government if I think that government is doing something that harms children."

Bernie Sanders says he will skip AIPAC conference

AIPAC eventually issued an "unequivocal apology" for its posts, but fell short of addressing the concerns of the lawmakers who were targeted.

"The ad, which is no longer running, alluded to a genuine concern of many pro-Israel Democrats about a small but growing group, in and out of Congress, that is deliberately working to erode the bipartisan consensus on this issue and undermine the US-Israel relationship," AIPAC said earlier this month.

McCollum said the half-hearted apology was not sufficient.

"If they are to make an apology, it needs to be sincere, heartfelt, and it should come with a caveat - 'We will not repeat this mistake again'."

UNITE is firmly committed to equality for all, and the members of our union are a strong representation of the diversity within our communities. Equal and fair treatment both at work and in society is a key priority for our union, and we make it clear that we all have a duty to challenge discrimination, harassment and bullying whenever possible. Unite acts on behalf of its members and bargains with employers to achieve greater equality within the workplace.

A key objective of the union is:To promote equality and fairness for all, including actively opposing prejudice and discrimination on grounds of gender, ethnic origin, religion, class, marital status, sexual orientation, gender identity, age, disability, caring responsibilities; and to pursue equal pay for work of equal value.

We oppose the current governments agenda of division, greed, prejudice and inequality. We need investment in jobs, in real opportunities, not racist vans of hate and attacks on the Equality Act.

Youth unemployment, womens poverty, pregnancy discrimination, hate crime, disabled workers access, lack of opportunities for black workers, workplace bullying and harassment, cuts to support for Lesbian, Gay, Bisexual and Trans people, poverty in retirement all need action now.

We oppose and challenge those employers who refuse to deal with discrimination and to eradicate barriers to equality and fair pay. And we continue to call for statutory rights for union equality representatives - who make a real difference in the workplace.

Unite is committed to the empowerment of all working people and in tackling under representation and discrimination against our members. Unite believes that in order to tackle discrimination, it is essential to ensure those who experience that discrimination are at the forefront of our campaigns and their voices are heard.

Unite takes positive action through minimum proportional representation of women and black and Asian ethnic minority members on all constitutional committees, equality monitoring of our membership and established constitutional committees and conferences to represent and empower the interests of our Women, Black and Asian Ethnic Minority, Disabled and Lesbian, Gay, Bisexual and Trans members.

Unites National Womens Committee and National Lesbian, Gay, Bisexual and Trans Committee came together to agree the following statement on gender, which was also agreed by the Unite Executive Council.

Unite believes in the principle of self-determination and empowerment through collective action as the route to tackling the discrimination that working class people face. Unite believes that by working together and tackling discrimination and oppression faced by our individual members we improve the working conditions of all workers.

Respect and tolerance are crucial and we oppose all hate crime, bullying and harassment, we therefore oppose any construct of a debate which seeks to divide and set one group of workers against another and will defend our members against any homophobic, transphobic or sexist hate language or abuse. Unite also believes that our members have the right to freedom of speech and that we have the right to disagree.

Unite recognises that there are people who do not identify as either male or female whose identities are not widely recognised by society. Individuals with non-binary titles, pronouns and modes of dress as well as the issues associated with being unable to express ones gender identity within the workplace. Unite believes there is a lot of work to be done, across both workplaces and government, to recognise additional gender identities.

Unite believes that any worker has the right to determine their gender identity without unnecessary medicalisation, and supports the review of the process of applying for gender recognition process / certificate.All Unite members who identify as women and meet the rule 6 qualifications of being a union workplace representative in employment are welcome to participate in the womens structure of Unite.

Unite recognises that sex discrimination at work arises from deeply ingrained patriarchal and systemic oppression of women and that our womens structure empowers women through a process of democratic policy making and collective action against gender stereotyping, occupational segregation, violence, harassment and pay discrimination and recognising our diversity as black, Asian and ethnic minority women, lesbian, bisexual and trans women, disabled women, younger and older women.

Unites womens structure has prioritised the gender pay gap, social security and pensions, decent work and employment rights, equality monitoring and auditing, positive action to tackle under representation of women, flexible working and decent child care, pregnancy discrimination, menopause, abortion rights, gender sensitive health and safety, sexual harassment and violence against women, a womans right to choose a legal safe abortion on the NHS and the right to organise in a trade union. Unite recognises that some of these issues may well affect trans men, and not all of these issues affect trans women.

Unites womens structure supports women only spaces in addition to gender neutral spaces and is particularly concerned that our trans members should be protected the from harassment and violence they face from the lack of gender neutral space.

Unite addresses the issues of transphobia within its Lesbian, Gay, Bisexual and Trans structure. All Unite members who identify as Lesbian, Gay, Bisexual and Trans and meet the rule 6 qualifications of being a union work place representative in employment are welcome to participate in the Lesbian, Gay, Bisexual and Trans structure of Unite.

Unites LGBT structure and union reps play a crucial role to ensure discrimination against our Trans members is prevented and a trans friendly environment is created in workplaces. UnitesLesbian, Gay, Bisexual and Transstructure has prioritised tackling transphobic hate crime and negotiating trans work place policies.

By working together to tackle the discrimination we all face, Unite believes that we will create a more tolerant, fairer society for all. We recognise that many of the issues we face are intersectional and at the same time we reject the notion of hierarchy of oppression. We oppose division between our Womens movement and our Lesbian, Gay, Bisexual and Trans movement, our campaigns to tackle discrimination are inclusive and member led. Join us.

‘There’s No Story That Stays Stable for Too Long.’ How Artists Are Using Artificial Intelligence to Confront Modern Anxieties – TIME

Agnieszka Kurants lower Manhattan studio stands among a scattering of cultural outposts that represent some of the most recent efforts of the avant guard to grapple with our cultural moment. When I visited in late January, a gallery two doors down was hosting a reproductive rights-themed show with works listed for upwards of $30,000. Across the street, four floors of the windowless New Museum were taken over by a retrospective of artist Hans Haacke, which included a demographic survey, a portrait of Ronald Reagan and a grass-covered mound of dirt. The seventh floor was occupied by a mixed reality pop-up, sponsored by Ruinart champagne, in which visitors could wander about in augmented reality glasses. Minders politely asked those without reservations to step away from the experience.

Technology and late capitalism similarly intersect in Kurants work, though perhaps with a greater degree of self-awareness. A conceptual artist, she explores modern questions over data rights, online labor exploitation and the power of big corporations. With growing public awareness of issues like the commodification of big data and the ever-increasing power of artificial intelligence (AI), shes part of a new generation of artists and curators who are trying to represent the nature of these new technologies, and the ways we are being transformed by them.

To talk about any kind of new media or new technology, sometimes its better to use an analogue technology, Kurant says, showing a photograph of a 2017 piece entitled A.A.I. She says the name is based on a phrase coined by Amazon founder Jeff Bezos, artificial artificial intelligence, which describes the process of digitally outsourcing work to human freelancers through distributed labor platforms like Amazon Mechanical Turk. The artwork consists of a series of fluorescent termite mounds created from green, blue, violet, yellow or orange artificial sand. She collaborated with entomologists at the University of Florida to enlist the labor of the termites.

If you give them something else that is not sand they will not notice the difference and they will still keep building, Kurant says. She sees termite societies as a kind of dispersed factory akin to the mechanism by which large tech companies collect massive quantities of information about users in order to power sophisticated advertising algorithms. We are all working on a very long, gigantic conveyor belt providing our data or expressing our emotions so that corporations could capitalize on it, she says.

New digitally-enabled economic systems figure even more directly into some of Kurants other pieces. In her Production Line series, produced between 2016 and 2017, she and co-author John Menick contracted hundreds of Amazon Mechanical Turk workers to each draw a single line which were then algorithmically assembled into cohesive drawings. When a painting is sold, the Turkers are given part of the profits.

Collectivity figures prominently in another of Kurants series, The End of Signature, in which she used computer algorithms to coalesce hundreds of individual signatures into a single illegible line. Another of her series, Conversions (2019), focuses on the ways in which collective social energy, in the form of tweets, posts and online searches, is transformed into revenue streams. Consisting of a copper plate covered with liquid crystal paint and attached to computer-controlled heat pumps, the painting changes composition in response to algorithmic sentiment analysis of tens of thousands of social media feeds tied to protest movements, continuously transforming collective societal disquiet into physical heat energy.

Even the activities of protest movements are somehow taken advantage of by corporations, says Kurant, explaining the context of the piece. There is a price tag on social energies.

Other contemporary artists are also grappling with the intersection of artificial intelligence, data and capitalism. At San Franciscos de Young museum, an exhibition entitled Uncanny Valley: Being Human in the Age of AI (Feb. 22 Oct. 25, 2020) takes its name from a term describing how artificial representations of ourselves can come too close for comfort. According to curator Claudia Schmuckli, the installation makes the case that widespread use of AI has brought about a fundamental change in humans relationship with machines.

The contemporary uncanny valley is no longer occupied by the image of the machine but by the statistical data profiles of humans that are compiled by algorithms, which are designed to mine and analyze behavior and project them into tradable or governable futures, Schmuckli says. She adds that famous pop culture representations of AI, like 2001s HAL and Schwarzeneggers Terminator, have been replaced by something even more unsettling: the reflected data profiles generated from our own lives.

Notions of uncanny resemblance figure prominently into another piece at the de Young, Conversations with Bina48, which features artist Stephanie Dinkins speaking with a humanoid social robot built to resemble a black woman.

[I] wanted to see what would happen if I tried to become friends, Dinkins tells TIME. Shes interested in exploring how communities of color fit into the new world being created by companies struggling to become more diverse. There is a small subsection of the population thats creating AI ecosystems that will be contributing to many of our lives, she says. What happens if regular people are not a part of thinking about and calling for transparency?

Other artists are using AI to take decidedly unconventional approaches to the uncertainties of our time. In BOB (Bag of Beliefs) (2018-2019), artist Ian Cheng combines neural networks with a video game engine to create an intelligent simulation named BOB. The digital animal resembles a multi-headed snake. As users interact with it via a smartphone app, BOB develops beliefs about the world it inhabits, and its personality evolves over the course of a simulated lifetime. BOBs body and BOBs personality and BOBs beliefs continue to grow, explains Cheng. BOB is quite particular by the end of any of these given exhibitions.

New technologies get blamed for much of todays collective unease, but for Cheng, that same technology may also provide one of the best ways to come to terms with the times we live in. I want to feel that the thing Im looking at is alive, that it has something that can surprise me, Cheng says of his artificially intelligent artworks. It mirrors a bit the way that life feels right now where everything is constantly changing theres no story that stays stable for too long.

Development Minister Jadwiga Emilewicz told a ministry debate on Artificial Intelligence (AI) on Tuesday that there are plans to develop AI centres in Poland so as to become creators rather than recipients of innovation.

Emilewicz was quoted in a ministry press release as saying that it is necessary to increase the productivity of the Polish economy with the aid of automatisation and the use of algorithms based on AI and machine learning.

"Poland is a place full of talented IT people," the minister said, going on to state that, as a result, the country has become a centre for outsourcing though "that state of affairs does not satisfy our ambition."

"We want unique intellectual value in the field of AI to be created in Poland," Emilewicz said, during a meeting with David Hanson, CEO of the Hanson Robotics company, which makes a humanoid robot called Sophia. "It is time to become a creator rather than a recipient of innovation. That's why we are striving for competence centres to emerge in Poland and for them to be catalysts of cooperation between business and science."

Hanson was quoted in the release as saying that he was considering working towards creating a hub related to ethical AI in Poland. He said the creative and technological sectors are very well developed in Poland as well as that related to robotics, which has persuaded Hanson Robotics to create an R&D centre in Poland and to conduct research into developing technology to serve people, including humanoid robots that interact with people.

The ministry pointed out that the development of AI hubs in Poland gains importance in light of a European Commission policy, which as part of the digital strategy, plans to earmark significant funds to AI development. "In the case of the 'Horizon Europe' programme, the Commission has proposed investing EUR 15 billion in a 'digital technology, industry and space' cluster in which AI is a key field of activity that will be supported," the release read.

When applying for a new job, candidates may well find that the use of artificial intelligence (AI) tools is involved at some point in the recruitment process. New recruitment businesses and technology are entering the market, setting up entirely automated initial conversations with candidates to help them find the right vacancy for their skill set, saving time for applicant and recruiter alike.

CV screening is also becoming more prevalent, with AI screening and tracking tools being used to quickly analyse CVs to ascertain whether the individual has the qualifications and experience necessary for the role for example, burger chain Five Guys is said to be utilising such technology.

Unilever recently hit the headlines when it announced that, instead of human recruiters, it uses an AI system to analyse video interviews. Candidates record interviews on their phone or laptop, and the system scans candidates language, tone and facial expressions from the videos, assessing their performance against traits that are considered to indicate job success at Unilever.

But it is not just the recruitment stage where AI and people analytics are being used by businesses performance management is another targeted area. Amazon is leading this charge the company was issued with two patents in the US for a wristband for tracking the performance of workers in their warehouse, which would mean that staff receive a little buzz if they place a product near or in the wrong inventory location.

It is also alleged that Amazon uses a computer system to automatically generate warnings or terminations to employees, when their productivity (or lack of) warrants it.

The benefits of such technology for employers are countless and clear, including costs savings, efficiency, and the purported removal of human unconscious bias and prejudice. However, the use of AI in the workplace has come under scrutiny and has posed serious ethical and legal questions, including whether AI itself could in fact be biased.

Another important aspect when implementing AI in the workplace is its relationship with data protection laws such as the EUs General Data Protection Regulation (GDPR). So, what data protection considerations should an employer make when considering the introduction of AI technology?

The use of AI for processing personal data will usually meet the legal requirement for completing a DPIA.

A DPIA enables the business to analyse how the AI plans will affect individuals privacy, and ensures the company can assess the necessity and proportionality of its technology.

As the UK Information Commissioners guidance confirms, the deployment of an AI system to process personal data needs to be driven by the proven ability of that system to fulfil a specific and legitimate purpose, not just by the availability of the technology.

The DPIA should demonstrate that the applicable purposes the AI is being used for could not be accomplished in another reasonable way. In doing so, organisations need to think about and document any detriment to data subjects that could follow from bias or inaccuracy in the algorithms and data sets being used.

A business cannot simply process personal data because it wishes to do so data can only be processed where one of the legitimate grounds or conditions of processing has been met. There are various bases, including performance of a contract, compliance with a legal obligation, consent and legitimate business interests. For the processing of sensitive personal data (such as health data), the bases are even more limited.

Before using AI or people analytics in the workplace, employers will first need to consider what data is being processed by such activity and second what legal basis can be relied upon in processing the data in that way. If they do not have a legal basis, the data cannot be processed.

One of the key principles of GDPR is transparency, requiring businesses to provide individuals with mandatory information about the processing of their personal data, including the reason why it is being processed, the legal basis, who it will be shared with and how long it will be retained. Employers will need to update their privacy notices to ensure anyone subject to the AI technology is made aware of its use.

The privacy notice needs to be concise and intelligible, using clear and plain language this will be particularly difficult when including a complex AI system, as businesses will need to provide a meaningful explanation of the technology to meet the transparency principle of GDPR. Opaque or complex descriptions of the tech may result in contention or pushback from the employees and candidates affected.

GDPR prohibits instances of computer says no and contains the right for data subjects not to be subjected to a decision based solely on automated processing, which has a legal or similarly significant impact on them. Its aim is to protect individuals against the risk that a potentially damaging decision is taken without human intervention, and will therefore likely capture a recruitment result made without any human input.

There are specific exceptions when automated decision-making is permitted, including where explicit consent was given, contractual necessity, or where authorised by law. Where such an exception is being relied upon, such as with the consent of a candidate, the business must still implement further safeguarding measures, including permitting the individual to request human intervention or to contest the decision.

Employers will need to ensure that their automated technology is being lawfully used, before relying on its output.

Why we need to adapt existing EU laws to Artificial Intelligence – European Public Health Alliance

Artificial Intelligence (AI) and other emerging digital technologies have the potential to build up public health capacity to deliver equitable solutions by improving screening, diagnosis, and treatments across many medical disciplines. In addition, AI can generate productivity gains and improve operational efficiency by providing more precise and complete information, better workflow management and refine continuity of care. However, these technologies are still in their infancy. Their increased use within society and the healthcare sector require sufficient safeguards and guidelines to minimize the risk of harm these technologies may cause to individuals.

Future research will need to set the focus even more on the vulnerability and liability gaps in AI as well as on the adjustments that need to be made in the already existing EU legislation, such as the Product Liability Directive. Concerning already existing liability regimes regarding digital technologies, the law of tort of EU Member states is largely non- harmonised, except for the Product Liability Law under Directive 85/374/ EC, liability for infringing Data Protection Law under Article 82 of the General Data Protection Regulation (GDPR) and liability for infringing Competition Law under the directive 2014/ 104/ EU. Thus on National level, it can be observed that laws of the Member States do not contain liability rules specifically applicable to damage resulting from the use of emerging digital technologies such as Artificial Intelligence. Adequate and complete liability regimes in the development of technological challenges are crucially important for society to ensure that damage or harm caused by emerging digital technologies do not lead to victims ending up totally or partially uncompensated.

As discussed at the recent workshop on Civil Liability Regime for Artificial Intelligence in the European Parliament, organized by the S&D group and hosted by MEP Tiemo Wlken (Germany), the following key suggestions (among many others) could be included in future discussions and research regarding the adjustments that need to be made on existing EU liability regimes:

AI is a difficult and complex system, which needs better understanding, building up health literacy, and research. Most importantly, the existing liability laws do not necessarily have to be reinvented but they will require modification and adjustment. . The EU should, therefore, try to find a balanced solution based on a harmonized and human-centred approach on AI to ensure civil protection and a fair and safe environment. In the health sector existing laws should be specifically adapted in the field of health and safety at workplace. AI may not only affect the employment area and wages but also the way workers approach their work and this could have an impact on their well-being such as job satisfaction, stress and health in a variety of ways. AI is therefore not only related to potential physical harm but also mental harm. The integration of Big Data and AI technologies into health systems must be accompanied by appropriate legislation, rules and standards that protect the fundamental rights of individuals and address new ethical challenges. Emerging technologies is an area, which still needs much discussion and research before we have a well-performing digital and AI- friendly European Union.

How a Portland nonprofit is using artificial intelligence to help save whales, giraffes, zebras – Seattle Times

To the untrained eye, zebras in Kenya probably all look alike. But each animals black and white markings are like a fingerprint, distinct and invaluable for scientists who need to track the animals and information about them, including their births, deaths, health and migration patterns.

Traditionally, getting this kind of information has been an invasive and labor-intensive process. But breakthroughs in artificial intelligence (AI) and crowdsourcing of photos of individual animals are beginning to change the conservation game.

Portland, Oregon-based nonprofit Wild Me has developed AI to pick out identifying markers the stripes on a zebra, the spots on a giraffe, the contours of a sperm whales fin and catalog animals much faster than a human can. Photo surveys are increasingly used as the backbone for population estimates, and Wild Mes Wildbooks, which catalog various species, are giving conservation groups, governments and citizen scientists a faster way to monitor animals around the world.

We can use this information to track diseases and poaching threats, look at manifestations of diseases, said Michael Brown, a conservation science fellow at the Giraffe Conservation Foundation and the Smithsonian Conservation Biology Institute, who has been working with Wild Me for the past few years. It lets us piece together an understanding of how these threats to giraffes are spatially situated (and) how the giraffes are utilizing different landscapes over time.

Founder Jason Holmberg launched the first iteration of Wild Me in 2003 after swimming with whale sharks off the coast of Djibouti. He wanted to find a different way to track the animals other than invasive tagging, so he teamed up with a biologist and a NASA astronomer, adapting the algorithm for the Hubble telescope to match the sharks spot patterns.

For years, Holmbergs endeavors were a side project he didnt leave his full-time job in tech until recently. Wild Mes work gradually expanded, then it really kicked into gear with a 2018 grant from Microsofts AI for Earth. Today, Wild Me has a team of six full-time staffers, with plans to add more soon.

Wild Mes process of creating and training algorithms takes serious time. Thousands of photos of the species must be manually annotated so that the algorithm learns what a given animal is, what the distinguishing characteristics are and whats just background noise.

The model relies largely on photographs taken by scientists or everyday people who upload their photos to the corresponding Wildbook. It uses AI to find things in the picture and then hand it to algorithms or machine learning to suggest IDs which whale, which giraffe, etc., Holmberg said.

Christin Khan conducts aerial surveys of North Atlantic right whales for the National Oceanic and Atmospheric Administration and had sought an AI-based solution for years. She said she watched Facebook implement facial recognition and wanted to use similar technology to help identify whales within the endangered species (there are only about 400 North Atlantic right whales left).

We needed a really simple, user-friendly web-based interface where a biologist who knows nothing about AI could upload a photograph and get a result back, she said. Eventually we realized the developers at Wild Me had already done a lot of what we needed, and it wouldnt require us to reinvent the wheel.

The Wildbook for whales, called Flukebook, encourages collaboration, which is particularly useful for whales that travel long distances because it can be difficult for one research group to effectively monitor one area.

The more people on the water, the more photos, the more its decentralized, (the better), said Shane Gero, who founded and runs the Dominica Sperm Whale Project. By doing the matching themselves, by contributing their own data, not only do they get to know the animals, but it creates a locally motivated community of people that can react when conservation actions come up.

Before the introduction of AI, Gero said it would take about a month to process a months worth of photos.

(Now), we have our numbers of individuals sighted and population estimates faster, so we can report (almost) in real time, he said.

That means his group is able to provide the government of Dominica with more up-to-date information and offer better advice on how to shape conservation efforts.

One of Wild Mes more recent innovations is an AI-driven feature that datamines YouTube videos of whale sharks and sea turtles, using user-generated videos (often taken by tourists) to get a better sense of the populations. This has been a great way to increase the amount of photos coming in and provide researchers with more data. But it also creates even more work for people on the ground, who have to manually check the AIs suggestions and accept the results.

Were flooding the whale shark community with more data than it can handle, said Holmberg.

So Wild Me is now building the capacity to automate the identification process and scaling the tech that combs social media for relevant videos.

The nonprofit recently received a two-year grant from the Gordon and Betty Moore Foundation to develop the new algorithm that will make the animal IDs on its own.

Its focusing the initial work on zebras because it already has an incredibly rich dataset. Every two years since 2016, the Great Grvys Rally in Kenya has used hundreds of citizen scientists spread out over thousands of kilometers to photograph Grvys zebras over two days. Wild Mes AI analyzes the zebra markings on all the photos to come up with a total population, which the Kenyan government treats as the official census for Grvys zebras.

This type of work is a huge upgrade from the traditional capture-mark-recapture process, which is both invasive and time consuming, with studies done every five to 10 years.

You can only make very coarse-grained conservation decisions, Holmberg said. The point of going to a fully automated system is to shorten that cycle so we can take all of the data over the past week or two weeks and have a continuous prediction of population size. Its fine-grained, which helps researchers understand and lobby for better conservation activities.

For Khan, meanwhile, the existing technology is still in its early days. The algorithm for North Atlantic right whales became operational in November 2019, and she said theyre still working out the kinks and figuring out how best to use it. But, she said, she sees the incredible potential that it holds.

My dream is that we get to the point where the worlds oceans will be trolled by satellite photos and we can understand the worlds whale population, she said. Combining AI with satellite imagery and drones we have the potential to exponentially understand the worlds oceans thats just not possible with manned aircraft.

Over the past decade, the belief that artificial intelligence could solve the complexities of the stock market has spread like a wildfire. The notion that humans lack the capacity and capability compared to machines, who will, without fail, consistently beat the market over time. By simply programming a machine, it will produce the ultimate formula making you filthy rich in the process. A radical change in society where anyone can make money, but not just a stable income: a modest fortune.

Unfortunately, though, this is a mere fantasy.

Theres a major flaw in algorithms built solely to predict future market moves: they dont. They only respect the technical aspects of an asset by taking into account past price movements, avoiding any consideration for future fundamentals. Any veteran trader will tell you the market isnt there to give away free money. Instead, its a competitive environment punishing anyone or anything who tries to make a quick buck by trading on reactionary information already priced in.

Technical analysis alone will not make you money. In fact, the myth that it does has fueled an entire industry which preys on the vulnerable: As the homepage of many online brokerage websites illustrates,up to 96% of foreign exchange traders have fallen for the trickery. The truth about the brokerage industry is it makes money when its clients lose. So when your broker offers you a plethora of trading algorithms to choose from, the alarm bells should be ringing.

Still, you may fall for the con, because the trickery itself is seductive: Let the algorithms do everything for you, sit back and relax until you can retire. All the algorithm has to do is choose the right direction: either buy or sell, right?

In a matter of minutes,hedge funds blew up, andretail traders lost a fortune, but the machines did too.

Not only are machines incapable of predicting a black swan event, but, in reality,they are more likely to cause one, as traders found out the hard way during the2010 flash crashwhen an algorithmic computer malfunction caused a temporary market meltdown.

Ultimately, A.I is doomed to fail at stock market prediction. Beating the stock market over time, however, is possible. The solution lies with us because we humans have an edge. We have the ability to make informed decisions by analyzing future catalysts of an asset, and the reasons why they will move the price up or down a strategy artificial intelligence has yet to beat us at.

Success in trading, like in any other discipline, requires hard work and extensive research, but this only results in having a slightly better chance of succeeding. With the best traders only getting up to half their trades right, this shows that if we humans have failed to decipher our own collective minds, then A.I doesnt have a chance.

Following the chaos at the Greek-Turkish land borders, leaders from the Balkan region have urged the EU to take immediate action to prevent a repeat of the 2015 migration crisis.

In Sofia, Bulgarian Prime Minister Boyko Borissov is today preparing to meet Turkish President Recep Tayyip Erdoan in Ankara. He called on the EU to do everything and quickly to give Turkey the money it needs to readmit and take care of the refugees.

In Zagreb, Domestic Affairs Minister Davor Bozinovic has said Croatia is ready for another migrant wave at its borders. We have plans in case of escalation, but this is an issue that needs to be addressed diplomatically, he said, adding that the current migration wave is exactly the same as the one in 2015. The EU has not learned its lesson, he emphasised.

In Belgrade, Serbian Foreign Minister Ivica Dacic promised on Sunday that Serbia would continue to treat migrants fairly, but warned it would not let them remain trapped in Serbia in large numbers.

Not having it. Czech MEP Tomas Zdechovsky (Christian Democrats) will take legal steps to defend himself against PM Andrej Babi who called him and another Czech MEP, Mikulas Peksa, traitors. Babi said that Zdechovsky and Peksa act against the Czech government by opening the topic of his suspected conflict of interest in the European Parliament. The PM criticised the two in connection with the fact-finding delegation of the EP, led by Budgetary Control (CONT) chair Monika Hohlmeier, that visited some authorities in order to check Babis conflict of interest in Prague last week. Coronavirus infection arrives. The health minister has confirmed the first three cases of coronavirus in the Czech Republic. Transition Fund eligibility. Six counties in Romania are eligible for Just Transition Fund projects, according to a preliminary analysis of the European Commission, cited by MEP Siegfried Muresan. Hunedoara, Gorj, Dolj, Prahova, Galati and Mures are the counties that could need the largest support to comply with the targets of the European Green Deal, said Muresan, Parliament rapporteur on the funding for the Green Deal. Urgent parliament session.Kosovo Parliament is set to convene today after opposition MPs asked for an urgent session to discuss the governments proposal on abolishing tariffs with Serbia. The initiative came from former PM Ramush Haraidnajs Alliance for the Future of Kosovo (AAK), who continue opposing revocation of tariffs. As PM, Haradinaj introduced in November 2018, a 100% tax on all Serbian imports. Speaker Vjosa Osmani, a member of the LDK, a coalition partner in Albin Kurtis government, said Kosovo cannot hinder its relations with the US only because of the tariffs. What We’re Watching: Europe’s migrant crisis, Bibi’s win, and Russians standing their ground – GZERO Media

A fresh humanitarian crisis on Europe's doorstep: A dramatic surge of migrants has arrived on Greek shores in recent days, after Turkey abandoned a 2016 deal with the EU under which it has housed some 3.7 million Syrian refugees in exchange for billions of euros in aid. Ankara took this step after a dangerous flare up last week in Syria, where Turkish troops are trying to halt a Syrian assault on Idlib province that's driving more refugees across the Turkish border. Some 10,000 migrants have since tried to breach the Greek border in recent days, leading Greek police to use tear gas and other riot control methods. One child died after a makeshift boat capsized off the Greek island of Lesbos, a main destination for migrants. Meanwhile, Greece's prime minister announced Tuesday that all asylum applications would be frozen while Athens deals with the emergency. Brussels has pledged emergency aid.

Netanyahu wins, but how big? With about 90 percent of votes in from Israel's parliamentary election, its third in less than a year, incumbent Prime Minister Benjamin Netanyahu's Likud party came out victorious, winning four more seats than its rival Blue and White party. At the time of this writing, Netanyahu is still two seats short of a 61-seat parliamentary majority. If Netanyahu, who is set to face a corruption trial on March 17, gets to 61 seats by merging with his allies on the right, he could seek parliamentary immunity from graft charges. But if the tally is a 60-60 split with the opposition, Netanyahu might need to entertain some sort of unity government with Blue and White party leader Benny Gantz. While much will be determined in the days ahead, one thing is clear: Netanyahu has won an election that was essentially a referendum on whether his legal troubles ought to disqualify him from leadership.

Putin isn't giving up any ground, literally: Russian President Vladimir Putin has submitted a flurry of proposed constitutional amendments, including measures that would effectively ban same sex marriage, criminalize blasphemy, and prevent Russia from giving any part of its territory to a foreign power. That last measure will directly affect two major territorial disputes: one with Japan over the fate of islands occupied by Soviet forces during World War Two, and another with Ukraine over the fate of Crimea, which Moscow has politically and economically integrated into Russia since illegally annexing the peninsula in 2014. It seems that even for the country with the largest land territory on earth, every hectare counts.

The EU rejects this claim. An EU Commission spokesperson told CNN that the EU was sticking to its side of the deal, pointing out that the EU had committed over $6.6 billion dollars to handling the crisis, $3.5 of which has already been spent. The source pointed out that Turkey's objections might have more to do with the fact that the money does not go directly to the Turkish government.

Whatever the truth, the threat this poses to the EU is significant. Migration has been a hot-button issue in Europe for some time. And the EU's lackluster approach to handling the crisis has left it in a position where a leader like Erdogan can effectively hold a gun to Brussels' head and start making demands.

The 2016 agreement came about after Syria's multi-year civil war saw unprecedented numbers of people fleeing violence trying to enter the EU through Greece's land and sea borders with Turkey.

Migration had become politically toxic among EU member states. Some leaders, most notably Germany's Angela Merkel, were eager to ease the humanitarian crisis, after reports emerged of refugees being subjected to horrendous living conditions and shocking images were published of bodies washing up on European shores after boats -- overloaded with refugees -- sank.

However, welcoming the influx of migrants from Syria aided the growth of Europe's far-right populists. Parties across the bloc used it to bash the EU's refugee policies and argue for tighter border control.

Why Toby Young and other robust white men are using free speech to whip universities – The Guardian

It has been a glorious couple of weeks for defenders of freedom of speech. Now theres even a union to join, led by father of the chapel Toby Young. You can imagine it: robust white men brandishing copies of John Stuart Mills On Liberty and bellowing ideas must fight it out in the marketplace of ideas.

But why, and why now? It seems to be part of a backlash against supposed censorship and political correctness, to say nothing of leftwing bias, bleeding over the university sector like a cheap red sock in a hot white wash. Policy Exchange, the rightwing thinktank, has just published a report, Universities at the Crossroads, intimating that the sector has lost the trust of the entire nation. Oops. That was careless of us.

They accuse: Following a very vocal and at times highly partisan participation in the Brexit debate, as well as an increasing number of unnecessary rows over freedom of speech, there is a growing risk that some on the right may begin to see the sector as actively and irredeemably opposed to conservative and British values.

Freedom of speech on campus, they say, has been pushed into the background by high-profile culture wars, and its time to reverse the trend. Limiting speech on campus isnt a good look. Mill, notoriously, argued if an idea is wholly or partially true, then cutting it off will obstruct progress. But even false ideas should be given voice. Otherwise truths will be become dead dogmas and we will lose our ability to defend them. Conclusion: never obstruct free speech. Yet others, sotto voce, intone: Its all a bit more complicated than that.

Mill himself, like many thinkers, distinguishes freedom of thought from freedom of expression, which, he argues, can be restricted if it is likely to cause serious harm, such as immediate violence. Hence the prohibition of hate speech and the offence of inciting racial hatred.

The question, then, is not whether there should be limits, but where they fall. This is the frontline in the culture war, where speakers have been subject to protest and boycott because opponents believe their views are akin to hate speech. The line will always be contested, and those pulling out a point of principle often use it to mask a political programme.

Policy Exchange is not the first to attempt to whip up the idea that universities are rotten with reprehensible leftwing, anti-British values, try to indoctrinate students, and pursue a woke agenda. If so, we are doing a spectacularly bad job, given recent election results. In my experience, students typically leave university with their political views unscathed, albeit a little better defended.

Nevertheless, it is in the interests of those in power to send a chill through higher education. Policy Exchange is right that many academics see their role as holding government to account. But we dont discriminate. Whoever is in power gets the same treatment. It is just that we havent had a chance to discomfit a Labour administration for a while.

Some criticisms of universities are well made and too often we enter a defensive mode rather unfitting to institutions of the higher mind. But other attacks have an ulterior purpose: to put universities on notice that they are being watched.

Universities are implicitly warned: stay in your lane, and look both ways before you cross us. Dare academics, and especially their leaders, criticise authoritarian government policy and identify dogma-driven stupidities? Before you open your mouth, keep half an eye on the next funding round, and the law around security of employment.

Darkness has not quite fallen. But ultimately speech and power cannot be detached. Who has the power to speak, who has the power to stop others speaking? And power works in multiple ways. It can be exercised by threat, overt or implicit. But most damaging of all, it can seep inside and make us self-censors. Iron has entered the soul of universities in many other countries. It mustnt happen here.

(Bloomberg Opinion) -- Modern investors have diversified portfolios with stakes in hundreds sometimes thousands of companies. Proxy advisory firms provide these investors with objective, unbiased recommendations about how they should exercise the voting rights tied to their shares.

The largest proxy advisory firms generally side with the management of the companies. But they will take an opposing side if company directors are not fulfilling their oversight responsibilities or if the managers try to entrench themselves in their jobs by adopting scorched-earth anti-takeover devices.

A number of corporate managers are enraged when proxy advisory firms call them to account for acting against the interests of the companys shareholders. What is surprising is that the Securities and Exchange Commission has chosen to favor management and undermine shareholders rights and interests.

The SEC is proposing new regulations that both stifle the ability of proxy advisory firms to criticize management and provide management with an inappropriate power to influence the advisory firms recommendations. Proxy advisory firms do much-needed research on issues like whether incumbent directors should be re-elected; whether a company should have a board whose directors are elected to staggered terms; and whether a company should enter into a merger that might involve reductions in the headcount at corporate headquarters, but would be wealth-creating for shareholders. The advisory firms also are an important voice for linking executive compensation more closely to corporate performance.

Corporate managers have the Business Roundtable and the U.S. Chamber of Commerce representing and lobbying for them in the halls of Congress and in the backrooms of the federal bureaucracies. These groups object to anyone advising shareholders to vote to rein in the self-interested proclivities of corporate executives.

The SECs move to regulate proxy advisory firms is a naked political gambit. It offers a solution to a problem that does not exist. There has been no significant episode on record of a proxy advisory firm making a material false statement about a company. Moreover, a mechanism is already in place for independent proxy advisers to correct any errors brought to their attention.

The politics behind this proposal has been ugly. In an apparent astroturfing campaign that was described by Bloomberg News, the SEC received ghost-written letters in support of the proposed regulations that were fraudulently represented as letters from ordinary investors. The SEC apparently relied on these fake letters in measuring public support for its proposed regulations and is now said to be investigating this scheme to subvert the agencys rulemaking process.

Nevertheless, at the behest of corporate interest groups, the SEC is fast-tracking a proposal that would give every corporation the right to review a proxy advisory firms recommendations as much as five days before the proposals are delivered to shareholders, who are the firms actual clients.

These companies are allowed to provide feedback on these proposals. While proxy advisory firms would not be compelled to accept revisions suggested by corporate managers, any advisory firm that does not accept this input exposes itself to the very real danger of being named as a defendant in a securities fraud suit brought by the company on the grounds that it knowingly countenanced the distribution of a misleading proxy.

Worse, the SEC proposes that companies also be allowed to prepare a written response to be included as a hyperlink along with the advisers report.

If companies dont like the proxy providers findings, they can even see to it that the shareholders dont have access to these opinions. Under current legal standards, a proxy advisory firm is subject to sanction if it knowingly publishes a false statement. One of the SECs proposed rules would subject an advisory firm to civil or even criminal penalties for vague, inadvertent transgressions such as publishing statements that later are deemed to be misleading. Proxy advisory firms under the proposed rules would even be subject to penalties for relatively minor errors such as failing to cite studies that produce different results from any studies cited by the firms.

It is indeed strange that the SEC, whose mission is to protect investors, is putting its thumb forcefully on the scale in favor of companies and against investors. Its proposal would land a one-two punch against corporate democracy and freedom of speech. Not only is the commission demonstrating a deep hostility for the value of dissent. It is also abandoning the idea that the free and open exchange of competing views will result in the triumph of good investment policies over inferior ones.
