Aerospace supplier Teledyne will continue to cut jobs – Reuters

SEATTLE, July 22 (Reuters) - Teledyne Controls Inc, whose subsidiary supplies data-acquisition and distribution systems for Boeing Cos 737, said on Wednesday that more job cuts were coming as the company looks to cut costs amid the COVID-19 and 737 MAX downturns.

Reuters reported on Tuesday that Teledynes Controls unit halved its factory workforce in California after sales of aerospace products plunged some 50%, with further staff cuts likely.

Executives from Teledynes parent company confirmed these numbers and layoff plans during an earnings conference call with analysts on Wednesday, though overall they expected strong free cash flow and a recovery in sales later this year.

In light of re-initiated shutdowns and travel restrictions, it is prudent to assume such recovery will begin in the fourth quarter, Teledyne Controls Inc Executive Chairman Robert Mehrabian told analysts.

We are still reducing our workforce, Mehrabian added later.

Aerospace to garden hoses: differing opinions in the English Court of Appeal as to obviousness over obscure prior art – Lexology

Since Arnold LJs elevation to the Court of Appeal in 2019, he and Floyd LJ have heard about 11 cases together, spanning a mixture of areas of law, some patents cases and some not. In the majority of these cases, Floyd LJ (or a third judge) has given the leading judgment with which Arnold LJ has agreed. In those cases where Arnold LJ gave the leading judgment, Floyd LJ has always agreed. However, this changed on 8 July 2020, when the Court of Appeal handed down its judgment in the above appeal. This time Arnold LJ gave the leading judgment (dismissing the appeal against Nugee Js judgment from first instance (for which see here)) and Floyd LJ strongly disagreed. Henderson LJ (whose background is in competition law rather than patents) had the unenviable task of deciding between these two highly respected patents judges. Whilst clearly conscious of the expertise of the other two members of the panel, he decided to side with the more junior of the two, Arnold LJ, providing clear reasons for doing so. In a nutshell, as discussed further below, the disagreement was about the approach that should be taken to a piece of prior art which was from a totally different field from that of the claimed invention.

At first instance, Emson (as exclusive licensee of UK Patent 2,490,276 and European Patent (UK) 2,657,585: the Patents) had brought infringement proceedings against Hozelock. The Patents protected an extendable hose, such as the XHose manufactured by Emson. Emson successfully asserted that Hozelocks Superhoze infringed the Patents; however, Hozelock was successful in its counterclaim to invalidate the Patents which were held to be obvious over a piece of prior art named McDonald, which was from the aerospace industry.

The first instance judgment was notable and widely reported, primarily due to the obiter comments about a potentially novelty-destroying prior disclosure by the inventor, Mr Berardi, who had been testing prototypes in his garden in Florida. This interesting aspect of patent law which on the facts encouraged English patent lawyers to imagine the scenes in Mr Berardis garden, with blue skies and presumably a bright green, beautifully watered lawn had the scope to alter the traditional test for what constitutes a public disclosure. However, this part of the case was only in issue on appeal by way of respondents notice, and unfortunately for connoisseurs of patent law, the appeal did not make it to that stage. Rather, the appeal judgment centered on the part of the case which was less likely to conjure up images of Mr Berardis Florida garden: the issue of whether Emsons Patents were obvious over McDonald.

The patents and the skilled person

In short, the patents disclosed a light weight, contractable and kink-resistant garden hose. This hose has an inner and outer tube, where the inner rubber tube expands (lengthways and radially) with incoming water pressure to the width and overall length of the outer nylon tube. The tube then contracts back to its small size on release from the pressurised water.

Notably, this was not the first time that the Patents had been considered by the English Courts. Birss J had held the Patents valid over McDonald in an attack brought by different parties in 2013. However, the attributes of the skilled person were held to be different in that case, based on the differing evidence in the two cases. In the present case, the skilled person had knowledge of technical hoses as well as garden hoses, whereas Birss Js skilled person was only experienced in garden hoses. Of the four experts who had appeared in the two cases (one on each side for each outing), only one had actual experience in design and manufacture of hoses and therefore knowledge of both technical and garden hoses (a fact described as remarkable by Arnold LJ). This was the expert who was favoured by Nugee J at first instance and which therefore led Nugee J to a different conclusion from that of Birss J as to the attributes of the skilled person (and also ultimately the approach to the prior art).

The prior art

US Patent Application No. 2003/0000530 (McDonald) is titled Self-elongating oxygen hose for stowable aviation crew oxygen mask.

The abstract of McDonald describes an expanding hose with an inner and outer tube structure. As stated in the specification, the inventive feature is the space saving, self-elongating hose which axially expands when pressurised. A key factor that gave rise to discussion at appeal was that, although McDonald did become a granted patent in some countries, there was no evidence that McDonald was ever implemented or commercialised.

Pozzoli obviousness

In following the established 4-step Pozzoli test for obviousness, Nugee J found that the only difference between the prior art and the Patents was that McDonald was not a garden water hose assembly expanded by water but an aerospace hose expanded by air. Nugee J decided that, standing back, it would have been obvious to the skilled hose designer to take the McDonald hose and adapt it for use as a garden water hose: once presented with McDonald, the skilled person would appreciate how it worked, and the adaptations needed were routine.

On appeal, Emson argued that the judge erred in principle as he conducted a hindsight-based analysis and also failed to take commercial success into account when assessing obviousness.

Appeal judgment

Arnold LJ opened his analysis of whether the judge had erred in relation to hindsight with the statement that, on its face, this appeal seemed unpromising. This was because the judge had made repeated comments about the need to avoid hindsight. Arnold LJ also acknowledged that an aspect of Emsons argument was slightly more nuanced: that the judges reasoning did involve hindsight despite all his attempts to avoid it. Arnold therefore stepped through each of the first instance judges findings in relation to McDonald. Two that were particularly relevant were as follows:

Emson also argued that the skilled person would find McDonald confusing in various different ways, and, for example, that the Judge had cherry-picked the parts of McDonald which support obviousness while ignoring all the inconvenient difficulties with the details, but these arguments were all also dismissed by Arnold LJ.

In the period between the first instance judgment and the appeal, the EPO Opposition Division handed down its decision on one of the Patents, which it found to be inventive over McDonald. Arnold J distinguished this decision on the grounds that the EPO was not faced with precisely the same arguments. Further, the short paragraph in the EPO decision, in his view, did nothing to cast doubt on Nugee Js detailed reasoning. Indeed, Nugee Js judgment was excluded from the ODs assessment.

All of Nugee Js findings were therefore upheld by Arnold LJ, with whom Henderson LJ agreed. The patent was therefore obvious over McDonald. Nevertheless, both judges were sympathetic to the inventor, Mr Berardi. Henderson LJ went as far as acknowledging that their decision was harsh and potentially even unfair on Berardi. Arnold LJ highlighted, as Nugee J had done, the underlying policy considerations. He accepted that in balancing the monopoly right of the patentee and the publics right to do something disclosed in the prior art, it is an unfortunate consequence that, as in this instance, clever patents can sometimes be found invalid due to an obscure piece of prior art totally unknown to the inventor.

Dissenting judgment of Floyd LJ

Floyd LJ was clearly more sympathetic to the inventor. He noted the harshness of a situation where an inventor is deprived of his monopoly in order to protect a right in the prior art which would never in fact be exercised. Whilst he acknowledged the policy justification for the rule that any prior art document which the skilled person can access can render a patent obvious, he suggested that the law has found ways of mitigating against the penal nature of the rule. Floyd LJ cited Jacob LJs comments from Inhale in this respect, that the more distant a prior art document is from the field of the patent, the greater the chance that the skilled person will fail to make the required leap. He indicated that he considered the aerospace field to be so remote, the skilled person would not make that leap. Further, Floyd LJ considered it an unreality that the skilled person would seize on an untested proposal from a very particular and very distant field when no changes had been made to garden hose design for decades.

Floyd LJ focused heavily on the relatively unknown and non-commercialised McDonald patent application being a mere paper proposal, a phrase used by Jacob LJ in the appeal of Grimme v Scott [2010]. Since it had not actually been implemented, he argued that McDonald is simply an untested proposal; a description of an idea. The skilled person would therefore be skeptical as to its use and whether it actually worked, and be even less inclined to adapt it to a different field. He thought it was principally this assumption that McDonald was a real, practical machine that infected the first instance judges mind with hindsight. In turn, Floyd LJ considered that Nugee J glossed over features of McDonald that the skilled person would otherwise have found confusing (such as precisely how the hose expanded and retracted Floyd LJ baulked at the suggestion that all one is doing in taking McDonalds idea into the field of garden hoses is transposing an application from one field to another; and he thought that it was redolent of hindsight that neither expert could fully understand the detail of how McDonald was supposed to work). He concluded that Nugee J had erred in principle in arriving at his finding of obviousness.

Commercial success

As noted above, the Court of Appeal also considered commercial success. Relying on Laddie Js judgment in Haberman v Jackel [1999] at [32], Arnold LJ dismissed the arguments quickly on the basis that McDonald was not something that was known to the skilled person. Commercial success could therefore not help to show that the invention was not obvious over McDonald. Floyd LJ and Henderson LJ agreed.

Conclusion

The difference of opinion between Arnold LJ and Floyd LJ shows that hindsight is an ugly subject matter which constantly needs to be grappled with. It is interesting that Arnold J (as he was until last year), was known for his commentary on avoiding hindsight in the instruction of experts (including his criticism of practitioners). Indeed he considered this issue very recently in Fibrogen v Akebia [2020] EWHC 866 (Pat). Yet in this case he has found that there was no error of principle in relation to hindsight.

In this appeal, the majority judgment upholds the application of patent law in relatively strict terms, at the unfortunate expense of a genuinely good idea from an individual in his garden. In future, practitioners might seek to use Floyd LJs comments on unknown, mere paper proposal ideas (as opposed to real life, worked inventions) as weaker starting points for obviousness attacks, although this may be limited to unusual situations such as this one, where the prior art is from a completely different field.

The case also illustrates how influential the specific expertise of an expert can be in determining the identity of the skilled person, and in turn how the expertise of the skilled person can impact the outcome of a case.

Whatever practitioners think of the outcome, they will be comforted (whilst their clients may be dismayed) to know that even when two highly experienced patent practitioners are faced with exactly the same task and are allowed to review each others work, they can come to, and stick with, very different conclusions.

Forge Biologics Launches with $40 Million to Manufacture and Develop Gene Therapies – BioSpace

Ohio-based startup Forge Biologics closed a $40 million Series A financing round that will be used to expand manufacturing capabilities and support the clinical development of a gene therapy program for rare diseases, including the typically fatal Krabbe disease.

Forge Biologics is a viral vector contract development manufacturing organization (CDMO) and therapeutics developer. The company plans to use proceeds from the funding round to expand its adeno-associated virus (AAV) manufacturing capabilities, as well as its gene therapy pipeline. Its lead program is FBX-101, a novel AAV and umbilical cord transplant combination approach to treat infantile Krabbe disease, a devastating neurodegenerative disorder. Krabbe disease has a predicted incidence of about 1 in 12,000 people in the U.S. with symptoms developing in babies and rapidly progressing to death by age two. Forge anticipates FBX-101 will enter the clinic later this year.

FBX-101 was initially developed in the laboratory of Maria Escolar, a professor of pediatrics and director of the Program for the Study of Neurodevelopment in Rare Disorders (NDRD) at the University of Pittsburgh. Escolar will serve as chief medical officer of Forge Biologics. The combination of AAV gene therapy and umbilical cord bone marrow transplant addresses both central and peripheral nerve degeneration associated with Krabbe disease, she said. Recent data showed the combination approach significantly improved efficacy compared to a single AAV administration alone in canines affected with Krabbe disease.

The companys manufacturing facility, known as The Hearth, will host end-to-end cGMP AAV manufacturing services at 500L scale, enabling biotech and pharma clients the ability to accelerate their gene therapy programs from pre-clinical development through clinical and commercial stage manufacturing.

Timothy J. Miller, president and chief executive officer of Forge Biologics, said the young company is a true gene therapy development engine. With AAV manufacturing, its pipeline and a strong leadership team, Miller said the company is ready to bring life-saving therapies for rare diseases into reality.

In addition to Miller, who previously served as CEO of Abeona Therapeutics, and Escolar, Forges leadership team includes Chief Operations Officer Jaysson Eicholtz and Chief Strategy Officer Erandi De Silva. Eicholtz was previously responsible for Nationwide Childrens Hospitals gene therapy manufacturing facility, and Silva was previously head of Program Management at Myonexus Therapeutics.

The Series A financing round was led by Perceptive Xontogeny Venture Fund with participation from Drive Capital. Chris Garabedian, CEO of Xontogeny, will join the Forge Board of Directors as its chairman.

RTW backs Encoded Therapeutics In June, RTW Venture Fund participated in a $135m Series D financing round for Encoded Therapeutics, together with other investment firms. Encoded is a US-based privately held preclinical stage biotech company developing precision gene therapies for a broad range of severe genetic disorders.

This was RTWs seventh investment following its IPO in October 2019 and its second gene therapy company.

Yesterday, Encoded announced thatits lead asset, ETX101, was granted Orphan Drug Designation (ODD) and RarePediatric Disease Designation by the U.S. Food and Drug Administration (FDA) for the treatment of SCN1A+Dravet Syndrome. Proceeds from the Series D fundraise will be used to conduct clinical trial activities including a natural history study to better understand the progression of SCN1A+ Dravet Syndrome as well as first-in-human trials for ETX101. Additionally, the funds will support progression of the companys pipeline of gene therapies being evaluated for additional pediatric CNS (central nervous system) disorders.

Dravet syndrome is a rare, severe genetic disorder that occurs in approximately 1 in 16,000 births worldwide.The disorder is characterized by uncontrolled seizures, ataxia, significant developmental delays and anincreased risk of early mortality due to sudden unexpected death in epilepsy (SUDEP). The majority of DravetSyndrome cases are caused by loss-of-function mutations in the SCN1A gene. Current treatments reduceseizures but do not address the underlying cause of the disorder SCN1A haploinsufficiency. The GOP Coalition Is Getting More Working-Class. Its Agenda Isnt. – New York Magazine

At this moment in time, the most significant fact about how the GOP coalition is changing is that it is getting smaller. Back in February, slightly more Americans identified as Republicans than as Democrats in Gallups polling; today, the Donkey Party leads in partisan identification by a margin of 50 to 39 percent.

Given the extraordinary context in which this survey was taken, one could plausibly argue that the result is an illusory byproduct of nonresponse bias, or the marker of a durable, pro-Democratic realignment. To the extent that partisans exhibit a greater tendency to answer calls from pollsters when they are eager to discuss politics because their side is doing well then this would seem like a bad time to get Republicans to come to the phone.

Conversely, to the extent that presiding over a catastrophic failure of governance can impair a partys brand in a long-lasting fashion as ostensibly happened with Herbert Hoovers GOP and (more arguably) Jimmy Carters Democrats then having your partys standard-bearer counsel the public to inject disinfectant while a pandemic kills 140,000 Americans and plunges the nation into the worst recession since World War II seems like it could do the trick.

Regardless, another significant way that the GOP coalition is changing is that its voting base is becoming more working-class. And if this November does bring a blue tsunami, that fact could theoretically have some bearing on how the Republican Party rebrands and rebuilds in the aftermath.

Donald Trumps erosion of support in recent months has been driven by the defections of white voters in general, and college-educated ones in particular. A variety of recent polls have found Biden leading Trump among the latter by roughly 30 percentage points. Although the presidents standing among non-college-educated whites has declined significantly in recent weeks, he still boasts a roughly 20-point lead with that demographic in the most recent surveys.

Counterintuitively, the presidents grip on a sizable minority of nonwhite voters has scarcely loosened: In recent polls from CNN, Monmouth University, and the New York Times, Trumps share of the African-American and Hispanic voting blocs remains about where it was in 2018 exit polls which was itself a bit higher than his share in 2016.

Considering that the pandemic and recession have harmed nonwhite Americans disproportionately and that Trump has turned his appeals to white racial grievance up to 11 since the onset of the George Floyd protests this is a rather surprising phenomenon. And it is possible that a collapse in Trumps nonwhite support is still in the offing. But, at least before the pandemic, the presidents modest gains among Black voters wouldnt have surprised some close observers of African-American political behavior.Keeping 90-plus percent of African-Americans united in one partisan camp takes work. The reason Democrats have enjoyed such a landslide margin among Black voters despite considerable ideological and attitudinal diversity within that demographic is not that each individual African-American Democrat concluded that the GOP was hostile to people like them through their own personal ruminations on current affairs. Rather, as political scientists Ismail K. White and Chryl N. Laird argue in their book, Steadfast Democrats: How Social Forces Shape Black Political Behavior, the Black bloc vote is a product of racialized social constraint which is to say, the process by which African-American communities internally police norms of political behavior through social rewards and penalties. In their account, the exceptional efficacy of such norm enforcement within the Black community reflects the extraordinary degree of Black social cohesion that slavery and segregation fostered.

If this thesis is correct (and White and Laird do much to substantiate it), then it would follow that the erosion of African-Americans social isolation would weaken racialized social constraint, and thus, narrow the Democratic Partys margin with Black voters. And, according to the Democratic Party data scientist David Shor, the polling bears out this thesis: Young, secular Black voters whose distance from the African-American church makes them less subject to social constraint have become slightly more Republican since 2016.

The Democrats triumph in the 2018 midterms was powered by college-educated whites, even in races where one might have expected a groundswell of nonwhite support to put the party over the top. In Georgias gubernatorial election, Stacey Abramss share of the states Black vote was 4 percentage points lower than Hillary Clintons was in 2016, according to the Democratic data firm Catalist.

The source of the relative stability of Trumps Latino support is less well-theorized. But it is true that, holding ethnicity constant, non-college-educated voters tend to be more conservative on immigration both in the U.S. and in other countries. It is conceivable that some of the same qualities that make Trumps politics appealing to white non-college-educated voters also serve to ingratiate him with a minority of working-class Latinos, particularly those generations removed from the immigrant experience.

Regardless, since the Latino and African-American voting blocs are more working-class than the electorate as a whole, one effect of the GOP holding its ground among nonwhite voters while bleeding white college-educated ones is to render its coalition less affluent and highly educated than it was in 2016.

This is the scintilla of truth behind Ted Cruzs remarks on the Federalist Radio Hour Thursday.

The big lie in politics is that Republicans are the party of the rich and Democrats are the party of the poor. That just aint true, the Texas senator told the right-wing outlet. Todays Democratic Party is the party of Silicon Valley billionaires. Todays Democratic Party is the party of Michael Bloomberg. It is the party of power, it is the party of suppression, it is jackbooted thugs who will enforce their will through force.

Setting aside Cruzs last remark (by all indications, the president wants the GOP to be known as the party of jackbooted thuggery), he is narrowly correct that the Democratic Party boasts more support from affluent voters than at any time in its modern history (although American billionaires still donate predominately to the GOP, and controlling for educational attainment, Republicans still soundly beat Democrats among high-income voters).

And yet: If the GOP is becoming more working-class, in terms of its coalitions demographic composition, there are few signs that it is becoming a party for the working class, in the sense of governing in the interests of workers as workers. By the same token, while the Democratic Party is becoming more affluent demographically, its economic policies have grown steadily more progressive over the past decade. Since taking control of the House of Representatives on the strength of the partys support in suburban districts, Nancy Pelosis caucus has passed a $15 minimum wage, The Protecting the Right to Organize Act (a pro-union labor-law reform bill), and pushed to have the CARES Act provide Americans with the highest unemployment benefits on offer anywhere in the world (albeit, on a disastrously temporary basis).

By contrast, since Donald Trump eked out an Electoral College majority by making significant inroads with lower-income white voters, he has established himself as (at least arguably) the most economically regressive Republican president in history. He began his presidency with an attempt to throw 14 million low-income Americans off Medicaid, and then proceeded to shower wealthy capitalists in tax cuts, make it easier for corporations to cut costs by poisoning children, and gutted the Consumer Financial Protection Bureau, among other reactionary things.

Now, with tens of millions of Americans freshly unemployed, upwards of 20 million at risk of eviction by autumn and state governments poised to layoff public-sector workers and slash social services due to cratering revenues the Republican Party is putting its principled commitment to slashing welfare provision above its political interests. There is no evidence that the CARES Acts $600 weekly federal unemployment benefit is starving the U.S. labor market of much-needed workers by making joblessness more rewarding than hard work. On the other hand, there is copious evidence that such benefits have stabilized personal income levels in the U.S., thereby preventing a much sharper recession.

Nevertheless, the party of single moms and steelworkers finds the theoretical threat of American workers having the power to turn down an unattractive job offer from an employer without suffering a significant loss of living standards so offensive, it is fighting to slash the incomes of 32 million Americans (in the middle of a pandemic, just months from Election Day).

Meanwhile, the partys other top priority for the next COVID-19 recovery package is to immunize employers from workplace safety lawsuits.

It is true that the Republican firmament is home to some conservative intellectuals who would like the party to embrace a more communitarian economic vision. Many religious conservatives have lost their reverence for plutocracy as neoliberal capitalism and cultural traditionalism have come to appear increasingly incompatible. Some dissident wonks, like former Mitt Romney policy advisor Oren Cass, have gone so far as to embrace sectoral bargaining, a policy that would enable an industrys workersto set minimum compensation standards that would apply to all employers in that sector.

But no major Republican lawmaker has crossed that Rubicon. Instead, as the Roosevelt Institutes Mike Konczal notes, the GOPs putative populists, like Missouri senator Josh Hawley, have opposed pro-union reforms and minimum-wage hikes while pretending that immigration is the primary driver of working-class wage stagnation in the U.S. As Konczal writes:

If, like me, youve told people on the populist right theres no evidence in the debates that immigration is among the top five reasons of wage stagnation; to whatever extent it exists the declining minimum wage is far more important by itself and just watched the blinking eyes, you know theres a gap here. I think the coverage of the debate over immigration and wages does a disservice here, because the range of the numbers in no way matches the scale of the fall in fortunes for American workers. The debate is between increased wages and minimal decline, and just for the small group of non-native-born Americans without a high school diploma. Even if you believe the high estimates, they pale in comparison to the things even moderate Democrats want to accomplish, and you should be skeptical of those estimates.

Contra [conservative commentator Saagar] Enjeti, full employment and a tight labor market arent determined by the number of people in the country immigrants take jobs, but they also create jobs through spending but instead by fiscal and monetary policy, demand and technology. Theres a pretty standard toolkit among the left for compressing the income distribution and raising wagesunionization, higher minimum wages, public programs, overtime, wage boards, high progressive taxation on the rich, sectoral bargaining, high aggregate demand and full employment, etc.to draw from. Historically and across nations, these are the things that work. Its telling that members of the populist right do not endorse these and even actively fight them (populist right Senator Josh Hawley supported right-to-work laws in Missouri), and also do not provide serious alternatives to them.

Given the hegemony that business conservatives have enjoyed over the American rights core institutions of policy and leadership development, the safe money would be against the Republican Party embracing a remotely prolabor economic agenda in the coming years, even if there were a significant faction within the GOP advocating for such a turn. As is, there is only a cohort of opportunists whove wedded marginally heterodox views on a few discrete issues to vituperative denunciations of a rootless, godless professional-managerial class.

So, the GOP is (almost certainly) not becoming a party for the working class. Whether it will become the preferred party of 51 percent of working-class voters is less clear. Given the relative sturdiness of the GOPs share of non-college-educated voters throughout three years of reactionary policy-making and five months of catastrophic misrule it seems possible that well-packaged pseudo-populism may be all the party needs to grow its blue-collar wing. All true friends of American labor must do what they can to guard against that possibility.

Will Boohoo shares recover? – IG

It has been a tumultuous month for Boohoo.

The online fast fashion house saw its shares climb to a record high at the end of June, driven by the companys lean and agile business model that has continued to perform well during the coronavirus crisis.

It has been able to quickly respond to pandemic-induced trends, such as the switch in demand from eveningwear and holiday clothing to tracksuits and other loungewear. Its youthful customer base has continued to spend, and its online-only model has thrived whilst traditional retailers on the high street are struggling to survive.

Despite experiencing a marked drop in demand when lockdown was introduced, it quickly returned to growth by the end of April and that seems to have only continued to improve. Revenue in the three months to the end of May shot up 45% - delivering solid double-digit growth across all its geographies and established brands.

But Boohoo shares lost nearly half of their value between 30 June and 15 July, rocked by allegations that its low-cost model is underpinned by a troublesome supply chain. Shares have recovered some of their value but are still trading over one-third less than the all-time high. It has been enough to knock Boohoo off its perch as the most valuable company listed on AIM, and the fact that it lost the title to rival ASOS makes it all the more hurtful.

We have a look at the allegations that have injected volatility into Boohoo shares and what the long-term impact may be, as well as a look at whether the sell-off in Boohoo shares has been overdone.

Boohoos supply chain has come under severe scrutiny after reports from The Sunday Times suggested a garment factory in Leicester that supplies Boohoos Nasty Gal brand was paying staff below minimum wage and not adhering to lockdown rules.

The paper sent in an undercover reporter that said the factory had continued to operate when the city was put into a local lockdown, all without any additional measures taken to protect to staff. It was then argued that this could have contributed to the rise in cases in the area. The reporter was also told to expect 3.50 an hour, well below the minimum wage of 8.72 for over-25s. Other media outlets reported that some furloughed workers were being told they would not receive their government support if they didnt continue to work.

Boohoo responded by stating it was shocked and appalled by the recent allegations, adding it was committed to doing everything in our power to rebuild the reputation of the textile manufacturing industry in Leicester.

One of the reasons Boohoo is able to keep costs down is because it designs its own clothing but outsources the manufacturing. In terms of assets, it has two major distribution centres that it uses to ship its products around the UK and the world. This means it makes sense for the company to source clothing made close to home, and around 40% of its products are made in the UK, which it argues protects thousands of jobs that would otherwise be lost to cheaper foreign workers abroad.

Leicester is the countrys hub for garment making and Boohoo is thought to be its biggest customer. A report by Labour Behind The Label, which campaigns for garment workers rights around the world, said Boohoo was ordering up to 400,000 units from Leicester per week during lockdown in April, up from 120,000 in a normal week. This is thought to account for up to 80% of Leicesters entire capacity, which is met through a number of small factories.

Boohoo has tried to add some clarity to the situation. It said the company subject to media reports was not a direct supplier, meaning it was a company that was used by one of its own suppliers. It said the garments were not made in the UK but in Morocco, and were simply being repackaged in Leicester so they could be sold in the UK. It also said that its investigation to date has not found evidence of suppliers paying workers 3.50 per hour.

Those claims have, so far, held up. No less than seven different UK authorities ranging from anti-slavery and immigration to the police and the council found no foul play in their initial round of investigations, but we can expect more surprise inspections going forward.

Plus, it has already attracted the attention of politicians, who have pledged to clean up Leicesters garment industry, where concerns over conditions have been rife for years. Home secretary Priti Patel said the claims were truly appalling and said the government was committed to stamping out malpractice.

Boohoo said it would not hesitate to end its relationships with any suppliers that were not meeting its code of conduct, and that this includes very clear expectations on transparency about second tier suppliers.

It has launched an independent review of its UK supply chain which will be led by Alison Levitt QC and committed 10 million to eradicate supply chain malpractice. It has also accelerated its review of its third-party supply chain and its ethical audit.

The investigation will not be quick, which means this issue will linger over Boohoo for at least the rest of this year. It will set out the scope of the review by the end of July, but said it intends to provide updates when it releases its interim results in September, and again when it publishes a trading update for its peak trading season in January 2021.

It then intends to inform shareholders about how it will ensure Boohoo is sustainable when it releases its annual results in April or May 2021. That suggests its supply chain will be under the spotlight for some time.

The problem for Boohoo is that investors have become concerned that its low-cost, fast fashion model is underpinned by underpaid workers that are treated unfairly. We wont know how true this is if at all until the investigation starts to give us some answers.

But, regardless, this has highlighted a major problem for Boohoo and other fashion firms. The fact Boohoo said it was shocked by the situation shows how opaque its supply chain is. Boohoo concerns itself with its direct suppliers those that supply the end product but not the other businesses used by those suppliers. It has highlighted the need for greater transparency in the supply chain, and that will have to become a top priority for Boohoo if it wants to assure investors.

The Conservative chair of the Environmental Audit Committee, Philip Dunne, sent a letter to Boohoos co-founders Mahmud Kamani and Carol Kane that said it was shameful Boohoo didnt know what was going on. It is incredible that, over a year since the committee highlighted illegal working practices in its supply chain, Boohoo has publicly denied any knowledge of what has been happening for years, he said.

The letter also accused Boohoo of being unwilling to engage with trade unions and the Ethical Trading Initiative (ETI), which is an independent body that promotes workers rights. Last year Boohoo told us that it was going to join the ETI. We note it has not done so. It is shameful that it took a pandemic and the ensuing outrage about working practices in their supply chain for Boohoo finally to be taken to task for turning a blind eye, said Dunne.

For now, the damage is being done to its reputation. That hasnt been helped by the fact it said it would pay up to 150 million in bonuses to its board and founders so soon after accusations that factory workers are being grossly underpaid came to light. The fact the bonuses are only based on the companys share price performance rather than the business itself has also raised eyebrows.

Some of its major shareholders have flagged concerns. Jupiter Asset Management, the second largest shareholder in Boohoo behind co-founder Kamani, actually raised its stake in the business after the allegations were made to capitalise on the slump in its share price. But Standard Life Aberdeen, apparently not convinced, was reported to have dumped almost all of its stock in Boohoo just days after the allegations were made.

Boohoos wholesale business has also been hit after a number of retailers, including rivals ASOS, Next and Zalando, all pressed pause on buying Boohoos clothing until they get clarity over the situation. However, the wholesale division accounts for just 4% of Boohoos annual revenues, and just 1.4% of sales in the first quarter, so this loss is highly manageable.

The fashion industry being accused of dodgy supply chains is nothing new, but the fact Boohoo has been caught out in the UK has brought it into the spotlight because, quite simply, people pay more attention when the problem is on their doorstep rather than elsewhere.

The main task will be increasing transparency of its entire supply chain and addressing whatever horrible truths that could unveil.

Still, we are yet to see any evidence that its reputation has been harmed to those that matter the most, or that its young customer base has been turned off Boohoos brand. Sales figures will be closely watched over the coming quarters, but there is little expectation that demand has been severely hit by the allegations.

At worst, the investigation will reveal that Boohoos supply chain is not fit for purpose and that the cost of production goes up, which in turn would push up prices because of Boohoos cost-plus model. But this shouldnt pose too much of a problem for Boohoo because it boasts superior profitability over its rivals, so it can afford to absorb higher costs if it must.

For example, ASOS generates more than twice the amount in revenue than Boohoo but its lower margin. Boohoos edge comes from the fact it sells its own products and has a lean model that outsources everything, from manufacturing to information technology (IT), whereas ASOS and others sell more third-party products bought from other labels.

ASOS said earlier in July that revenue in the three months to the end of June had risen by 10% year-on-year.

It didnt take long for Mark Pope to seal his name in the annals of BYU Basketball history.

In his debut season as head coach, the man who Fox Sports Tate Frazier refers to as Young Pope led the Cougars on a 24-8 campaign that, if not for the novel coronavirus, would have culminated with BYUs 30th-ever March Madness appearance.

By elevating the Cougars to their first AP Top 25 ranking since Jimmermania in 2011, Pope accomplished something that BYU fans have been waiting on for nearly a decade: he ushered the team back into college basketball relevance.

Pope, however, doesnt see himself as the impetus behind the Cougars sudden resurgence. He directs all the praise to the team he inherited, which included four returning starters.

They were so hungry and willing to set it all aside, Pope said in an interview on the Titus & Tate podcast in April. Nobody really sets aside their personal agenda, but what our guys were willing to do was try as hard as they could to trust the game. If they gave themselves to the game, then the game was going to pay them back double than their own agenda.

Of course, the players redirected that praise right back at their coach.

Hes brought so much to this program, but he just has so much energy and he works so hard. You never really see him taking days off or taking time off, starting guard TJ Haws told The Salt Lake Tribune in February. Hes always up in his office. Hes always working. Hes always trying to figure out what to do next and that kind of energy is contagious to all of our guys.

In addition to earning his players respect through his work ethic, Pope also managed to win over the hearts of the Cougar fan base with his enthusiasm. After BYUs surprising 91-78 victory over No. 2 Gonzaga in February, the coach invited fans to celebrate with him at a local eatery where he picked up a $1,800 tab.

Some may chalk up Popes impressive first year to beginners luck, and he could be in danger of a one-hit-wonder label if the 2021 season doesnt mirror success in 2020. While only the future can truly reveal Popes legacy as a coach, a closer look at his recent track record before BYU shows this might not be a fluke.

During his four years as head coach at Utah Valley University, Pope led the Wolverines to a 17-win season in 2017, a 23-win season in 2018, and a program-best 25-win season in 2019 before signing with BYU the following April. Pope isnt lucky, hes methodical.

Under Popes offense, BYUs three-point percentage jumped from 33.0% in 2019 (240th overall) to 42.3% in 2020 (first overall) notwithstanding that this year the three-point line was pushed back from 20 feet, 9 inches to 22 feet, 1 inches. At the seasons close, BYUs offense ranked third overall in efficiency according to teamrankings.com.

Popes scheming doesnt stop at the chalkboard either, as some of his most notable successes have occurred during the offseason. He has quickly built a reputation as a fierce recruiter.

In May, he landed Purdues star center Matt Haarms, a player who was being pursued by both Kentucky and Texas Tech. BYU was also in the conversation to pick up Georgetowns firecracker guard Mac McClung, who ultimately signed with Texas Tech. Before Pope, BYU was not known as a destination for high-profile transfers, but this offseason is showing signs that players are starting to see the program in a new light.

Theres a clear reason why Pope was a finalist for the 2020 Naismith Mens Coach of the Year Award and was labeled CBS Sports No.1 Most Rewarding New Hire, the first wave of what will surely amount to many accolades during his (hopefully) lengthy tenure at Brigham Young University. As a BYU student (probably) once said, Long live the Young Pope.

BATAVIA Olga R. Meleca, 79, of Batavia, passed away peacefully on July 19, 2020 at the LeRoy Village Green Nursing Home with her sons by her side.

Olga was born Sept. 7, 1940 in Batavia, a daughter of the late Joseph and Cristina (Baggetta) Meleca.

A member of the former St. Anthonys Church and the Ascension Parish in Batavia, Olga loved spending time with her sons and her grandchildren, going for coffee and lunch with the girls, going to church, baking and loved her home. Olga was a 1958 graduate of Batavia High School. Prior to Olgas retirement she was employed throughout the area previously at NY Telephone, St. Jerome Hospital, US Gypsum, St. Marys Rectory and Cristinas Restaurant. You would often see Olga riding her bike through the neighborhood, manicuring her yard or enjoying the sun or by the pool or baking for her beloved grandchildren.

Survivors include her sons, Charles Brumsted Jr. of Florida, David (Elizabeth) Brumsted of Byron and Robert (Lori) Brumsted of Byron; brothers, C. Benjamin (Jeanne) Meleca of Columbus, Ohio, and Anthony Meleca of Columbus, Ohio; her grandchildren, Cameron, Catherine, Alexander, David, Bianca and Joseph, nieces, nephews and her loving in-laws, John and Patricia Brumsted and family, and several cousins from Batavia, Rochester, Canada and Siderno, Italy.

Olga is predeceased by her brothers, Frank Meleca and Carl Meleca; sister, Josephine Meleca and Frances Meleca Martino; and sister-in-law, Terry L. Meleca.

There are no prior calling hours. Olgas Mass of Christian Burial will be on Thursday, July 23, at 9:30 a.m. at Ascension Parish, 19 Sumner Street, Batavia.

Due to COVID 19 there will limited seating available during the Mass, only 60 people will be allowed inside the church. Masks must be worn at all times and seating will be in every other pew.

Olga will be laid to rest in St. Josephs Cemetery, Batavia.

Memorials may be made to Ascension Parish, 19 Sumner Street, Batavia, NY 14020.

Twitter Just Deleted Thousands of QAnon Accounts – Vice Impact

Surprisingly, Q didnt see this one coming.

Twitter announced on Tuesday night that it was taking the unprecedented step of removing or downgrading content and accounts linked to the conspiracy theory known as QAnon.

Twitter said that it had already removed over 7,000 accounts belonging to QAnon adherents and taken actions to stop the spread of the conspiracy theory that will impact some 150,000 accounts.

Weve been clear that we will take strong enforcement action on behavior that has the potential to lead to offline harm. In line with this approach, this week we are taking further action on so-called QAnon activity across the service, Twitter announced.

The company says that it will permanently suspend accounts that post about QAnon and are engaged in violations of our multi-account policy, coordinating abuse around individual victims, or are attempting to evade a previous suspension.

Twitter said it has seen more of this activity in recent weeks.

As well as suspending accounts, Twitter will no longer push QAnon accounts and content in its trending topics and recommendations. It will downgrade QAnon content in search results and block URLs associated with QAnon from being shared.

QAnon accounts that have not been suspended at already looking at ways of circumventing the ban, using hashtags like #CueAnon or #17Anon to avoid detection.

The Qanon conspiracy theory originated on the imageboard 4Chan, and broadly holds that President Donald Trump is waging a war against a shadowy deep state cabal. It also posits that members of the global elite, such as Bill Gates and Hillary Clinton, are running an underground child sex trafficking ring.

The theory is based on postings from a purported mysterious deep state operative known as Q who has made a series of predictions, like a 2017 post that claimed that Trump was days away from unsealing 25,000 indictments against deep state officials, a move that would trigger a state of temporary military control.

While it began as a fringe conspiracy theory, in recent years Qanon has gained more mainstream attention, particularly in Trumpworld, where supporters regularly show up at rallies wearing QAnon t-shirts and waving Q flags.

QAnon followers have also been implicated in armed standoffs, attempted kidnappings, and at least one killing. This has led the FBI to designate the group a potential domestic terrorism threat.

But it is QAnons online harassment campaigns that have led to Twitters drastic action.

Recently, major QAnon accounts have begun harassment campaigns against celebrities perceived to be opponents of Trump. These accounts then direct their followers to harass the celebrities with coordinated attacks.

TV presenter Chrissy Teigen, who has been repeatedly targeted with harassment by swarms of QAnon followers, hit back at one Twitter account holder who said the move amounted to censorship.

You dont have a right to coordinate attacks and make death threats. It is not an opinion to call people pedophiles who rape and eat children, she tweeted.

Despite the negative coverage of QAnon, it has gained support among lawmakers. Former National Security Adviser Michael Flynn who many supporters believe could be the mysterious Q gave the conspiracy credence recently when he posted a video on July 4 showing him and his family swearing allegiance to QAnon.

There are currently 66 current or former 2020 congressional candidates who have endorsed or given credence to QAnon, according to a list kept by Media Matters. Trump has also retweeted multiple QAnon accounts to his 83 million followers.

But Twitter told CNN that for now, politicians wont be subject to the new rules.

Currently candidates and elected officials will not be automatically included in many of these actions broadly, a Twitter spokesperson said.

As the QAnon conspiracy theory moved from the obscure corners of the internet, social media platforms like Twitter, Instagram, Facebook, and YouTube have helped propel its popularity far beyond what would have been possible otherwise.

The Q keyword has brought together a networked faction, aided by automation, that continuously spreads misinformation and inspires dangerous behaviors, Joan Donovan, a disinformation expert and director of technology and social change research at Harvard Kennedy School's Shorenstein Center, tweeted.

While Reddit banned QAnon two years ago, most social media platforms have been too slow to act, Donovan says, pointing out that some companies are not even trying.

Twitter is late out the gate. Facebook and YouTube arent even in the race.

PromptPress to release Afrofuturist collection in collaboration with CAS in August – Iowa City Press-Citizen

The unfurling ofpossible futures froma year agohassynthesized as futures do into a presentmomentequal parts unpredictable and inevitable. In this moment, anAfrofuturistcollection, the product of collaboration between PromptPress and the Center for Afrofuturist Studies (CAS), in its final phase of cultivation.

"Afrofuturism is a really exciting area of art to explore," said Kalmia Strong, the Book Arts Editor on this collection,a year ago. "What does it mean to try to create a future world where people of color are equally sharing in a positive way, which has not been the history of this country?"

The text planned for anAugust release,but not yet officially titled collectseight artists, largelyof the African diaspora. Visual artist Brandon Drew Holmes provided the illustrated images in the text to which the writers responded.

"I love Brandon's work because it lives in poetry and visual art at the same time, a divide I'm always trying to straddle myself," Anas Duplan, the founder of CAS,told the Press-Citizen in an email. "These particular drawings make such efficient use of space and reference a rich pop cultural world and imagination."

Allfour of the illustrations depict multiple subjects sometimes seemingly disparate. One includes two pop animations above the image of an apparently gay Black man across from another faintly realized image. Another shows the tracks of the Trans-Atlantic Slave Trade out of Africa above a pair of Black hands, a sign reading "Whites Only" and the text "A man people becomes invisible."

The works created in response are primarily poetic in form and vary in topics from a socialized sense of "otherness"to Black femininity.

"One of my former students dee(dee) Redd has a poem in this collection and I believe it's their first print publication,"Duplan said."I was impressed with their work when I taught them and thought it was only a matter of time before they started publishing more work. Their work is steeped in Black radical theory and, like Brandon's drawings, make really elegant and innovative use of space.

Most includedcreators were selectedby Duplan, but the publication was open to outside submissions, which is how Andrew David King came to be included.

"I became aware of PromptPress through my friend, who was interning there last summer," recalled King, who graduated from the University of Iowa with an master's degree in poetry last year. "I would come by and visit him in the press's reading room. I found the call for submission on Instagram and started looking at (Holmes') work. The pieces stayed with me; not long after, I began a poem in response to them."

King is the only white contributor to the publication, but still derived broader systemic issues he could speak to in the margins of the racial focus of the prompts.

"Although Holmes' drawings are 'about' race and racial violence, they also see to be 'about' a peculiarly American form of trauma, one with partial origins in prosperity-gospel Protestantism and capitalism," notedKing.

His hope is that his own poem "earns its presence" in the collection.

King's submission, "Theory of Regeneration," is a poem the author sees as growing from out of his ownsense of loneliness and displacement.

While the text and interior images have been determined,the design that contains these items is still being determined.

PromptPress is an ekphrastic journal with an emphasis on book art, with many of its publications challenging how a text is physically presented and thus examining how that presentation can amplify the text.

As for the future of this Afrofuturist collection, Duplan gives the impression that thisforthcoming effort is a singularity rather than a recurrent thing.

"PromptPress does a lovely job of seeking people out to guest-curate their issues," Duplan said."We'll be having a reading of the issue we put together on Montez Press Radio in August, and I hope folks tune into that."

Adults Walk The Anti-Violence Talk – New Haven Independent

Britton Braggin Rights Braggs noticed Darnell, 14, and James, 11, sitting on their bikes in front of Winchester Avenues B&K Grocery.

You heard about these people getting hurt out here with guns? the Newhallville-raised rapper asked the boys. They nodded. Were walking because we want kids like you guys to be safe, Braggs said.

Bragg, 29, was walking Newhallville Monday night along with dozens of other adults issuing a call to stop the violence.

After running into the store for an Arizona to share, Darnell and James joined a crowd of walkers on their bikes, mostly sticking by Braggin Rights side. And the quest continued to spark a community response to the rise in gun violence on New Haven streets.

I know what its like. Sometimes these kids just need someone to talk to, Braggin Rights said.

We came because we want the killing and violence to stop, said Darnell.

Black lives matter. We shouldnt be killing each other, said James.

The gathering began around 6 p.m. at Bassett Street Park. Former Alder Carlton Staggers (pictured) issued a call to parents and residents of Newhallville to come together to figure out a strategy for addressing the spike of sometimes deadly shootings in town over the past month.

Fifty people responded to Staggers call.

Staggers came with no script or agenda for the rally besides talking with adults about how to engage the youth.

We dont want the police or mayor involved. This has to be a message coming from the people, our kids need us, Staggers said.

Staggers also has five kids of his own for whom he fears every day. I wanna see my kids. I want my kids to bury me, he said.

We need to get our kids. What do we do? Staggers asked the crowd.

A conversation ensued followed by the group taking to the streets.

One audience member suggested the group collaborate with community organizations in the future to increase their impact.

Reeves said in his experience with todays youth he has learned they are most interested in entrepreneurship. They dont all want to be trained in trades like we were. They want to be entrepreneurs, Reeves said.

Reeves also said Newhallville needs to have a dedicated spot for meeting up as a community.

Newhallville native Brother Born stopped by the gathering in passing to share with the crowd that a Saturday breakfast program will start up this week from 10 to 11 a.m at the Newhallville Learning Corridor on the corner of Hazel Street and Shelton Avenue.

Devin Avshalom-Smith founder of the Newhallville Community Action Network, encouraged the crowd to attend the Newhallville Equality and Empowerment Rally on July 26 from 2 p.m to 5 p.m at Lincoln Bassett Community School. Books, groceries, masks, and gloves will be distributed. There were also be census and voter registration, blood pressure checks, and Covid-19 testing.

The city has taken away our Covid testing site, so were bringing it right back, Avshalom-Smith said.

In order to rebuild a community village, Reeves said, neighbors must hold each other accountable. I gotta be able to talk to your kid when they doing wrong, he said. We have to get off singularity thinking if were going to save these kids.

Staggers and others agreed.

We need to change the culture of resolving beef, Jahad said.

Before beginning their walk the group chose when and where they would meet next with the goal of walking in every New Haven neighborhood to engage youth directly. West Hills Alder Honda Smith suggested Westville Manor. The group agreed and decided they will walk around Westville Manor on Wednesday at 6 p.m.

So which way are we going? Staggers asked.

About 30 walked through the neighborhood streets stopping at residents sitting on their porches, cars, and bikes.

Were walking out here today to let people know were tired of all these young kids getting killed. Its time to put the guns down, said Staggers to a family hosting a gathering in their backyard. And if you support us were walking Westville Manor on Wednesday, tell friends. Or you could come walk with us right now.

Retired Police Sgt. Jacqueline Jackie Hoyte was amongst the walkers. On Shepard Avenue, Hoyte and neighbor Lakeisha Williams stopped in front of a white two-family house.

On the front porch sat Manualynn King. Come walk with us. Were trying to talk to these kids out here, said Hoyte.

Oh yes. Let me get my shoes, said King who ran inside to get shoes and her mask then joined the crowd.

God put this opportunity in front of me today, said King. These kids dont know love, hope, and peace so we need to help them.

Jahad passed out his card to neighbors during the walk telling people of all ages he can help out anyone from entrepreneurs who need help writing grants or getting funding to youth who just need someone to talk and care about them. If you have some young heads send them my way, I got some jobs for them, Jahad told neighbor as he passed them his card. We need to change the culture of resolving beef, he said.

I feel like Im doing my job especially because I know I have influence and platform, he said. Braggin Rights shared videos of the walk on his Facebook and Instagram where another 12,000 people could follow along.

Thank you to all the wonderful community members stepping up, speaking out and working to change peoples lives by engaging young people, organizing others to work towards stopping the violence, and providing services where the city has dropped the ball. You give me more hope than ever before in my lifetime that a change is going to come. Young people will only listen to the community-members in the community they live in. Its been proven that the police arent the answer to stopping the violence, they can only react after the violence has already happened. Only when the community stands up and pulls together and works for a change, and shows the young people that they matter, that they are loved, will the violence end. Only love conquers hate. Thank you! NHI- can you post daily in a section where these type of events will happen and how to contact anti-violence groups, volunteer groups in the community, social service organizations and other organizations where people can contribute their time, money and services? Could the city of New Haven and towns of Hamden, East Haven and West Haven coordinate a website similar to See, Click, Fix where people can connect with services and organizations and volunteer or donate? If we all work together to connect services and organizations with communities and community members in need, we could become stronger together.

Police crack down on those spreading fake news – The Hindu

Those engaged in online propaganda against individuals, health workers and local body leaders by spreading false information on COVID-19 have started facing the music with the police cyber cells quick response to such crimes following a recent State-level directive.

The police recently booked an Indian Union Muslim League (IUML) worker from Chalappuram, accused of spearheading a fake campaign against Thuneri block panchayat president C.H. Balakrishnan. According to the complainant, he was portrayed as a COVID-19 carrier in a fake online campaign by the accused.

In Kozhikode city and rural areas, probe is on into a number of such petitions against fake online campaigns that create misunderstanding and panic among the people.

Officials attached to the cyber cell said the tracking of the source of fake messages would be easier with the full-fledged functioning of the Kerala Police Cyberdome. With the opening of its Kozhikode branch, we have the support of a large number of cyber experts to handle such incidents very effectively, they said.

Health activists and doctors have also shared details of suspicious campaigners with the cyber cell. Action has also been intensified against people who recklessly share fake content on social media.

Station house officers have warned that the admins of WhatsApp groups will be held accountable in case they failed to report such fake messages to the police. The persons who post fake messages should be removed from the groups and the incident should be reported to the police with relevant screenshots to avoid legal action.
