A few days ago, the national press published the news of the approval in Cuba of the regulations to carry out the work associated with genetically modified organisms (GMOs) and their use in the production of food in agriculture. Undoubtedly, having standards to regulate the investigation and use of these organisms is healthy for the present and the future of our country.

According to the World Health Organization genetically modified (GM) foods are foods derived from organisms whose genetic material (DNA) has been modified in a way that doesnt occur naturally, e.g. through the introduction of a gene from a different organism. The technology is often called modern biotechnology or gene technology, sometimes also recombinant DNA technology or genetic engineering. It allows the outcrossing of selected individual genes from one organism to another, also between unrelated species. Foods produced based on GM organisms or used are often called GM foods.

Cuban scientists Fernando R. Funes-Monzote and Eduardo Freyre Roach in their book Transgnicos, qu se pierde? qu se gana? define it like this:

A GMO is an organism whose genetic information has been manipulated in laboratories, in a deliberate way, in order to confer one or more specific characteristics that make it behave differently to organisms of the same family, genus or species. They can be considered as new organisms that become part of the living beings who cohabit the planet. This fact has generated not a few ethical concerns regarding its biotic behavior and regulation.

Much has been written about the application of these GMOs in agriculture, their advantages and, above all, their dangers.1 In Cuba, opinions are divided, as in much of the world, among those who are for or against.

I summarize below a part of the history of GMOs in Cuba published in the aforementioned book:

From 2009 to the present its almost certain that much more has been done in this area, but I dont have that other part of the story.

Cuba opens door to GM crops amid food crisis

A revolution in yields?

Successive reports confirm that the yields of the most important varieties of genetically modified crops are lower or, at best, equal to the yields of traditional varieties. Several studies carried out between 1999 and 2007 undoubtedly reveal that soybean yields decreased between 4 and 12% compared to non-GMO soybeans, while Bt maize yields were up to 12% lower than those of conventional lines.

Up to 100% failures in Bt.21 cotton crops have been reported in India. Recent research from the University of Kansas shows just 10% average yield for Roundup Ready.22 soybeans, which also demands soil fertilization with manganese. Scientists from the United States Department of Agriculture (USDA) discovered at the University of Georgia that growing genetically modified corn in that country can lead to a drop in income of up to 40% .23.2

However, its true that in todays world, a decisive part of the raw materials used for the production of feed for pigs, poultry and cattle is produced from raw materials (genetically modified corn and soybeans) and, therefore, its also true that, in some way, Cubans and almost the entire world population today have become a great testing laboratory for those two great food producing? monsters Monsanto and Bayer,3 which have shifted their production systems to many third world countries due to the restrictions in developed countries to use GMOs and their accompanying technological package with its star product: glyphosate,4 a sad memory for the Vietnamese.5

Glyphosate is a 50 percent mixture of two herbicides with phenoxy groups: 2.4-D (2.4-dichlorodiphenoxyacetic acid) and 2.4.5-T (2.4.5-trichlorophenoxyacetic acid). These chemicals were widely used in the U.S. agricultural sector. Although the two herbicides break down fairly quickly, dioxin is a highly persistent compound that can remain in the environment for decades and cause cancer and other health problems.

For Monsanto6 and Bayer, the main objective is not to produce food, in the end GM corn and soybeans are only a means to increase their profits, an essential purpose of the company whose concern with world nutrition is very doubtful.

Its also true that Cubans have been eating chicken fed with GMOs for at least a decade and we are still here, alive and walking on this earth, without apparently something terrible happening to us, beyond the disappearance of GM chicken itself or not. I am not aware of any documented research examining the relationship between the increase in some diseases and the increase in consumption of GM foods in Cuba.

When presenting the decree law, Deputy Minister Armando Rodrguez Batista said: The essential thing is to incorporate the orderly and controlled use of genetically modified organisms (GMOs) in agricultural development programs as an alternative to develop productivity, consistent with sustainable agriculture and food sovereignty, based on local research.

According to the CITMA deputy minister: Cuba seeks to use this technology for sustainable development and not practices that in other contexts have had an environmental impact. Cuba can take advantage of the production and technological capacity it has, but doing so with an environmentally sustainable approach.

Achieving a positive synergy between the use of GMOs in agriculture and agricultural and environmental sustainability is in fact a very high goal which, if achieved, will be a relevant innovation on a global scale. Is it possible in Cuba to change the technological paradigm that accompanies GM crops on a world scale? Will we achieve seeds that dont require the massive use of glyphosate or amino glufosinate? So how is it possible to think that the use of GMOs in Cuban agriculture can be compatible with food sovereignty, environmental sustainability, nutritional quality, and local food production systems?

From the furrow to the table: removing obstacles and obstacle-makers in food production in Cuba

Cuban agriculture, that which must provide us with fresh and healthy agricultural products for our consumption and produce raw materials so that the national food industry provides us with other products, good and healthy, has several characteristics:

Analysis on the economic-social strategy approved by the Cuban government (II)

The reforms that the Cuban government has recently announced should, within a reasonable period of time, promote the change of these characteristics with the consequent benefits in terms of yield, productivity and production. Is it necessary, then, to use GMOs in Cuban agriculture?

The yields of Cuban varieties of maize and hybrids (non-GM) obtained by scientific institutions during the last 40 years have shown that they can be achieved in production conditions between 4 and 6 t/ha.10

Recently, in a meeting with scientists who are experts in issues related to food sovereignty, the importance of bioproducts was highlighted, something far removed from GMOs.

That Cuban science should investigate this topic, follow trends and document decision-makers as much as possible, is unquestionable, but I believe there is a distance that must be kept between the above and promoting the use of GMO technologies as a way to raise yields and agricultural production in Cuba, when there are other ways that generate much less uncertainty about human health and biodiversity in our country and that are far from having exhausted their technological borders.

What is a surprise is that she knows so little science that when she committed eco-terrorism against a "GM" sunflower field she didn't realize they were actually created using Mutagenesis. Which is not a GMO, it has been used for 2,000 different plants, many of them labeled organic. Eat organic lettuce? You're probably eating a genetically modified food, but since organic food activists need to think science began in 1998 to exempt their own products, they leave out awkward facts like that their organic strains were created using chemical and radiation baths to force mutations. If they ignore all genetic engineering they can argue that no science was involved in the creation of their goods.

These people are just goofy. If you think you see Jesus in your food, you are their target customer:

Gangneux is being lauded as a champion of the organic movement because she is willing to commit violence. Again, no surprise. But what is a surprise is that they read us and have started to notice that mutagenesis is science; just different science than GMO or RNAi or CRISPR-Cas9. We have criticized organic industry trade groups for 13 years due to their hypocrisy in putting Non-GMO Project and USDA Organic labels on foods they know were created using a precursor to GMOs; the less precise mutagenesis that transgenes made safer and better.

GMOs literally made impossible the Frankenfoods that mutagenesis or, worse, all natural high-energy cosmic rays in the environment, could allow. And with the battle in Europe against GMOs won or lost, depending on who you ask, they need to find new fields to destroy or else eNGOs and organic food lobbying groups are out of business.

To rationalize terrorism, these groups need to call mutagenesis "new GMOs", as they did with the VrTH sunflowers they ransacked for a publicity stunt. Even though they are using a process common since the 1950s, again with 2,000 plants that can all be considered organic.

Terrorists are never the most literate lot. You don't strap suicide bombs onto your best and brightest. Russian influence in Europe encourages these modern day "useful idiots", because agriculture is one of their largest exports. And with a wave of a pen declaring almost all of their food is "organic" - no outside verification allowed - Russia wants to block its competition in Europe so they can prosper from the label they gave themselves. They love people like Gangneux, Russia Today and Sputnik are probably retweeting articles about her right now. But it's still a criminal act, if Europe would stand against violence the way they stand against science.

Advances in gene editing technology and improved access via the web have substantially increased the prevalence of engineered organisms in our world. Benefits range from pest-free crops to reduction in the spread of infectious diseases, but along with these advantages comes a need to identify good bioengineering from the kind that might pose a threat.

To address this challenge, the Office of the Director of National Intelligence (ODNI) has contracted with Draper to develop new kinds of detection systems that can identify whether engineered organisms have been created from natural organisms. Officials at ODNIs Intelligence Advanced Research Projects Activity (IARPA) have awarded Draper a two-year Phase 2 contract under its Finding Engineering-Linked Indicators (FELIX) program, for a total contract value worth $7.8 million.

The award calls for Draper to continue development of two distinct lab-based genetic tests, custom bioinformatics pipelines that contextualize DNA sequencing data, and miniaturized microarray hardware with a specialized design. The devicesmaller than a postage stampallows multiple rounds of genetic tests on any organism, from a broad variety of sources including soil and water. Potential applications include biothreat detection, environmental monitoring and food inspection.

The microarray can be equipped with up to 10,000 surface probes to help identify genetic engineering. The device and associated lab methods combined are sensitive enough to pick out a ratio of a single engineered organism against a complex environmental background containing millions of natural organismsa signal-to-noise ratio that is a significant improvement over current methods.

Kirsty McFarland, molecular microbiologist and Principal Investigator on Drapers FELIX program, says the technologies under development will be able to detect genetic signatures that are not accessible with current technologies. Current methods for detecting engineered organisms, in soil for example, read only a subset of all the genetic material thats present in the sample, typically through next-generation sequencing. That process inherently misses information and does not reveal important genetic context, she said. She noted that one gram of soil may contain up to one billion microbial genomes.

To accompany each genetic identification system, Draper also developed two custom bioinformatics tools, which include a computational pipeline and visual dashboard that convert lab data into actionable intelligence that users can see on a computer screen.

Macau pulls the plug on staycation promotions – CalvinAyre.com

In an effort to promote local tourism and get its commercial activity rolling again, Macau announced a couple of weeks ago a series of initiatives designed to reward those who got out and about around town. Things like local tourism routes and even, in some cases, spending vouchers were introduced and, at first glance, appeared to be helping boost domestic spending. Some of these staycation incentives, though, might not be around for long, though, as the city most famous for its casinos is said to be backing off a plan that would have included stays at area casino resorts, according to GGRAsia.

Macau has reportedly earmarked just over $35 million to spend on various products related to staycation and domestic spending, with the Macao Government Tourist Office (MGTO) overseeing the programs. The initiative established a long list of included activities, one of which would have been staycations at area hotels through the use of vouchers or other incentives. The program officially kicked off last month and is set to run through the end of September, with August being the month chosen for the casino resort promotion.

According to the director of the MGTO, Maria Helena de Senna Fernandes, the decision to remove the staycation promos stems from the fact that they would have been redundant. She explained during a recent event, I think most large-scale hotels have already been selling some [staycation] packages, and even at very favourable rates. So, at this stage, the Macau government does not need to allocate public resources on a staycation programme.

Its also possible that there had been backlash received over the idea of the government given incentives for locals to hit the slot machines and gaming tables. While there wasnt any official statement to that effect, the idea of using what amounts to public money to allow people to gamble may not have been seen as a smart move. However, it had never been made clear whether or not public funds would have been used for the scheme.

The MGTOs local tourism initiatives are being sponsored by the Macao Foundation, a public entity that is partially funded through gaming taxes, and organized with the help of the Travel Industry Council of Macau, the Association of Macao Tourist Agents and the Macau Travel Agency Association. Since the Macau Foundation is also funded through means other than gaming taxes, the link between public money and gambling funding is tenuous at best.

The local tours will still include trips to the casino resorts, but primarily to visit non-gaming facilities. Among the stops on the tours are places like the backstage area of the House of Dancing Water show at City of Dreams Macau, the digital interactive art display at the Venetian Macao and more.

54000 seniors to get cash injection on 21 August – Macau News

The Social Security Fund (FSS) said on Tuesday that about 54,000 senior citizens will have the money from the governments annual cash injection into their Central Provident Fund accounts transferred into their bank accounts on 21 August.

The 54,000 senior citizens are those who are eligible to receive this years cash injection and had registered for a new measure which was rolled out last year allowing them to automatically receive the annual payments in their bank accounts, starting from this year, without having to apply for the transfer every year.

Some 20,000 other residents are eligible to receive this years cash injection, comprising 1) senior citizens who did not register for the new measure last year, and 2) those who are not senior citizens but are eligible for this years cash injection due to various kinds of special reasons. They will have the money transferred into their bank accounts on 21 October, provided that they apply for the transfer between next month and September.

The Social Security Fund, which is headquartered on the 18thfloor of China Civil Plaza in Nape, made the announcement during a press conference in a pressroom on the 19thfloor of the building, where a number of service counters run by the Macau Trade and Investment Promotion Institute (IPIM) are located.

In 2010, the government started to deposit MOP 6,000 into the Central Provident Fund accounts of eligible permanent residents every year. The amount was raised to the current amount of MOP 7,000 in 2014.

The government opens a Central Provident Fund account for every local resident aged at least 18. The system of local residents Central Provident Fund accounts was initially regulated by a now-defunct law which came into force in 2012, which was replaced by the current law on the Non-mandatory Central Provident Fund system.

The citys Non-mandatory Central Provident Fund system was implemented on 1 January 2018.

According to the law, permanent local residents aged at least 22 who stay in Macao for at least 183 days a year are eligible to receive the annual amount injected by the government into their Central Provident Fund accounts. The annual cash injections are officially known as extraordinary budget surplus allotments.

The Social Security Fund announces in June every year a list of permanent residents who are eligible to receive the annual cash injection for the particular year i.e. those who reached the age of 22 by the end of the previous year and stayed in Macao for at least 183 days in the previous year.

Before the new measure, residents aged at least 65 who had been added to the annually updated list could apply to withdraw the annual cash injection for that year, and after the Social Security Fund approved the respective applications, the money was then deposited into their bank accounts.

TikTok says ‘we are not the enemy’ – Macau Business

TikTok pushed back Wednesday at what it called maligning attacks by Facebook as the fast-growing video-sharing app claimed it helps competition in the US market.

The comments by TikTok came hours ahead of a hotly anticipated antitrust hearing with the top executives of Facebook and three other Big Tech firms, and amid suggestions the app may be banned due to its connections to China.

TiKTok welcomes fair competition chief executive Kevin Mayer said in a blog post, while adding that without TikTok, American advertisers would again be left with few choices.

He added: Lets focus our energies on fair and open competition in service of our consumers, rather than maligning attacks by our competitor namely Facebook disguised as patriotism and designed to put an end to our very presence in the US.

The comments appeared to respond to claims by Facebook CEO last year that TikTok had censored information about protests in China, the home of TikTok parent firm ByteDance.

TikTok, which has grown its user base to an estimated one billion, is striving to show that we are responsible and committed members of the American community, according to Mayer, who pledged more transparency from the platform.

With our success comes responsibility and accountability, he said.

The entire industry has received scrutiny, and rightly so. Yet, we have received even more scrutiny due to the companys Chinese origins. We accept this and embrace the challenge of giving peace of mind through greater transparency and accountability.

Mayer said TikTok has established a policy on transparency and added that we believe all companies should disclose their algorithms, moderation policies, and data flows to regulators.

He repeated the companys claims that it has no ties to the Chinese government, after TikTok was banned in India and US officials said they were looking at potential actions against it.

We are not political, we do not accept political advertising and have no agenda our only objective is to remain a vibrant, dynamic platform for everyone to enjoy, he said.

TikTok has become the latest target, but we are not the enemy.

Retired teacher loses over RM1mil in Macau scam – The Star Online

PETALING JAYA: A 71-year-old retired teacher lost about RM1.06mil to a Macau scam recently.

Petaling JAYA OCPD Asst Comm Nik Ezanee Mohd Faisal said the woman received a call on May 25 supposedly from a Pos Laju company that a parcel under her name was sent from Kepong to Kota Kinabalu.

"The caller alleged that the package was filled with contraband items.

"The call was then transferred to another scammer posing as "Sjn Chong" from Kota Kinabalu.

"The scammer said the victim was being investigated and warned her not to tell anyone or risk prosecution for money laundering," he told a press conference on Monday (July 27).

The victim transferred RM1.06mil of her life savings into ten bank accounts, he added.

"The transactions were made from June 15 until July 23.

"After realising that she has been duped, the victim lodged a police report," ACP Nik Ezanee said.

The Petaling Jaya Commercial Crime Investigation Department has already detected a few accounts used in the scam.

"We will investigate further.

"We believe such scammers often target senior citizens and retirees," he added.

ACP Nik Ezanee advised the public not to release any banking details to anyone.

"Always double-check with police or family members before taking action by transferring funds to these scammers.

"Always stay vigilant and be careful not to be duped by them," he said.

US to withdraw 11900 troops from Germany – Macau Business

The United States will slash its military presence in Germany by 11,900 troops in what the Pentagon on Wednesday called a strategic repositioning but President Donald Trump said was to punish Berlin for its weak defense spending.

US Defense Secretary Mark Esper said that the Pentagon will be sending home about 6,400 of its military personnel in Germany, and move nearly 5,600 to other NATO countries, including Italy and Belgium.

Some could also be relocated to Poland and the Baltic countries if Washington can reach agreements with them, he said.

The move, which will cost the US government several billion dollars, will cut the presence of US military personnel in Germany to around 24,000, Esper said.

He stressed that the action is part of his broader plan to reposition US military forces around the world to better address key threats and enhance flexibility, including with the NATO alliance, which is focused on deterring a possible Russian threat to Europe.

But at the White House Trump told reporters that Germany has not paid its fair share for the defense of Europe.

They are there to protect Europe, they are there to protect Germany, and Germany is supposed to pay for it, Trump said of the troops.

We dont want to be the suckers anymore. Were protecting Germany, so were reducing the force because theyre not paying the bills.

In moves that could begin within weeks, some US command operations currently in Germany will be moved to Belgium and Italy, where they will be located with their NATO counterparts, Esper said.

This will strengthen NATO and improve the operational efficiency and readiness of over 2,000 (US) service members, he said.

The planned relocation of 2,500 US air force personnel from Britain to Germany has been cancelled.

The Pentagon also will move an F-16 fighter squadron from Germany to Italy, closer to the Black Sea area where they can protect NATOs southeastern region, he said.

Another command unit and US troops could be rotated into Poland, Esper said, if Warsaw signs a defense cooperation and burden-sharing agreement crafted by Trump and Polish President Andrzej Duda in June.

The repositioning of our forces in Europe constitutes a major strategic and positive shift, Esper said.

These changes will unquestionably achieve the core principles of enhancing US and NATO deterrence of Russia; strengthening NATO; reassuring allies; and, improving US strategic flexibility, he said.

The goal is to enhance deterrence and reassure allies along NATOs southeastern flank, Esper said.

The move could have a significant economic and strategic impact in Germany, where tens of thousands of US troops have been stationed since the end of World War II.

Earlier this month, the leaders of four German states urged the US Congress to block the troop reduction, warning it could weaken the Atlantic alliances front against Moscow.

Esper said the move was long-discussed and was not the result of President Donald Trumps unhappiness with the relationship between Washington and Berlin.

Trump abruptly announced plans for the cut in June amid rising political and trade tensions between the two countries.

That came after German Chancellor Angela Merkel rejected Trumps plan to convene the Group of Seven leaders in Washington, citing the ongoing coronavirus threat. At the time, Trump maintained the virus spread was in decline.

Angered, Trump postponed the summit and then said he would expand the group to include Russian President Vladimir Putin.

Russia was expelled from the elite group after its seizure of Ukraines Crimea region on the Black Sea in 2014.

Federal violence against protesters in Portland, Oregon, has escalated this week, with federal officers in military gear and helmets using batons and tear gas against protesting moms late on Tuesday night. Throughout the past week, uninvited and heavily militarized Customs and Border Protection agents have been violently seizing and detaining protesters. On Monday, the president promised to expand this operation to Chicago and other majority-Democrat cities. CBP agents are normally tasked with policing the border. So why are they in our cities, potentially violating the First, Fourth, and Fifth amendment rights of Portlanders in ways that clearly have nothing to do with enforcing immigration law? Unfortunately, court decisions created loopholes that have emboldened CBPs lawless behavior against undocumented immigrants at the border, abuses that are now being exported into the interior of the country against American citizens by President Donald Trump.

The White House has deployed the Border Patrol, claiming that their presence is needed to protect court buildings and monuments, and enforce criminal law in American cities. The CBP is normally tasked with enforcing immigration law and apprehending undocumented migrants. It is unclear why the White House enlisted CBP in the current mission. CBP and the Department of Homeland Security more broadly are better-funded than interior federal law enforcement agencies, like the FBI. However, CBP has a very different mandate and culture. The tactics that are now being decried as indicative of fascism or authoritarianism have been deployed by the CBP for years. The authorization of federal authorities in a realm that is generally in the purview of state and local law enforcement may be a symbolic show of federal force and its unclear what these actions are meant to achieve other than dangerous political theater.

After Sept. 11, when immigration, and specifically the Southern border, began to be portrayed as a national security threat, the border became increasingly militarized and the agencys influence grew exponentially. An expansive definition of terrorism helped justify the agencys doubling in size from 2003 to 2019, along with its budget. In 2020, the CBP budget was $18.2 billion, a nearly 20 percent increase from just 2019 and triple what it was in 2003.

Ordinarily, the CBP works primarily in the border regiontheir normal statutory authority is confined to within 100 miles of the borders of the United States. Critically, federal courts have had a tendency to view the border as a place where the Constitution works differently. Its also important to note that CBP officers normally enforce civil immigration law, not criminal law. Constitutional protections also work differently when it comes to enforcing civil law, with one hallmark being less robust procedural protections.Further, the targets for CBP officers are most often undocumented migrants, many of whom either just entered the United States or are seeking entry into the United States.

The border that CBP patrols has been given a different constitutional status, especially with respect to the Fourth Amendment. And it is the Fourth Amendment that is most implicated by federal agents detaining protestors and putting them into vans for interrogation. Suspicion-less stops and seizures forbidden elsewhere have been accepted by both travelers and courts when they occur near the border. These ordinarily occur at border checkpoints, but CBP has taken wide latitude in extending those checkpoints nearly anywhere within 100 miles of the U.S. border, a vast space that includes many major U.S. cities along both American coastlines and the Northern and Southern borders. The Supreme Court has even gone so far as to explicitly allow for racial profiling at the border, and the agency itself was exempt when theObama Justice Department tried to ban racial profiling by law enforcement.

Because the CBP engages in civil immigration enforcement, many of the protections that the public takes for granted under criminal law simply have not applied to their interactions with undocumented immigrants. Judicial warrants are not needed for arrests, and Miranda warnings are rarely, if ever, provided.

Sadly, the Supreme Court itself just this term indicated that undocumented migrants who recently crossed the border have fewer due process rights, with the court denying the right of habeas corpus to asylum-seekers who complain of an unconstitutional process. Even before this decision, some federal district courts ruled undocumented migrants do not have Fourth Amendment rights at all.

What may be most disturbing is how difficult it has been to hold the agency accountable even when it does violate the law.Earlier in the term that just ended, the Supreme Court ruled that a CBP agent could not be sued civilly, even when an officer shot and killed a teenager in cold blood across the Mexican border. The court ruled that the CBP officers constitutional violation had no remedy under the law. While a police officer could be sued under a section of federal law known as Section 1983, no such mechanism existed for the Mexican parents of the murdered teenager.

The CBP has enjoyed legal authority to treat people and communities at the border with force untethered from the Constitution and without legal accountability. It is tragic, but perhaps unsurprising, that they are now conducting themselves in the same reckless and lawless manner in our cities and against people who are accustomed to constitutional protections. As outrage over these tactics used against protesters grow, the public should demand these practices be ended everywhere, including at the border.

Back in early June, there was considerable outrage over the idea of using the military to conduct what are essentially police operations and crowd control. The use of the CBP is perhaps an even worse alternative. The federal police power was viewed with caution by the founders, and federal authority to police crime has wisely been limited in scope and has required explicit congressional authorization. The 10th Amendment of the Constitution specifically designates all powers not designated to the federal government to the states and localities, and police powers have always been deemed to be the strict purview of state and county criminal law enforcement agencies.

Whether the conscription of the CBP to engage in law enforcement in our cities is lawful will be an issue the courts will answer, but in the meantime, the practical implications of this choice will be felt by city residents confronted by officers from the Border Patrol, untrained and unused to being held accountable.

As Yale historian Timothy Snyder, the author of On Tyranny: Twenty Lessons From the Twentieth Century, told the New York Times Michelle Goldberg: This is a classic way that violence happens in authoritarian regime . When fascistic escalations have happened in the past, the people who are getting used to committing violence on the border are then brought in to commit violence against people in the interior.

Perhaps instead of bringing the borderand its lawlessnessto our cities, we should bring democratic rule of law and constitutional rights to the border.

Trump, Law Enforcement, and the Return of the Agent Provocateur – International Policy Digest

There are a lot of problems constitutionally and politically with President Trump sending federal forces into places such asPortland, Oregon, or Chicago, Illinois allegedly to restore order. Overlooked in most stories are how these federal agents represent the return of the agent provocateur as a tool of politics.

Start with the basics. Trump issued an executive order declaring authority to send in federal agents to cities and states in order to restore order. Constitutionally there are numerous problems here. No one will argue that the federal government doesnt have the authority to protect its facilities such as courthouses. Inherent within Article II of the Constitutioneither section one which vests executive power in the president or section three which says the president shall take care that the laws shall be faithfully executedone can find ample authority to do that.

However, remember that the U.S. Constitution is a power-conferring document. There is no inherent federal or presidential authorityall of it must be traced back ultimately to some text in the Constitution. Among the powers that the U.S. government does not have is general police power. By that, states have broad authority to enact laws to protect the health, safety, welfare, and morals of the people. The police power is also what gives states the general authority to pass criminal laws and take enforcement actions to maintain law and order. Because of this authority states and, when delegated to them, cities can create police departments.

There is no federal equivalent. There is no Federales or national police force in the U.S. as there are in many other countries. Not even the Insurrection Act of 1807 allows for that, contrary to what the president asserts. Any federal crimes or law enforcement must trace back to the Commerce or perhaps another constitutional clause. The U.S. government has no general criminal law jurisdiction or authority, especially at the state and local level. On top of that, the Posse Comitatus Act of 1878 bans the use of federal troops for law enforcement purposes, reinforcing the notion that general policing is an issue for state and local governments according to the Tenth Amendment.

But even though the U.S. government lacks general policing authority, it is possible for them to intervene when requested by states or cities. However, that is not the case with Portland or Chicago. Trump is directing unnamed or marked federal agents to be deployed there, often without the knowledge and certainly against the request of local officials. There is no constitutional authority to do that. Finally, to the extent that these federal agents are simply arresting or roughing up peaceful protestors raises critical First Amendment questions, and if they are questioning them without advising them of their rights, there may also be Fifth Amendment issues. Overall, there are many problems from a legal perspective here.

Of course, Trumps motives appear not legitimately law enforcement. Post-George Floyd and the riots that occurred, the president is running a redux of the 1968 Richard Nixon law and order campaign, playing on the racial fears and anxieties of whites who saw the race riots of 1967 across the nation. It is also a diversionary tactic to take away attention from his mishandling of the coronavirus and the economy.

But the playbook is even worse. These federal law enforcement personnel are the new agent provocateursa person who intentionally encourages people to do something illegal. The term comes from nineteenth-century France and the Soviet Russia period where the government used plains-clothes police to incite the opposition to break the law. This is Trumps tactic. Take a tense situation such as a Black Lives Matter demonstration and send in plainclothes federal agents to arrest, question, and rough up. Also, do it without local authorities knowing what is going on. The recipe here is to inflame, giving the president a manufactured crisis in which he can show force to appease his base. It is 1968 Chicago, and Mayor Daley all over again, with Trump hoping that the American public will react in the same way and go with the law and order candidate one more time.

Four years ago, Trump declared immigrants to be the enemies from which he would protect us. Now the enemies are internal and like four years ago when he fabricated legitimate immigrants and refugees into caravans of rapists and murders at Americas door, he now is trying to convert legitimate protests into threats on America with agent provocateurs.

In commemoration of UTDallas 50th anniversary, the fourth annual Comets Giving Day will last 1,969 minutes from Aug. 5 at 10 a.m. until Aug. 6 at 6:49 p.m. More than 50 campus groups will participate in the extended day of giving with a challenge to raise $1 million.

In 1969 the 61stTexas Legislature passed House Bill 303, establishing a state-supported institution of higher education to be known as The University of Texas at Dallas.

We began this year celebrating everything thats made UTDallas great for the past half-century. The resilience and caring shown by our community over the last few months have demonstrated just how great we really are. The comet is just a bit fainter than magnitude 2 and youll likely need binoculars or a small telescope to see it. But with optical aid, you should also spot the comets tail, which stands out best in photographs. NEOWISE recently passed Earth on July 23, when it was just 64.1 million miles (103.2 million kilometers) from our planet. As it continues to pull away from the Sun and Earths orbit, it will continue to dim, although observers can expect to enjoy this binocular object for at least the rest of the month.

Saturday, July 25The Moon reaches perigee, the closest point in its orbit around Earth, at 1:02 A.M. EDT. At that time, it will stand 228,889 miles (368,361 kilometers) from our planet. Tonight, our satellite is a 34-percent-lit waxing crescent in Virgo. Youll find it about one-third of the way on a line drawn from magnitude 1 Spica northwest toward magnitude 2.1 Denebola, the tail of Leo the Lion.

Look about 28.5 above the Moon to see another bright star: magnitude 0.1 Arcturus, Botes alpha star. Scan farther northwest to find the familiar Big Dipper asterism, which is part of a much larger constellation: Ursa Major the Great Bear.

Sunday, July 26Observers willing to brave the wee hours of the morning will be rewarded with a dark, moonless sky today. If its particularly clear, consider searching out the Dumbbell Nebula (M27), located in Vulpecula the Fox. This planetary nebula the result of an aging Sun-like star puffing away its outer layers late in life was discovered by Charles Messier in 1764. Youll find it amidst the dusty plane of the Milky Way, which is standing straight up from the southwestern horizon around 2 A.M. EDT. At that time, M27 is roughly 70 high and, although its a bit challenging with binoculars, a small scope will easily show it. A larger scope will bring out more detail. Most telescopes should reveal the nebulas bi-lobed structure, from which it gains its name.

Nearby is open star cluster NGC 6885 (Caldwell 37). This magnitude 6 cluster is roughly 7' across and can sometimes be seen barely with the naked eye. Its an excellent binocular or telescope target. Youll find it less than 5 north-northeast of M27.

Monday, July 27First Quarter Moon occurs at 8:33 A.M. EDT, making this evening is an excellent time to consider some lunar observing. With moonrise occurring in the afternoon, the Moon will still be high in the south at sunset and wont set until after midnight. Even a small telescope or pair of binoculars will bring out immense detail on our satellites face, which appears to observers on Earth as half in daylight and half in darkness during this phase. The line dividing the two is called the terminator, and its an excellent starting point for your observing campaign. HLRB hears temporary workweek trial – Thegardenisland.com

LIHUE County of Kauai Managing Director Michael Dahilig testified that the temporary four-day, 10-hour work schedule was an operational decision necessary to reduce movement and the spread of coronavirus yesterday in a Hawaii Labor Relations Board hearing on merits via Zoom.

The board heard opening statements and from two witnesses in Hawaii Government Employees Association v. Mayor Derek Kawakami of Kauai.

In May, HGEA filed a prohibited-practices complaint against the county with the board. Now, HGEA must prove that the county willfully and intentionally violated collective-bargaining laws in Chapter 89, Hawaii Revised Statutes, which states the county must consult and negotiate provisions affecting changing employee work conditions and work toward a mutual consent and agreement by changing to a temporary four-day, 10-hour workweek.

Stacy Moniz, Advocacy Chief for the HGEA, argued that a change from a five-day, eight-hour workweek to a modified four-day, 10-hour day changes working conditions, overtime and work hours was made without merit, formal negotiations and mutual consent and agreement on these terms.

In opening statements, Deputy County Attorney Mark Bradbury argued the county did not act in willful defiance and did engage in discussion with HGEA and took its considerations into account and added an exemption process, but that HGEA wanted more negotiations.

Bradbury said the county administration had to act swiftly in the face of the pandemic, consulted Chapter 89 and statewide emergency orders, and found the temporary modified schedule was reasonable to mitigate the spread coronavirus by up to 20%, for about 400 county employees, and limiting interaction with other residents. Moniz argued there is no scientific evidence of this. The county cited stay-at-home orders and recommendations from the Centers for Disease Control and Prevention urging social distancing.

The county contacted HGEA regarding the temporary work schedule on April 16 and sent proposals of the temporary work schedule. The county also pushed back the implementation of the schedule from April 27 to May 4 to allow HGEA time to reach out to members, but that wasnt enough time or formally negotiated, according to the union.

Kaulana Finn, Kauai division chief for HGEA, testified that the county has gone through similar negotiations before and the processes were laid out.

In August 2019, the county approached HGEA about moving to a 9-80 work schedule, which would require eight nine-hour days, one eight-hour day then one day off in a 14-day cycle. HGEA reached out to members, and reported an overwhelmingly negative reception to this.

Moniz said negotiations with the county and HGEA took place recently to change Ocean Safety Bureau members to a four-day, 10-hour work schedule, effective June 25 of this year.

The county has since gone back to a 5-day work week, with employees working eight hours Monday through Friday. But some employees, notably in the Finance Department, requested continuing the 4-10.

These employees have since signed agreements with HGEA and the county to remain on this schedule. Negotiations lasted about a week and were signed Tuesday, according to Moniz.

Dahilig said he was not intimately aware of these most recent discussions and if discussions last August were done incorrectly.

Last week, the board ruled that Iges emergency proclamations did not suspend HRS Chapter 89 in its entirety. The board also ruled that this trial will be bifurcated, meaning it would be split between Chapter 89 and the merits of Chapter 127A, if the board moves in that direction.

Were not against the idea of modifying work schedules so long as the parties mutually agree to the terms and conditions of the modified work schedule; but, were strongly opposed to the way this administration refused to bargain and unilaterally implemented changes on county employees which violated their collective bargaining agreements, HGEA said in a statement last week.

HLRB will continue the hearings on case no. 20-CE-03-946a-c Wednesday morning.

Broadway Stages: When will the Staten Island film studio reopen? – SILive.com

STATEN ISLAND, N.Y. -- Much like everything else, the world of filming came to a halt during the coronavirus (COVID-19) pandemic.

With New York City now in Phase 4, Broadway Stages is looking to slowly get back to work.

The film studios borough location at the former Arthur Kill Correctional Facility in Charleston closed its doors at the beginning of the pandemic and the parking lot is still roped off to the public. When asked when it would reopen, Broadway Stages personnel said that staff will likely resume work around September.

Despite the approximate timeline, representatives said it is still finalizing details with film studios and production companies to bring future projects to Staten Island.

In addition to Staten Island, Broadway Stages has locations in Brooklyn and Queens. According to the Hollywood Reporter, productions that film at Brooklyn Broadway Stages -- namely CBSs Blue Bloods -- will incorporate germ-zapping disinfecting robots to ensure safety on set. Broadway Stages representatives say the Staten Island location will not receive the same treatment.

Broadway Stages is continuing to follow protocol and recommendations of the CDC in ensuring the health and safety of the crew at each stage and we will continue to do so going forward, a representative wrote to the Advance/SILive.com. However, these robots are the decisions of each production, not Broadway Stages.

COMING SOON: ANOTHER STAGE?

Broadway Stages said it is on track to build several more stages and studio facilities on the Charleston property. The pandemic has reportedly slowed construction work on the site, but plans to continue soundstage production are moving ahead in the coming weeks.

Broadway Stages Charleston location will reportedly open at the same time as its Brooklyn and Queens facilities. CDC guidelines will be followed once it does, such as limiting the personnel on set, proper distancing and operation sanitizing.

We will have whatever sanitizing and protection are needed, even more than required, and we will be following the best practices guidelines for all work being conducted in order to keep our staff, film crews, actors and our facilities safe, a representative wrote. We want people safe and for work to begin and continue, so we will be ready to make sure they are and it does.

THE BACKSTORY OF S.I.s BROADWAY STAGES

Staten Islands Broadway Stages location is an offshoot of the thriving production studios based in Brooklyn, where they film everything from Veep and Broad City to The Marvelous Mrs. Maisel and Marvels The Defenders.

It took years to get cameras rolling at Broadway Stages on Staten Island.

When the state selected Broadway Stages to develop the land in 2014, company founder Tony Argento predicted that Broadway Stages could build the five sound stages and open the studio in just a few months.

The state finally sold the former prison site to Broadway Stages in August 2017.

Broadway Stages had invested at least $2 million in the property even before the deal went through. The money has been spent on security, utility service and general maintenance. The company planned on revamping parts of the prison for the additional sound stages, while keeping other areas intact to give films and TV shows that authentic prison backdrop.

Broadway Stages is located at 2911 Arthur Kill Road. In 2018, it welcomed Netflix titles The Good Cop, a dramedy crime series starring Josh Groban and Tony Danza; Marvels Daredevil, and Orange Is The New Black.

2 additional Staten Island library branches will reopen Aug. 3 – SILive.com

STATEN ISLAND, N.Y. -- Two additional Staten Island library branches will reopen for grab-and-go service on Monday, Aug. 3.

The New York Public Library (NYPL) announced that it will reopen 22 additional neighborhoods for limited, grab-and-go service -- expanding its initial opening of eight branches on July 13.

With these additional locations -- which were temporarily closed since March 16 due to the coronavirus (COVID-19) -- the NYPL system will have 30 branches open for grab-and-go service.

On Staten Island, New Dorp Library and Stapleton Library will reopen Monday -- joining the already open Richmondtown Library and Todt HillWesterleigh Library.

The reopenings expand on the 22 total branches that the NYPL, Brooklyn Public Library (BPL) and Queens Public Library (QPL) reopened July 13 across the five boroughs with guidelines patrons must follow during the ongoing coronavirus (COVID-19) pandemic.

The Queens Public Library will reopen eight more branches for to-go service on Monday, Aug. 10 -- increasing the total number of open branches to 15. The Brooklyn Public Library plans to reopen more branches Aug. 10, but those locations have not yet been announced.

The citys libraries will reopen in phases to ensure a safe transition back for employees and visitors.

In the first phase of the library reopening plan, New Yorkers will be able to access a small area of the open branches to pick up and return checkouts placed online or on the phone, which will be a contactless process.

Guests must wear masks, physically distance from staff and other patrons, and respect capacity limits at open branches.

Patrons must leave the library as soon as their pick-ups or returns are complete. At this stage, there will be no browsing, in-person reference, or computer use.

Fines have been temporarily suspended for all items checked out before the temporary closure or during phase one of the reopening. At NYPL, fines will not accrue until Oct. 1 at the earliest.

Patrons can continue to access programming, e-books, research databases, classes, and more virtually, via enhanced digital offerings that will remain in place. For now, in-person programs and classes will not be held in branches.

The NYPL said it is taking precautionary cleaning measures and making a few accommodations for patron accounts during this period of service. Each open library will undergo enhanced cleaning protocols and will have equipment, such as sneeze guards, installed. All returned materials will be quarantined for 72 hours, per expert recommendations.

New Yorkers with NYPL digital library cards -- which are usually only able to check out digital materials -- will be able to use them to check out physical materials.

All three systems are working toward opening more branches and adding services in a safe and thoughtful manner in later phases of the citys reopening.

How This N.Y. Island Went From Tourist Hot Spot to Emergency Garden – The New York Times

This was supposed to be the busiest summer yet for Governors Island. After 15 years of careful redevelopment, a semi-abandoned isle off the southern tip of Manhattan had blossomed into a lush day-trip destination.

There were plans for a new tram, ferries designed to shuttle in a thousand people at a time, and field trips for hundreds of city children to scramble around a one-acre teaching garden on the islands southeastern shore, one of its last unrenovated parcels. Then the city shut down.

Now its crazy quiet, said Shawn Connell, who manages the seven-year-old garden on behalf of the environmental organization GrowNYC. You can hear the water and the boats.

It was just before noon one recent weekday, and his three seasonal staffers were packing pints of berries, tying beets into bunches and cooling down several hundred pounds of just-picked greens in the shade of a gazebo. All it of was headed to emergency food distributions in the Bronx, Harlem and central and eastern Brooklyn.

Those staffers were hired to wrangle students on field trips from April to November, but during lockdown they became farmhands. And they say the farm transformed them. If they couldnt use it to teach, they would use it help the one in four New Yorkers who now need food.

Mr. Connell and his team reimagined their mandate and converted their land with its fruit trees and its 50-foot demonstration farm rows into a victory garden for New York City.

Six months on, their shift has been so successful that it has changed their whole approach, and it even has the potential to alter the future of this piece of the island, perhaps to the dismay of any developers still hoping to turn it into a Hudson Yards in the harbor.

We were so preoccupied in past seasons by the work of engaging with these young people that we never gave much thought to producing food, said Mr. Connell, 37, one of a handful of people who ferry to work on the island year-round.

Most of what they grew was eaten by students, Mr. Connell said. Some was left to wither and die in order to show the life cycle of a plant.

We knew in past seasons wed been able to grow 10,000 pounds of food, and we thought, You know, thats a good number to shoot for, he said. Were certainly on track to produce more than that twice that, he added, and thats not even factoring in the extra beds planted this spring with squash and potatoes.

His staff also put out feelers to the network of organizations already connected to GrowNYC which also runs greenmarkets and builds community gardens to find neighborhood groups that were giving out food.

The Black Feminist Project in the southeastern Bronx, for example, was eager to work with the farm. Since June, the group has been taking deliveries every other week from the teaching farm 400-pound parcels with red-leaf lettuce, hand-tied sprays of basil, freshly picked eggplant. All of it goes to the free or low-cost coronavirus relief food boxes the group has been preparing for families in the area.

There is plenty of free food from other sources, said Tanya Fields, the groups founder, but it usually arrives in cans or boxes, lacking in both nutrients and in dignity. There is this belief that when we provide things to working-class people, Ms. Fields said, they should just be happy with what they get.

The quality of the produce from the garden on Governors Island, she maintains, is better than the food you find at a farmers market.

The collard greens are big and beautiful and abundant and green and not full of holes, said Ms. Fields. The mint was like Ive not seen mint like that except when were growing it. People, particularly older people, they recognize how fresh it is as well. It triggers memories for them of being in Puerto Rico or the Dominican Republic, or folks who did subsistence farming down South.

Margaret Chin, a city councilwoman whose Lower Manhattan district includes Governors Island, has seen similar reactions from her constituents when theyve received extra produce from the island.

Some have even grown their own at a public garden run by Earth Matter, a composting organization on Governors Island that is also donating everything its growing this year, most of it to Lower Manhattan soup kitchens in Ms. Chins district.

The city really needs to look at, how do we look at this, how do we use urban agriculture? said Ms. Chin, who also sits on the board of the Trust for Governors Island, which manages the land.

Theres money for emergency food, she added. How can we use some of that money to support fresh produce?

The United States Department of Agriculture has already made a move in that direction: In May, it announced $3 million in grants to support urban agriculture projects this year.

That urban farming is being considered as a way to feed large numbers of New Yorkers is a big shift, even to urban growers like Mr. Connell, who has been able to hire an extra employee this summer through city funds for emergency food distribution.

Until the pandemic, he always believed the best use of large city farm projects was education, because that reaches the largest number of people.

This kind of turned that on its head, he added.

Everything has changed for Mr. Connell: When students do return, he has decided that his staff will continue to produce as much food as they can on their acre, which still has room to expand. And in addition to lesson plans built around an appreciation of the environment and where food comes from, Mr. Connell is also going to teach students how and why to grow produce.

Before the pandemic, the future of Governors Island looked a lot less agrarian. In addition to hosting a growing glamping scene and huge parties like Pinknic, the Trust for Governors Island has been actively searching for income-generating real estate developers for its last two undeveloped parcels.

One of those is the half-empty 26-acre plot with a row of crumbling old residential buildings once called Brick Village. This is where Earth Matter and GrowNYC lease about three acres of space.

James Yolles, a spokesman for the Trust for Governors Island, said that both organizations which share a crescent-shaped piece of land the trust calls the Urban Farm will be a part of the islands future. We are committed to providing space for both of them on the island for the long term, regardless of any development plans, he wrote in an email.

Last week, the trust finally reopened Governors Island to the public. People can tour the garden in small groups at set times on weekends.

After months alone in the fields, Mr. Connell and his farmers at last had a few curious visitors to show around. But he still misses his kids.

One of my greatest regrets about this season, he said, is that as the teaching garden literally blossoms in ways it never has before, our students arent able to be here with us to see the impact that this little sliver of New York City soil is having.
