MYRTLE BEACH As businesses continue to close due to the COVID-19 pandemic putting a strain on the local economy, Drift Eatery owners confidently decided to move forward with opening toward the end of 2020, and business has remained steady.

The breakfast and lunch spot, at 980 A-6 Cipriana Dr. in Myrtle Beach, has a menu featuring classic breakfast meals, like shrimp and grits and chicken and waffles, along with signature omelets and breakfast sandwiches. For lunch, the eatery offers dishes including soups and salads as well as grilled pork belly, ahi tuna and duck leg confit.

"We integrate the menu with different flavors and options that you may not see at other places," said Carlos Ramirez, an owner of Drift. "We try to manage the best quality of coffee thats available. We try to incorporate the brunch style with mimosas."

Drift opened in October, about seven months after the pandemic began to impact the Myrtle Beach area.

"We were a little nervous in the building to be honest, but at the same time, we were confident that we could get all that support," he said, adding many owners have been in the Myrtle Beach area restaurant industry for decades. Now, about three months into business, Ramirez said business has remained steady.

Ramirez said the restaurant focuses on three aspects: friendly service, quality food and being affordable.

"Being consistent is key," he said.

The setting inside the restaurant has a coastal theme, with blues and greens, as well as natural wood.

Ramirez said the owners are hoping to extend hours and offer dinner at some point later this year.

Gios Italian Kitchen in Myrtle Beach opened in the fall at 7915 North Kings Highway. The restaurants first location is in Pawleys Island. Its menu features a variety of dishes including escargot genovese and burrata caprese as appetizers and pasta dishes like quattro formaggio and paglia el fieno.

Chubbys Taco, the first location in South Carolina, recently opened in Carolina Forest. Its located at 201 Fresh Dr. Suite A. The menu offers chicken, beef, pork, seafood and vegetarian tacos, as well as burritos, quesadillas and fajitas.

BoCo Bistro, at 1035 Third Ave. in Conway, offers happy hour from 4 to 7 p.m. Monday-Saturday, as well as lunch and dinner menus. From loaded nachos to handhelds to country fried chicken, BoCo has a range of dishes for lunch and dinner.

Chantis, at 104b Laurel St. in Conway, specializes in pizza and also offers salads, sandwiches and starters.

Two Flagler Beach Residents Arrested After Refusing to Comply With Mask Mandate at Commission Meeting – FlaglerLive.com

In a first at a local government meeting, two Flagler Beach residents were arrested Thursday evening after defiantly delaying a Flagler Beach City Commission meeting for 12 minutes, refusing to don a mask, in accordance with a city ordinance, and refusing to leave the commission room on their own. They were not arrested for a mask violation, but for trespassing after warnings.

Karen D. Streit, 67, and Michael Scott Streit, 64, residents of Oak Place in Flagler Beach, were charged with the misdemeanor count of trespassing after warning, booked at the Flagler County jail and released the same evening, each on $500 bond.

The city last week renewed its mask ordinance, which explicitly mandates masks for in-person attendees of city meetings while inside city facilities. The ordinance forbids entry to anyone not masked. Commissioners themselves, though partitioned by plexiglass, keep their masks on at all times except from time to time when theyre speaking. The Centers for Disease Control and a overwhelming majority of scientists, backed by copious evidence and studies, recommend mask-wearing, primarily to prevent the wearer from infecting others with the coronavirus, but also to provide the wearer some protection.

But mask-wearing has turned into an ideologically-fraught issue and a point of contention in numerous communities, triggering lawsuits. Just this week, a Florida appeals court upheld Palm Beach Countys mask mandate, rejecting the claim that masks infringe on personal freedoms and comparing the requirement to bans on indoor smoking.

The Streits had been sitting at the back of the commission room at City Hall, unmasked before the meeting, when Flagler Beach Police Chief Matthew Doughney approached them discreetly to explain the law and request that they put on a mask. They refused.

All commissioners and the mayor were seated. They waited. I dont want to start this meeting because we have some people in the room without masks on, Commission Chair Jane Mealy said, and we just renewed our ordinance that says we require masks, or a resolution. So if the people without masks would wait outside until its time for them to come in to make their comments, that would be much appreciated.

City Attorney Drew Smith asked if the television carrying the meetings live video was running. It was. Police Capt. Blanchette offered the Straits masks. Capt. Blanchette, it was nice of you to offer them masks. But theyre not putting them on, Mealy said. She and her colleagues waited some more. We have a very long agenda tonight, Id really appreciate not wasting this time, Mealy said again. Not going to start until the room is the way its supposed to be.

Were citizens of Flagler Beach, Scott Strait said as he spoke to the officers. The officers, who handled the situation with remarkable patience and discretion throughout, talked to the Streits as the minutes passed, minute after minute, the commissioners sitting, waiting, the meeting immobilized. Then an officer walked up to Mealy and quietly told her that she would have to ask them to leave. Doughney then whispered something in Mealys ear.

Commissioner Eric Cooley, who sits to Mealys right, suggested quietly that, as he explained later, she ask them directly to leave immediately so we could get on with the meeting. My thought was they received direction from police to follow the chairs directions and they understood the choices. No need to give them any additional bandwidth to be a martyr for whatever point they were trying to make.

Im going to ask one more time that the people without mask, please leave. You have the right to wait outside, to watch the TV, and when its time for public comment that you can come back in and tell us what your problem is.

We have the right to be in this room as Flagler Beach citizens, Scott shot back.

No, Mealy said, Flagler Beach citizens have been informed that they must wear a mask in this room.

The state has said that the cities, the county, have no right to penalize citizens for being in public places, he replied.

We cant give you a fine. I read the law, too, Mealy said. She was right: Gov. Ron DeSantis, who has refused to issue a statewide mask mandate, has nevertheless allowed local mandates to remain in place, but disallowed the imposition of fines.

The officers again spoke to the Straits, explained the law and the individuals rightsand the chairs request. If you do not step outside, you will be arrested, an officer told them.

I will not give up my liberty, or freedom, Scott Streit said.

Please stand up, sir, and Im going to arrest you, the officer said.

Streit said something about what this government has become, but complied, while his wife spoke up.We all know, on Stalys website, she said of Sheriff Rick Staly, it says on his website, its an encouragement, and that a mandate is unenforceable. She was correct in so far as enforcing the mandate itself. But she had not read the part where Staly makes clear that people like her were violating the law nevertheless.

While Staly wrote of his objection to becoming the mask police, he also warned: If a person becomes disruptive on private property over a business asking them to follow their practices to keep everyone safe, it would work like any normal trespass. The person leaves and if they return to cause trouble only then does law enforcement become involved.

Thats what Flagler Beach police did, after displaying the sort of patience law enforcement generally doesnt in most lawbreaking situations, let alone in a situation where two people are holding up the official business of a government. The Straits were finally led out in handcuffs.

I apologize to everyone else whos trying to be very cooperative, Mealy said. Thank you very much. So. Sorry, thats not a great way to start a meeting, but thank you for all being very patient. So now we will call the meeting to order. This is a regular meeting of the Flagler Beach City Commission, it is Thursday, January 28, 2021, and it is 5:42.

The couple had delayed the meeting 12 minutes.

In July 2020, Scott Streit had appeared before the commission to speak of his concern regarding a water line servicing Oak Place, and the need for a hydrant there. There appears to have been no other public interactions between the Straits and commissioners. But they do have an unsettling history with th city.

They have been trespassed from City Hall before, Mealy said in an interview. They are very abusive of city staff, often over their water bill, the way it gets paid, and if theyre late they dont want to pay a late fee. Karen Streit gets verbally very abusive of staff, and that shouldnt be. You can have a calm disagreement, but she gets verbally very abusive, so she has been trespassed, I believe by Larry Newsom, the late city manager. So theyve got a long history with the city.

They were asked numerous times to put on a mask, they were given a mask by the police captain and they absolutely refused to do so and theyre now residing at the Green Roof In, Flagler Beach Commissioner Rick Belhumeur said during a break of the commission meeting. He described the Streits before their arrest as just sitting there, defiantly sitting there and not wearing a mask.

My perception of this behavior is very different than many on the board since I work in retail, Cooley said after the meeting. He owns the 7-Eleven on South Oceanshore Boulevard, in the heart of the city, where he was among the first of county businesses to don protective gear and put up plexiglass, very early in the pandemic. I have a high exposure to this type of interaction as there is a segment of the population that believes it is ok to verbally abuse folks in service industries which I work in.

Now, the treatment has glaringly spilled into public forums: both county commission meetings and Palm Coast City Council meetings have been disrupted by people who have refused to wear masks, to the point of causing Palm Coast to consider stepping up security measures considerably. But Cooley sees it as more of an acceleration of a trend than something new.

The climate and attitudes directed at elected officials has eroded noticeably over the last three years I have been a commissioner, he said. Folks like what we dealt with today are dangerous. Anyone who is so out of control that they will not comply with law enforcement orders, that an arrest is the only solution, need to be addressed. We cannot make the best decisions possible for the citizens when we feel threatened or have potentially volatile situations happening during meetings. I thought Jane and our police handled the situation with utmost professionalism. It is unfortunate that something as simple as keeping others safe has become such a charade to some. That is why my mask says, We are all in this together.'

Mealy said she wasnt worried about her personal security as far as any guns or anything like that, she said. I was upset that people would be willing to spread an ever increasing disease, even though Ive had one vaccination. But theres all these new variants out there. And I dont think its fair when he walked out, she said of Scott, referring to his statement decrying citizens submitting to the commissions treatment. Its incumbent on him to be concerned about his fellow citizens, and obviously he isnt.

What to expect from hybrid cloud in 2021 – following a year of change – Cloud Tech

As businesses this time last year wrapped up their planning for the year ahead, few could have predicted the dramatic changes that awaited them. By Spring, the coronavirus pandemic had disrupted all manner of operations globally, forcing businesses to pivot in real-time to accommodate remote working for the vast majority if not all of their workforce. This unprecedented change accompanied by huge levels of uncertainty required heavy restructuring of IT infrastructure.

Often, we saw IT operations across the globe managing this monumental lift through moving additional workloads to the cloud and adopting a hybrid cloud environment model. In many cases, these digital transformations were already occurring and the COVID-19 pandemic accelerated plans which were already in place. Plans were set in motion by teams who increasingly see the value of hybrid cloud environments and the benefits that can be found.

One thing 2020 has taught us is to expect the unexpected and whilst we do not know what 2021 has in store, several trends have emerged that enable us to make some predictions for what this year might hold for the world of hybrid cloud.

New technology was required in more ways than ever last year, with a number of changes related to growing hybrid cloud use emerging including:

In 2021, we predict businesses will address the above changes and drive them further in ways that will apply new resources and strategies to drive business outcomes as the world around us advances in cloud and AI research. Our predictions are as follows:

Companies are already in the process of decentralising IT operations to hybrid cloud environments and we predict that in the year ahead, this will continue at rapid speed with even businesses in the most regulated industries partaking. This is due to the availability of security measures that will improve isolation, ensure system and data integrity and implement Zero Trust strategies whilst remaining compliant with data privacy regulations worldwide (which become increasingly more tough as security threats evolve). These security technologies such as Confidential Computing, quantum-safe, and fully homomorphic encryption will become more mainstream than they have ever been before.

We have already seen the power of AI in technologies such as natural language processing (NLP), graph-based techniques and explainable AI in tools such as voice recognition and language translation apps. In 2021, we predict that the same AI will be applied to machines code which will in turn significantly accelerate the moving of applications to the cloud and aid their management. This AI will teach machines to reason, offering explanations for an applications behaviour and its structure to recommend and automate the generation of identified microservice candidates.

Crunching a large dataset from your laptop may require using 100,000 containers and the knowledge of how to re-code applications for the hybrid cloud. Developers and data scientists without years of experience with containerisation, parallelisation and container orchestration tools currently find it very hard to programme in hybrid cloud environments.

Throughout 2021, open-source tools will help integrate many clouds and on-premise systems into a single, seamless hybrid platform by shortening the learning curve for programmers and non-programmers for that matter. This application deployment model will be easier for those without lots of hybrid cloud expertise to programme and use freeing up programmers with more experience to work on higher-value projects.

This year, we expect to see huge breakthroughs in AI hardware used to build and deploy AI models. Paired with 5G advances, sustainable AI computing at the edge could remove even more borders between cloud and edge, offering a key technological upgrade for hybrid cloud infrastructures, and a major advancement for privacy and security of AI models by keeping more data at the edge. 5G cellular architecture is also expected to be a catalyst trigger wide-spread adoption of edge computing.

Much of the change we expect to see in 2021 will be focused on the improvements in AIs power and efficiency, so it can help businesses meet a number of challenges to securely deploy and manage hybrid cloud environments for a larger number of users to meet the challenges of last year.

Whilst we dont know exactly how 2021 will play out, we expect hybrid cloud technologies to continue to play a large role in breaking down barriers for the enterprise.

Pentagon could reassess future of JEDI cloud, depending on court action – C4ISRNet

WASHINGTON The Department of Defense will reassess its cloud-computing options if a federal court does not dismiss allegations of improper influence in the contract process for the project worth billions, a new DoD memo said.

The Joint Enterprise Defense Infrastructure cloud, awarded to Microsoft in October 2019, would provide a department-wide platform needed to develop artificial intelligence and computing capabilities for war fighters at the tactical edge. But if the U.S Court of Federal Claims clears the way for Amazon Web Services interference allegations against former President Donald Trump over the JEDI project, the Pentagon warned that the prospect of such a lengthy litigation process might bring the future of the JEDI cloud procurement into question, according to the memo from the DoD CIO office to Congress.

Under this scenario, the DoD CIO would reassess the strategy going forward, the memo read.

AWS has stated that it wants to collect sworn statements from Trump and other current and past senior officials, including former Defense Secretary Jim Mattis. Evidence AWS cites against Trump includes public and private statements about his dislike for Amazon founder Jeff Bezos.

These motions will be complex and elongate the timeline significantly, the memo said.

Building the JEDI cloud infrastructure has been delayed since the Pentagon awarded the contract, valued up to $10 billion over a decade,. Shortly after the award, AWS filed a lawsuit to block the department from working to build the enterprise cloud environment, alleging political interference and technical evaluation errors by the department during the selection process.

Regardless of the JEDI cloud litigation outcome, the department continues to have an urgent, unmet requirement, the DoD memo said. Specifically, the departments need for an enterprise-wide, commercial cloud services for all three classification levels, extending from the homefront to the tactical edge, at scale. We remain fully committed to meeting this requirement we hope through JEDI but this requirement transcends any one procurement, and we will be prepared to ensure it is met one way or another.

The allegations of interference by Trump add uncertainty to the JEDI cloud project under President Joe Bidens Department of Defense. Meanwhile, some industry experts have challenged the construct of the JEDI cloud, arguing that the contract shouldnt be a single award and instead should involve several vendors.

DUBAI (Reuters) - Saudi Arabias futuristic city project NEOM is in talks with companies to pick a lead partner for its first cloud computing deal that will lay the foundation for hi-tech services in its flagship $500 billion business zone, a senior executive said.

The talks with local and international tech firms come after a subsidiary of oil giant Saudi Aramco recently partnered with Google to bring its cloud services to the kingdom, and Saudi Telecom Co. struck a similar deal with Alibaba Cloud.

From a compute perspective, were seeing lots of opportunities for partnerships with large, hyper-scale providers, Joseph Bradley, head of technology and digital at NEOM, told Reuters.

Were in final stages of negotiations with several.

Last year NEOM, which is backed by the $400 billion Saudi sovereign fund PIF, announced a deal with Saudi firm stc group to establish a 5G network for its planned cognitive cities.

NEOMs flagship project is a carbon-free zone called The Line. Its construction will begin this year and the first phase will be completed by 2025, Bradley, a former CISCO Systems executive, said.

The plan, unveiled by Crown Prince Mohammed bin Salman on Jan. 10, is the first major construction project aimed at diversifying the economy of the worlds largest oil exporter.

NEOM also plans to build a city-wide operating system based on artificial intelligence in the business zone to better utilise data for its inhabitants.

The WisdomTree Cloud Computing ETF (WCLD) was the star of cloud computing exchange traded funds last year. It has more to give in 2021.

The WisdomTree Cloud Computing Fund seeks to track the price and yield performance, before fees and expenses, of the BVP Nasdaq Emerging Cloud Index, an equally weighted index designed to measure the performance of emerging public companies focused on delivering cloud-based software to customers.

Public cloud revenue is one of the many catalysts that can spark more upside for WCLD this year.

According to data presented by Finaria, public cloud revenues jumped by 25% year-over-year amid the COVID-19 crisis and hit $271.9bn in 2020. The increasing trend is set to continue this year, with revenues growing by another 25% YoY to $338b, notes Finaria.

The cloud computing industry refers to companies that (i) license and deliver software over the internet on a subscription basis (SaaS), (ii) provide a platform for creating software applications which are delivered over the internet (PaaS), (iii) provide virtualized computing infrastructure over the internet (IaaS), (iv) own and manage facilities customers use to store data and servers, including data center Real Estate Investment Trusts (REITs), and/or (v) manufacture or distribute infrastructure and/or hardware components used in cloud and edge computing activities.

As more business models look to technology amid social distancing, cloud computing will only grow to greater heights. Prior to the pandemic, businesses were already transitioning to the cloud to streamline their processes.

Today, billions of people use cloud storage to manage and store private data. However, its ability to provide access to computing power that would otherwise be extremely expensive has seen cloud computing technology spread widely in the business sector, also, notes Finaria. Examples of cloud computing use can be found practically everywhere, from messaging apps, social networking, and streaming services to business processes, office tools, lending platforms, or chatbots.

Cloud computing has been a boon for companies that have been able to capitalize on the increased work-from-home labor force.

The COVID-19 and the shift to remote work and video conferencing accelerated moves to the cloud in 2020, with annual revenues rising by more than $55bn. Statista data indicate the global public cloud market is expected to hit a $500 billion benchmark in the next two years and continue rising to $679.5bn value by 2025, concludes Finaria.

Fed Chairman Jerome Powell may have fed some market pessimism when he spoke after the meeting, and pointed out that unemployment, which has been rising in recent months. For market watchers seeking support, there is solace in the Feds monetary policy. The central bank is committed to buying $80 billion monthly in Treasury notes, and has put a rate increase on hold, likely until 2023. At least one top strategist sees the current market environment in terms of opportunity. JPMorgan strategist Marko Kolanovic takes a bullish stance, writing, We expect the global COVID pandemic to decline rapidly in the coming weeks. In fact, the pace of decline in new cases over the last 2 weeks is the highest on record both in the US and globally Central Banks should remain accommodative given the elevated unemployment levels and over a decade of low inflation running below their targets Short-term turmoil, such as the one this week, are opportunities to rotate from bonds to equities. Taking this outlook into consideration, we set out to find exciting opportunities that wont break the bank, namely penny stocks. These stocks, priced at $5 or less, offer investors some of the highest growth potential available in the market. There is risk here, too, as the pennies are often priced low for a reason, so due diligence is essential. Using TipRanks database, we identified two penny stocks that have earned a Strong Buy consensus rating from the analyst community. Not to mention each offers up massive upside potential, as some analysts see them climbing to $11. BioLineRx, Ltd. (BLRX) Well start with BioLineRx, a clinical stage biopharma company focused on developing new cancer treatments. Oncology is a major field for cutting edge biopharmas. The drug is being studied for its efficacy in promoting the harvesting of bone marrow prior to the cancer treatment. Results from a pre-planned interim analysis showed statistically significant evidence favoring treatment with motixafortide in the primary endpoint, evidence which was so significant that the enrollment was completed early, with 122 patients instead of 177. Stem cell mobilization, using motixafortide, is seen as the companys most efficient path to registering the new drug for regulatory approval. Based on the potential of motixafortide and the $2.40 share price, some analysts think that now is the time to pull the trigger. Covering BLRX for Oppenheimer, 5-star analyst Mark Breidenbach noted, Our thesis remains centered on motixafortide in stem cell mobilization, and we see a disconnect between the companys market capitalization and motixafortides market opportunity as a stem cell mobilizer. Key GENESIS secondary endpoints are expected by mid-2021, and we see little risk heading into these data The analyst added, We believe results from the Phase 3 GENESIS trial could spur the majority of transplant physicians to choose BL-8040 over Mozobil to combine with G-CSF if the drug is approved. Upside to our thesis includes BL-8040 for use in other auto-HSCTs, allo-HSCTs, AML, and solid tumors. The company boasts a catalyst-rich, deep oncology pipeline that has attracted collaborations with Novartis, Merck, and Genentech. Given all of the above, Breidenbach rates BLRX as a Buy, and his $11 price target suggests a whopping 358% upside for the year ahead. As it has racked up 3 Buys and no Holds or Sells, the consensus is unanimous: BLRX is a Strong Buy. Adding to the good news, the upside potential lands at ~428% based on the $12.67 average price target. (See BLRX stock analysis on TipRanks) Kindred Biosciences (KIN) While most biotech companies focus on human medications, we are not the only market. Kindred biosciences is biopharmaceutical company in the veterinary market, developing biologic medications to improve the lives of our pets and working animals. The company describes its mission as [bringing] to pets the same kinds of safe and effective medicines that human family members enjoy. Parvovirus (CPV) is a highly infectious, and highly lethal, viral disease affecting dogs. While vaccines are available, untreated cases can see upwards of 91% mortality. Kindreds main pipeline drug, KIND-030 is under development as a treatment for this disease. Currently, the drug candidate is following two paths in the development process one for treatment of established infections, and one as a prophylactic preventative treatment for CPV. The prophylactic study has shown positive results, with treated dogs all avoiding infection, while all dogs in the placebo group developed parvovirus disease. KIND-030 also showed a mortality benefit when given as a treatment for infection. The drug candidate is in the pivotal study stage of development, the last before potential approval. Last month, Kindred announced that it had entered an agreement with Elanco Animal Health a major manufacturer of veterinary medicines for production of KIND-030. Cantor analyst Brandon Folkes sees plenty of potential in Kindred, especially in the companys agreement with Elanco. A partnership with a leading animal health company, in this case Elanco, is exactly what the company needed, in our view. In our view, this validates KIN's new strategic approach, as a developer of drugs while seeking larger commercial partners. We believe that today's deal should reinforce to investors that there remains meaningful value in Kindred's pipeline, which could be realized over the next 12 to 18 months, Folkes opined. Kindred is also conducting studies of Tirnovetmab, or KIND-016, an antibody targeting IL31, in the treatment of atopic dermatitis in dogs. The pivotal efficacy study of this drug started in the last quarter of 2020. There is a potentially huge market for a successful dermatitis treatment for canines; in the last six years, there has been a 47% increase in vet visits for dogs with severe itchy skin, and the market is estimated at $900 million or more. While 2020 has been a tough year for KIN stock, the company continues to have multiple shots on goal from its diversified pipeline that could reward investors from the current levels. With multiple readouts in 2021, and the renewed sole focus on development of its pipeline we expect 2021 could be a banner year for KIN should it be able to deliver on the promise of its pipeline, and in particular the atopic dermatitis portfolio, the analyst summed up. To this end, Folkes gives KIN an $11 price target, implying a 139% upside potential for 2021, and an Overweight (i.e. Buy) rating. Google Is Making Up Lost Ground When It Comes To Cloud Computing – InvestorPlace

Alphabet (NASDAQ:GOOG, NASDAQ:GOOGL) is undoubtedly one of the biggest and best mega-cap stocks on Wall Street.

Google stock is coming off another solid year. And increasingly, Googles cloud services are a growing part of the companys success.

While it didnt show some of the amazing returns enjoyed by some of the biggest tech stocks in the world, Google stock still managed to pull a 27% return in 2020. That easily topped the greater Nasdaq composite, which gained roughly 15%.

Now as Alphabet barrels toward its fourth quarter and full-year earnings report (expected February 2), the big question is what investors can expect from Alphabet. The company has its hands in everything from AI to cloud storage, internet services, advertising, entertainment and autonomous vehicles.

Such reach gives Alphabet huge advantages to pull in profits from a variety of sources, making the company relatively impervious to long-term downtrends.

But Alphabet is also in keen competition with other mega-cap tech companies that are vying for the same slices of pie that are fueling Google stock.

Heres what you should be looking for as Alphabet prepares its earnings report.

The big question for Alphabet is whether it will be able to replicate the success it showed for Q3. In the third quarter, Alphabet posted revenue of $46.2 billion and earnings per share of $16.40.

Analysts had expected revenue of $42.9 and EPS of $11.21, so the earnings beat was a big one.

The beat was especially significant as the company saw its first-ever decline in revenue in the second quarter, thanks to a fall-off in advertising revenue during the novel coronavirus pandemic.

Those numbers turned around in Q3, with advertising revenue of $37.1 billion compared to $33.8 billion in the third quarter of 2019. Alphabet will need to continue that positive trend in Q4.

While advertising is a core business for Alphabet, theres yet another reason why I think Google stock is one worth watching as we head into the Q4 earnings report.

Undoubtedly, there are some big players in the cloud computing and storage game. Competition is fierce and the market is growing.

So its notable that that Alphabet isnt just sitting on its laurels when it comes to building out the Google Cloud Platform (GCP).

Three years ago, Cockroach Labs began issuing annual comparative cloud reports, giving consumers and businesses an indication of which company was doing the best in cloud services and computing. And in that early study, Google ranked far behind competitors such as Amazon (NASDAQ:AMZN) Web Services and Microsoft (NASDAQ:MSFT) Azure.

Not any longer.

In the Cockroach Labs 2021 report released this month, Google is ranked as providing the best overall performance.

The margins are tight. For instance, Google gets top scores for running online transactional processing workloads. Amazon is considered to be the best value for the money.

Declaring a winner was much harder to declare in years past, the authors say in the study.

Amazon, Microsoft and Google are three mega-heavyweights. Its like a prize fight with Muhammad Ali, Mike Tyson and George Foreman all in their primes.

Alphabet will have to work hard to continue to improve its cloud services, but its on the right track. And more importantly for Google stock, the companys cloud services are a reliable money-maker. In the third quarter, Google stock recorded $3.44 billion in revenue from the companys cloud services, versus $3.32 billion that analysts had expected.

Just this month, Alphabet announced some new AI tools that will help retailers using Googles cloud services to deliver a better user experience to their customers. The tools will allow retailers to suggest products based on their browsing history and will be able to adapt in real time to user behavior.

Nobody collects browsing data like Alphabet. The companys Google Chrome web browser is by far the dominant browser in the United States, with more than a 50% market share.

Tools such as these are doubly important for retailers who are doing more business online, thanks to changes in customer behavior brought on by Covid-19. They will help Alphabet compete with Microsoft and Amazon for cloud dominance.

Google stock had a good though not great 2020. But theres good reason for optimism, particularly with the companys emphasis on cloud computing and services.

Forrester Research estimates that the public cloud computing infrastructure market will grow by 35% to $120 billion. Now that Alphabet has made up the ground with Amazon and Microsoft, its going to be important for Google stock that the company keep investing in its cloud products.

The Covid-19 pandemic and the shift to remote working it has prompted means that 2020 was in many ways the year of the cloud.

The adoption of cloud-based systems and public clouds has soared over the past 12 months as businesses look to digitise quickly and support remote workers. And this trend looks like its here to stay.

According to research by Sumo Logic, in 2020 multi-cloud adoption grew by 70% year-over-year.

Verdict spoke to Ian Massingham, global director of startup solutions architecture at Amazon Web Services (AWS) to find out how startups can utilise the benefits of the cloud to adapt to the challenges posed by Covid-19.

Ian Massingham: The Covid-19 pandemic has ultimately changed the way that we live and work, and as a result, all organisations have had to adapt to the challenges it has raised. One of the main characteristics that helps startups to succeed is adaptability. This is such a fundamental necessity for startup success that it resulted in the term pivot being coined, which means a rapid, and sometimes unexpected change of direction or business model that helps a startup flourish.

We have seen some fantastic examples from our customers of companies that successfully pivoted their business as a result of the pandemic. For example, Phorest, a company that specialises in computer software for hairdressers, spas, and beauty salon owners, pivoted its business model and quickly built a voucher platform and e-commerce offering to help support salon owners through the pandemic, enabling them to generate income while non-essential services were closed. The cloud-based management system was used this year by over 90,000 salon and spa professionals globally. Another example is Manna Aero, the worlds first aviation-grade, B2B autonomous drone delivery as-a-service company. Due to the Covid-19 pandemic, Manna pivoted its business from commercial food delivery and partnered with the Irish governments Health Service Executive to deliver prescription medicine and critical supplies to the local community, and in particular elderly and vulnerable people, in the town of Moneygall, in southwest Ireland.

The pandemic has also created challenges in some of the sectors where our customers are building new businesses travel would be an obvious example but at the same time, it has created growth opportunities for others, such as digital fitness apps or remote collaboration tools. One such company is AWS customer Peleton, a New York-based company specialising in tech-enabled exercise equipment, that has registered a 66% surge in sales this year.

The pandemic has underlined how important cloud computing technologies are for developing a technical infrastructure and a culture that can adapt to and thrive in different circumstances. This year, weve seen enterprise organisations rapidly develop concrete plans for cloud adoption, after years of talking about moving to the cloud without necessarily taking the steps to make that shift.

This change in attitude reflects the central role that cloud plays in enabling businesses to rapidly and effectively transform how they operate and bring new services and solutions to the table and to therefore adapt to changing circumstances. Often, these adaptations reinvent the organisation, transforming how it works and what it means to its customers look, for example, at Netflixs fateful shift from mail-order DVD delivery to streaming.

When we look at the businesses that endure and sustain their success over many years, the consistent factor that unites them is this capacity to reinvent themselves where necessary. Moreover, this is not just-in-time reinvention, which happens at the last minute and is prompted by urgent external factors. It is instead continuous reinvention that often takes place when the company is in a good position and is healthy.

There is a cultural factor to this continuous reinvention the ability to focus relentlessly on customers needs, to drive change from the top, and to access the top talent. But there is also a technological factor. Reinvention often consists of launching novel services and/or products and substantially changing internal processes, and knowing what technology is available to you and deploying it effectively plays a key role in accomplishing these changes.

Cloud computing makes it easier to pursue reinvention and enables builders to deploy a broad set of tools and capabilities as they imagine a new way forward.

The shift to remote working and the other effects of the Covid-19 pandemic have accelerated the adoption of the cloud by several years. Organisations have had to rapidly adapt to deal with the challenges that the pandemic has presented. Cloud computing has proven an effective tool in meeting these needs quickly, reliably, and without the need for employees to travel or work in close proximity to one another.

It has been incredible seeing how our customers have implemented agile and innovative solutions this year, using cloud computing during the pandemic to adapt to operating remotely. One such example is Morrisons. The British retailer built a cost-effective and flexible contact centre system on Amazon Connect in just eight weeks. The new scalable solution enabled Morrisons to respond immediately to the challenges of the Covid-19 pandemic, and within a day, it enabled every single person in the contact centre to work from home. It was also able to quickly hire a broad range of people from across the nation such as travel-industry employees who had lost jobs to respond to the increased call volume, which had swelled to as much as six times the weekly average. AWS APN Partner, Voice Foundry, also used Amazon Connect to help local councils manage call volumes from residents during the pandemic. Not only did it ensure they could meet citizens needs at this critical time, it ensured employees could attend to calls without having to leave their homes.

Depending on the size of the organisation, there are a number of steps that can help ensure a smooth and effective transition to the cloud.

One of the underlying aspects is having well-equipped and well-trained staff. For small businesses and startups this often means hiring people with the right skills who can bring their experience and knowledge. Smaller companies often dont have the luxury of time to train people meaning that hiring people with experience is the easiest way to ensure a smooth transition to the cloud.

For bigger organisations, who often have well-developed product and IT teams, and hundreds or thousands of employees, replacing or re-hiring talent is not an option. For these organisations, training becomes a very important prerequisite for initiating cloud migration. One of the first things we do when working with large, enterprise businesses is to develop what we call an AWS Cloud Enablement Engine. This is a dedicated business unit within the organisation that is focused on helping with the cultural changes needed to get the most from the cloud. This can be everything from setting up governance frameworks, so cloud consumption can happen in line with an organisations regulatory obligations, through to developing training and certification programs to up-skill all employees on AWS technologies and new ways of thinking.

Secondly, working with partners who specialise in cloud adoption can have a positive impact on the overall cloud migration experience. Companies should look for partners who bring a wealth of expertise in this area and who have a strong record of delivering similar projects for other organisations.

Lastly, it is also important to put in place early foundations for cloud adoption. This includes integrating identity management systems with cloud providers and establishing policies and processes, as well as security protocols, that could be later used to facilitate cloud adoption.

When it comes to global cloud adoption, we are just at the beginning of the journey. According to Gartner, public cloud is projected to make up 14.2% of the global enterprise IT spending market in 2024, up from 9.1% this year.

For the most part, IT is still delivered by traditional models, where customers own and operate their own infrastructure and data centres. However, as more organisations start to realise the benefits of cloud computing, in part accelerated by the Covid-19 pandemic and the major shift to online this year, we can expect a considerable uptake of cloud adoption and usage over the coming years. However, its important to note that cloud will quite often co-exist with existing IT infrastructure in a variety of hybrid cloud models, and in other instances lift and shift migrations will see applications or workloads being migrated directly from on-premises to the cloud. These approaches speed up innovation and growth, enabling businesses to adopt cloud technologies in the way that best suits their requirements.

But for cloud adoption to be successful, investing in tech skills will become imperative over the next few years. A teacher could be banned from the classroom after writing an anonymous 'Gossip Girl'-style blog about teachers and pupils at his school.

Alexander Price, 43, penned the "The Provoked Pedagogue" blog about students, parents and staff at Denbigh High School in Denbigh, North Wales.

The design and technology teacher even targeted school girls, writing that they dressed " like Eastern European prostitutes and trans-human Kardashian clones" at prom.

Between January 2016 and March 2018 he wrote 24 blog posts, until a colleague found the site, and reported it to headmaster Dr Paul Evans.

Dr Evans quickly connected the dots, and realised that one post, titled 'Liars, Backstabbers and Empire Builders' referred directly to a meeting the two had had.

In some posts he made up nicknames for headteachers at the school, calling one "El Supremo" and another "Grima Wormtongue" after a character from Lord of the Rings.

At a hearing in Cardiff, Mr Price, who admits writing the blog but denies the posts amount to unacceptable professional conduct, said he had no intention of ever returning to the teaching profession.

Mr Price said: " I would assert the absolute right to freedom of expression.

"In these times of cancel culture and the ownership of language this is one further example of the liberal elite attempting to sanitise the world with their own brand of passive-aggressive censorship and bullying."

He added: "Teaching in Wales is in crisis, teaching at Denbigh High School was non-existent in any meaningful sense of the word, fact borne out of its inability to meet even the basic standards of competence.

"The school is run in a shameful way which negatively impacts on the lives of children and their families in one of the poorest wards of the UK.

"Paul Evans treated Denbigh High School like his own personal fiefdom, running roughshod over procedure and bullying those who did not comply with his methods.

"He blamed me directly for failings in his own management and to seek to intimidate me to complying with his unreasonable demands."

The headteacher said he had been made aware of the 'The Provoked Pedagogue' blog and Twitter account in February 2018.

The 540-student school was in special measures at the time Mr Price wrote the blog.

Dr Evans added: "T o know that one of our colleagues was letting the world know it was a challenging situation and a lack of leadership and direction showed a lack of loyalty towards the school and what we were trying to do at the time.

"I think many staff would find it hurtful one of their colleagues was being disrespectful and pouring scorn on their efforts.

"I think it's very disrespectful to his colleagues, I think if they were to read that they would find it hurtful."

Mr Price has no plans to return to teaching regardless of the panel's decision, but he urged them to not "shoot the messenger" for exposing problems at the school. He said he hoped the blog would "shine a light" on the "disgraceful behaviour" of Dr Evans.

He said: " Behaviour was horrendous and unsafe. Drug use was rife. The blog had a tiny readership and was fully anonymous.

"Hundreds of pages of papers and hours and hours of time have been invested to investigate a blog which yielded zero complaints and simply told the anonymous truth.

"The articles are colourful and meant to be entertaining. While it was active I would regularly receive responses asking if I worked at their school - indicating the issues experienced were mirrored and lending strength to the efforts to anonymise the blog.

"I hope this shines a further light on the how poorly the children of Denbigh High School are being served.

"I hope these proceedings finally manage to drive the improvements that all the people served by the school deserve."

In one article titled "The Problem With Prom", Mr Price called the event "a shallow, vacuous affair, about nothing more than who has spent the most on looking nice".

He described the evening as where anxious young teens are "shoehorned into gowns and paraded into towns like cattle".

The post called attending teenagers: "Shameless chicken fillets shoved into criminally expensive and ill-fitting gowns."

Presenting officer Ashanti-Jade Walton asked Mr Price if he was sorry for his comments about the school prom.

He answered: "I'm sorry that so many pupils are forced to do this. That's what I'm sorry about."

Dr Evans hit back, saying his comments were "extremely hurtful".

He added: "The pupils are not from rich backgrounds therefore could not be in a position to afford expensive prom gowns or overpriced cosmetics.

"I believe they are wholly derogatory comments about the pupils at the school, disrespectful and seeking to undermine pupils at the school.

"The comments are wholly offensive to parents whose pupils attend the school."

Colin Adkins, Mr Price's NASUWT union representative said his comments were fair and a "reasonable professional opinion", in which the school, parents and pupils could not be identified.

He said: " The contents of the blog are true and the attack on Mr Price is an attempt to cover-up the failings of the school.

"Just because these facts are inconvenient to the school should not allow the school to succeed in this cover up.

"The blogs are totally anonymised. There is not one article which mentions a pupil by name, a parent by name, or a member of staff by name."

Mr Price left the school in 2019 and may be struck off permanently, pending the outcome of the hearing.

How much did Its A Sin teach you about the Aids crisis of the 80s?

Omari Douglas: From the minute I knew Id be doing this, I dove into it and it was overwhelming. One of the reasons Im glad were doing this is were so used to shows and films about Aids from the American narrative, and this is a British perspective and quite different, and how Thatchers Britain wasnt a particularly great time to be gay. Whats brilliant is being able to pass this story on to our generation.

Do you feel privileged to be part of Russell T Davies lineage of landmark gay dramas (that includes 1999s groundbreaking Queer As Folk, 2001s underrated Bob & Rose, and 2015s Cucumber)?

Yeah! Its such a canon of work. I was five when Queer As Folk came out, but I remember the adverts and going: Oooh, whats that? My real entry into his work was Cucumber. It came out when I was in my last year of drama school and it was an event in our flat wed all schedule it, squash up on the sofa and watch it together.

Why hes so great: Anybody whos binged Its A Sin need only hear the name Colin to be suddenly surrounded by a moat of their own tears. Nicknamed Gladys Pugh (the Welsh character from 80s sitcom Hi-de-Hi! played by Ruth Madoc) by the Pink Palace gang, loveably sweet-natured ingnue Colin arrives in London from Wales to take up a Savile Row tailors apprenticeship under the tutelage of a sleazy boss. In episode three, actor Callum Scott Howells expertly takes your heart, puts it in a NutriBullet, and hits pure as Its A Sin delivers its first true emotional stop-the-clocks moment. Surprisingly, this is Scott Howells first on-screen credit (although he appeared on stage in Matthew Bournes Lord Of The Flies and Cameron Mackintoshs Oliver!), and he filmed Its A Sin while studying at Royal Welsh College of Music and Drama.

How much did you know about the Aids epidemic of the 80s before Its A Sin?

Callum Scott Howells: Whats really important is were telling this story now particularly for my generation in Wales. We dont talk about it enough. I was never taught about it in school, and I didnt know about it until I turned 18/19 and left home for drama school and spoke to people about it. Even then, I had to seek out the information. Hopefully, young people are going to watch the show and realise how this affected so many people. Doing this as well, weve been blessed with having amazing older actors like Stephen Fry in the cast that we can talk to about their experiences and the friends they lost.

Would you like to see it taught in schools then?

Definitely. People see the gay community as big, colourful and vibrant, but there needs to be more understanding of the struggles and what our community has been through. If I had been taught this at school, I would have been blown away to know what I would have gone through if I grew up in the 80s.

How does it feel to be part of Russell T Davies lineage of landmark gay dramas?

I wasnt born when Queer As Folk came out, but I grew up watching Doctor Who, which is a different strand of his work. So it feels amazing and brilliant.

The show honours the memory of those lost by highlighting the joy, humour, fun and energy they had. Did that feel important?

Completely. Because this community is so joyful. Weve filmed in Manchester and walking down Canal Street, its multi-coloured and theres drag queens, youth, energy and vibrancy. That goes for our boys [in the show] theyre so young and fresh and experiencing things for the first time.

Why shes so great: Based on a real-life friend of Russell T Davies (actor Jill Nalder, who plays her mum in the show), aspiring thespian Jill is the first in the Pink Palace to stand at the storm-front when the Aids crisis looms. The ultimate selfless ally, she acts as a maternal Wendy figure to the flat of Lost Boys. Lydia Wests scene with Keeley Hawes, as her best friend Ritchie Tozers (Olly Alexander) mum, in the final episode is a masterclass; like watching the acting equivalent of a heavyweight boxing match. West isnt a complete unknown, she played technology-obsessed transhuman Bethany Bisme-Lyons in Davies 2019s dystopia Years and Years, but her future is definitely starrier than her past. Shes set to appear alongside Uma Thurman in TV thriller Suspicion and Celine Dion in the romantic drama Text For You.

Your co-star Olly Alexander talked about watching Queer As Folk in secret at 14 and it helping shape him as a gay man. Is there a sense this could be a similarly important drama to young queer people?

Lydia West: Completely agree. Even though the Aids epidemic only happened relatively recently in the 80s, I didnt know as much as I know now after researching for the show. Its important that we remember those we did lose and raise awareness for the prejudice around the disease, which still stands. For 14-year-olds today, I think its going to be educational. But its important to note that its not a sad story. Its fun, youthful, energetic everything great in life which we connect to.

Theres never been a UK drama about Aids on this scale before, and Jill is based on a real person. Does that come with a responsibility to get it right?

Yeah. Its a period drama, so were recreating a period of time that actually happened so theres a humungous pressure in the sense that we want to be as truthful and as honest to the time and to the characters, because its a sensitive subject. Because were not just creating something entirely fictional, it feels like it has a huge weight of importance and as an actor, thats what you really want to do.

How does it feel to go from the dystopian future of Years And Years to the real past of Its A Sin...

Im a Time Lord! The roles are so different that I havent thought about the time-period, Im more focused on the character. But again, the writing is just phenomenal you connect with each character, and know their friendships, relationship and nuances straight away. Its a beautifully human drama.

It seems like the cast got on like a house on fire too

It was instant. The first time I met Olly was in a singing rehearsal and I was nervous because I didnt want to sing because I was singing with a singer! Because its such a sensitive subject, it helps that we all get on and trust each other so well. Theres no egos. We feel like a team and know that without one of us, the whole ship would sink.

Why hes so great: As Ritchies calm, sensible and faithful friend, and occasional lover, Ash not only gets to educate on the importance of douching (You need a good wash OK?) but also delivers one of Its A Sins most pointedly political moments an evisceration of Section 28, the reviled law that forbade promoting homosexuality. Hes portrayed with aplomb by screen newcomer Nathaniel Curtis, who was hot off playing Romeo in Shakespeare in the Gardens production of Romeo And Juliet before Its A Sin.

Theres never been a UK drama about Aids on this scale before. How important to you was it to get that right?

Nathaniel Curtis: With having such an incredible script, it takes the pressure off us a little bit. Were all trying our hardest to make sure were portraying the truth that our characters have to live through, which is horrific. Speaking to friends who were alive in the 80s, it was terrifying and our characters are so young, and theyre trying to find their way in the world, and this happens and its scary. But theres a confidence that comes from knowing everyone the writer, the producer, director, etc are handling it in the most beautiful respectful way.

Did you all end up best mates?

We have so much fun. Weve been told off for having too much fun! We went and danced in each others trailers every morning, and went out for dinner every night. The subject matter is so sad and devastating and obviously being able to support each other when things are difficult and being able to celebrate when things are difficult, has really helped.

Even in a pandemic, energy innovators are developing blockchain technology to implement powerful changes. From automating crude oil trading to amplifying the impact of renewable energy sources, innovations harnessing blockchain technology are likely to change the energy industry in profound ways. Inventors, enterprises, and investors who act today to obtain patent protection for their early blockchain-based inventions will find themselves in an enviable position tomorrow to capitalize on their early visions. This article explains some basics of blockchain technology, highlights two exciting applications of energy-related blockchain technology, suggests patenting strategies, and recognizes challenges to patentability and enforcement of such technologies.

Blockchain is a software-based technology used to track and secure a list of continuously growing data records (blocks) that are linked together (chain) using cryptography, over a network of computers (nodes). It was introduced along with the cryptocurrency Bitcoin. However, innovators are now developing applications of blockchain technology beyond cryptocurrency.

Blockchain technology is often called distributed ledger technology to emphasize the distributed or decentralized nature of its list of records (that is, its ledger or database), in contrast to a traditional, centralized database. Conventionally, databases have been secured by entrusting them to third-party intermediaries having administrative privileges. However, blockchain technology secures a database, without the trusted third-party, through a combination of three core enabling technologies: peer-to-peer networks, digital signatures, and consensus algorithms.

Peer-to-peer computer networks account for the decentralized nature of blockchain technology. In a conventional client-server network, one central computer (server) stores data and responds to requests from numerous computers (clients). In contrast, each node in a peer-to-peer network can act as a server and a client. If a server fails, a client-server network fails. However, if a node fails, a peer-to-peer network continues to work.

Digital signatures provide the integrity and authenticity for transactions that make up a blockchain ledger through cryptographic hash functions and public-key encryption. Consensus algorithms allow the nodes in a blockchain network to agree on the current state of the ledger while making it virtually irreversible and tamperproof. Different types of consensus algorithmssuch as, Proof-of-Work and Proof-of-Stakeare being developed to better serve the needs of specific applications of blockchain technology.

Smart contracts allow agreements to be automated through terms and conditions preprogrammed into a blockchain. Smart contracts are where blockchain technology becomes unleashed from its cryptocurrency origins.

In the energy industry, blockchain technology is being developed to dramatically alter the supply, demand, and distribution of energy. For example, VAKT Global Ltd., a European company, is developing a blockchain-based energy commodity trading platform, with no cryptocurrency involved. As of April 8, 2020, the platform was in use in the North Sea BFOET crude oil market. The platform makes physical commodity markets more efficient by becoming a single source of truth for the trading parties and ecosystem participants: terminals, surveyors, agents, ship owners, brokers, banks, etc. By transforming conventional paper-based processingwhich tends to be slow, complicated, and error-proneinto a digital process that is fast, secure, immutable and private, VAKT intends to become the digital backbone of commodities trading within the energy industry and beyond.

Energy Web Foundation (EWF) is also developing an energy-specific blockchain called the Energy Web Chain (EW Chain), which uses a Proof-of-Authority consensus mechanism for reduced energy consumption. This blockchain aims to accelerate the global transition to a decentralized, democratized, decarbonized, and digitalized energy system. EWF has collaborated with Wirepas and Vodafone Business to combine blockchain technology with the Internet of Things (IoT) to develop systems for connecting renewable energy assets to energy grids. By providing the core digital infrastructure connecting utilities, distributed energy resources, and consumers, EWF sees itself as the digital backbone of the futures low-carbon electricity systems.

Importantly, such digital platforms are likely to exhibit network effects. That is, digital networks of energy providers and consumers are likely to become more valuable to their users as they gain more users and, at some point, an expanding energy network may prevent competitors from entering the market. Accordingly, pioneering energy platforms may have a head start to dominate energy-related industries through the power of network effects.

The database of the U.S. Patent and Trademark Office (USPTO) suggests that energy-related blockchain patent application filings have continued to increase since the first of such applications was filed in 2016. Nevertheless, the energy-related blockchain patent landscape is currently not a crowded one. Thus, the time is ripe for energy innovators to claim valuable patent rights. Patent owners may use patents defensively and offensively to gain an edge over competitors and realize significant business value.

A defensive approach to patenting allows patent owners to benefit without suing. For example, patents can deter competitors from copying and encourage them, instead, to seek a licensing agreement or focus their research efforts elsewhere. Furthermore, patents are considered assets of a company and therefore increase the companys valuation and provide leverage in negotiating business deals.

An offensive approach to patenting allows patent owners to enforce their rights through litigation in a federal district court, or at the U.S. International Trade Commission (ITC). Courts may award a successful patent owner litigant remedies including injunction, lost profits, reasonable royalties, andfor egregious intentional infringerspunitive/enhanced damages. As importantly, the ITC provides a quicker process than the courts and is able to stop patent infringers from importing infringing products or services into the U.S.

To adequately benefit from patent ownership, a patent application must be prepared to overcome the statutory hurdles to patentability, without giving up valuable scope of protection. Software-based technologies, like blockchain technology, are often rejected under the subject matter eligibility hurdle of the U.S. Patent Law (35 U.S.C. 101). To overcome this hurdle, care should be taken to ensure that the disclosure of the invention in the patent application emphasizes a practical, and advantageous, technological application of the invention to prevent the rejection of the patent application based on an unpatentable abstract ideasuch as, a mathematical concept, a method of organizing human activity, or a mental processand/or provides for additional elements amounting to an inventive concept beyond a mere abstract idea.

For example, patent claims describing a method of renewable energy trading using IoT sensors, processors, and memory to autonomously measure, record, and analyze energy supply and usage data through a blockchain ledger may be rejected by the USPTO based on the grounds that they are directed to a method of organizing human activity (that is, measuring, recording, and analyzing energy data may be considered as organizing human activity or a fundamental economic practice). Furthermore, the USPTO may reason that merely recording and analyzing energy-related data through a generic blockchain ledger provides no practical application of the fundamental economic practice and that the recitation of generic IoT sensors and computer hardware does not provide an inventive concept beyond the fundamental economic practice.

Such a rejection may be avoided altogether by drafting the application with a technological problem-solution emphasis and identifying how problems of existing approaches are overcome by the applicants invention. This approach would help ensure that the patent claims are not drafted to preempt all future technological improvements, but to focus more reasonably on the relevant technological area of invention. For example, claims incorporating features of an energy-specific data structure to be stored in a blockchain to improve the processing of transactions would likely remove the claims from the abstract idea realm, because the invention would not threaten to preempt virtually all applications of blockchain technology as applied to energy trading.

Furthermore, inventions that improve the functionality of blockchain technology itself may avoid or overcome a rejection under 35 U.S.C. 101. That is, improvements to distributed storage, distributed processing, cryptography, security and authentication, data structures, and data exchange protocols would not likely be interpreted as being directed to an abstract idea. For example, proof-of-work consensus algorithms provide security for many cryptocurrencies, but they intentionally slow down processing and waste electricity. Accordingly, an invention involving an energy-specific consensus algorithm that provides adequate security with greater energy efficiency and faster processing would not likely be rejected under 35 U.S.C. 101.

Additionally, patent claims should be drafted to facilitate investigation and the collection of facts to support an infringement allegation. For example, patent claims related to distributed renewable energy assets and linked via blockchain technology should allow for a finding of infringement by one infringer in one location, rather than requiring a series of steps to be performed by multiple parties in multiple jurisdictions.

While blockchain technology is in its infancy, choosing to invest and become a patent holder for early blockchain inventions could pay dividends as the technology matures to become widely popular and useful, particularly in energy-related industries. To benefit from the maximum scope of patent protection, it is important to seek out counsel with the experience and sufficient understanding of the legal and technical issues to handle the challenges associated with patenting software-related technologies.
