Birmingham Health Care denies it misappropriated funds

BIRMINGHAM, Alabama -- Answering new allegations against it, Birmingham Health Care denied it misappropriated funds from a Tuskegee community health center, according to its latest court filing.

The Birmingham community health center also reiterated its denials on a series of other allegations and pointed the finger back at the Tuskegee operation, Central Alabama Comprehensive Health (CACH), for any damages incurred in the dispute stemming from a prior business relationship.

CACH's "damages, if any, are the direct result of its own acts, negligence and/or omissions," according to the Birmingham Health Care (BHC) filing this week in Jefferson County Circuit Court.

CACH sued Birmingham Health Care (BHC) Feb. 6, 2012, initially for conversion and breach of contract in a case dating back to 2011 when CACH ended a $225,000 per year management contract with BHC. CACH claimed BHC withheld records CACH says are essential to its financial viability and its ability to comply with federal regulations.

CACH and BHC are both federally qualified health centers which give them the ability to receive higher Medicaid reimbursements and access to other federal funding to serve the poor and homeless.

After a series of audits, which included depositions of past and present BHC officials, CACH added "misappropriation of funds" to the lawsuit.

"BHC and its agents and employees misappropriated CACH's grant funds and other monies for their own use," CACH alleged in its amended complaint filed May 23.

CACH is asking for compensatory and punitive damages and attorney's fees and costs, but did not put a dollar figure on that amount.

Besides denying the misappropriation allegation in the latest filing, BHC also denied all other allegations, including conversion, breach of contract and negligence.

Before I stumbled across vegangmo.com the other day I thought I knew the arguments for and against genetically-engineered crops.

The Vegan GMO website showed me I don't know as much as I thought. The site's "why are we vegans pro GMO?" page (http://www.vegangmo.com) lists four reasons, three of which were new to me:

-- Some safety tests for GE crops involve animal experiments;

-- Genetic engineering could create "animal alternative" foods that would encourage more veganism, like artificial cheese;

-- Genetic engineering could create plants containing nutrients vegans lack, like vitamin B12 and DHA;

-- GE crops use less fertilizer and pesticides, so fewer insects and fish are killed, and "no- or low-till agriculture will save the lives of ground-dwelling animals."

It was the first reason -- opposition to animal tests -- that led me to the site. I had been reading up on a study purporting to show that pigs consuming genetically-engineered corn and soybeans had developed health problems. Vegan GMO had quoted (http://www.vegangmo.com), a rebuttal charging that "this study subjects animals to inhumanely poor conditions resulting in health impacts which can then be data-mined to present 'evidence' against GMO feeds."

The rebuttal, by British environmentalist and recent pro-GE convert Mark Lynas, leveled other broadsides at the study (http://tiny.cc/). It noted that while the study's authors highlighted one measure on which the GE-fed pigs scored worse than those on conventional feed, on several health measures the GE-fed pigs had scored better.

As you might expect, though, the vegan website's excerpt from the Lynas rebuttal stuck with the animal-cruelty argument.

"Most damning of all," the excerpt continued, "close to 60% of both sets of pigs were suffering from pneumonia at the time of slaughter -- another classic indicator of bad husbandry. Had they not been slaughtered, all these pigs might well have died quickly anyway. No conclusions can be drawn from this study, except for one -- that there should be tighter controls on experiments performed on animals by anti-biotech campaigners, for the sake of animal welfare."

Freedom Celebration set for Sunday

North Glencoe Baptist Churchs annual Freedom Celebration takes place from 6 p.m. to 9 p.m. Sunday in the churchs park, and the community is invited to take part.

Vision Pastor Adam Ragsdale said this years event is designed to be more community- and veteran-oriented.

The focus on the community starts well before the celebration does.

We are having an abbreviated service on Sunday morning, Ragsdale wrote in an email. Our church has partnered with McGuffey Health Care to take gift baskets to residents and employees. Were calling the event The Church Has Left The Building. Well also be asking our people to spread the word about Freedom Celebration that morning as well. Were trying to get our people to stop coming to church and to start being the church. We hope this event will be a great way to do that.

As time for the celebration nears, church members will return to the building, but Media Minister Brian Goble said he hopes no one has to go in the building.

As of right now, we are going forward with outdoors, Goble wrote in an email. Our immediate rain plan will more than likely move things inside the main building at North Glencoe. We are closely monitoring the weather and will post more details about the game plan this weekend on Facebook (Facebook.com/northglencoe) and our website (northglencoe.org).

As the festivities get started, visitors can enjoy free hot dogs, snacks and bottled water. As in the past, there will be inflatables, dunking booths and face-painting for children, all free of charge.

We have some really cool things going on that we havent (had) in the past, Ragsdale wrote.

This includes a salute to those who have served the cause of freedom.

Freedom Win Series Over Windy City With Tanis Two Run Homer

June 21, 2013 - Frontier League (FL) Florence Freedom Crestwood,IL-The Florence Freedom(17-13)defeated the Windy City ThunderBolts(11-20) 4-3 Thursday night at Standard Bank Stadium. With Windy City ahead 3-2 in the eighth, J.C. Figueroa started the Freedom inning off by singling into centerfield. Two batters later Jacob Tanis hit a two run homer to left field, his fourth of the season as it gave the Freedom a 4-3 lead. Tanis finished 2-4 with 3 RBI. Figueroa also went 2-3 for the Freedom.

The game was scoreless until the fifth inning as Mike Torres lined out on a terrific diving catch by shortstop Junior Arrojo in left field scoring C.J. Gillman giving Windy City a 1-0 lead. The Freedom took the lead in the sixth as Tanis produced an RBI triple, and Jeremy Hamilton recorded an RBI single to make it 2-1. Windy City then scored a run in the sixth and seventh before the comeback by the Freedom in the eighth.

Michael Oros, the Freedom starter earned a no decision as he went 5.2 innings allowing eight hits on two earned runs. Brandon Mathes(2-4) collected the win out of the bullpen throwing 1.2 scoreless innings with Jorge Marban nailing down his seventh save. It was a 1-2-3 inning for Marban in the ninth.

The Freedom will now travel to Marion, Illinois and start a three game series Friday night against the Southern Illinois Miners. RHP Justice French(0-2, 5.68) will start for the Freedom as the Miners will have RHP Travis Bradshaw(0-2,5.68) on the hill. The game can be heard starting at 7:50 pm with Steve Jarnicki on 1320 AM and gospel1320.com.

Invicta FC 6: Cyborg vs. Coenen II Moves to Cable and Satellite PPV in North America

Invicta FC 6: Cyborg vs. Coenen II, the promotions next event, will be available on traditional cable and satellite provider-based pay-per-view in the United States and Canada.

Promotion officials announced the move, a first for the company, on Thursday.

Invicta FC 6 features Cris Cyborg vs.Marloes Coenen rematching in a headlining featherweight title bout, while the co-main event features undefeated strawweights Ayaka Hamasaki and Claudio Gadelha.

Invictas previous events have been available as an online-only pay-per-view on its website and via U-Stream. Invicta FC 6 will still be available via U-Stream for international viewers, but will now be available in the U.S. via iN Demand, DISH, and Avail-TVN, and on Bell TV in Canada.

Both the traditional and online pay-per-view are priced at $14.95, and starts at 9 p.m. ET / 6 p.m. PT.
