Liberty student OK after struck by car

OTTUMWA A very scary and dangerous event took place Thursday morning at Liberty Elementary School when a student was struck by a moving vehicle, but thankfully no one was seriously injured in the accident.

According to Dr. Davis Eidahl, Ottumwa Community School District superintendent, a fifth-grade female student was working safety patrol on one of the crosswalks outside the school. She apparently stepped away from where she was standing and was struck and knocked down by a vehicle.

Thankfully, though, the student was not seriously injured.

Eidahl said immediately after the accident observers in the traffic line called 911, and the schools office and the mother of the child were notified.

When the parent arrived at the scene, Eidahl said, she and Liberty staff assessed the young girl to see if she was injured before the ambulance crew arrived. Then, when the paramedics got there, professionals also made sure she wasnt seriously hurt before releasing the student to her mother.

We can all feel fortunate that she is safe, Eidahl said.

As far as the crosswalk goes, he said they will plan to not have students there in the future.

We are going to make some adjustments as far as that specific site, he said.

According to Eidahl, adults will be performing safety patrol at that crosswalk from now on, and the administration staff has met to review the schools pick-up and drop-off practices so everyone can remain safe.

Pizza restaurant named for Liberty Center development

Pies & Pints, not your average pizza joint, is the first restaurant tenant to be announced for the future Liberty Center.

The pizzeria, with arguably the best craft brew program around revealed plans Friday to enter the Cincinnati market with the Butler County location. Co-owner and President Rob Lindeman said the five-restaurant and growing pizza business has signed a lease at the mega retail center.

Liberty Center, in the early stages of construction in Liberty Twp., is the name of the approximately 1.4 million-square-foot mixed-use shopping, office and residential complex planned for the intersection of Ohio 129, Interstate 75 and Liberty Way. Its scheduled to open in September 2015, according to developers.

We have an executed lease and will be going into the project when it opens, Lindeman said.

Were a small mom-and-pop company that really prides itself on high quality, great tasting pizza, he said. We try to provide the most flavorful, most unique pizza.

Liberty Center is being built by Columbus-based developer Steiner + Associates, the same developer of Easton Town Center in the Columbus-area and The Greene in Beavercreek. The projects first phase is expected to be a more than $300 million investment encompassing 65 acres.

Its being developed by one of the premier developers in the country, Steiner. Weve known those folks for a period of time. They saw the product in Worthington, liked it, and we got a great location in the center, Lindeman said.

Pies & Pints was founded in 2003 at original storefront Fayetteville, W.Va. The craft pizza and beer venture has since expanded to Charleston, W.Va.; Morgantown, W.Va.; Worthington, Ohio, and Beavercreek at The Greene. Lindeman said a sixth restaurant is opening this year in Lexington, Ky.

The Greene location opened in August 2013. The yet-to-open Liberty Center pizza place will be comparable to the nearby Dayton-area restaurant with 60 to 65 full- and part-time employees, Lindeman said. Pies & Pints at The Greene has seating for approximately 150 people, and sells 22 bottled beers with 35 rotating beer taps. A similar size restaurant and offering can be expected in Liberty Twp.

CPAC's Conservative-Libertarian Split Could Be Hard To Bridge

If any two issues illustrate how difficult it could be for the part of the Republican Party represented by the social and national security conservatives to bridge their differences with libertarians, same-sex marriage and National Security Agency intelligence are good candidates

Discussions at the 2014 Conservative Political Action Conference got testy Friday, when libertarians defended positions out of synch with the more traditional stances that have defined the Republican Party for decades.

At a panel on privacy, for instance, centering on Edward Snowden's revelations about the NSA's data gathering, former Virginia Gov. Jim Gilmore dramatically held aloft a New York Post front page with photos of Snowden and Russian president Vladimir Putin under the headline "Comrades."

"Edward Snowden is a traitor and a coward," Gilmore said. "The fact is, Edward Snowden betrayed his trust."

Gilmore, who once served as a military intel officer, said Snowden seriously damaged U.S. intelligence efforts. He also accused political leaders who've used Snowden's disclosures to suggest that there's widespread surveillance of average citizens by the federal government of "demagoguery."

Responding to Gilmore, Bruce Fein, a libertarian lawyer who's been involved in a lawsuit against the federal government, said that he ignores the more rampant lawlessness which is "government violating the rule of law."

"All these examples of government lawlessness, total silence on Gov. Gilmore's side," Fein said. "And when the government becomes a lawbreaker, it invites every man and woman to become a law unto themselves."

If there was common ground, it wasn't much on display during this session. That debate also displayed the tricky territory Republicans are going to have to navigate if they are to find a compromise on this issue.

Secretary of State Jon Husted decided late Friday to remove Charlie Earl, the Libertarian candidate for governor, off the May primary ballot.

That decision effectively removes the possibility of a Libertarian name being on the November ballot.

Husted said he is following the recommendation of a hearing officer who concluded Earl and Steve Linnabary, the Libertarian candidate for Attorney General, do not have enough valid signatures on petitions.

The decision is being hailed as a victory for state Republicans who were concerned that Earl could garner 3 to 5 percent of the statewide vote in November.

Republican governor John Kasich narrowly defeated then-Democratic governor Ted Strickland in 2010 by a 49 to 47 percent margin.

Kasichs two point victory came in an election year heavily dominated by GOP candidates who swept every statewide office in Ohio.

Republican strategist Terry Casey said the evidence was clear that Libertarian operatives failed to meet the legal requirements on petitions.

"I was shocked when I saw the involvement of the Ohio Democrat Party in collusion with Libertarians," said Casey. "There was testimony about the breakfast between the Libertarian Party head and Ohio Democrat Party chairman Chris Redfern. I'm shocked the Democrats are this desperate."

Democrat operatives were quick to criticize the decision and suggested Kasich supporters are trying to clear the ballot.

In good news for Gov. John Kasich, a Libertarian gubernatorial candidate was ruled off the ballot today.

Secretary of State Jon Husted accepted the recommendations of a hearing officer saying professional signature gatherers hired by the party should have listed the Libertarians as their employer on the petitions and petitions were gathered contrary to state law. That means that Libertarian Charles R. Earl and running mate Sherry L. Clark are off the ballot. So is attorney general candidate Steven R. Linnabary.

Mark Brown, attorney for the Libertarian Party, said he would file an appeal in federal court tonight.

Were going to argue under the First Amendment that the employer statute is unconstitutional, and well also argue under the 14th amendment of equal access, Brown said. Secretary Husted changed the rules in the midst of the game once again, and you cant do that either.

The Libertarians have already successfully won two preliminary injunctions in federal court during the 2014 election cycle; one preventing Husted from enforcing residency requirements for petition circulators and the other preventing him from enforcing a bill that would have it made very difficult for minor party candidates to make the ballot.

Both of those laws were passed by the Republican-controlled legislature and signed by Kasich; some Republicans were worried that Earl would draw votes from Kasich.

Husted, who like Kasich is a Republican, based his ruling on the recommendation of former Federal Election Commission member Brad Smith, who presided over a protest hearing this week.

Earl, who is in Columbus for the Libertarians state convention this weekend and is supposed to give the keynote address, said on the face of it, the way the law is written, I cant disagree with Husteds ruling. But Earl said he would let attorneys challenge the ruling in court and Ill know in a week or so if Im going to go back and plant a garden this spring.
