Ian Lesser, senior director for foreign and security policy at the German Marshall Fund of the United States, said NATO must remain mindful of other modern security challenges, including cyberterrorism, threats to energy supplies and armed Islamic extremism.

But he predicted the trans-Atlantic alliance's focus will shift dramatically because of what he termed the biggest game changer in European security and defense environment in 20 years: Russia's armed aggression in Crimea and the Kremlin's continuing military pressure on Ukraine.

"Today we have a situation in which Russia and especially the Russian leadership is highly unpredictable," Lesser said. "There is something about the current crisis that suggests Russia is a rogue state, with all that would imply for deterrence and reassurance of allies."

As the alliance ponders how to react in Europe after years of fielding operations in the Middle East, Africa and Afghanistan, one of NATO's top commanders told The Associated Press that Russia's demonstrated ability to swiftly mobilize large numbers of troops in so-called snap exercises and Moscow's uncertain intentions have forced a rethink of NATO's capacity to respond and the deployment of its forces.

"What I am thinking about now is, is NATO correctly positioned and is it at the right state of responsiveness?" U.S. Air Force Gen. Philip Breedlove, NATO's supreme commander in Europe, said in a recent interview. "If we expect that Mr. Putin is going to be in charge of Russia for many years, if we are going to see this kind of exercise behavior in the future, are we prepared to react to the next snap exercise that goes across a border to impose its will on another sovereign nation in a different part of Europe? That's what I've been doing a lot of thinking about."

Already, NATO has reinforced its Baltic air patrols, put AWACS surveillance planes in the skies over Poland and Romania, dispatched warships to the Baltic and Black seas and sent 600 U.S. Army paratroopers to Poland and the Baltic states on temporary deployment.

Discussions are under way on longer-term measures, and how NATO must reposition, retool and otherwise react to the new challenge from Moscow will be the most pressing question on the agenda when President Barack Obama and leaders of the alliance's 27 other member nations gather for a summit in Wales this September.

During a visit to Canada this week, Breedlove said he wants the political leaders to think about permanently stationing alliance forces in Eastern Europe to reinforce local defense capabilities.

Magistrate waxes poetic while rejecting Gmail search request

A federal magistrate in San Jose has rejected a bid by prosecutors to search an unidentified target's Google e-mail account, criticizing the "seize first, search second" request as overbroad and unreasonable under the Fourth Amendment.

U.S. Magistrate Paul Grewal could have simply denied the request in a stark order without preamble or explanation.

Instead, Grewal waxed poetic, beginning his seven-page ruling Friday by painting a portrait of how each day he "joins the teeming masses of the Bay Area on Highway 101 or 280," marked by "lengthy queues" at exits in Mountain View, Sunnyvale and Cupertino. "The Technorati are, in short, everywhere" in Silicon Valley, from the "humble downtown San Jose taqueria" to the "overpriced Palo Alto cafe," he said.

Grewal said he was hammering home a point, that "too few understand, or even suspect, the essential role played by many of these workers and their employers in facilitating most government access to private citizens' data."

The magistrate said he had reviewed an application by the government to search the Gmail account of a person suspected of stealing government funds.

The judge noted that "no defendant yet exists, as no case has yet been filed. There are no hearings, no witnesses, no briefs and no debate. Instead, a magistrate judge is left to predict what would or would not be reasonable in executing the warrant without any hard, ripe facts. This is hardly a recipe for success."

Although Grewal said he did find probable cause to believe that the Gmail account in question in fact contained evidence of theft, "what of all the data associated with the account which supplies no such evidence whatsoever?"

Grewal blasted the request as overreaching under the Fourth Amendment, which bans unreasonable searches. He said federal officials failed to provide any date restriction, other than to say the alleged crimes began in 2010.

"Nor has the government made any kind of commitment to return or destroy evidence that is not relevant to its investigation," Grewal wrote.

"This unrestricted right to retain and use every bit Google coughs up undermines the entire effort the application otherwise makes to limit the obvious impact under the plain view doctrine of providing such unfettered government access," he wrote.

Lawmakers divided on bill that restricts EBT use

State Rep. Timothy Horrigan is blasting a proposed bill that would ban people from buying guns with their electronic benefits transfer cards, saying it violates their Second Amendment rights.

EBT cards are part of a system that allows people to use their welfare funds electronically. The proposal is part of Senate Bill 203, and would ban EBT card users from buying items such as alcohol, cigarettes and guns.

Inserting guns into the proposal has both Republicans and Democrats taking shots at each other.

Horrigan, a Democrat and an anti-gun politician, said he wants people on government assistance to be able to buy guns with the card.

Republicans said these are entitlement funds earmarked for food and other essentials instead of firearms.

State Rep. Bill OBrien, a Republican, said Horrigan has consistently voted for tougher gun laws and that his sudden concern with a persons Second Amendment right is a tactic to stall the bill.

They are using Second Amendment arguments to keep it from going through, OBrien said.

Horrigan said his concern is for peoples safety and their constitutional rights.

There may be cases where people need a gun for self-defense or target shooters. You cant buy a fancy gun or ammo, Horrigan said.

Horrigan said EBT cards are a small part of the state budget. The proposed measure must go through a committee during the summer to see if it will advance to the House floor for a vote.
