Ex-Freedom High student to face charges of plotting school attack

By ELAINE SILVESTRINI | The Tampa Tribune Published: August 20, 2012 Updated: August 20, 2012 - 12:54 PM

TAMPA A former Freedom High School student will face charges alleging he plotted a Columbine-style attack at the school, a Circuit Court judge has ruled.

Jared Cano's plans to blow up the school were nothing more than a "half-baked scheme," according to his lawyer, Norman S. Canella Sr., who filed a motion asking a judge to dismiss charges of threatening to discharge a destructive device and attempting to discharge a destructive device with intention to harm.

Canella argued that the items assembled by Cano including a timer, pipes and chemicals could not have exploded or hurt anyone.

But Assistant State Attorney John Terry said it doesn't matter under the law whether Cano's bomb would have succeeded.

Cano told a high school student about his plans, and the student was concerned enough to go to police and become an informant, Terry said. Cano made a timer and compiled bomb ingredients and instructions.

"The Legislature wants to stop these people before they actually make these bombs," Terry said during a hearing last Month before Circuit Court Judge Kimberly Fernandez.

Fernandez has issued a written order denying the defense motion, siding with the prosecution. Fernandez wrote that a jury could reasonably conclude that Cano's actions fulfilled the legal requirements for a conviction.

"I was disappointed, but not shocked," Canella said Monday. "I need to consult with my client. Obviously, there is a real possibility of an appeal."

Cano, who had been expelled from the school, was arrested in August 2011 after authorities said they received a tip Cano wanted to bomb the school. Police searched his family's apartment and said they found bomb-making material, marijuana plants and a "manifesto" containing minute-by-minute plans to kill two school officials and at least 30 students.

Do you have children starting school this week?

WEST FARGO - Freedom Elementary opens here this week and its already full.

The newest building in the rapidly growing West Fargo School District is expected to greet 561 students when classes start Thursday, said Principal Jeff Johnson.

Its built to handle 550.

Plans were to have the school open with 470 students when the school board approved construction last year, Business Manager Mark Lemer said.

We knew we were going to have growth, he said. But we didnt anticipate that it would open over its maximum capacity.

You can thank the great construction weather this past year, Johnson said. It helped builders pepper the area with homes for young families.

Freedom is patterned after Aurora Elementary, which opened in fall 2007 in the Eagle Run area. Using that template saved at least $180,000 in architectural fees on the new school just south of Interstate 94 and west of Veterans Boulevard, Lemer said.

Freedom runs for two second-half scores but can't overcome big hole

Credit: Charles Wingate | The News Herald

Freedom senior wide receiver Marcus Davis (5) hauls in a pass that helped set up his team's first touchdown on Friday in Sawmills.

Freedom Highs football opener was a tale of two halves.

South Caldwell raced to a three-touchdown advantage in the opening half then held off a vicious second-half rally by the visiting Patriots to claim a 21-12 non-conference football contest Friday at Spartan Stadium.

The Spartans dominated the first quarter in all aspects of the game. They received the opening kickoff then drove 70 yards on 11 plays all rushes to hit paydirt on a 2-yard run off tackle by senior running back Tyler Barber.

Freedoms Khris Gardin returned the ensuing kickoff 43 yards to the Spartan 42. After an illegal motion penalty, senior quarterback Shawn Fairchild hit Gardin with a 9-yard completion. On second down, Fairchild scampered for a 4-yard gain but was stripped of the ball, which was recovered by SCs Andrew Tilghman.

I think if we would have scored there, it would have been a different game, said Freedom coach Mike Helms.

The Spartans wing-T ground attack went back to work in fine fashion, piling up 66 yards on eight attempts as Zac Pollard converted the final 2-yard scoring run for a 14-0 lead with 1:44 left in the opening quarter.

Freedom junior Kwan Hall scooped up a squib kick and returned it 11 yards to put the Pats in good field position at their own 42.

The Patriots could not convert as a dropped pass, a 3-yard rush by David Burgess and an incompletion forced a punt, which only traveled five yards to put SC at midfield.

Leaked: The GOP's Proposed New Position On Internet Freedom

House Oversight Committee Chairman Darrell Issa, R-Calif., leads a hearing on Capitol Hill.

The Republican party may be ready to take a new position on Internet freedom, according to a document obtained by Whispers.

California Rep. Darrell Issa's proposal calls for the Republican party to take a stance on the Internet that limits the role of government and allows Americans to "participate where and how they choose on the Internet."

According to sources familiar with the Republican party platform process, the GOP has been increasingly discussing Internet freedom, and could be ready to officially roll out its stance later this month at the Republican convention.

Kirsten Kukowski, a spokesperson for the Republican National Committee, writes in an E-mail that Issa's is "one submission of many on the subject."

But don't expect another showdown between Issa, who favors a lighthanded approach to Internet legislation and Texas Rep. Lamar Smith, who introduced the controversial Stop Online Piracy Act (SOPA), a bill that spurred widespread Internet blackouts and protests earlier this year.

Kim Smith, Lamar Smith's press secretary, tells Whispers that the Congressman "did not submit any language pertaining to the Internet for the GOP platform."

[Four ThingsAmericansHave Learned From the SOPAFight]

Sources familiar with ongoing discussions say they are "hopeful" that Issa's proposal will make it into the final party platform, and that "conversations that have occurred [on Internet freedom] have been well received" and that the Republicans hope "not to over-regulate the Internet."

Freedom comes with responsibility — Tay Tian Yan

AUG 17 The controversies over the section 114A of the Evidence Act are not hard to comprehend. The key lies with the correlation between the freedom accorded and accountability.

To enjoy freedom of expression, one is ethically bound to shoulder the responsibility of exercising such a freedom.

This is a basic social norm and the core spirit of a community ruled by law. Any orderly democratic society cannot do away with this prerequisite.

That said, there is often a grey zone standing in the way of freedom and responsibility. It is at times next to impossible to draw a distinct line between the two opposing attributes.

Several days ago, a friend forwarded me a joke that somewhat epitomises such a conflict.

A Beijing reporter asks a visiting leader: What do you think of the hostesses here?

Appearing shocked, the leader asks: You mean you have hostesses in Beijing as well?

The newspaper headline the following morning: Visiting Leader asks for Beijing hostesses.

The leader rings up to clarify: Please, Im not interested in hostesses!

Another days headline: Uninterested in local hostesses, the Leader has higher tastes for after-dark pleasure.

Rights and freedom

By LIM MUN FAH Translated by SOONG PHUI JEE Sin Chew Daily

Media practitioners are well aware that there is not government that does not wish to suppress freedom of the press and freedom of speech in the world. And there is no political party that does not wish to manipulate the media and public opinion.

You might have heard a clich for thousands of times, but I still have to mention it here. That is, there is no absolute freedom in the world, but only relative freedom.

If you understand the above mentioned reality, you will then find it not difficult to understand why governments around the world always introduce laws to restrict freedom of the press and freedom of speech.

Originally, the formulation and adoption of any statutes in democratic countries should consider the following points:

The answers are not absolute for the same questions.

It depends on your view point and what stand you are taking. Take Section 114A of the Evidence Act as an example, it is definitely necessary, urgent and reasonable in the eyes of the ruling coalition.

On the contrary, the opposition will never agree with it. Instead, it is neither necessary nor reasonable. Moreover, the next general election might be held at any time now and in this crucial period, of course the alternative coalition is very much worried that the government might make use of the Act to stop the alternative coalition from gaining the people's support through the Internet.

In fact, not only alternative coalition members, but also some in the ruling coalition, are opposing Section 114(a) of the Act. Among them are Umno Youth chief Khairy Jamaluddin and Deputy Higher Education Minister Datuk Saifuddin Abdullah.

Saifuddin has very accurately grabbed the people's anxiety, namely the provision might create a culture of fear.

Hoy set for Freedom of Edinburgh

15 August 2012 Last updated at 15:59 ET

Sir Chris Hoy is set to be awarded the Freedom of Edinburgh if councillors vote to approve the honour next week.

Edinburgh's Lord Provost also vowed the city would welcome home Sir Chris and other Olympic heroes despite official celebrations being in Glasgow.

It comes after SportScotland confirmed the official victory parade for Scotland's Olympians will be held in Glasgow on Friday 14 September.

Scottish athletes won a record 13 medals at the London Games.

Lord Provost of Edinburgh Donald Wilson said the capital would host its own parade for Edinburgh Olympians.

Mr Wilson said: "While I am naturally disappointed the parade for our Olympians and Paralympians will not be held in the nation's capital, I am pleased that their fantastic achievements are being celebrated.

"This does not affect Edinburgh's intention to welcome our own local Olympians and Paralympians to their home city and to show them how proud we are of their achievements."

Sir Chris won two gold medals at the Games in London to become Britain's most successful Olympian.

Councillor Steve Cardownie added: "There is no higher - or more fitting - recognition for Sir Chris than to offer him the Freedom of the City of Edinburgh."
