AKRON, Ohio - After 17 years in prison for murder, Dewey Jones will get a new trial in Summit County.

Jones motion for a new trial was granted by the Summit County Common Pleas Court Tuesday based on new DNA evidence.

Judge Mary Margaret Rowlands wrote in her decision that the absence of Jones and another suspect Gary Rusus DNA on newly tested evidence calls into question the States entire theory of the case.

Jones, 50, was convicted in 1995 for the 1993 murder of Neal Rankin, a 71-year-old Goodyear retiree, who was discovered shot inside his home on Valentine's Day in Akron's Chapel Hill area.

The DNA Diagnostics Center of Fairfield conducted the DNA tests. They showed DNA taken from a rope used to tie Rankin's wrists and a knife found at the scene do not match Jones.

Rowlands said that evidence also undermines the testimony of State witness Willie Caton that Jones and Rusu went to Rankins house to rob the man and Jones shot him.

This newly discovered evidence calls into question the credibility and reliability of Mr. Catons testimony, and combined with the absence of any DNA supporting his testimony, requires this Court to grant the motion for a new trial, Rowlands wrote.

The Court denied the defenses argument of prosecutorial misconduct as grounds for the new trial.

Joness daughter Ashley told NewsChannel5s Bob Jones in May that her father believes hes innocent.

In one of his letters to his daughter, Jones wrote, "I've always knew God was going to bring out the truth. I just never thought it would take as long as it has been. I'm looking forward to the day the truth comes out and they set me free and I can see all my children."

DNA evidence helps police find suspect in 2009 break-in, truck theft

LAKE HALLIE, Wis. (WEAU) A suspect in a break-in two years ago is now charged in the case, and officers say DNA evidence is what led them to the suspect.

Curtis Brown, 25, of Lyndon Station is charged in Chippewa County with Burglary and several other counts. Hes scheduled to appear in court later this month.

Lake Hallie Police initially responded to Randys Holiday Towing on 115th Avenue in Lake Hallie on November 13, 2009. They say someone had forced their way in through the front door, and stole an employees pickup truck. The suspect drove it through the overhead garage door. Eau Claire Police found the truck that day, and a Lake Hallie officer collected DNA evidence by swabbing the interior of the truck. An unidentified mans DNA was found in the truck.

Brown, who was on probation in Sauk County, was reported to Lake Hallie Police as a matching person to the DNA evidence in March 2012. Officers interviewed him and collected his DNA. Brown admitted to police that he forced the door open and stole the truck. Police say the owner of the business doesnt know Brown. He also didnt know who owned the vehicle which was stolen.

Jones, 50, was convicted in March 1995 of robbing and killing 71-year-old Neal Rankin, a family friend. Jones previously had been convicted of drug trafficking and passing bad checks, but he has always maintained his innocence in Rankins murder.

Ive done some things Im not proud of in life and made some bad choices, Jones told The Dispatch last year at the Richland Correctional Institution in Mansfield last year. But Ive not hurt or killed anyone.

The lab tests, conducted by DNA Diagnostics Center of Fairfield in southwestern Ohio, found a partial male DNA profile on the piece of rope used to tie Rankins wrists, the knife used to cut the rope, and pieces of Rankins shirt sleeves. None of it matched Jones when compared with his DNA.

The testing also found no DNA that matched Gary Rusu, whom the states lead witness testified was in Rankins home on the night of the murder, Feb. 13, 1993.

Rowlands, in her two-page ruling, said the lack of DNA evidence is significant.

The absence of both Mr. Jones and Mr. Rusus DNA on the new tested evidence calls into question the States entire theory of the case, Rowlands wrote. Carrie Wood, Jones Innocence Project attorney from Cincinnati, said she will now be seeking Jones release from prison.

Finding a treatment to HIV or cancer might not be far away for one MU professor.

Peter Cornish, a biochemistry assistant professor in the MU School of Medicine, became the first MU recipient of the Pew Scholar Award.

The Pew Scholars Program in the Biomedical Sciences provides funding to young investigators of outstanding promise in science relevant to the advancement of human health, the Pew Charitable Trusts website stated.

Cornish graduated from Graceland University with bachelor's degrees in biology, chemistry and mathematics in 2000. He received his doctorate in biochemistry from Texas Tech University in 2005. After five years of working in a post-doctoral program at the University of Illinois-Urbana-Champaign, Cornish arrived at MU in 2010, where he has conducted research on disrupting protein factories inside bacteria and viruses throughout the body.

New Study Affirms Masimo rainbow® Pulse CO-Oximetry™ Accuracy for Noninvasive Carboxyhemoglobin and Methemoglobin …

IRVINE, Calif., July 9, 2012 /PRNewswire/ --Masimo (MASI) announced today a new study in Respiratory Physiology & Neurobiology shows that noninvasive carboxyhemoglobin (SpCO) and methemoglobin (SpMet) measurements with Masimo rainbow Pulse CO-Oximetry are accurate and conclude they can be used as an effective first screening test with emergency room patients suspected of suffering carbon monoxide (CO) poisoning.(1)

CO poisoning is a major cause of morbidity and mortality(2) and is responsible for more than 50,000 emergency department visits per year in the United States.(3) Because symptoms of CO poisoning are nonspecific ranging from mild headache, nausea, confusion, and dizziness to end-organ injury, such as myocardial infarction, stroke, and death diagnosis is difficult and has historically relied on clinical suspicion and confirmation by measurement of carboxyhemoglobin (COHb) via invasive blood-gas analysis. Unfortunately, it has been estimated that up to half of U.S. hospitals do not have invasive COHb testing ability increasing the potential that many victims of CO poisoning could be overlooked and misdiagnosed.(4)

The study was conducted on healthy subjects who inhaled a mixture that included carbon monoxide such that it raised the COHb to 10% to 14%. Investigators compared the mean bias and precision of SpCO and SpMet data obtained noninvasively with a Masimo Rad-57 Pulse CO-Oximeter and adult reusable SpCO rainbow sensor (DCI-dc3) with invasive venous blood samples analyzed on an arterial blood-gas analyzer (ABL80 FLEX CO-oximeter, Radiometer America).

The SpMet results showed the mean bias was 0.0% and precision was 0.3%. The SpCO measurements showed a mean bias of 0.8% and precision of 2.5%.

Researchers noted the Rad-57 "provides coherent and reproducible day-to-day measurement" of SpCO and SpMet, and concluded the "Rad-57 should be used as a first screening to determine whether an invasive blood measurement of COHb should be performed to confirm the (CO) intoxication."

American Society for Microbiology’s newest journal earns a high impact factor in latest rankings

Less than two years after publishing its first issue, the online open-access journal mBio is now ranked among the top 20 highest-impact microbiology journals according to Thomson Reuters, which has just released its Journal Citation Reports for 2011. Thomson Reuters tracks the number of times scholarly articles are cited by other authors and compiles the information into "impact factors", rough measures of the quality or standing of a journal within its field. Since the American Society for Microbiology (ASM) launched mBio in April 2010, it already boasts an impact factor of 5.311 and ranks 16th among all microbiology-centered journals.

mBio is ASM's first broad-scope open-access journal and is published solely online. Among the journal's other distinguishing features is its streamlined decision policy, a response to what many in science perceive to be overly onerous revision requirements by many study reviewers. Using a rigorous peer-review process with an eye to importance and impact, mBio offers authors an up or down decision on manuscripts and will request only minor revisions. The average time to first decision for all mBio manuscripts (excluding those editorially rejected) is 23 days.

In its short history, mBio has published a number of studies and opinion pieces that have garnered national and international attention, in such media outlets as the New York Times, MSNBC, and CNN. An article published in February 2011 by scientists at Northwestern University was the first to reveal the presence of human DNA in a bacterium, the pathogen Neisseria gonorrhoeae, a genetic entanglement that many thought was not possible and contributes to our understanding of how pathogens and hosts can evolve together. The news about gonorrhea was picked up by bloggers and writers for the national press.

mBio published another high-profile article in February 2012 which revealed that one type of MRSA, a bacterium that causes invasive skin infections, most likely acquired its resistance to antibiotics while it lived in livestock. The findings illustrated the best evidence to date linking antibiotic use on the farm and antibiotic resistance in an organism that can cause lethal infections in humans. The article added fuel to an already fiery debate about the wisdom and ethics of using antibiotics as growth promoters in livestock.

Editor-in-Chief, Arturo Casadevall, says that the goal for the next year is a continued focus on identifying highly important papers.

While the journal rankings by Thomson Reuters are not the final word on journal quality, they do offer authors guidance on which journals are more likely to garner attention from other scientists in their particular field. ASM expects that mBio's streamlined editorial process, rigorous review process, and high caliber research studies will continue to provide readers with a quality publication and will propel the journal even further up the impact factor rankings in 2012.

Technique spots disease using immune cell DNA

ScienceDaily (July 9, 2012) By looking at signature chemical differences in the DNA of various immune cells called leukocytes, scientists have developed a way to determine their relative abundance in blood samples. The relative abundance turns out to correlate with specific cancers and other diseases, making the technique, described in two recent papers, potentially valuable not only for research but also for diagnostics and treatment monitoring.

When a person is sick, there is a tell-tale sign in their blood: a different mix of the various types of immune cells called leukocytes. A group of scientists at several institutions including Brown University has discovered a way to determine that mix from the DNA in archival or fresh blood samples, potentially providing a practical new technology not only for medical research but also for clinical diagnosis and treatment monitoring of ailments including some cancers.

The key to the new technique, described in two recent papers, is that scientists have identified in each kind of leukocyte a unique chemical alteration to its DNA, called methylation. By detecting these methylation signatures in a patient's blood sample and applying a mathematical analysis, the researchers are able to determine the relative levels of different leukocytes and correlate those with specific diseases.

"You can simply look at the DNA and discern from the methylation marks the relative abundance of different type of leukocytes," said Karl Kelsey, professor of pathology and laboratory medicine in the Warren Alpert Medical School of Brown University and a senior author on both papers. "It's a way to more easily interrogate the immune system of a lot of people."

Other tests, using flow cytometry, can already sort through the abundance of different leukocytes in a blood sample, but they require the blood to be fresh and leukocyte cell membranes to be intact. Because the DNA in a blood sample remains even after cells have died and degraded, tests based on detecting methylation could help doctors or researchers analyze a patient's blood sample that has either aged or has simply not been kept fresh.

In a paper published in advance online June 19 in Cancer Epidemiology, Biomarkers, and Prevention, the researchers describe using their technique to distinguish accurately which blood samples came from patients with head and neck squamous cell carcinoma, ovarian cancer, or bladder cancer. By using methylation to determine the leukocyte populations in each sample, they could predict that the same samples were as much as 10 times more likely to have come from a patient with ovarian cancer than a healthy control patient, six times more likely to be from a head and neck cancer patient than a healthy control, or twice as likely to be from a bladder cancer patient than a control.

"Our approach represents a simple, yet powerful and important new tool for medical research and may serve as a catalyst for future blood-based disease diagnostics," wrote the authors, who hail from Dartmouth, Oregon State University, the University of Minnesota, and the University of California-San Francisco, as well as Brown. Several authors worked with Kelsey at Brown during the research.

They describe the technique and its analytical methods in deep mathematical detail in another paper published in May in BMC Bioinformatics. They also report experiments that included analyses of the leukocyte mix of noncancer conditions such as Down syndrome and obesity.

The paper found many examples of differences between the immune cell mix of healthy controls and people with specific illnesses. For example, obese African Americans had an estimated increase in granulocyte leukocytes of about 12 percentage points. People with Down syndrome, had 4.8 percentage points fewer B cells. For head and neck cancer, they noted a 10.4 percentage point drop in CD4+ T-lymphocytes.

"Any disease that has an immune-cell mediated component to it would have applicability," Kelsey said.

"My doctoral work was with Julius Adler, the first scientist to study the molecules behind bacterial behavior. His work led to the discovery that bacteria have a molecular 'memory' system that allows them to 'remember' the past, compare it to the present and thus move toward the area that is most favorable," Hazelbauer said. "When I began my work as a researcher in the late 1960s, studying bacterial behavior was a curiosity and its significance unclear. Now, decades later, the research done by my group and others has grown into a body of knowledge about the fundamental processes used by all living things to recognize, remember and respond to changes in their environments."

The National Institute of General Medical Sciences (NIGMS) recently recognized and rewarded Hazelbauer's scientific contributions by granting him a "Method to Extend Research in Time" (MERIT) Award. The award, which is worth at least $5.5 million over 10 years, will allow him to continue his research without re-applying for funding. Hazelbauer joins only 11 other MU researchers who have received the MERIT award, including his wife, Linda Randall, who is also a biochemistry professor.

MERIT awards are intended to foster creativity and allow researchers to take more time to develop new techniques. The awards are given only to scientists who have proven themselves by succeeding in at least 10 years of previous NIGMS-funded research and who seem likely to continue making valuable contributions to their field.

RENO, Nev. (KRNV & MyNews4.com) -- University of Nevada, Reno senior Clarissa Martins always knew she wanted to be involved in the medical field. Receiving the 2012 Thomas J. Bardos Award for her research involving cancer and nutrition is a reflection on those childhood dreams. "Winning this award means so much to me, and shows that all my hard work is paying off," Martins said. "Out of the 16,000 people who applied worldwide, I was one of the 17 people chosen for this award. It's a huge honor."

The award is intended to inspire young science students to enter the field of cancer research and to help those students develop their careers in science by providing a unique educational opportunity. Martins' research is largely inspired by her mother, who was diagnosed with pancreatic cancer.

"When I was about nine years old, my mother was diagnosed with pancreatic cancer, and as a child, I didn't really understand what that meant," Martins said. "So, I began researching cancer and in my freshmen year of college I found the Pardini research lab. I started out helping with a couple projects there and learned about various research techniques. My passion for cancer research exploded from there."

To be eligible for the award candidates must be a full-time, third-year undergraduate student majoring in science as well as a current American Association for Cancer Research member. Martins will receive $3,000 from the AACR, which grants the career-development award.

Martins said that she applied to the association upon the encouragement of her mentor Keith Kikawa, a postdoctoral scholar with the University's Department of Biochemistry and Molecular Biology.

"My mentor initially told me about the award," Martins said. "The minute the application was open I was applying for it with his help."

The award is named after Thomas J. Bardos, a professor emeritus from the University at Buffalo, who participated in cancer research for more than 50 years.

Martins, scheduled to graduate in 2013, plans to be a clinical researcher in the oncology field.

Andre Davis spent 32 years behind bars as an innocent man before DNA evidence overturned his life sentence. He was only 19 when he was wrongfully convicted of raping and murdering three-year-old Brianna Stickle in 1980.

Now 50, Mr Davis walked out of Tamms super-maximum security prison in Illinois, USA, last Friday into a radically changed world.

Had his legal team not requested in 2004 that blood and semen samples be DNA tested, he might never have been freed. The results proved that Davis could not have committed the crime.

One of 42 convicted men in Illinois who were proven innocent after DNA testing, Mr Davis's case reflects a growing trend in the United States. With support from the Innocence Project and other organisations, DNA testing is being used to re-examine cases where prisoners may be innocent.

Australia has not experienced a similar ratio of wrongful convictions being overturned after DNA testing and is unlikely to do so in the future, according to a senior NSW forensic expert, who asked not to be identified.

Unlike the US, forensic laboratories in Australia are more heavily regulated and testing standards are higher, he said.

"We run an extremely thorough and accurate system in Australia where laboratories became accredited very early on.

UI Biology Department officials say renovations in the Ph.D. program will better train students for careers in science through collaboration and seminar opportunities.

Josh Weiner, head of the IBIO program and associate professor in the department, said the new program to be implemented in the fall of 2013 will attract students interested in big-picture puzzles in basic biology.

"We are rebooting the grad program," he said. "We compete for students with other institutions and other overlapping UI programs, like the biosciences and interdisciplinary programs. We want to attract the kind of students who are most interested in big issues in basic biology."

Last year, four new students enrolled in the biology Ph.D. program, but Weiner wants to double those admitted. The program has 33 Ph.D. students; Weiner said the program used to house 50 before severe state and Graduate College budget cuts reduced the number.

Weiner said there aren't many departmental graduate programs around anymore, noting many have merged to create interdisciplinary focuses.

A major concentration for IBIO is to encourage collaboration among faculty, students, and various labs in the department.

"There were different 'research areas' in the old biology Ph.D. program," he said. "In IBIO, however, everything is integrated, and while each lab is focused on a smaller set of topics, students will be expected to integrate into the program as a whole."

During the fall semester of their first year, students previously participated in research rotations between three labs for 10 to 11 weeks, but IBIO will allow seven weeks.

Researchers at the RUB and from Berkeley have used metal complexes to modify peptide hormones. In the Journal of the American Chemical Society, they report for the first time on the three-dimensional structure of the resulting metal-peptide compounds. With this work, we have laid the molecular foundation for the development of better medicines says Prof. Raphael Stoll from the Faculty of Chemistry and Biochemistry at the Ruhr-University. The team examined hormones that influence the sensation of pain and tumour growth.

Peptide hormones have many functions in the body

Hormones consisting of amino acids, the peptide hormones, convey bodily sensations such as pain and hunger, but also transmit growth signals. One example of this is insulin, which is important for the control of blood sugar levels. In interaction with specific receptors, the G-protein-coupled receptors, peptide hormones transport their messages to the cells. The hormones can be specifically chemically modified so that their effect changes, for example pain tolerance is lowered, or tumour growth inhibited. The German-Californian group of researchers has now found a new way to modify peptide hormones.

Metal complexes react with various peptide hormones

The first time they used a metal complex, namely, a rhodium compound, which reacts with the amino acid tyrosine. The precious metal rhodium is used as a catalyst in the synthesis of highly complex medicinal substances in the research laboratory as well as in industrial plants. Among other things, the researchers analysed the peptide hormone encephalin, which is important for the sensation of pain, and octreotide. The latter is a synthetic derivative of the growth hormone somatostatin, approved as a medicinal substance and already used in the treatment of certain tumours. The reaction with the metal complex was highly selective. Although the hormones consist of hundreds of atoms, the rhodium compound was always coordinated by the carbon ring of the tyrosine - the phenol ring.

The team also clarified the structure of the resulting metal-peptide complexes. We hope to develop other metal-containing, peptide-like substances by building on these basic studies says Prof. Dr. Nils-Metzler-Nolte of the Chair of Inorganic Chemistry I. These could modulate the effect of naturally occurring peptide hormones and, for example, be used as a novel remedy for pain or cancer. For the project, the Californian colleagues made their knowledge of the special reactivity of the rhodium compound available. The researchers in Bochum contributed their experience with metal-peptides, the corresponding receptors and the structural analysis of biological macromolecules. This again demonstrates that cutting-edge competitive research can only be carried out efficiently within a research association, says Prof. Stoll. The German Research Foundation (SFB 642 and Research Unit 630) and the Research Department for Interfacial Systems Chemistry at RUB supported the work.

Fort Worth crime lab to resume DNA testing

FORT WORTH, Texas (AP) The Fort Worth police crime lab will resume DNA testing a decade after questions were raised about whether its tests were valid.

On Monday, two forensic scientists in the lab will start working on DNA cases. Three other scientists will be trained in the coming months.

The lab stopped DNA tests in October 2002 after prosecutors did not seek the death penalty in a capital murder case due to concerns raised about one of the lab's scientists. An investigation later found widespread problems at the lab, but prosecutors said no one was wrongly convicted or accused because of flawed DNA analysis.

Still, the department began sending DNA samples elsewhere for testing and currently spends about $250,000 a year to do so. Grants cover other tests at the University of North Texas.

An in-house lab will be cheaper and quicker, said Tom Stimpson, the crime lab director, adding that a faster turnaround can mean quicker arrests.

In the past, after submitting a sample, police would have to wait one to three months to get a DNA profile to link with a suspect.

"Now, we're going to be able to do that in a week, so we can get them off the streets much sooner," Stimpson said. "It saves a lot of surveillance and investigation costs."

The DNA analysis lab has been moved into a defunct department store building that was been converted into a high-tech crime lab and property room in 2010, the Fort Worth Star-Telegram reported (http://bit.ly/M496I6).

Tarrant County Assistant District Attorney Christy Jack, who helped investigate the old crime lab, has toured the new one and is pleased Fort Worth will resume DNA testing.

"The new facility is state of the art, and I have the utmost confidence in the personnel who will be overseeing the DNA testing," Jack said.

DNA from DWI links man to cold-case murder

KANSAS CITY, Mo. A Missouri man forced to provide a DNA sample after pleading guilty in a drunken driving case has been charged in a 23-year-old killing.

Prosecutors announced Friday that Guy Shannon Jr., 43, of Odessa, faces charges of first-degree murder and forcible rape. Shannon is accused of strangling and assaulting Marcia Lynn Davis, 20, of Independence, in March 1989.

Davis was last seen leaving the Jackson County Jail after visiting a friend. A homeless person found her partially clad body in an abandoned apartment building the next day, according to a probable cause statement filed in the case.

Shannon became a suspect after he was convicted of driving while intoxicated in 2010 and, as a felon, had to give a DNA sample. It was entered in a database and ultimately linked him to genetic material found on Davis' body. Authorities said only one in 10 quadrillion unrelated people would have the same genetic profile.

Davis' friends and family were shown Shannon's photo but didn't recognize him, the probable cause statement said.

When interviewed, Shannon said he had never seen Davis before. He told authorities he had never been to the building where her body was found or picked up hitchhikers or women on the street.

Shannon requested an attorney when told his DNA was found on the victim, the probable cause statement said.

Although the charges were filed Monday, the case was temporarily sealed until Thursday, when the warrant was served.

Bond has been set at $350,000. No attorney is listed for Shannon in online court records.

In the early 1970s, Kansas City police started more carefully archiving physical evidence from hundreds of unsolved homicides, rapes and other crimes, often storing it in a giant freezer in the city's crime lab. Ensuing technological advances made the practice pay off, with numerous cold cases solved with the old physical evidence.

ENVIRONMENT: Carlsbad woman works to protect turtle nest eggs

After studying marine biology and spending family vacations in Costa Rica, a Carlsbad woman turned her fascination with sea turtles into an effort to help the endangered animals in the Central American country.

Courtney King, a recent marine biology graduate from U.C. Davis, spent one of her last quarters abroad working on turtle conservation with the nonprofit Costa Rican organization Pretoma.

Based in the idyllic beach community of Playa San Miguel, where howler monkeys and armadillos share the town with fishermen, King helped the organization patrol beaches against turtle poaching and collect eggs into a protected hatchery.

Olive ridley turtles are threatened by consumption of their eggs, which locals believe to be aphrodisiacs, she said.

The 70- to 100-pound turtles nest on the Pacific Coast of Costa Rica. There conservationists watched for their tracks, which resemble tire tracks.

Each time they found a nesting turtle they would tag her, measure her and place her eggs into a fenced, protected area of marked plots.

When the eggs hatched after 42 to 60 days, they returned the baby turtles safely to the sea.

King's family owns vacation property in Costa Rica, and she had hoped to return to the country to work on a conservation project, she said. Plus, the Carlsbad High School graduate said her mother had instilled a love of sea turtles from an early age.

"My mom absolutely loves sea turtles, so our whole house is decorated in sea turtles," King said. "So growing up with that made me really interested."

King plans to return to Costa Rica on Monday, where she'll continue the conservation project, and also start some research on another species: the endangered hawksbill sea turtle, a 100- to 150-pound turtle prized for its exquisitely patterned shell.

Two Drugs Safe for Rare Forms of Kidney Cancer

(HealthDay News) -- Using a combination of the drugs temsirolimus (Torisel) and Bryostatin appears to be safe in patients with metastatic kidney cancer, according to early data from 25 patients in a phase 1 trial.

The researchers said a pathway known as mTOR signaling promotes tumor cell proliferation and tumor blood vessel development. The temsirolimus-bryostatin combination blocks two portions of the mTOR signaling pathway, and the early data suggests the drugs may be active in patients with rare forms of renal cell cancer that are less likely to respond to other therapies.

"We have certainly seen sustained responses with this combination, which are encouraging," Dr. Elizabeth Plimack, a medical oncologist and attending physician at Fox Chase Cancer Center in Philadelphia, said in a news release from the center. Read more…

15 Year Old Develops Inexpensive Test to Diagnose Pancreatic Cancer

In Maryland, a 15-year-old high school freshman developed a diagnostic assay that experts say can be developed into medical laboratory test for the detection of pancreatic cancer. The teen’s prize-winning breakthrough test could change how cancer and other fatal diseases are diagnosed and treated.

 More to the point for anatomic pathologists, this new approach to detecting pancreatic cancer is non-invasive, so it does not require a biopsy specimen. It is also inexpensive and fast. At a cost of about $3 per test, the diagnostic assay produces a result in five minutes.
