Former National Security Advisor Michael Flynn will invoke his Fifth Amendment rights rather than testify before the House Intelligence Committee, Flynns lawyer Sidney Powell said in a letter Monday, according to The Washington Examiner.

Powell has previously accused federal prosecutors of withholding evidence favorable to Flynn, who pleaded guilty to lying to the FBI about his conversations with the Russian ambassador. Flynns sentencing on the false statements charges was previously delayed to allow him to continue cooperating in the investigation into a former business partners foreign lobbying.

District Judge Emmet Sullivan, an Obama appointee, has proposed a Dec. 18 sentencing date for Flynn, while Powell has pushed for more time before sentencing, saying she needs additional time to seek a court order for the supposed exculpatory material. Powell said in early September that Flynn has no plans to withdraw from his plea deal.
