Despite a basic structure, Indian federalism needs institutional amendment to be democratically federal
Events coinciding with the jubilee of Indias Independence draw attention to the federal structure of Indias Constitution, which is a democratic imperative of multi-cultural India, where the constituent units of the sovereign state are based on language, against competing identities such as caste, tribe or religion. This built-in structural potential for conflict within and among the units, and that between them and the sovereign state, need imaginative federal craftmanship and sensitive political management. The ability of the Indian Constitution to keep its wide-ranging diversity within one sovereign state, with a formal democratic framework is noteworthy. Possibly, with universal adult suffrage and free institutions of justice and governance it is nearly impossible to polarise its wide-ranging diversity within any single divisive identity, even Hindutva; so that, despite its operational flaws, the democratic structure and national integrity are dialectically interlinked. But its operational fault lines are increasingly denting liberal institutions, undermining the federal democratic structure as recent events have underscored.
First, the tempestuous Parliament session, where the Rajya Sabha Chairperson broke down (in August 2021), unable to conduct proceedings despite the use of marshals; yet, the House passed a record number of Bills amidst a record number of adjournments. Second, cross-border police firing by one constituent State against another, inflicting fatalities, which also resulted in retaliatory action in the form of an embargo on goods trade and travel links with its land-locked neighbour.
Such unfamiliar events of federal democracy are recurrent in India, except their present manifest intensity. Legislative disruption was described by a Union Law Minister (while in Opposition) as a legitimate democratic right, and duty. In the 1960s, the Troika around Lohia claimed its right to enter Parliament on the Janatas shoulders to exit on the Marshals; posters with labels such as CIA Agent were displayed during debates; suitcases were transferred publicly to save the government; occasionally, Honorable Members emerged from debates with injuries. This time, in the federal chamber, Honorable Members and Marshals are in physical contact both claiming casualties official papers vandalised and chairpersons immobilised. Even inter-State conflict has assumed a new dimension.
Such empirical realities have led scholars to conceptualise Indias Post-colonial democracy, and federalism, differently from their liberal role-models. Rajni Kotharis one party dominance model of the Congress system has now been replaced by the Bharatiya Janata Party; Myrdalls soft state is reincarnated in the Pegasus era with fake videos and new instruments of mass distraction and coercion. Galbraiths functioning anarchy, now has greater criminalisation in Indias democracy, which includes over 30% legislators with criminal records, and courtrooms turning into gang war zones; it is now more anarchic, but still functioning, bypassing any Dangerous Decade or a 1984.
Federal theorist K.C. Wheare analyses Indias centralized state with some federal features as quasi-federal. He underscores the structural faultlines of Indian federalism not simply as operational. So, while many democratic distortions are amenable to mitigation by institutional professionalism, Indian federalism, to be democratically federal, needs institutional amendment despite being a basic structure. Wheares argument merits consideration.
Democratic federalism presupposes institutions to ensure equality between and among the units and the Centre so that they coordinate with each other, and are subordinate to the sovereign constitution their disputes adjudicated by an independent judiciary with impeccable professional and moral credibility. But Indias federal structure is constitutionally hamstrung by deficits on all these counts, and operationally impaired by the institutional dents in the overall democratic process. Like popular voting behaviour, institutional preferences are based either on ethnic or kinship network, or like anti-incumbency, as the perceived lesser evil, on individual role-models: T.N. Seshan for the Election Commission of India, J.F. Ribeiro for the police or Justices Chandrachud or Nariman for the judiciary.
Indias federal structure, underpinned on the colonial 1935 Act which initiated provincial autonomy, attempted democratising it by: renaming Provinces to autonomous States; transferring all Reserved Powers to popular governance; constitutionally dividing powers between the two tiers; inserting federalism in the Preamble, and Parts 3 and 4 containing citizens Fundamental Rights and Directive Principles; but nothing about States rights, not even their territorial boundaries. This has enabled the Centre to unilaterally alter State boundaries and create new States. The Indian Constitution itself has been amended 105 times in 70 years compared with 27 times in over 250 years in the United States.
With nation-building as priority, the constitutional division of power and resources remains heavily skewed in favour of the Centre; along with Residual, Concurrent and Implied powers, it compromises on the elementary federal principle of equality among them, operationally reinforced by extra-constitutional accretion. While the judiciary is empowered to adjudicate on their conflicts, with higher judicial appointments (an estimated 41% lying vacant), promotion and transfers becoming a central prerogative, their operations are becoming increasingly controversial.
The story is not different for the all India services, including the State cadres. What is operationally most distorted is the role of Governors: appointed by the Centre, it is political patronage, transforming this constitutional authority of a federal link to one of a central agent in the States. Thus, the critical instruments of national governance have been either assigned or appropriated by the Centre, with the States left with politically controversial subjects such as law and order and land reforms. Thus, most of Indias federal conflicts are structural, reinforced by operational abuses.
Yet, there is no federal chamber to politically resolve conflicts. The Rajya Sabha indirectly represents the States whose legislators elect it, but continue even after the electors are outvoted or dismissed; with no residential qualification, this House is a major source of political and financial patronage for all political parties, at the cost of the people of the State they represent.
Possibly, this explains its continuity. Constituting roughly half the Lok Sabha, proportionately, it reinforces the representative deficit of Parliament, which, through the Westminster system of winner-take-all, continues to elect majority parties and governments with a minority of electoral votes. The second chamber is not empowered to neutralise the demographic weight of the populous States with larger representation in the popular chamber; it cannot veto its legislations, unlike the U.S. Senate. It can only delay, which explains the disruptions. Joint sessions to resolve their differences are as predicable and comical as the voice votes in the Houses. Indias bicameral legislature, without ensuring a Federal Chamber, lives up to the usual criticism: when the second chamber agrees with the first, it is superfluous, when it disagrees, it is pernicious.
Historically, party compositions decide when they agree or disagree. Whenever any party with a massive majority in any state finds itself marginalised in the central legislature, it disrupts proceedings, just as popular issues not reflected in legislative proceedings provoke undemocratic expressions and reciprocal repression. Such examples abound in Indias quasi- federal democracy till now.
Empirical and scholarly evidence suggest Wheares prefix about federalism arguably applies to other constitutional goals (largely operationally), while the federal flaws are structural, reinforcing conflicts and violence, endemic in the distorted democratic process. It is a threat to national security by incubating regional cultural challenges to national sovereignty, and reciprocal repression. We might learn from the mistakes of neighbouring Sri Lanka and Pakistan rather than be condemned to relive them. Indias national security deserves a functional democratic federal alternative to its dysfunctional quasi-federal structure, which is neither federal nor democratic but a constitutional basic structure.

MURRIETA, Calif., Oct. 7, 2021 /PRNewswire/ --Inland Empire TMS is excited to announce the grand opening of its mental health treatment center in Murrieta, Riverside County.
Led by Dr. Keerthy Sunder, MD, an experienced physician, clinician, researcher, and teacher with an extensive background in mental health treatment, the center leverages state-of-the-art NeuroStar and MagVenture Transcranial Magnetic Stimulation (TMS)technology to treat patients who have not found success in standard psychotherapy and pharmaceutical interventions.
Dr. Sunder is a double-board certified psychiatrist and serves as the Chief Medical Officer of Karma Doctors & Associates, partnering with this new center to provide TMS therapy. This integrated approach to psychiatry represents an innovative form of treatment, underscoring Dr. Sunder's belief that true happiness and fulfillment for those struggling with depression is possible.
The Inland Empire TMS team of mental health professionals are passionate advocates for patients who have not had success in treating their depression through the more traditional avenues. TMS offers patients renewed hope for what life can hold after depression.
Unlike medications and other alternative options for treating depression, TMS is a non-invasive approach and has virtually no side effects. Patients engage in 40-minute sessions five days a week for six weeks. No anesthesia or mind-altering substances are used with this therapy, which means patients can independently drive themselves to and from the center for treatment.
TMS is unique because it is not an alternative therapy but rather a groundbreaking scientific approach to managing and/or eliminating depression. A large segment of this patient population achieves full remission from depression, which means that their symptoms disappear entirely.
TMS therapy gives patients hope that they can overcome treatment-resistant depression. Inland Empire TMS center represents an important role in helping those with depression to access an option for treatment that will net them the results they've been seeking.

The benefits of Transcranial Magnetic Stimulation (TMS) on people with obsessive-compulsive disorder (OCD) is the focus of a collaborative study between Monash University and the Epworth Centre for Innovation in Mental Health (ECIMH).
OCD can have a profound effect on a persons life with psychological therapy, self-help techniques, and medication the current treatment options, although these are ineffective in many patients.Using a form of TMS, a non-invasive brain stimulation treatment that can change brain activity, researchers will use Theta-burst stimulation (TBS) to try to normalise brain activity in OCD patients.
The study offers participants individualised treatment using a process known as Neuronavigation, which involves mapping an individual's brain and then matching that to MRI images so that the treatment site can be found with more precision.
TMS has shown to be so successful for managing treatment-resistant depression that it has recently been added to the Medicare Benefits Schedule.
The study, being conducted at ECIMH is a collaboration between Professor Paul Fitzgerald from Monash University and Epworth Healthcare, Associate Professor Andrew Zalesky from the University of Melbourne, and Associate Professor Luca Cocchi from Research QIMR Berghofer, and is coordinated by Dr Oscar Murphy from the Monash Central Clinical School.
Dr Murphy says TMS is approved for the treatment of OCD by the US Food & Drug Administration. However, the same evidence base has not been established in Australia. This study will investigate the efficacy of TMS for OCD in Australia.
TMS is a very promising technology and has already shown efficacy in treating other conditions, such as depression, and is a promising step forward in developing individualised treatments, Dr Murphy said.
Involving a daily two to three-week treatment period with a three-month break in between, the trial is looking to recruit people aged between 18 and 75 until the end of 2021.
Given that many individuals with OCD may display fears of contamination or infection, the ongoing global pandemic has added a significant additional psychological burden for these individuals, with fewer people accessing treatments for OCD due to fears of going out in public, reduced capacity at clinics, longer waiting times to see clinicians due to the increased demand for mental health services and less social support.
Experiencing symptoms of OCD since early childhood, Rachel* was diagnosed in her early twenties. With her symptoms and fear of things being dirty, that people around her are going to be injured or die, and that things often feel out of place, increasing in intensity throughout her life, now in her sixties, she is often fearful to leave home and unable to work.
My compulsions relate to those obsessions, including rigid ordering and routine, excessive cleaning and counting rituals. Ive tried a plethora of typical pharmacological treatments for OCD but Ive been unable to tolerate medications well, often suffering debilitating nausea every time I try a new medication. The TMS trial is an alternative I just have to try - it gives me hope.
Dr Murphy says OCD is a severe and relatively common mental illness that significantly reduces the quality of life of more than 230,000 Australians, frequently leading to isolation, family dysfunction, difficulty in forming and maintaining relationships, and unemployment.
Although medications and other therapies are effective treatments for OCD, more than half of individuals with OCD still present with symptoms that affect their daily functioning more than 40 years after initial treatment. Many individuals also report experiencing side-effects of medications, which makes adherence to treatment quite difficult, he said.
The study we are running is particularly promising as we have identified regions of the brain that are typically altered in individuals with OCD and can then use MRI scans of the participants brain to identify where we will stimulate with TMS.

Y. Pritham Raj: 'As October is Depression Awareness Month, let's challenge ourselves to take a proactive approach.'
Amid COVID, another epidemic is on the horizon.
Mental health issues resulting from and exacerbated by COVID have created a second crisis. Between 2019 and 2020, the prevalence of depression increased fourfold. There are predictions that by 2035, depression will be the number-one cause of morbidity in the world.
As October is Depression Awareness Month, let's challenge ourselves to take a proactive approach.
One way is to look for the signs and symptoms of depression in yourself and others. There are many signs/symptoms of depression besides low mood. This includes sleeping more or less than usual, constant fatigue, restlessness, anxiety, irritability, poor appetite, unexplained weight gain or loss, and increased substance use. The actual diagnosis of major depression is made when symptoms persist for two weeks.
Isolation and taking care of kids or parents have taken their toll. This new way of living may prevent us from checking in with family, friends, and colleagues in our usual ways.
Burnout from stressful jobs can lead to depression. If you recognize these signs in yourself or someone you know, please reach out for help or advice. Your health insurance, a primary care doctor, a loved one, or NAMI (National Alliance on Mental Illness) helplines are all available resources.
It is essential to know that depression is treatable. Depending upon the type of depression, many people find relief through talk therapy and/or a course of antidepressants (that help correct how the brain uses neurotransmitters). Now there are even more options, like TMS (transcranial magnetic stimulation), which stimulates underactive brain areas related to mood. Most insurance plans cover these treatments.
Here are three ways to take care of our mental health:
Move your body. Physical activity is incredibly important for mental health! In one study, aerobic exercise had the same effect on mood as antidepressant medication. Just 30 minutes of walking or something similar each day will undoubtedly boost your mood and sense of wellbeing.
Reflect on the good. One of my favorite things to recommend is the "Three Good Things" exercise. At the end of each day, name three good things that happened to you. Go beyond simply thinking about what happened to you and consider your active part in it. I often do this with my kids at night. Research has shown that this simple practice helps build resiliency and prevents burnout.
Honor your passions. Our jobs and daily tasks don't always include activities that feel fulfilling. However, it's been proven that doing a little bit of what we're passionate about every week significantly impacts mental health and prevents burnout.
If you can, try to find a career you enjoy or focus on what you like about work. If that isn't possible, make efforts to do what you love outside of your job, whether it's volunteer work or a hobby.
It may be difficult to stay positive, but simple practices like these three can boost mood and wellbeing. Share these ideas with your loved ones, and let's combat burnout and depression together.
Y. Pritham Raj, M.D., is chief medical officer at Active Recovery TMS, a mental health clinic specializing in transcranial magnetic stimulation (TMS) as a treatment for depression and OCD. He is also an associate professor at Oregon Health & Science University in the departments of internal medicine and psychiatry.

POLK COUNTY, Fla. (WFLA) A woman is in extremely critical condition after deputies say she was shot while riding on the back of a motorcycle early Friday morning on Interstate 4 in Polk County.
According to Sheriff Grady Judd, just after midnight 38-year-old Ronald Donovan, a member of the Sin City Deciples Motorcycle Club, was driving eastbound on I-4. Donovan, his passenger, a 33-year-old woman, and two other motorcyclists were driving toward the Orlando area.
Judd said thats when two members of the Thug Riders Motorcycle Club passed by them, which didnt sit well with Donovan.
There was some skirmishing and some driving about 100 miles per hour, the sheriff said.
He said Donovan then shot and hit one of the Thug Riders motorcyclists, a 36-year-old man, who fired back toward Donovan.
According to Judd, the bullet struck Donovans passenger in the head just above the ear, causing her to fall off of the motorcycle. Medical experts say she is not expected to survive.
They took an 1888 old western shootout and brought it to 2021 last night, Judd said. You had a rush of testosterone and a rush of idiocy and it ended up with near death.
The sheriff said the injured Thug Riders motorcyclist drove to Champions Gate and stopped at Papa Johns to call 911. At the same time, other 911 calls came into the Polk County Sheriffs Office regarding the shooting on the interstate.
When deputies arrived at the scene, Judd said Donovan had two empty gun holsters, but no guns were found in the area. A motorcyclist was also seen fleeing from the area.
The sheriff also noted that when deputies tried to ask Donovan questions, he responded by saying I know my rights and invoked his Fifth Amendment right.
Donovan was arrested on scene and has been charged with the following:
According to Judd, at this time, the investigation shows that the Thug Riders victim was acting in self-defense when he returned fire.
A portion of I-4 was shut down for several hours as deputies and Florida Highway Patrol troopers searched for firearms and bullet casings over a half-mile area.
Since the shooting involved two separate motorcycle gangs, the sheriff gave the following warning to members of each side:
Let me warn you, retaliation will get you all locked up in prison for a very long time and thats a guarantee in Polk County, he said. Your stupidness has already gotten a 33-year-old beautiful young lady in a near-death situation and another man shot.
Sheriff Judd he expects to provide more details on the case on Monday.
