Champignon Brands revamps its brand identity to better reflect its scientific focus on psychedelic medicine – Proactive Investors UK

The firm is changing its name to Apotheosis Scientific Ltd and spinning out its consumer packaged goods division
Champignon Brands Inc (CSE:SHRM) (OTCQB:SHRMF) is headed into the future with a new identity that reflects the companys focus on scientific research.
The psychedelic healthcare company has proposed changing its name to Apotheosis Scientific Ltd or another name that better conveys its business activities going forward, Champignon told shareholders on Friday.
In addition, the Vancouver-based firm said it was planning to spin out its consumer packaged goods division by the third quarter of 2020.
The news comes after Champignon executed a series of game-changing acquisitions earlier this year, including AltMed, which owned ketamine clinic operatorthe Canadian Rapid Treatment Centre of Excellence (CRTCE) and California-based Wellness Clinic of Orange County.
AltMed has three trials in the Phase I stage and three trials in the preclinical stage during 2020, as well as seven patents for its ketamine/psilocybin delivery platforms and formulations. The company also has a preferred commercial relationship with InterVivo Solutions, Canadas largest neuroscience-focused preclinical contract research organization, to collaborate on Phase I testing and novel drug development of psychedelic molecules and delivery systems.
The CRTCE was founded by leading ketamine expert Dr Roger McIntyre, who took the reins as Champignons CEO last month.
While the topic of medical psychedelics has recently gained worldwide momentum, I am exceptionally pleased with the strategic approach our team has taken in establishing a differentiated platform with operating treatment clinics in the US and Canada that also facilitate research and development of a wide range of therapeutic and medical applications, McIntyre said in a statement.
We have made tremendous progress to date and have proven our ability to quickly seize opportunities in this rapidly emerging industry. Mormonism is the religion followed by Mormons.
Although a "new" religion, Mormonism supposedly upholds the correct tenets revealed by God through His prophets since "the beginning".
Indeed, Mormons believe their religion is pure Christianity restored by God after centuries of apostasy through Joseph Smith, a man called of God to do so.
The restoration was set in motion in upstate New York in the 1820s. In March 1830, Joseph published the Book of Mormon, said to be a translation of sacred texts compiled by a man named Mormon in 600 C.E. Those nicknamed "Mormons" accepted that record to be as authoritative as the Bible.
On April 6, 1830, Joseph Smith officially founded what became the Church of Jesus Christ of Latter-day Saints.
Mormons believe God continues to manifest Himself today.
"What are the differences between Mormons and Christians?"
Most Mormons consider themselves Christians.
Mormons believe Jesus is the Son of God who was sent to minister to mankind and shed his blood for the remission of sins.
However, some tenets set Mormons apart:
Mormons believe God called Joseph Smith to be His prophet like the prophets of old. Therefore, their religion is not solely based on the Bible but relies on additional records, such as the Book of Mormon and revelations received through Joseph Smith (and others). The canon of Scriptures remains open.
Mormons believe the religion of Christ sank into apostasy after the death of his Apostles.Consequently, Mormons reject the Councils that defined the Christian faith in the third and fourth centuries, including the doctrine of the Trinity, so essential to most Christians.
Instead,Mormons believe God the Father is an embodied person and that Jesus was and is a distinct person. They believe that all men and women are the offspring of the Father.
As for the Fall of Adam and Eve, Mormons consider it a positive event that enabled our spirits to become embodied. We are on Earth to learn from experience, to progress, and, by making the right choices, become like Jesus Christ and the Father.
For Mormons, salvation comes through grace as well as through personal works.
"What's Mormon Fundamentalism?"
Fundamentalists believe some essential teachings of their religion have been modified or abandoned by the Church of Jesus Christ of Latter-day Saints (LDS) in order to comply with society or become more popular.
Today, between 75,000 and 100,000 so-called Fundamentalists continue to defend, practice and believe in a variety of "fundamental" doctrines no longer taught or practiced by the LDS Church.
Some communities, like the Fundamentalist Church of Jesus Christ of Latter-day Saints (FLDS), often seen in the media, are quite radical whilst others, such as the Apostolic United Brotherhood (AUB), with members in North and South America, Australia, New Zealand and Europe are more progressive.
About 15,000 Fundamentalists around the world are not related to any group and have no "Prophet". Those Independent Fundamentalists' beliefs and practices are varied. They rely on their own understanding of Scriptures and revelations as well as personal inspiration to guide themselves.
"What do Mormon Fundamentalists believe in?"
Mormon Fundamentalists' beliefs and practices differ from one organized group to another and even from one family to another.
However, all believe in fundamental principles (hence the label of "Fundamentalist") that the Church of Jesus Christ of Latter-day Saints (LDS) no longer teaches or practices.
Fundamentalists often express a commitment to the doctrines revealed and taught by the Prophet Joseph Smith, Brigham Young and John Taylor.
Consequently, Fundamentalists tend to reject the teachings of the new Presidents of the LDS Church that contradict those of the early leaders.

Balanced atop the highest spire of the Salt Lake Temple, gleaming in the Utah sun, a statue of the angel Moroni stands watch over downtown Salt Lake City with his golden trumpet raised. This massive granite edifice is the spiritual and temporal nexus of the Church of Jesus Christ of Latter-day Saints (LDS), which presents itself as the world's only true religion. Temple Square is to Mormons what the Vatican is to Catholics, or the Kaaba in Mecca is to Muslims. At last count there were more than eleven million Saints the world over, and Mormonism is the fastest-growing faith in the Western Hemisphere. At present in the United States there are more Mormons than Presbyterians or Episcopalians. On the planet as a whole, there are now more Mormons than Jews. Mormonism is considered in some sober academic circles to be well on its way to becoming a major world religion--the first such faith to emerge since Islam.
Next door to the temple, the 325 voices of the Mormon Tabernacle Choir swell to fill the tabernacle's vast interior with the robust, haunting chords of "Battle Hymn of the Republic," the ensemble's trademark song: "Mine eyes have seen the glory of the coming of the Lord . . ."
To much of the world, this choir and its impeccably rendered harmonies are emblematic of the Mormons as a people: chaste, optimistic, outgoing, dutiful. When Dan Lafferty quotes Mormon scripture to justify murder, the juxtaposition is so incongruous as to seem surreal.
The affairs of Mormondom are directed by a cadre of elderly white males in dark suits who carry out their holy duties from a twenty-six-story office tower beside Temple Square.* To a man, the LDS leadership adamantly insists that Lafferty should under no circumstances be considered a Mormon. The faith that moved Lafferty to slay his niece and sister-in-law is a brand of religion known as Mormon Fundamentalism; LDS Church authorities bristle visibly when Mormons and Mormon Fundamentalists are even mentioned in the same breath. As Gordon B. Hinckley, the then-eighty-eight-year-old LDS president and prophet, emphasized during a 1998 television interview on Larry King Live, "They have no connection with us whatever. They don't belong to the church. There are actually no Mormon Fundamentalists."
Nevertheless, Mormons and those who call themselves Mormon Fundamentalists (or FLDS) believe in the same holy texts and the same sacred history. Both believe that Joseph Smith, who founded Mormonism in 1830, played a vital role in God's plan for mankind; both LDS and FLDS consider him to be a prophet comparable in stature to Moses and Isaiah. Mormons and Mormon Fundamentalists are each convinced that God regards them, and them alone, as his favored children: "a peculiar treasure unto me above all people." But if both proudly refer to themselves as the Lord's chosen, they diverge on one especially inflammatory point of religious doctrine: unlike their present-day Mormon compatriots, Mormon Fundamentalists passionately believe that Saints have a divine obligation to take multiple wives. Followers of the FLDS faith engage in polygamy, they explain, as a matter of religious duty.
There are more than thirty thousand FLDS polygamists living in Canada, Mexico, and throughout the American West. Some experts estimate there may be as many as one hundred thousand. Even this larger number amounts to less than 1 percent of the membership in the LDS Church worldwide, but all the same, leaders of the mainstream church are extremely discomfited by these legions of polygamous brethren. Mormon authorities treat the fundamentalists as they would a crazy uncle--they try to keep the "polygs" hidden in the attic, safely out of sight, but the fundamentalists always seem to be sneaking out to appear in public at inopportune moments to create unsavory scenes, embarrassing the entire LDS clan.
The LDS Church happens to be exceedingly prickly about its short, uncommonly rich history--and no aspect of that history makes the church more defensive than "plural marriage." The LDS leadership has worked very hard to persuade both the modern church membership and the American public that polygamy was a quaint, long-abandoned idiosyncrasy practiced by a mere handful of nineteenth-century Mormons. The religious literature handed out by the earnest young missionaries in Temple Square makes no mention of the fact that Joseph Smith--still the religion's focal personage--married at least thirty-three women, and probably as many as forty-eight. Nor does it mention that the youngest of these wives was just fourteen years old when Joseph explained to her that God had commanded that she marry him or face eternal damnation.
Polygamy was, in fact, one of the most sacred credos of Joseph's church--a tenet important enough to be canonized for the ages as Section 132 of The Doctrine and Covenants, one of Mormonism's primary scriptural texts.* The revered prophet described plural marriage as part of "the most holy and important doctrine ever revealed to man on earth" and taught that a man needed at least three wives to attain the "fulness of exaltation" in the afterlife. He warned that God had explicitly commanded that "all those who have this law revealed unto them must obey the same . . . and if ye abide not that covenant, then are ye damned; for no one can reject this covenant and be permitted to enter into my glory."
Joseph was murdered in Illinois by a mob of Mormon haters in 1844. Brigham Young assumed leadership of the church and led the Saints to the barren wilds of the Great Basin, where in short order they established a remarkable empire and unabashedly embraced the covenant of "spiritual wifery." This both titillated and shocked the sensibilities of Victorian-era Americans, who tended to regard polygamy as a brutish practice on a par with slavery. In 1856, recognizing the strength of the anti-polygamy vote, Republican candidate John C. Frmont ran for president on a platform that pledged to "prohibit in the territories those twin relics of barbarism--Polygamy and Slavery." Frmont lost the election, but a year later the man who did win, President James Buchanan, sent the U.S. Army to invade Utah, dismantle Brigham Young's theocracy, and eradicate polygamy.
The so-called Utah War, however, neither removed Brigham from power nor ended the doctrine of plural marriage, to the annoyance and bafflement of a whole series of American presidents. An escalating sequence of judicial and legislative challenges to polygamy ensued, culminating in the Edmunds-Tucker Act of 1887, which disincorporated the LDS Church and forfeited to the federal government all church property worth more than $50,000. With their feet held fast to the fire, the Saints ultimately had no choice but to renounce polygamy. But even as LDS leaders publicly claimed, in 1890, to have relinquished the practice, they quietly dispatched bands of Mormons to establish polygamous colonies in Mexico and Canada, and some of the highest-ranking LDS authorities secretly continued to take multiple wives and perform plural marriages well into the twentieth century.
Although LDS leaders were initially loath to abandon plural marriage, eventually they adopted a more pragmatic approach to American politics, emphatically rejected the practice, and actually began urging government agencies to prosecute polygamists. It was this single change in ecclesiastical policy, more than anything else, that transformed the LDS Church into its astonishingly successful present-day iteration. Having jettisoned polygamy, Mormons gradually ceased to be regarded as a crackpot sect. The LDS Church acquired the trappings of a conventional faith so successfully that it is now widely considered to be the quintessential American religion.
Mormon Fundamentalists, however, believe that acceptance into the American mainstream came at way too high a price. They contend that the Mormon leaders made an unforgivable compromise by capitulating to the U.S. government on polygamy over a century ago. They insist that the church sold them out--that the LDS leadership abandoned one of the religion's most crucial theological tenets for the sake of political expediency. These present-day polygamists therefore consider themselves to be the keepers of the flame--the only true and righteous Mormons. In forsaking Section 132--the sacred principle of plural marriage--the LDS Church has gone badly astray, they warn. Fundamentalist prophets bellow from their pulpits that the modern church has become "the wickedest whore of all the earth."
Mormon Fundamentalists probably cite Section 132 of The Doctrine and Covenants more than any other piece of LDS scripture. Their second-most-popular citation is likely Section 85, in which it was revealed to Joseph that "I, the Lord God, will send one mighty and strong . . . to set in order the house of God." Many fundamentalists are convinced that the one mighty and strong is already here on earth among them, "holding the scepter of power in his hand," and that very soon now he will lead the Mormon Church back onto the right path and restore Joseph's "most holy and important doctrine."
TWO
SHORT CREEK
Extreme and bizarre religious ideas are so commonplace in American history that it is difficult to speak of them as fringe at all. To speak of a fringe implies a mainstream, but in terms of numbers, perhaps the largest component of the religious spectrum in contemporary America remains what it has been since colonial times: a fundamentalist evangelicalism with powerful millenarian strands. The doomsday theme has never been far from the center of American religious thought. The nation has always had believers who responded to this threat by a determination to flee from the wrath to come, to separate themselves from the City of Destruction, even if that meant putting themselves at odds with the law and with their communities or families. . . . We can throughout American history find select and separatist groups who looked to a prophetic individual claiming divine revelation, in a setting that repudiated conventional assumptions about property, family life, and sexuality. They were marginal groups, peculiar people, people set apart from the world: the Shakers and the Ephrata community, the communes of Oneida and Amana, the followers of Joseph Smith and Brigham Young.Philip Jenkins,Mystics and Messiahs

This isolated wedge of backcountry--almost as big as New Jersey, yet traversed by a single paved highway--is known as the Arizona Strip, and it has one of the lowest population densities in the forty-eight conterminous states.
There is, however, one relatively large municipality here. Colorado City, home to some nine thousand souls, is more than five times as populous as any other town in the district. Motorists driving west on Highway 389 across the parched barrens of the Uinkaret Plateau are apt to be surprised when, twenty-eight miles past Fredonia (population 1,036, the second-largest town on the Strip), Colorado City suddenly materializes in the middle of nowhere: a sprawl of small businesses and unusually large homes squatting beneath a towering escarpment of vermilion sandstone called Canaan Mountain. All but a handful of the town's residents are Mormon Fundamentalists. They live in this patch of desert in the hope of being left alone to follow the sacred principle of plural marriage without interference from government authorities or the LDS Church.
Straddling the Utah-Arizona border, Colorado City is home to at least three Mormon Fundamentalist sects, including the world's largest: the Fundamentalist Church of Jesus Christ of Latter Day Saints. More commonly known as the United Effort Plan, or UEP, it requires its members live in strict accordance with the commandments of a frail, ninety-two-year-old tax accountant-turned-prophet named Rulon T. Jeffs.* "Uncle Rulon," as he is known to his followers, traces his divinely ordained leadership in an unbroken chain that leads directly back to Joseph Smith himself. Although his feeble bearing would seem to make him poorly cast for the role, the residents of Colorado City believe that Uncle Rulon is the "one mighty and strong" whose coming was prophesied by Joseph in 1832.
"A lot of people here are convinced Uncle Rulon is going to live forever," says DeLoy Bateman, a forty-eight-year-old science teacher at Colorado City High School. Not only was DeLoy born and raised in this faith, but his forebears were some of the religion's most illustrious figures: his great-grandfather and great-great-grandfather were among the thirteen founding members of the Mormon Fundamentalist Church, and his adoptive grandfather, LeRoy Johnson, was the prophet who immediately preceded Uncle Rulon as the leader of Colorado City. At the moment, DeLoy is driving his thirdhand Chevy van on a dirt road on the outskirts of town. One of his two wives and eight of his seventeen children are riding in the back. Suddenly he hits the brakes, and the van lurches to a stop on the shoulder. "Now there's an interesting sight," DeLoy declares, sizing up the wreckage of a television satellite dish behind some sagebrush off the side of the road. "Looks like somebody had to get rid of their television. Hauled it out of town and dumped it."
Members of the religion, he explains, are forbidden to watch television or read magazines or newspapers. The temptations of the outside world loom large, however, and some members of the faith inevitably succumb. "As soon as you ban something," DeLoy observes, "you make it incredibly attractive. People will sneak into St. George or Cedar City and buy themselves a dish, put it up where it can't easily be seen, and secretly watch TV during every free moment. Then one Sunday Uncle Rulon will give one of his sermons about the evils of television. He'll announce that he knows exactly who has one, and warn that everyone who does is putting their eternal souls in serious jeopardy.
"Every time he does that, a bunch of satellite dishes immediately get dumped in the desert, like this one here. For two or three years afterward there won't be any televisions in town, but then, gradually, the dishes start secretly going up again, until the next crackdown. People try to do the right thing, but they're only human."
As the TV prohibition suggests, life in Colorado City under Rulon Jeffs bears more than a passing resemblance to life in Kabul under the Taliban. Uncle Rulon's word carries the weight of law. The mayor and every other city employee answers to him, as do the entire police force and the superintendent of public schools. Even animals are subject to his whim. Two years ago a Rottweiler killed a child in town. An edict went out that dogs would no longer be allowed within the city limits. A posse of young men was dispatched to round up all the canines, after which the unsuspecting pets were taken into a dry wash and shot.

California Proposition 65: Trends and Highlights in April 2020
As COVID-19, shelter-in-place orders and California Court closures continued into April, new Proposition 65 (Prop. 65) claims were plentiful and creative, particularly as to food products. 60-day Notices of Violation (Notices) in April alleged that lead, acrylamide and carbaryl in foods including dried seaweed and seafood, balsamic vinegar and other vinegar products, baby food pouches and teething wafers require Prop. 65 warnings. Familiar claims regarding lead and plasticizers in consumer products also were numerous, as were claims that dietary supplements contained lead and therefore require Prop. 65 warning label.
Prop. 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires clear and reasonable warnings on consumer products (including foods) sold in California, if use of the products causes and exposure to chemicals on the Prop. 65 List. Our monthly overview of product trends in the Notices is as follows.
Californias court closures have created the opportunity of extra time for retailers and manufacturers to conduct Prop. 65 risk analyses as to the applicability of Prop. 65 warnings to the products they sell. Those receiving Notices during the COVID-19 California court closures can use this time to shore up their Prop. 65 procedures and evaluate settlement and/or defense of the Notices before the Courts reopen.

If you take a look at the GOLO diets website, its easy to see the appeal of this plan. The program suggests that its diet along with its dietary supplement can help you lose weight, keep it off, increase your metabolic efficiency and prevent or reverse health conditions. The core concept behind the GOLO diet is the theory that weight problems are caused by insulin resistance. The diet aims to help people maintain healthy insulin levels so their cells can process glucose from their blood efficiently. When insulin levels are within a healthy range, it may be easier to lose weight
GOLO claims that its proprietary supplement, Release, which is promoted as a feature of the diet, can help control insulin, thereby nudging the body to lose weight without dieting. The company also claims that by pairing its balanced meal plan, The GOLO Metabolic Plan, with the Release supplement, your metabolism gets faster and is able to convert food into energy quickly.
The bottom line? No. The Release supplement includes a little magnesium, plus zinc, chromium and some other plant compounds. Though the company cites data suggesting their Release supplement can enhance weight loss, the quality of the research is low. All of it is sponsored by the company, it involves very small populations being observed over a short period of time and most of it isnt published in peer-reviewed journals. The peer review process means that scientific findings are subject to the scrutiny of others with expertise in the field and without this, the findings arent nearly as meaningful.

Heres what we know: There are no magic bullets for weight loss. Supplements have never been demonstrated to produce long-term weight loss benefits. Also, even if a supplement is plant-based and natural, it might cause side effects. Supplements can also interfere with the medications youre taking. For example, ingredients in Release may interfere with diabetes medication, which might cause your blood sugar to dip too low.
The GOLO diet itself has some merit. It is a calorie-reducing diet and its eating plan the GOLO Metabolic Plan supplies between 1,300 and 1,800 calories per day, through whole foods, like fruits, vegetables, meats, eggs and grains, according to its website. These foods are permitted in portioned amounts so while you can have some brown rice or a dinner roll, it might be a much smaller portion (say, 1/2 cup of rice) than the amount youre used to eating. Processed foods and treats arent recommended, but you can use the plans fit points (earned by exercising) to eat these foods or heartier portions if you wish.
Emphasizing whole foods over heavily processed ones is a good strategy for managing your weight. In one study that compared the same set of participants who were fed a whole foods diet or a calorie-, carb-, fat- and protein-matched processed foods diet, participants ate faster and more on the processed foods diet, gaining about two pounds over a two week period. The same people lost about two pounds over the same period when eating whole foods. Whole foods take longer to eat, have more fiber and are more filling than processed foods, so embracing these types of foods may promote weight loss. Learning how to manage portion sizes and balance meals is also useful. In this case, you might find that your typical eating pattern is low on veggies but high on grains, whereas a more balanced approach is to reverse the ratio. In this case, a pasta dinner might involve 1/2 cup of pasta and 2 cups of veggies instead of 2 cups of pasta and 1/2 cup of veggies.
However, the GOLO diet may not be a healthy choice for everybody, especially if youre pregnant or nursing, or if you have a medical condition that requires you to take medication that could be impacted by the Release supplement.
If youre used to eating larger portions of foods and your diet includes a lot of heavily processed foods, making the changes suggested on the GOLO diet could produce weight loss. But these changes may also feel restrictive and overwhelming. Many weight-loss programs are unsustainable because they dont match your lifestyle (such as how often you like to cook or order takeout) and food preferences and because they promote portions that arent filling enough for you. Its hard to put up with hunger.
To lose weight and keep it off, you need a set of skills that involves more than what you eat or popping a poorly studied supplement that will also prove to be a big expense over time. Instead, eating well, tuning in to your bodys appetite signals, staying active, getting sufficient sleep and managing stress healthfully are better long-term strategies for weight loss and insulin management.
Anyone can lose weight on a low-calorie menu, but whether thats healthy or sustainable for you is the real question. And whether the supplement can enhance your weight loss is certainly questionable. If you want to give the GOLO diet a try, consider these things first:

High anxiety: Will CBD ever be legal in foods and beverages? – Nutritional Outlook

The COVID-19 pandemic, and societys response to it, has strained every aspect of our lives, from our social connections and work routines to the public-health infrastructure and global supply chains. But it did help cannabis, at least at the start, says one market research firm, Headset, who noted sales gains for edibles and cannabis-containing beverages of 28% and 14%, respectively, as of April 2. Since then, other reports have emerged at industry events generally observing a potential leveling off of CBD product sales as the pandemic persists. Still, the fact remains that there is a sizeable group of customers interested in these products.
Of course, these discussions are happening notwithstanding the fact that it remains illegal, per FDA regulation, to introduce into interstate commerce foods or beverages that contain hemp-derived cannabidiol, or CBD, the non-psychoactive cannabinoid thats become one of the buzziest health-and-wellness ingredients of the decade.
Which raises the question: With FDA busy vetting coronavirus tests, therapeutics, andone can hopean eventual vaccine, will the agency have the bandwidth to develop a regulatory framework for permitting CBDs use in foods and beverages? And if the answer is no, what does that mean for FDA enforcement, the sectors future, andmost cruciallyconsumer safety?
Under Investigation
Those questions remain as unsettled as they were in December 2018, when President Donald Trump signed into law the 2018 Farm Bill.
For while that bill legalized industrial hempprovided it contain less than 0.3% tetrahydrocannabinol (THC) contentand removed it from Schedule I of the Controlled Substances Act, it did not set out a legal pathway for formulating foods, beverages, or dietary supplements to include hemp-derived CBD.
Thus, says Marc Ullman, of counsel, Rivkin Radler LLP (Uniondale, NY), FDAs position remains the same as its been since day one: CBD is not a lawful ingredient in foods or dietary supplements.
The agency arrives at this position via a plain reading of the provisions of the Federal Food, Drug, and Cosmetic Act (FD&C Act) prohibiting the use of an approved drug or investigational new drug (IND) thats been the subject of substantial clinical investigationswhich is precisely what pharmaceutical-grade CBD isolate was in the research that GW Pharmaceuticals conducted on its groundbreaking anti-seizure drug Epidiolex, which remains the first and only CBD product to enjoy FDA approval.
In other words, the FD&C Act stipulates that if a party makes the effort to investigate a substances potential as a drugas GW Pharma did with CBDthat party essentially gets first dibs on the substances commercial use, and that its subsequent appearance as a garden-variety dietary ingredient in foods, drinks, or supplements is outside the law.
Room to Maneuver
Unless, that is, FDA exercises its power of enforcement discretion to allow it onto the market as a dietary ingredient, says Megan Olsen, vice president and associate general counsel, Council for Responsible Nutrition (CRN; Washington, DC).
So: crystal-clear, right?
Whats even less clear, says Justin J. Prochnow, shareholder, Greenberg Traurig LLP (Denver), is whether FDAs prohibition applies specifically to CBD isolatethe subject of GW Pharmas investigationsor more widely to anything with CBD in it, like full-spectrum or broad-spectrum hemp extract.
His reading: FDAs been purposefully vague about this distinction. While he views the agencys approach as technically in accordance with the law, expanding that approach beyond a strict consideration of CBD isolate to cover all CBD-containing ingredients would beagain, in my opinionan overextension.
The law states that the article investigated is excluded, he reiterates. But does the investigation of CBD isolate extend to anything with CBD in it? I dont think thats the intention or spirit of the law.
Too Hot or Too Cold?
For his part, Ullman sees FDAs approach as on one hand, overly legalistic, and on the other, dangerously lax.
Evidence of excessive legalism lies in the agencys plain-language interpretation that the FD&C Act prohibits CBDs food and supplement use with no apparent openness to any serious dialogue about alternate pathways to market, he says.
Dangerous laxity arises in FDAs refusal to take action against any foods or supplements marketed as containing CBD in the absence of unapproved new drug claims, he saysthis despite the agencys serious concerns about the lack of any adequate regulatory filings for the GRAS [Generally Recognized as Safe] use of CBD in food, or as a new dietary ingredient [NDI] for use in supplements.
Fair Warning
Prochnow, too, sees gaps in FDAs enforcement. It certainly hasnt been proactive, he notes. Its been very reactive, and its only taken action in the form of warning letters to companies that have painted FDA into a corner by making egregious disease claims. It still seems that FDA doesnt really know what to do.
Of the batch of warnings that FDA dropped in November 2019, for example, several took aim at companies promoting gummies as foods or claiming that their products treat inflammation, diabetes, and other conditions, Prochnow notes.
And now that some CBD brands have even made treatment and prevention claims in the COVID-19 space, FDAs had to lay the hammer down there, as well. Says Prochnow, Out of 60-plus letters, only one didnt take a company to task for egregious disease claims. Let that be a lesson.
Food for Thought
Also aware of the wild claims out there, Olsen nevertheless views FDAs treatment of the CBD question as in line with its treatment of other regulatory questions before it. Theyre a science-based organization, she says, and theyve been very clear that their number-one mission, whatever ends up on the market, is to protect public health.
Which is what makes the question of allowing CBD in foods and beverages so trickyeven more than in supplements. As Olsen points out, there are nuanced differences between CBDs safety profile in foods and beverages and its profile in supplements.
Douglas Duffy MacKay, ND, senior vice president of scientific and regulatory affairs, CV Sciences Inc. (San Diego, CA), agrees. Consider the scientific gaps in establishing CBDs safety in children and during pregnancy. This isnt because CBD is known to be unsafe, he explains, but because theres limited scientific information about its use in sensitive populations.
Conventional food regulations dont easily accommodate the labeling of, say, granola bars, candy, and soda as Not for use during pregnancy and/or in children, either, he continues. By contrast, Dietary supplement labels can clearly say, Not for use in children under 18 or Do not use if pregnant.
And food- and beverage-manufacturing standards arent set up to deliver specific amounts of a biologically active substance like CBD per bite or serving, MacKay claims. Once again, supplements by regulation must supply a specific amount of an active per serving.
Finally, he says, theres no post-market adverse-event reporting for foods and beverages like there is for dietary supplements. And that surveillance, he insists, is important to herbal-product safety.
No wonder CV Sciences predicted that FDA wouldnt permit the food or beverage use of CBD. In fact, we included this opinion in our public comments at the FDA public meeting on May 31, 2019, MacKay notes. Our observation has been that entrepreneurs have been so excited about CBDs business potential that the scientific and regulatory facts and our opinions were largely dismissed. In the meantime, CV Sciences is focusing on a path toward CBDs use in supplements first.
Show Them the Data
Its not as though companies like CV Sciences, or an association like CRN, for that matter, oppose an eventual road toward delivering CBD via foods and beverages. Rather, Olsen says, We just think that FDA should tackle the easier issuehow to approach this in supplementsand understand that the food path might take longer.
Either way, FDA says it needs more, and better, data before it can render a prudent decision.
Ullman cant blame them. While ceding the ultimate analysis to the toxicologists, he says, In my experience, there seems to be a lack of serious, published literature that could be used to support FDAs effort to provide a pathway for moving, should it choose to do so. Brands can better make their case, he believes, if they supply serious, science-driven published data.
FDA recently removed a hurdle to their doing so by allowing companies to protect proprietary dataand their investment in itfrom the disclosures required by the normal NDI notification process. Now companies can submit data to the docket confidentially, Olsen says, and CRN is encouraging them to do so.
As far back as 2018, CV Sciences published preclinical toxicology studies on its food-fiber hemp CO2 extract to establish a GRAS intake level. Now, says MacKay, as companies wake up to the reality of FDA regulation, we see more serious companies following our lead and publishing their own toxicology data.
Hurry Up and Wait
Even so, they may have to hurry up and wait before FDA uses this data to inform its decision-making. As Ullman says, The vast majority of the agencys resources and scientific expertise are rightly focused on dealing with COVID-19. So, I would expect a slowingeven from FDAs normal glacial speedon this.
Unfortunately, he continues, Because FDAs taken the position that CBD cannot legally be an ingredient in food or supplements, it has created a situation where its unable to conduct any real regulatory inspections of companies producing these products. Failure to have adequate quality or GMP programs in place is potentially a serious vulnerability to a large segment of the trade.
The agency has already expressed concerns about the categorys heavy-metals content, Olsen notes; but if they were enforcing inspection regulationsthat is, if theyd spelled out a legal route to marketthey could handle such concerns with CBD just as they do with any dietary ingredients. Its another botanical, Olsen says. Companies know how to deal with heavy metals in botanicals and put into place appropriate good manufacturing processes. It harms consumers the longer they let this market linger without any effective oversight.
Ultimately, Olsen concedes, We respect that this is a challenging question that theyve never confronted. But the progress that advocates had made before the COVID-19 crisis is worth sustaining. As the country hopefully begins to return to normal over the next few months, she says, we can build on that progress, maybe even as early as the fall. Because this needs to be solved, sooner rather than later.
