Localities win in Democratic bill that Republicans dismiss out of hand – Buffalo News

WASHINGTON The congressional Democrats' latest proposal for rescuing the nation from the coronavirus economic crash looks like a series of dreams come true for New York State and the Buffalo area.
The state would get $34.4 billion over two years, and more than $1 billion would flow into Buffalo's coffers. Congress would send $517 million to Erie County, and property owners across the state would get back the cherished SALT deduction that Congress trimmed three years ago.
"This is exactly what a disaster relief bill should look like," Rep. Brian Higgins, a Buffalo Democrat, said of the Health and Economic Recovery Omnibus Emergency Solutions Act, or Heroes Act.
But to Republicans, the Democrats' $3 trillion proposal is a disaster in itself.
"Obviously, it's a partisan exercise," said Rep. Tom Reed, a Corning Republican who criticized the measure for loosening the reins on the cannabis industry, releasing federal prisoners and aiding undocumented immigrants.
In other words, then, the Heroes Act is just the opening volley in what's likely to be a longer and more difficult tussle than Congress endured in passing its first four pieces of legislation aimed at responding to the Covid-19 pandemic.
The Heroes Act would refill local government accounts that have been running low because sales tax revenues have disappeared amid the Covid-19 shutdown. In the Buffalo area alone, municipalities would get $2.2 billion over two years.
"This proposal would absolutely eliminate the city's fiscal problems," said Buffalo Mayor Byron W. Brown. "I think that this proposal is very forward-thinking in that municipalities won't just need federal aid for one year, but they will need it for multiple years."
Erie County Executive Mark C. Poloncarz was equally pleased.
The bill "provides the certainty we need so that we could continue providing the services as normal for a county government without having to do drastic layoffs," Poloncarz said.
The measure would also give $171.2 million to the City of Niagara Falls and $117.7 million to the Niagara County government. The largest towns in the region would each receive tens of millions of dollars, and even the smallest municipalities would get something.
Moreover, the bill would likely limit cuts in state funding to municipalities and school districts. Gov. Andrew Cuomo said Wednesday that the state now faces a $61 billion funding gap. The Heroes Act would cover $22.3 billion of this year's shortfall and give the state $12.1 billion in 2021.
Cuomo was particularly pleased with the bill's proposed return of the federal deduction for state and local taxes. Capped at $10,000 annually in the Republican Congress' 2017 tax overhaul, that deduction would go uncapped for the next two years a move that would help high-tax states such as New York to retain residents.
"It's the single best piece of action for the State of New York," Cuomo said.
The trouble with the Heroes Act, though, is that its an entirely Democratic bill and any successful measure will have to pass muster with the Republican-led Senate and the Republican president.
And while President Trump remained silent on the measure, Senate Majority Leader Mitch McConnell had plenty to say.
"Even the media is describing it as a partisan wish list with no chance of becoming law," McConnell, a Kentucky Republican, said in a statement. This is exactly the wrong approach."
Rather than starting work on a fourth major coronavirus funding bill, McConnell said he is putting together a bill aimed at protecting businesses from lawsuits if they reopen amid the Covid-19 crisis.
Meantime, House Minority Leader Kevin McCarthy took issue with provisions of the Heroes Act guaranteeing the right to vote by mail this fall, rescuing troubled pension funds and restoring the SALT deduction.
The problems with this 1815-page, multi-trillion dollar messaging bill are plain to see," said McCarthy, a California Republican. "Its central demands changing election laws, bailing out mismanaged pensions, and temporarily suspending the cap on SALT tax deductions for millionaires and billionaires were drafted behind closed doors, predate the crisis, and are not targeted to coronavirus."
Despite that partisan divide, Democrats and Republicans agreed there are areas where the two parties may eventually come to an agreement.
Reed has been working with Sen. Bill Cassidy, a Louisiana Republican, and Sen. Bob Menendez, a New Jersey Democrat, on a measure that would provide $500 billion to states and localities half of what the Heroes Act would deliver.
"A trillion dollars is not reasonable," Reed said.
There's also bipartisan interest in increasing funding for the National Institutes of Health. The Heroes Act would boost NIH funding by $4.75 billion just shy of the $5 billion that Higgins has been pushing for research into finding a vaccine or treatment for Covid-19.
"We have to deal with the problem at hand," Higgins said.
Congress may do that at a leisurely pace, though, partly because the Trump administration has said there's no need to pass another relief bill immediately.
"We just want to make sure that before we jump back in and spend another few trillion of taxpayers money that we do it carefully," Treasury Secretary Steven T. Mnuchin said on Fox News this week.
But Congress is already facing pressure from the nation's governors. Cuomo, the Democratic vice chair of the National Governors Association, and Gov. Larry Hogan, the group's Republican vice chair, delivered a joint statement Wednesday calling for fast action.
"With widespread bipartisan agreement on the need for this assistance, we cannot afford a partisan process that turns this urgent relief into another political football," they said.

Proponents insist that CBD oil is capable of curing a wide variety of ailments, from anxiety to nerve pain. But is it the miraculous cure-all wed like it to be?
CBD oil is a natural product that has gained popularity in recent years, thanks, in part, to the legalization of cannabis in many states. Youve likely seen businesses advertise that theyre now selling CBD oil (and similar products), and heard various claims about what constitutes the best CBD oil.
Lets start by explaining what CBD oil is. CBD stands for cannabidiol, which is a cannabinoid, a non-psychoactive compound found in cannabis plants. CBD oil is a concentrated form of CBD that is separated from other components of cannabis. Its available in a wide variety of products, ranging from drops, capsules, and edibles to topical creams.
Note that CBD is non-intoxicating; it does not make you high. A different cannabis compound called THC is responsible for the high feeling associated with consuming cannabis.
What is the evidence for CBD oil as a beneficial remedy?
One of the most common claims of CBD proponents is that CBD oil can relieve anxiety. Generally speaking, theres evidence to suggest that this is true. According to a study by the National Institute on Drug Abuse, CBD oil is shown to reduce stress in animals like rats. Other studies have suggested possible uses for CBD oil in other areas related to psychotherapy. For example, one study from 2016 found that CBD could have antipsychotic effects in some people suffering from schizophrenia. The substance also doesnt have the same debilitating side effects linked to most other conventional antipsychotic drugs.
There is early supporting evidence that CBD (and other cannabinoids) may reduce tumor growth at least in animal models. For example, one 2019 review of both in vitro and in vivo studies on pancreatic cancer development found that cannabinoids reduce tumor invasion, slow tumor growth, and in some cases, can even cause death of tumor cells. However, the exact mechanisms responsible for this effect are in debate, and factors like appropriate dosing are not yet clear.
CBD may also improve the uptake or potency of certain cancer treatment drugs. Its also considered an antiemetic, which can be useful in specific types of cancer treatment.
For people suffering from severe forms of epilepsy or seizures, CBD may be an effective treatment. In fact, the prescription drug Epidiolex was contains CBD. When taken orally, Epidiolex can reduce the number of seizures suffered by a patient. However, its worth noting that the patients in these studies were taking Epidiolex with at least two other epilepsy drugs and were suffering from an extreme form of epilepsy (i.e., Lennox-Gastaut syndrome or Dravet syndrome).
Epidiolex is the first FDA-approved drug made from cannabis; researchers are eager to learn more about how and why cannabidiol protects against seizures.
CBD can also function as an anti-inflammatory and an analgesic, according to some studies.
In these applications, CBD can be applied topically, usually as a spray. Anecdotally, sufferers of arthritis and similar forms of chronic pain have found relief when regularly applying CBD. As with many of the other potential applications for CBD, we need more research for a definitive analysis of its effectiveness for pain management.
Additionally, early research shows CBD to be well-tolerated by humans and animals. A review from 2011 suggests that CBD is non-toxic in non-transformed cells and does not induce changes on food intake, does not induce catalepsy, does not affect physiological parameters (heart rate, blood pressure and body temperature), does not affect gastrointestinal transit and does not alter psychomotor or psychological functions. This study covered even high doses of up to 1,500 mg of CBD per day.
There is some evidence that there may be long-term side effects of CBD, such as inhibition of hepatic drug metabolism, decreased fertilization rates, and alterations of in vitro cell viability. We need more research to confirm the extent and occurrence rate of these side effects.
Short-term side effects from CBD seem to be rare and limited, but can include diarrhea, fatigue, changes in weight, and changes in appetite. Its also unknown how and when CBD may interfere with medications and dietary supplements. Thus far, CBD appears to be less habit-forming than substances like alcohol and tobacco but may produce withdrawal symptoms if someone uses it consistently for an extended period of time then suddenly stops.
CBD oil appears to have some evidence-backed benefits for humans, with limited side effects. But its still something we dont know a lot about. The FDA does not yet regulate CBD, and warns that there are unanswered questions about its safety. Future studies may reveal important information about its applications for human health.

Buyer beware: False medical claims about CBD and COVID-19 | TheHill – The Hill

As we all continue to navigate this challenging new normal amidst the COVID-19 pandemic, consumers need accurate information about effective precautions to prevent the spread of coronavirus.
No proven treatments exist yet for COVID-19, nor is there a vaccine. That is why social distancing and good hygiene practices are so important to prevent the spread of the virus.
Across the United States, people are rising to the challenge, but a cynical minority has seized on the crisis to promote unscrupulous, and frankly dangerous, marketing claims about CBD products conferring immunity against the coronavirus and providing relief for those infected.
These false claims touting unproven medical benefits are nothing more than craven attempts to take advantage of fearful consumers. Moreover, it spreads misinformation among consumers anxiously seeking ways to stay safe and healthy amidst the coronavirus crisis.
A CBD store in Portland, Oregon was ordered by the office of the state's attorney general to remove signs claiming that its products could boost immunity against COVID-19. Last month, New Yorks attorney general ordered a companyto immediately cease and desist the marketing of their product as a means of curing the coronavirus.
There have been numerous reports of a fabricated news story promoting CBD oil as a treatment for the virus that was shared across the country through texts and social media, pointing unsuspecting consumers to a CBD sales site. Former All-Pro NFL offensive lineman, Kyle Turley, was promoting CBD products in the fight against COVID-19. Turley received warnings from the FDA and the Federal Trade Commission, and since then, these false claims have thankfully stopped.
During this time of heightened attention on wellness and prevention, consumers must be aware that CBD products have not been tested or evaluated by the U.S. Food and Drug Administration (FDA). Recent studies have also found potential harmful side effects from consuming cannabis products with Tetrahydrocannabinol (THC) if a patient is infected with COVID-19. Studies have shown that many unregulated CBD products have been found to contain THC the primary psychoactive compound in marijuana though the labels may not disclose this.
Unregulated, untested CBD products present an increasing threat to public health. Consumers risk illness, exposure to THC and contaminants including lead, arsenic, pesticides and toxic mold. The vast majority of CBD on the shelves today fail to meet even the most basic safety and efficacy standards. CBD carries potential risks, including liver toxicity, fatigue and harmful interaction with other drugs. Not one scintilla of credible scientific evidence indicates that CBD products prevent the spread of the coronavirus. Consumers need to know these facts.
A recent report from the FDA to Congress underscores many of the warnings expressed by Consumers for Safe CBD and the Consumer Federation of America. While the FDA report is a step in the right direction, coupled with the agencys warning letters to companies illegally selling various products containing cannabidiol and updates on a variety of safety concerns, much more work remains to protect consumers.
Consumers deserve the gold standard protection that the FDA has provided for decades. We want and need access to sound, reliable information about CBD. Today more than ever, the FDA must stop bad actors from making false medical claims and encourage the further testing of CBD.
In these uncertain times, we urge consumers to take precautions and follow CDC guidelines, practice social distancing and avoid untested, unregulated products. As we collectively adjust to the realities of this global pandemic, we must increase efforts to protect consumer health and safety.

Kore Organic Watermelon CBD Oil Tincture recalled because of high levels of lead – PennLive

Summitt Labs is voluntarily recalling Kore Organic Watermelon CBD Oil Tincture because it contains a high level of lead.
According to an announcement with the U.S. Food and Drug Administration, the Florida Department of Agriculture and Consumer Services tested a random sample and found a lead level of 4.7 ppm.
Summit Labs had the same batch tested by another lab, which found .5 ppm, which is within the legal limit.
However, Summit opted to recall the batch No. 730, Lot No. K018.
According to the USFDA, the product has a Kore Organic Logo and kraft paper packaging. There are nine, 30 milliliter bottles per package.
The product was distributed nationwide by I.E. Nirvana Kulture and North East Rally.
According to the Florida Department of Health, acute lead poisoning could have signs and symptoms including but not limited to pain, muscle weakness, paresthesia, abdominal pain, nausea, vomiting, diarrhea, constipation, poor appetite, weight loss, symptoms associated with encephalitis, metallic taste in the mouth, shock, hemolysis and kidney damage.

‘Obamagate’ and the end of scandal – The Week

As far as I can tell, what is now being referred to by Donald Trump and some of his more enthusiastic supporters as "Obamagate" does not involve a discrete scandal. Instead, umbrage is being taken at the fact that, in addition to refusing to throw his attorney general, Eric Holder, under the bus in 2011, Barack Obama did not shed many tears on behalf of right-wing 501(c)(3) groups on the receiving end of extra attention from the IRS or seriously object to the investigation of a presidential candidate he thought unlikely to win office.
Whatever one thinks of these things, there is no "gate" here. The conspiratorial framing is an implicit rejection of Obama's entire presidency, as if every aspect of it, from his famous speech at the 2004 Democratic National Convention until the day Donald Trump took the oath of office had been part of a single overarching plot against the American people.
The gate suffix is nearly as old as the original scandal to which it owes in name. As early as 1974, William Safire (whose reputation as an authority on good English has always baffled me) was denouncing the iniquities of "Vietgate," which he would follow up with "Billygate," "Briefingate," "Contragate," "Debategate," and goodness knows how many more without his editors telling him to find another metaphor. The first of these was a reference to the issuing of presidential pardons for draft dodgers, a policy open to criticism but not a common-law offense punishable under any jurisdiction carried out at the behest of a sitting president. Like so many subsequent gates, it did not involve an underlying crime that became the object of a cover-up certainly not a crime as brazen as the burglarizing of a hotel room in the hope of obtaining a dubious advantage in an election whose outcome was never remotely in doubt.
It is astonishing how rare it is to encounter both of these conditions the specific offense and the conspiracy to obscure it from public view fulfilled in the vast gate-related literature. Instead one finds offenses that were never hidden from the world ("Hailgate," a video of white supremacists openly employing the Nazi salute at a conference) or simply crimes against taste ("Donutgate," i.e., the time Ariana Grande licked a doughnut); there are procedural offenses ("Emailgate"), accidents ("Elbowgate," i.e., Justin Trudeau's elbowing of a female member of the Canadian parliament), mean-spirited public remarks ("Faceliftgate," when President Trump asserted that MSNBC's Mika Brzezinski had undergone the aforementioned surgical procedure), embarrassments ("Fartgate," which doomed Congressman Eric Swalwell's never very serious presidential aspirations), and government policies worthy of criticism ("Pastygate," widespread disagreement with taxes levied in 2012 upon meat pies and other cooked snacks by the Conservative government in Britain). There are also cases in which there does not appear to be any underlying offense ("Russiagate") but in which attempts at journalistic investigation are met with resistance comparable to that of the Nixon administration. In some instances ("Gamergate") there is neither a crime nor a conspiracy but a kind of generalized resentment in search of an incident that might justify it after the fact. Obamagate most resembles the last of these: an insinuation of conspiracy so wide ranging that it cannot by definition be refuted, even by Trump's attorney general.
Why do we insist on appending this meaningless suffix to everything from using the profits of arms sales to fund right-wing militias to doubts about Hillary Clinton's ability to open a pickle jar? I suspect it is because Watergate is the founding myth of contemporary journalism, the lens through which we insist upon seeing all of reality. The urgency with which we lavish attention upon insignificant events (and journalistic attempts to place them inside an implied meta-narrative of cover-up) becomes self-justifying; the currency of scandal is thoroughly debased even as it remains the only acceptable journalistic tender. This is what made Trump's presidency possible: politics re-conceived not as the pursuit of the common good but as an agon of irreconcilable totalizing worldviews, each the product of its own bespoke mythology complete with heroes, villains, bards, noble deeds, and ancient wrongs. So far from being the perfect object of journalists' meta-investigative obsession, he is its totally predictable consequences.
Meanwhile the destruction of the post-war consensus on the mixed economy, the disastrous consequences of globalized free trade, the downside of unregulated instantaneous mass communication, the rise in drug addiction and so-called "deaths of despair" are all stories that became tragedies before they were ever seriously reported. A country whose attention was fixed instead upon Valerie Plame, Dan Rather, one of Janet Jackson's breasts, lane closures in New Jersey, and how Tom Cruise felt about being mocked in an episode of South Park was astonished to learn facts about ordinary life, such as the decline in the American life expectancy during the last decade.
When everything becomes a scandal, nothing is.
