22,000 File Appeals With Obamacare Site, Report Says

Roughly 22,000 Americans have filed requestsfor the Health and Human Services Department (HHS) to fix errors in their health insurance coverage caused by HealthCare.gov glitches, but the computer program to process those 22,000 requests has yet to be built, the Washington Postreports.

The appeals were filed by people who say that HealthCare.gov -- the website that serves as the Obamacare portal for 36 states -- failed to correctly calculate the subsidies theyre eligible for, sent them into the wrong insurance program or completely denied them coverage, the Post reported after obtaining internal government data.

Those 22,000 appeals were submitted through the mail, since the computer and phone systems for filing appeals have yet to launch. The appeals were transferred to a computer system at the Centers for Medicare & Medicaid Services (CMS), but the program to process those appeals does not yet exist, unnamed sources told the Post.

While the program may not yet be built, CMS spokesman Aaron Albright told CBS News that the agency is already helping some of the consumers who filed those requests. As we work to fully implement the appeals system, CMS is working directly with consumers to address concerns they have raised through this process,"Albright said.

The pending appeals are largely related to HealthCare.gov glitches that are now fixed, he said, so CMS is recommending that people who had problems enrolling reset and resubmit applications on the site.

We are also working to ensure that consumers who wish to continue with their appeal are able to do so, Albright said.

He declined to say when the computer program to process those appeals is expected to be finished, or which contractor is working on the program. The administration recentlytapped the consulting firm Accentureto replace CGI as the lead contractor responsible for HealthCare.govs ongoing construction.

Now that most of the front-end problems with HealthCare.gov have been resolved, the Obama administration has stepped up its efforts to encourage more people to enroll in insurance via the site. As of late January,about 3 millionhad enrolled in insurance plans through HealthCare.gov or one of the 14 state-based Obamacare sites.

President Obama over the weekenddefendedhis choice to keep HHS Secretary Kathleen Sebelius on the job, even after HealthCare.govs disastrous launch in October.

We hold everybody up and down the line accountable but when were midstream, Bill, we want to make sure that our main focus is how do we make this thing work so people are able to sign up, the president said in an interview with Fox News Bill OReilly.

Europe Letter: European Court of Human Rights has profoundly shaped Irish law

This weeks judgment by the European Court of Human Rights on a case brought by Irish woman Louise OKeeffe is the latest ruling by the court that could have deep implications for Irish law.

Irish social history has been dotted with rulings by the Strasbourg-based court that have profoundly shaped the law of the land over the last 50 years. David Norriss landmark action against the State in 1979 led to the decriminalisation of homosexuality in Ireland. The more recent ABC abortion case, which found that the State was in breach of the Convention on Human Rights, exerted political pressure on the government to legislate for the X-case ruling.

In the public response to the OKeeffe judgment, many commentators have coyly remarked that it took a European court to hold the State to account, welcoming the existence of an alternative legal avenue for citizens.

Just as EU employment law is widely credited with advancing womens right to equal pay and conditions in Ireland during the 1970s and 1980s, Irelands obligations under European law have been viewed as a welcome instigator of Irelands move away from the entrenched social conservatism that characterised Irish identity post-independence.

Valued ideal At a time when public support for Europe is fading, Irelands obligation to abide by rulings of higher courts is one of the few aspects of the European ideal that people value.

Not so in Britain. Across the water, the European Court of Human Rights is being held up by Eurosceptics as another example of excessive European interference.

Although not a European institution the European Court of Human Rights is attached to the Council of Europe, an assembly of 47 countries the ECHR has nonetheless become embroiled in Britains fraught relationship with Europe.

The court is deeply unpopular with many Conservatives. British prime minister David Cameron criticised the institution at the Conservative Partys autumn conference, while justice secretary Chris Grayling declared last month the court had lost legitimacy.

At issue is a series of judgments on criminals rights. A ruling dating from 2005 which states that prisoners have a right to vote and a separate judgment imposing restrictions on the deportation of foreign criminals have been strongly questioned by the British government.

It was the culmination of an 11-month investigation, and the attorney generals office says its still looking into whether human trafficking was involved.

Advocates for preventing sex trafficking and labor trafficking say the lead-up to major sports events around the world is a ripe time for educating people about these often-hidden crimes.

There are disputes about whether sex trafficking spikes in advance of events such as the Super Bowl, and some prominent anti-trafficking organizations say it would be difficult to document such a trend. Nevertheless, a coordinated effort is often launched to boost the training of hotel and transportation workers as well as law enforcement officers and to reach out with messages to potential customers and victims of the sex trade.

A big push around any big sporting event gives us an opportunity ... and raises awareness that will carry over, says Carol Smolenski, executive director of the nonprofit End Child Prostitution and Trafficking-USA. Its important for [sex trade] customers to understand that sexually exploited children are mixed in with the adults.

The New Jersey Coalition Against Human Trafficking has taken a number of steps leading up to this years Super Bowl. It trained more than 200 volunteers to engage hotel managers in anti-trafficking efforts, for instance. Some of them took along bars of soap bearing the National Human Trafficking hot line number (888-373-7888) part of a project called S.O.A.P.: Save Our Adolescents from Prostitution.

In Indiana, similar outreach took place in advance of the 2012 Super Bowl. A report from the Indiana attorney general noted that the KlaasKids Foundation tracked Backpage.com female escort ads and found that four weeks before the Super Bowl, there were 17 ads, and the number rose steadily each week, culminating in 118 ads on Feb. 2 and 129 on Feb. 3. Many of the ads appeared to involve underage girls.

Deuitch appointed to Human Rights post

MICHIGAN CITY Mayor Ron Meer has appointed a new executive director of Michigan City Human Rights Commission: U.S. Army veteran and Michigan City native Jeff Deuitch. He replaces Angela Jackson, the commission's former director who resigned late last year.

"One of the biggest things when I retired from the military was that I wanted to give back to Michigan City," said Deuitch, a 1990 graduate of Elston High School.

After high school, Deuitch served in the Army for more than 22 years. He completed tours in Afghanistan, Iraq, Kosovo and Korea; and has been awarded the Bronze Star, Purple Heart and Meritorious Service Medal, amony other military awards.

He said he intends to use his military experiences to help him in his new role on the Human Rights Commission.

"The things I learned in the Army are honesty, integrity and hard work," he said.

As the commission's director, Deuitch will work closely with the community to ensure the fair treatment of all local residents. Some of his responsibilites will include investigating complaints of human rights violations and even to monitor the compliance of the city's hiring ordinance.

"The mayor is really pushing this to where we're out in the community and we're talking to people so that people know their rights," Deuitch said.

Meer reflected Tuesday on his decision to appoint Deuitch to the head of the Human Rights Commission.

"There's a big push across the United States as our veterans come back from overseas, from Afghanistan, to have some job opportunities for them," he said. "And for (Deuitch) to have this skill level and to have done this in the military for an entire batallion makes it, for me, a privilege and an honor to have him (as director)."

Black Hawk County supervisors eliminate human resources director post

WATERLOO | Black Hawk County's human resources director has fallen victim to the budget ax.

Members of the Board of Supervisors voted 5-0 Tuesday to eliminate Human Resources Director Jerry Clyde's position effective today while "realigning" his department's staff as part of the board office.

The supervisors said the move, expected to save about $80,000 next year, was strictly budget driven.

"It's not a matter of personnel," said board chairman Craig White. "It's a matter of the almighty dollar."

Supervisor Frank Magsamen said the supervisors already had voted to eliminate a courthouse maintenance job, a vacant position in the auditor's office and will not fund two health department posts. All were designed to hold down next year's property tax increase.

The supervisors hired Clyde in July 2011 after former human resources director June Watkins left for another position.

"I can fully understand what is happening and why it's happening," Clyde said. "I leave with nothing but pride in what my department and staff have accomplished, and I have nothing but great admiration for Black Hawk County."

Clyde had requested to stay on through June to help with the transition and complete a job reclassification program he felt was vital to the future of the county's workforce. That was rejected.

Both Clyde and the supervisors expressed confidence the remaining human resources staff is capable of handling the work.

"I appreciated the restructuring you've done and having some strong people in that department we can lean on," said Supervisor Linda Laylin.
