The stakes are high. Estimated to gross some $31 billion in national sales for 2021, a 41% increase over 2020 sales according to analyst BDSA, cannabis was recently named the fifth most valuable agricultural crop in the United States by a report from industry leader Leafly.com. Even so, marketing avenues in legal states are narrow and social media remains the No. 1 way for brands to distinguish themselves. Losing access can be ruinous.

According to data from Pioneer Intelligence founder Ben Walters, whose Index tracks brand activity for over 600 cannabis companies, Instagram account suspensions and removals have increased over 100% from November 2020-November 2021, from roughly 8% of tracked cannabis brands to around 17%. At press time, Walters says that, of the index of 645 brands in his active pool, nine of the top 200 companies are currently suspended. "As significantly," he adds, "three of the top 15 cannabis companies are down."

Nick Green has been skiing at Whistler Blackcomb since it opened 41 years ago, but this year his enthusiasm has been dampened by concern that unvaccinated people could be riding with him on the gondolas.

The 70 year-old cancer survivor is part of a Load Safe Whistler group behind a 12,000 name petition, calling on the provincial health officer to order proof of vaccination to ride in the five gondolas at Whistler Blackcomb.

Packing 10 strangers into an enclosed gondola for a minimum 25 minute ride is the very definition of an enclosed space, so its totally mysterious to me why Dr. Bonnie Henry wont protect us, he said.

Henry, the provincial health officer, told reporters on Tuesday it is not her job to micromanage businesses.

As with many specific businesses, I think that is not my role, she said. My role is to advise different businesses on how to do their business safely and I would encourage people who ski at Whistler to make their views known to Vail, who makes those decisions.

Green said dozens of letters have been sent to the U.S. owner, Vail Resorts, to no avail.

Its a Mexican standoff with the resort, he explained. They simply say they are complying with public health requirements. By doing this, Vail has positioned Whistler as the number 1 choice of the anti-vaxxers.

In a written statement, Vail Resorts said guests must show their vaccine cards in all dining areas and bars, masks are mandated in all indoor spaces and all of its employees are required to be vaccinated.

Our goal is to keep our guests, employees and communities safe and to keep our mountains open for a long, successful ski and ride season, it said.

The resort was forced to close early for the past two years because of COVID-19 outbreaks, despite the requirement then that people could only ride in a gondola by themselves or with those in their bubble.

Vancouver Coastal Health said data from last year showed most of the 2,000 cases of the virus at Whistler between October and May were transmitted between roommates in household settings, or among friends at social gatherings, and the risk is low this year due to a very high rate of vaccination in the Whistler community, a very low background rate of COVID-19 in the region and a robust communicable disease prevention plan by Vail Resorts.

The municipality of Whistler said in a statement that it continues to rely on the advice of the provincial health officer in regards to preventing the spread of COVID-19 in the community.

Green believes local politicians are running scared.

There is an incredible fear that you cannot question anything public health is doing, he insisted. And, Vail is the biggest taxpayer and contributor to all the associations in Whistler. Its the biggest employer and council is scared of offending it.

Nevertheless, Green said his group isnt giving up its fight.

I have produced thousands of stickers saying I have my COVID vaccine and we have retired doctors and senior lawyers who plan to hand them out to people to put on their helmets so when you are in the lineup you can look around and feel safe loading with people.

With the Tigray Peoples Liberation Front (TPLF) rebels and theOromo Liberation Army (OLA) pressing on with their fight in Ethiopia and threatening the capital Addis Ababa, Prime Minister Abiy Ahmed has put his money where his mouth is.

Abiy announced he was jumping into camouflage, taking up a gun, and going to the front to lead his governments pushback.

It is dangerous business. When Chads strongman Idriss Dby, who had some credits to his name as a frontline warrior, joined his troops in April to battle rebels, he returned home in a coffin within a few days.

Presumably, then, as Kenyans say, Abiy should put his affairs in order before heading out to the frontline. Risky though it is, should he prevail, the political pay-off would be massive. Africa and indeed the world loves to glorify its victorious generals and rebel leaders. An Abiy returning from the battlefield with his adversaries vanquished could install himself as the new Ethiopian emperor and get away with it.

The calls for him to be stripped of the 2019 Nobel Peace Prize he won for making peace with bitter foe Eritrea would be even louder, though. Its possible the Nobel committee could take the unprecedented move of withdrawing the prize. If Abiy were not to return from the war, though, the pressure would be off. His supporters and they are many would present him as a martyr. He would have served his penance.

But the controversy over Abiys Nobel is a beautiful one. For one, it starkly and inconveniently takes the prize back to its contradictory roots. The prize was founded by Alfred Nobel, the Swedish chemist, engineer and industrialist who invented dynamite and made his fortune selling it and other explosives. Nobels conscience was troubled by the destructive power of his inventions.

Nobel died in 1896, leaving his considerable fortune as an endowment for yearly awards in peace, chemistry, physics, medicine and literature all representing his lifelong interests.

If there is one person in the world who personifies the history, incongruity, possibilities and problems with the Nobel Peace Prize, then it is Abiy.

The tragic drama unfolding in Ethiopia also highlights an old problem; about when to get on a political ship, and when to abandon it.

The US, France, Germany, Turkey, and other countries have advised their nationals to flee Ethiopia, as they fear a bloody fight for Addis Ababa is nigh.

The United Nations, too, is temporarily relocating families of international staff from Ethiopia due to the security situation. Kenyan giant telco Safaricom, which had a historic deal to operate in the prized Ethiopian market, weeks back announced it was pulling back some staff.

It is the right thing to do. However, if you are going to enjoy the fruits that a country offers when it is stable, and to take the first parachute out when it is in trouble, there is a way you should conduct yourself.

Dont lecture it about how it should run its affairs when the going is good. As good old Dolly Parton sang, If you want the rainbow, you gotta put up with the rain.

Yesterday, for just a fleeting moment, I missed lockdown. I would never wish for the suffering of those times to continue and it was probably just a case of transitional unease or re-entry exhaustion, but it hit me how difficult it is navigating this post-lockdown world.

It feels like everyone is trying to convince themselves that life is normal again the past couple of years just some sort of bad dream. Click your fingers and everything will be as it was: workers back in offices, restaurants booked out, classes full. But its not normal and its now become an endless game of Russian roulette every decision as to where to go and who to interact with a gamble. Lose, and its the very thing that matters the most that is lost our health and the health of those we love.

People tell me this is the New Normal, living with COVID, but I hate the need for constant risk assessments the weighing up of every activity and whether its worth the risk, or even just worth the worry about the possibility of the risk. I hate the anxiety that lurks after the activity as to whether we have exposed ourselves, our unvaccinated children, our loved ones to this wretched virus. Whether we should visit our immune-compromised friend, that elderly relative, our newborn niece. And if so, whether we should take with us our child, the one who blew her nose once and sneezed twice but says she feels fine.

Say no to the restaurant invitation with friends and it feel like I am over-reacting, letting fear win and missing out. Say yes and end up in isolation, like I am now, after an encounter with at least three infected wait-staff at a local restaurant. At my childrens school, at least eight classes over six year levels are now in isolation after being identified as potential primary close contacts during a period of five days last week. Even if not directed to, many parents half in many classes chose to keep their unvaccinated children home yesterday and this will probably continue. More disruption and challenges for those who take that path and more worry and a feeling almost akin to guilt for those who send them off. These are hard decisions. There is no easy answer, no crystal ball.

There is damage in keeping our children home after such a long lockdown, of pulling them away from longed-for social interaction and a sense of routine and normalcy and of placing that stress back onto the family unit. There is also damage in sending them when they are aware that many of their peers are absent by parental choice why arent my parents keeping me home? They are left surrounded by a sense of unease among those remaining, clutching their sanitiser, tightening their masks. Left to worry about a stray cough, a sneeze.

And there is damage, of course, in sending them to school and them catching COVID, unvaccinated to their own immediate health, potentially their long-term health, and to the people they may unwittingly spread it to, including those most vulnerable.

We have reached a point where we can no longer hide behind government directives and simply do as we are told. The time has come for difficult decisions and fraught conversations when your risk assessments dont match with those around you. I never thought I would say it, but yesterday, for just a moment, I did look back on lockdown as a simpler time for my own family unit. A time when we were kept safe and kept out of the decision-making, absolved of the responsibility for those we love.

Calling it a fiction, a Washington, D.C.-based judge late Monday ruled that a deal giving the Seminole Tribe control of online sports betting in Florida violates a federal law that regulates gaming on tribal lands.

U.S. District Judge Dabney Friedrichs ruling invalidated a sports betting plan in one of the nations most highly sought-after markets and scrapped a deal negotiated by Gov. Ron DeSantis.

However, if you want to place a bet right now, you still can. The Seminole Tribe said it is Reviewing its options.

Sports betting was included in an agreement, known as a compact, signed by the governor and Seminole Tribe of Florida Chairman Marcellus Osceola, Jr. this spring, and approved by the Legislature during a May special session. The U.S. Department of the Interior, which oversees Indian gambling issues, signed off on the deal in August.

But in Mondays 25-page decision, Friedrich ruled that the deal violates the federal Indian Gaming Regulatory Act, or IGRA, which creates a framework for gambling activity on tribal lands. The ruling centered on gamblers being able to place sports bets online from across the state, with the wagers run through computer servers on tribal property.

Altogether, over a dozen provisions in IGRA regulate gaming on Indian lands, and none regulate gaming in another location, she wrote. It is equally clear that the (Interior Department) secretary must reject compacts that violate IGRAs terms.

Although the compact deems sports betting to occur at the location of the tribes servers, this court cannot accept that fiction, Friedrich wrote.

When a federal statute authorizes an activity only at specific locations, parties may not evade that limitation by deeming their activity to occur where it, as a factual matter, does not, she added.

Under the 30-year deal, the Seminoles agreed to pay the state at least $2.5 billion over the first five years in exchange for controlling sports betting and being allowed to add craps and roulette to the tribes casino operations.

The hub-and-spoke sports-betting plan was designed to allow gamblers anywhere in Florida except on other tribal lands to place bets with mobile apps or other devices, with the compact saying bets shall be deemed to be exclusively conducted by the tribe.

Owners of Magic City Casino in Miami-Dade County and Bonita Springs Poker Room in Southwest Florida which have been owned by the Havenick family for decades filed a lawsuit against U.S. Department of Interior Secretary Deb Haaland and her agency alleging that the sports-betting plan violated federal laws and would cause a significant and potentially devastating impact on their businesses.

Friedrichs ruling, which came weeks after the tribe quietly launched its mobile sports-betting app, injects uncertainty into the Seminoles future sports-betting activities. The tribes Hard Rock app was still accepting wagers Tuesday morning, and a spokesman did not say whether the Seminoles plan to shut it down.

The Seminole Tribe is reviewing the judges opinion and carefully considering its next steps, Gary Bitner, a spokesman for the tribe, said in an email.

But Magic City called Friedrichs ruling a victory for family-owned businesses like ours who pay their share in taxes and believe the free market should guide the business operations of gaming venues.

We look forward to working with the governor, Legislature and stakeholders to pave a path forward that ensures a fair gaming marketplace exists in Florida, the pari-mutuel operator said in a prepared statement.

In a court document filed this month, lawyers for Haaland conceded that the sports-betting plan would allow bets to take place off tribal land but said the state had authorized the wagers, calling it a permissible hybrid approach that complies with state and federal law.

But Friedrich found that the governments reliance on Florida law to defend the compact misses the mark because the agreement authorizes gaming off and on Indian lands.

Speaking to reporters Tuesday in Broward County, DeSantis said he negotiated the agreement with the tribe because he felt the state wasnt receiving enough money under a previous deal with the Seminoles, whose Tampa casino is one of the nations most profitable. The governor, a lawyer, acknowledged that the hub-and-spoke plan was an unsettled legal issue.

They wanted to do the sports (betting), and so we said fine. And the reason why Id said that is because it would probably pass on a referendum anyways. And then if a company gets it, the tribe gets it anyways. So, we felt that that made sense, he said.

The governor said the state, which is not a party in the lawsuit, would support an appeal by the federal government.

The compact was structured to allow the state to continue reaping revenues from the Seminoles gambling activities if the sports-betting provision was struck down, DeSantis noted.

But Friedrichs order vacated the entire compact, saying the practical effect of this remedy reinstates a 2010 agreement with the Seminoles that expires in 2030. That deal gave the tribe the ability to offer banked card games, such as blackjack and baccarat, at most of its casinos. The tribe stopped making payments to the state in 2019 after a drawn-out dispute over designated player card games offered by pari-mutuels around Florida.

Friedrich also found that the new compact violated a 2018 Florida constitutional amendment that requires statewide approval for expansions of gambling, including sports betting.

But the judge noted that her decision does not foreclose other avenues for authorizing online sports betting in Florida.

For example, she wrote, the state could negotiate a new compact with the tribe that allows online gaming solely on Indian lands.

Friedrich also suggested that Floridians could approve a citizens initiative to allow online sports betting, an effort already underway that could get a boost from her ruling.

Online sports betting behemoths DraftKings, Inc. and FanDuel have poured more than $32.7 million into a political committee backing a proposed Florida constitutional amendment that would legalize sports betting at professional sports venues, pari-mutuel facilities and statewide via mobile applications.

As of Tuesday, the state Division of Elections had received 116,437 valid petition signatures from the Florida Education Champions committee sponsoring the initiative. The committee would need to submit 891,589 signatures to get on the November 2022 ballot.

The committee is confident that it can meet the deadline, spokeswoman Christina Johnson said in a prepared statement.

Our effort was always mutually exclusive from the compact. Florida Education Champions focus remains in securing the nearly 900,000 valid petitions to make the November 2022 ballot, she said.

Those words from actress Jane Greer, the ultimate femme fatale in the 1947 film-noir classic, Out of the Past,could well have been written above the caption of the Biden administrations brief this week before the Supreme Court, seeking to enjoin the Texas abortion law. The administration is returning to ask for an injunction from a court that just voted against such an injunction as legally unfounded.

Asking the same justices the same question would not seem a way to win. Indeed, as actor Robert Mitchumdryly responded to Greer in the film, this may not be the way to win, but at least theres a way to lose more slowly.

For pro-choice advocates, the pending case ofDobbs v. Jackson Womens Health Organization, out of Mississippi,is a more ominous threat to abortion rights with a newly constituted conservative majority on the court including Justice Amy Coney BarrettAmy Coney BarrettRoe roulette: Biden administration takes a gamble with emergency appeal of Texas abortion law Supreme Court rejects Maine health workers' challenge to vaccine mandate Senate Democrats blast Supreme Court on one-year anniversary of Barrett's confirmation MORE who, as an academic before joining the court, was highly critical ofRoe v. Wade. TheDobbscase is due to be argued in December.

However, the Court has been thrown early into the arena by the Biden administrations emergency demand to seek an injunction of the Texas law, which imposes an even more stringent limit on abortion than the Mississippi law at issue inDobbs.

As previously discussed, the attempted intervention of the Justice Department in the Texas case was not just legally unnecessary but unwise. I share theview that this law is unconstitutional, and I have long favoredmore liberal standing rules, but the Biden administration is risking a great deal to enjoin a law that was already declared unconstitutional in Texas. Indeed, the rushed hearing this week could lock in a majority on language impacting the much more important appeal inDobbs.

The government's lawsuit raises questions of both whether it can sue and whether a court can remedy constitutional violations at this time. The Texas brief attacks the very claim of an injury with the words The federal government cannot get an abortion. By intervening as an actual party, instead of in its traditional role as an amicus or friend of the court, the Biden administration unwisely introduced an additional legal controversy into the case. It is claiming the right to challenge any state law that is considered unconstitutional, and to enjoin any state judge or court from considering such cases.The Supreme Court has long been hostile to federal courts enjoining state courts.

To win, the Biden administration must get at least one of five justices to effectively reverse a position taken just weeks ago when they rejectedthe same injunction inWhole Womans Health v. Jackson.The problem is that, unlike other state limitations on abortion, the Texas law is directed at allowing private citizens to enforce a prohibition after six weeks of pregnancy. That prohibition is clearly unconstitutional under current Supreme Court precedent covering the pre-viability period of pregnancies. However, since it creates authority for private citizens to sue, there is no agency or government officers who enforce the rule. So, in the earlier case, pro-choice litigants randomly selected a judge and a clerk to enjoin from allowing such lawsuits.

The practical and procedural problems are obvious. First, you would have to enjoin every judge and clerk to stop this law from being used. Second, this is a not-so-subtle evasion of a long-standing rule that the court enjoins people, not laws. That is why five justices declined to issue an injunction despite acknowledging that The applicants now before us have raised serious questions regarding the constitutionality of the Texas law at issue. However, the justices ruled that their application also presents complex and novel antecedent procedural questions on which they have not carried their burden.

Even Chief Justice John Roberts, who voted for an injunction with his three liberal colleagues, admitted that it is unclear whether, under existing precedent, this Court can issue an injunction against state judges asked to decide a lawsuit under Texass law.

Nevertheless, the Biden administration again demanded the same injunction after losing before the United States Court of Appeals for the Fifth Circuit. Moreover, unlike the first attempt, a federal court has already declared the law to be unconstitutional. There is no court that has declared the law enforceable. In addition, the Fifth Circuit has fast tracked arguments on the merits and will hear the case in December.

While perhaps politically popular, the Biden administrations move could create even more restrictive precedent on its ability to seek such relief. Worse yet, the procedural rule could have blowback on that big case pending on the docket:Dobbs v. Jackson Womens Health Organization. The majority could note that there is an unlikelihood to prevail on the merits because the law contains an affirmative defense that it cannot be used to imposean undue burden on a woman or group of women. That is the current test under the controlling case ofPlanned Parenthood of Southeastern Pennsylvania v. Casey, 505 U.S. 833 (1992).

The Biden administration seems to overcome the obvious with the hyperbolic in making the same demand, in hopes of a different outcome:If Texas is right, no decision of this court is safe.The problem is that the Texas law was already declared unconstitutional and any person actually subject to its application could quickly secure an injunction. That is usually how such cases come before the court a party with a cognizable injury seeks judicial relief. It can then move quickly through the system with an injunction in place.

With others challenging this law with direct injuries, there is even less reason for the Biden administration to gamble on this filing. Likewise, there is a second case brought by Whole Womans Health that is consolidated in the appeal. That is the same group that was just before the court in September and lost on the same demand.

Playing roulette with reproductive rights may pay off for the administration. Or it might not. But forcing this issue at this stage, and just weeks after the prior rejection inJackson,does not seem to be a way to win. Again, this does not take away from the legitimate concerns of pro-choice advocates:Dobbsmay indeed curtail or even set asideRoe v. Wade. Yet, even if there is no way to win entirely, there could be a way to lose more slowly but the administrations latest legal move is not it.
