Schlichter Strikes Another Excessive Fee Suit Settlement – National Association of Plan Advisors

Just days before a scheduled trial date, Columbia University has struck a deal with plaintiffs in an excessive fee suit involving the universitys 403(b) plan.

The notice (Cates v. Trs. of Columbia Univ., S.D.N.Y., No. 1:16-cv-06524, notice of settlement 4/7/21) that the parties had come to terms comes one week after Judge George B. Daniels ordered all designated witnesses[i]to testify in personand less than a week before the April 12 start date of that trial in the U.S. District Court for the Southern District of New York.

While particulars of the settlement were not disclosed, the letteraddressed to Judge Danielsasks for a 45 day pause so that they can prepare the settlement paperwork.

Case(s) History

The suit was one of the first wave of 403(b) university suits filed by the law firm of Schlichter Bogard & Denton in August 2016. The plan offered 116 options, with two recordkeepers (TIAA-CREF and Vanguard), and the plaintiffs had alleged that, By failing to monitor and control the compensation paid to TIAA-CREF and Vanguard for recordkeeping and administrative services, Defendants caused the Plans to pay unreasonable expenses for administration, resulting in Plan losses of at least $15$20 million.

While at least 20 universities have been sued over the fees and investment options in their retirement plans since 2016, settlements have been struck with the University of Pennsylvania,Brown University,Vanderbilt Universityand theUniversity of Chicago. On the other hand, St. Louis-basedWashington University,New York UniversityandNorthwestern Universityhave prevailed in making their cases in court.

What this Means

Theres only so much you can learn from a settlementwhere the parties seem to basically agree to disagree, conceding that the outcomefor good or ill (depending on your perspective)under a full adjudication (much less appeal) is uncertain at best, and as likely to wind up costing twice as much (in time and expense, if not settlement amount) as to be tossed out by a judge (though those time and expense costs remain).

However, we will (and should) wait until the particulars of the settlement are shared to see if there are, in fact, lessons to be learned from this one.

[i]More than a dozen of Columbias witnesses expressed discomfort about testifying in person during the COVID-19 pandemic, but Judge Daniels said the virus does not alone constitute good cause or compelling circumstances to allow witnesses to testify remotely rather than personally in court.

Amazon . com Inc. employees in Alabama who sided against unionization said they had broad concerns about job security and grew convinced that their pay and benefits might not markedly increase with the help of a union.

The resounding victory for Amazon, the nations second-largest private employer, came after it organized what proved to be a successful local campaign, highlighting the companys strengths and questioning the unions benefits. Nationally, Amazon grew vocal in pushing back against criticism about its workplace conditions, including when a top executive engaged in disputes with members of Congress on Twitter.

Analysts say the defeat of unionization will strengthen Amazon after what has already been a year of tremendous growth and success fueled by the pandemic. The tech giants revenue last year soared 38% to $386 billion, and its profit nearly doubled, as it added 500,000 people to its global workforce.

Some workers said Amazon helped steer their vote against unionization. Other employees said they didnt need convincing by Amazon and were against unionizing from the start.

Amazon pointed to its minimum wage of $15 an hour, double the states minimum wage of $7.25 an hour, which is also the federal minimum. The company also highlighted its healthcare and retirement benefits.

Always in Season/ Mike Jacobs: Spring and ducks go well together – Grand Forks Herald

Charlie Christianson and I spent a morning looking at ducks last week. Our best sightings were at the Grand Forks Air Force base lagoons. We climbed onto the end gate of my pickup to see over the levee. The wind nearly blew us into the pond, but we persevered, and we were rewarded.

Ring-necked ducks were the prize. We had a bit of hesitation. Ring-necked ducks are not among the most common of ducks in the Red River Valley, even in migration. Whats more, they closely resemble the scaup, which are among the most numerous of ducks around here in spring migration. So, odds were against our identification.

We cinched it, however, by a close examination of a beautiful drake that presented himself within easy viewing distance. All the field marks were there: a large head, somewhat iridescent and somewhat tufted, a white blaze Christianson called it a spur behind the dark breast and ahead of the dark upper part of the belly.

The neck played no part in the identification; the ring is effectively invisible.

The bill, however, is distinctively ringed. The bill pattern put all of our doubts to rest.

The ring-necked duck is the least abundant of the so-called diving ducks that frequent North Dakota. One of these, the lesser scaup, is fairly common. Its close relative, the greater scaup, migrates through the state. It can be abundant in late fall.

Other diving ducks that nest in the state dont pose any possible confusion with ring-necked ducks, apart from the common features that all duck species share broad bills and webbed feet. The divers, in order of abundance, are lesser scaup, redhead, canvasback, ruddy duck, a unique species with a stiff tail thats often held erect, and the ring-necked duck.

Most other ducks in the state are dabblers. In order of abundance these are the blue-winged teal, mallard, gadwall, northern shoveler, American wigeon and green-winged teal.

Within the city of Grand Forks, mallards are probably most abundant, with wood ducks in second place. Wood ducks are tree nesters, unlike most other ducks.

Ring-necked ducks are fussy about habitat. They are not so fond of prairie potholes as most of the states other nesting species. Instead, they like wooded lakes. This habitat preference makes them more numerous in the Turtle Mountains than elsewhere in the state, although they nest as far west as Des Lacs National Wildlife Refuge northwest of Minot.

On Monday, April 5, Suezette and I made a day trip to the International Peace Garden. A drive through the park produced a red-necked grebe but no ring-necked ducks. We werent concentrating on bird finding in any case. Wed made the drive to see the cactuses in bloom. The Peace Garden has one of the worlds largest collections of cactus species.

The red-necked grebe is another of those finicky nesters. Other grebes are found on prairie wetlands but the red-necked insists on wooded lakes, like the ring-necked duck.

Elsewhere in the bird world, sharp-tailed grouse have shown up at the lek I wrote about several weeks ago. Clearly, the extraordinarily warm weather lured me to look for grouse earlier than the grouse were ready to dance. The birds at the lek this week were nervous and easily spooked. I made a quick estimate of their number about 20 and left them to their business.

Feeder activity has fallen off dramatically; Im expecting an upturn as migrating sparrows begin moving northward. So far, Ive had only American tree sparrows and fox sparrows, always the vanguard of sparrow migration.

Mourning doves are back. So are grackles and blackbirds the latter in large numbers. And the house sparrows are still hanging out at my feeder array.

Later this spring, Ill make my meadowlark survey hoping that numbers remain steady, at least. Im not optimistic. The long, dry fall allowed tilling and burning, both of which reduce the cover that meadowlarks need for successful nesting.

US retaliation for taxing its tech giants may be as high as $900 MILLION media – RT

Washington is reportedly moving forward with its additional duties for hundreds of billions in imports from six nations in response to digital service taxes targeting the likes of Google and Amazon.

A wide range of goods from the UK, Spain, Italy, Turkey, India and Austria could be hit with 25% tariffs, the US Trade Representative documents show. If the US goes ahead with the punitive measure after public consultations scheduled for May, those tariffs would total around $880 million annually, according to Bloomberg.

The sum is thought to be equivalent to what the countries that adopted digital service taxes plan to raise by taxing Amazon, Google, Facebook, and other American internet giants. Given that, the UK, which imposed 2% levies on large tech corporations revenues, is set to be hit hardest by the US move with about $325 million worth of its exports to the US, ranging from clothing and cosmetics to furniture, being on the line.

The duties for Turkey, Spain and Italy could amount to $160 million, $155 million and $140 million respectively, judging by estimated taxes paid in those countries by US-based companies. Meanwhile, Indian and Austria exporters could lose $55 million and $45 million respectively due to retaliatory measures from the US.

While announcing the move last week, Washington said that it is still in favor of an international consensus that is being discussed by the Organization for Economic Cooperation and Development (OECD). The body has been trying to address the tax challenges of the digital economy for years, but no global deal has been struck so far. Until an agreement is reached, the US said that it will maintain our options under the Section 301 process, including, if necessary, the imposition of tariffs.

Tech companies were quick to welcome the renewed US tariff threats. Last week, the Internet Association, which represents leading US internet platforms, including Amazon, Google and eBay, said the move signals that the US is pushing back on these discriminatory trade barriers, while the OECD deal is still in progress.

Artist Phoebe Beasley Reflects on Life and MIGRATIONS – SF Weekly

What Phoebe Beasley does with other peoples discards can be called collage, but thats like describing the Taj Mahal as a building or KafkasThe Metamorphosisas a book. Yes, its accurate, but those words are just the reductive start of a much bigger conversation about history and complexity and characters whose lives veer off in unpredictable and unintended directions.

Beasleys exhibit at Rena Bransten Gallery, MIGRATIONS in Our Minds Eye, isa visualnarrative of the African-American exodus that, from 1916 to 1970, prompted six million Black people to leave the American South for the Northeast, Midwest and West. In Beasleys art aresnapshots of people who are dreaming of their escape or are on their way as inAnother Fireside Chat, where a gray-haired woman practically embracesan old-fashioned radio for the news of the day.

The radio is an actual wooden device from the 1930s that found its way into Beasleys possession, while the woman is composed of different materials including colorful fabric for a dress that resembles a field of new flowers; lined, yellowing paper that is her wrinkled skin; and a brownish stocking that crawls halfway up her left knee but is bunched in a way that would be unbecoming in public. This is a view both flattering and unflattering of a woman alone in the early 20th century with a then-new media device, which brought the world directly into her home. For the woman depicted in that scene, there was no need to migrate anywhere else but the green chair on which shes seated. Beasley says hercollages are almost like stop-action stories.

MIGRATIONS in Our Minds Eye also navigates issues related to migrations in general, as in Beasleys work calledClimates Climax, which hints at the environmental damage that has uprooted people from previously fertile land. But its the Great Migration from the American South, which Beasleys grandparents participated in, thats at the root of her new exhibit.

Beasley, whois now celebrated for her decades-long career in art and arts education (shes a former member of the Los Angeles Arts Commission and the California Arts Council),has gone through her own challenging migrations and obstacles, many of them rooted in racism.In high school, when she aspired to study art in college, her counselor laughed dismissively and told her that African-Americans couldnt become artists. You have to understand:Theres no such thing as a Black artist, Beasley remembers her saying.And after Beasley moved from Ohio to Los Angeles in 1969,she frequently encountered gallerists who told her, Oh, we have one Black person already and our clients dont buy Black art.

In the late 1970s Beasley was at an artistic crossroads: She worked a day job doing sales for two Los Angeles radio stations while doing art at night and weekends, when the poet Maya Angelou by then a good friendhelped convince Beasley to be even more creative to get her art noticed. A car trip from Los Angeles to San Francisco became a tipping point for Beasley. Maya said, Were going to take a car trip, and I want you to meet everyone whos still alive who Ive written about in my books, Beasley says. By the time we went to San Francisco, she asked me what I was working on. And I started to hem and haw. I was doing shows in hospital lobbies or community centers. And she said, You must do this! You must do this! Ive bought your work. I care about your work. Ive told other people about your work. You must do it. If you dont, youll lose it.'

Fast forward to the present: Two American presidents, George H.W. Bush and Bill Clinton, acknowledged Beasleys art with official presidential seals, and Oprah Winfrey, Samuel L. Jackson, and other celebrities regularly collect Beasleys work. Beasley will never want for material to work with, especially for collage, which Beasley was first inspired to do by the work of the great African-American collage artist Romare Bearden, and by her days as a high-school art teacher, when she had limited paint supplies and turned to material that was available. My friends, she jokes now, all have a freebie box at their front door, because everyone I know is old enough to be deaccessioning. The only houseaccessioning is mine. So I have everyones discards or their junk.

The bulls that appear in the collaged, fabric sculptures of Zulfikar Ali Bhuttos latest exhibit are, lets put this matter of factly, weird looking. Two of them have milky eyes that are ghostly. And one of them is really a half-bull, half-human thats dressed in shiny jewelry and a red, flowing skirt that falls halfway to the floor. It helps to know that Bhutto is referencing the bulls that are in Islams holy book. And that hes also celebrating real and imagined queer Muslim fighters. Based in both San Francisco and Karachi, Pakistan, where he was raised, Bhutto has made a name for himself withvisually provocative art thataddresses queerness and Islam. Bhuttos video animation,Tomorrow We Inherit the Earth, is a tour-de-force work that takes Islams oldest extant building of significance, Jerusalems Dome of the Rock, and flies it into a kind of outer space, where it meets a Hindu deity, and the earth circles aroundas sacred Islamic chanting erupts in the background, along with voices and other sounds. When the YBCA exhibited Bhuttos video earlier this year as a window display, you could watch it at night amid the stars and outside elements. That was a perfect spot. The Art Academy of Latvia announces POST, a new interdisciplinary specialization of masters degree programme in art, based on art in context. The programme seeks to explore and examine how it is possible to study art today, while being simultaneously in Eastern Europe and Northern Europe, a region with different borders, characterised by a changing environment and a rich experience regarding the forced use of global ideologies and their collapse. Taking into account the cultural, historical and geopolitical contexts and the artistic processes attached to them, we are in an environment of unique experiences. MA POST can be perceived as an open study space for various ideas and experiments, moving along in the zigzagged relief of theory and practice. The structure of this degree programme consists of three interacting blocks: Practice, Theory and Context.

The key objective of the Practice Block is to shape and reconstruct individual artistic practice. The programme offers time, space and support for the analysis and development of practice, expecting the student to be involved in motivated, self-organised activity in the studio or outside it. The teaching methodology aims to provide each student with the support of two practical study tutors and the discomfort that promotes creativity. International experience of the lecturers and personal practice that covers various art media provide a comprehensive and multifaceted critical contribution to the study process. The course brings into focus individual thinking, analysis and self-reflection, while applying skills, knowledge and a critical view.

Great emphasis is put on the experiments and interpretation in the search for the form of expression, regardless of whether the form is material or immaterial, three-dimensional or two-dimensional, digital or performative, puritanical or hedonistic, etc. The new degree speciality is aimed at capturing ideas that could be viewed or experienced in the form of an exhibition at the end of each study year, in exhibition projects outside the academy as well as in the final exhibition after two years of study.

Theory block consists of three parts: Critical Theory & Art, Creative and Uncreative Writing as well as Academic and Practice Writing.

The Critical Theory and Art course offers a range of theoretical perspectives that shape the discourses of art and visual culture in the late 20th and early 21st centuries, exploring the intersection of artistic practice and theoretical and political ideas. The course is based on trauma and memory studies, gender and sexuality studies, disability studies, critical race theory, psychoanalysis, postcolonialism, posthumanism, ecocriticism and new historicism. An equally important role in the course is given to regional research, which critically evaluates what is happening in the Baltic, Eastern European and Northern European regions. The Creative and Uncreative Writing course takes a look at the diversity of text and visuality relationships in contemporary culture, referring to contemporary art and literature. It involves reading both creative and critical texts as well as working on creative tasks.

The Context Block aims to explore random or deliberately selected, interconnected fragments of circumstances, events, facts and experiences that may prove fundamentally necessary or, on the contrary, superfluous, in order to approach the possibility of comprehending the meaning of the aggregate or causal relationships in art. The Context Block offers a closer look at various aspects that can influence the work of art or an artist culturally, politically, socially, economically, geographically, institutionally and in other ways. This section of the course takes the students on a journey to three enigmatic planets: the artists planet, the work of arts planet and the viewers planet. How free are we or can we be in this space?

The block consists of four parts: practical involvement in the creation of exhibitions and exhibiting in an environment outside the academy are covered in the Exitus section; supplementing the experience through educational excursions and group visits to museums and exhibitions are part of the Excursions section; a platform for generating unexpected creative lines, delivering new and unpredictable impulses in creative activity is discussed in the Out of Context section; creative activity in connection with career development and commercial understanding of the field is viewed in the Creative Industries section.

The syllabus of the POST degree programme is provided by tutors whose backgrounds cover the fields of poetry, philosophy, graphic design, painting, sculpture, music and other areas of art and theory Kristaps Ancans, Ieva Astahovska, Atis Jakobsons, Artis Ostups, Janis Ozolin, Glebs Pantelejevs, Karlis Verdin, Armands Zelcs and Amanda Ziemele. Every two years, students from Latvia and abroad who have completed their bachelors degree and have a wide range of interests, skills, beliefs and an unfocused view of the purpose of life are invited to apply for the programme. Students who lack a portrait in a landscape, sound in still life and movement on a pedestal.

AUSTIN (KXAN) Several new efforts to provide mental health resources could be coming for Austins first responders.

In 2019, the Austin City Council directed city staff to study how to fill the gaps in mental health resources for EMS, fire and police personnel. On Monday, the Public Safety Commission approved the study results and the recommendations made for improvements.

A document provided during the meeting stated the commission believes that the mental and physical health of our first responders is key to the safety of the citizens of Austin.

They voted 6 to 1 to support the following efforts:

Regarding the department policies on CBD oil, the chiefs of staff of each agency noted their officers and employees are permitted to use legal hemp or CBD products. Still, the have to caution them against any product that could cause a random drug test to come back positive.

Reena Kaven, owner of Tribe CBD and Cannabinoids in North Austin, explained that some CBD products feature small, legal amounts of THC to help the CBD work better in the body. These are called full-spectrum products.
