Workers’ rights need more protection in the gig economy – The Guardian
Posted: July 17, 2017 at 4:05 am
Matthew Taylor seems more concerned to preserve the gig economy business model than worried about the resultant exploitation, writes Simon Diggins. Photograph: Charles Platiau/Reuters
Rafael Behrs commentary on Matthew Taylors gig economy report is too kind by half (The gig economy can be exploitative but there is no easy path to Good Work, 12 July). Both in the report and in interviews, Taylor seems more concerned to preserve the gig economy business model than worried about the resultant exploitation. Thebusiness owners excuse, that they couldnt run their business otherwise, is exactly the same old excuse used right back to the slave owners.
If the only way the business model can work is by denying workers rights, rights hard-won by generations of struggle, then that flawed model has no place in any kind of decent, fair society. The Orwellian rebranding of the workers title dependent contractors, or some such nonsense, should tell you all you need to know about how flawed Taylors proposals are. It really is that simple. Simon Diggins Rickmansworth, Hertfordshire
Rafael Behr agonises over the trade-off facing the gig economy, between having a flexible labour market and guaranteeing a minimum hourly income for people who work flexibly.
The Taylor review posits that people in the gig economy who choose to work at off-peak times should not necessarily be entitled to the minimum wage. Butwhen I raised this in the House of Commons, the minister could not have been clearer in her assurance: Minimum wages rates are sacrosanct. There will be no trade-off when it comes to ensuring that everybody is paid at least the minimum wage.
This is a clear undertaking from the government. The Houses job now is to ensure that undertaking is honoured in any subsequent legislation. If gig companies are required by law always to abide by the minimum wage, even if that means a loss in flexibility, they will need to regulate the supply of labour or pay from their profits the minimum wage when there is not the level of demand to pay all workers at that rate. Frank Field MP Labour, Birkenhead
Theresa May doesnt need to introduce new laws to protect workers in the gig economy: British employment law is fair and robust already. But what she could do is ensure that the basics of the law and economics are explained to everyone before they start working, preferably at school, so they can assess the viability of an offer themselves.
Most of these workers are actually not self-employed, so are entitled to holiday pay, statutory sick pay and the other benefits of payrolled employment, while the rates their employers offer are not economically viable as a sole income.
A properly self-employed worker has to charge many times more per hour than their waged colleagues in order to achieve parity of income. Until this is explained to school leavers, this type ofexploitation will continue. Michael Heaton Warminster, Wiltshire
Can you be self-employed if you only have one employer? The taxman once had a rule that you couldnt. Whochanged that? Ian Davidson London
The Guardian has been conducting investigations into the gig economy over the past few months. The publication last Tuesday of the Taylor report into the same topic therefore ought to have justified more than the usual level of coverage. Instead, what did we get? Theresa May, Rebecca Long-Bailey and the GMB offer their reactions to the report, Robert Booth gives us a critical summary of the report, we get another two tales from the gig economy, and there is an editorial along with a comment piece by Rafael Behr.
What we do not get is a proper report of the report itself, its main recommendations, its findings and some key excerpts from it. When the facts of the matter are supplanted by a flurry of opinions from all and sundry, you do your readers a disservice. Id like to know what Taylor says, after which opinions can be aired. Roderick MacFarquhar Edinburgh
Wortley Hall, the self-styled workers stately home on the outskirts of Sheffield, is a wonderful monument to the co-operative movement and the trade unions and has been lovingly restored to its former glory. Is there any need for it to hire staff on zero-hours contracts? Malcolm Smith Pwllheli, Gwynedd
In defence of freelancing stewards at Lords (Letters, 12 July), while I appreciate the reasons that led Rick Hall to resign his Tate membership in sympathy with the staff on zero-hours contracts, the case at Lords is rather different. The Tate has a permanent exhibition and therefore a relatively constant need for a certain number of staff, but the number of stewards required at a Test cricket ground varies vastly. While crowds of over 20,000 can be expected to enter Lords on up to 15 days of the year, there will seldom be a 20th of that number for the other 350 days. For at least five months of the year there will be no spectators at all. To expect the MCC to employ full-time staff on that basis is maybe a little exaggerated. Juan Carlos Escandell Bonn, Germany
I am a chef and a father of four children. Today in the world of UK hospitality, working hours laid down in our contracts are 48 per week, but we are bound by signing an extra clause to our contract that commits us to work more as required by the establishment which usually means a working week of between 55 and 60 hours.
This evidently leaves little or no room for any quality life. Of course, you feel obliged to sign this clause as this is part and parcel of the job offer but you soon realise that it is a trap. You live a life of modern-day slavery in which you dont see your family, you have poor quality sleep and you never get enough rest. In short, you are exploited to the maximum. Needless to say, turnover is extremely high in the hospitality business among chefs.
In our job we know when we start our shift, but not when it ends. Why do we have to be different from any other profession that has reasonable eight-hour shifts?
The hospitality industry currently receives recognition in the form of star rankings from various reviewing bodies depending on the quality of menus, their creativity and presentation, prices, the excellence of service and so on.
But who is taking responsibility to ensure that cooks and chefs have a balance between work and family and living any sort of quality life? Surely, we are more important than the star rankings? Many people in this industry are suffering and they have no other choice as no law is protecting them. Jose Cacn Christchurch, Dorset

Labor hopes for abolition of job contractualization – The Manila … – The Manila Times
Posted: at 4:05 am
GRASSROOTS workers remain hopeful that President Rodrigo Duterte will address their concerns in his coming second State-of-the-Nation Address, particularly their long demand for the abolition of work contractualization.
Taking the cudgels for the estimated 25 to 30 million contractual workers, the group Associated Labor Unions-Trade Union Congress of the Philippines (ALU-TUCP), in a statement over the weekend, called on the President to address the issues of unemployment and underemployment, and the falling buying power of the existing daily minimum wage.
The Duterte one-year honeymoon period with the people is over. It is now time for action. Grassroots workers and their families want to know from the President the Duterte roadmap to address falling wages, joblessness and underemployment with five years left in his term. We want to know [his]plan on how to make economic growth benefit workers who helped built that wealth and how he intends to accomplish them, ALU spokesman Alan Tanjusay said.
The ALU-TUCP is the biggest workers organization in the country registered with the Department of Labor and Employment.
Although majority of its members come from the banking, manufacturing, services and agricultural sectors, it also has members in the public sector and the informal-economy sector.
According to the group, there are close to 12 million unemployed and underemployed individuals while the purchasing power of the daily pay fell from 24 percent to 27 percent in highly urbanized Metro Manila and in 16 other regions nationwide in view of a 3.4 percent inflation rate announced by the government in March this year.
It said short-term endo (end of contract) or contractualized workers, numbering 25 to 30 million working in hotels, restaurants, malls, factories and plantations nationwide are hopeful that the President would come up with an Executive Order (EO) that outlaws the temporary work arrangement.
In his May 1 Labor Day speech, Duterte asked workers for time on his campaign promise to abolish job contractualization, asking the Nagkaisa labor coalition group to draft for him to sign an EO that obliges direct-hiring, does away with labor contractors and cooperatives and eradicates fixed-term employment.
The rich are getting richer while the poor are getting poorer because workers wages and benefits are inadequate. There are no new decent jobs created and if there are jobs, they carry no security of tenure and skills and jobs are mismatched. There is no trickle-down effect. There is no genuine progress because of these inequalities, Tanjusay said.

Auditor-General won’t be investigating Peter Thiel’s NZ citizenship – The National Business Review
Posted: at 4:04 am
The Auditor-General won't be conducting an inquiry into the decision to grant citizenship to San Francisco-based billionaire investor Peter Thiel, said deputy controller and auditor-general Greg Schollum in response to a request from Green Party MP Denise Roche.
Roche called on the auditor-general to look into the decision after it came to light that in June 2011 then Minister of Internal Affairs Nathan Guy, approved Thiel's application for citizenship under the "exceptional circumstances" provisions of the Citizenship Act.
According to Schollum, the provisions allow the minister to grant citizenship to someone who may not satisfy the normal criteria for citizenship, but where granting citizenship "would be in the public interest because of exceptional circumstances of a humanitarian or other nature relating to the applicant".
He noted act gives the minister "broad discretion" and the section does not specify what these terms mean or how the minister's discretion should be exercised. "This means the legislation allows for considerable flexibility on a case-by-case basis," he said.
He said the issues largely come down to policy questions - for example, whether the legislation strikes the right balance for citizen decisions - or legal questions such as whether the provisions were applied correctly. "These are not questions that the Auditor-General generally has authority to answer," said Schollum.
Thiel is a member of US President Donald Trump's transition team, having donated to his campaign, and is a long-time libertarian who has in the past invested in the exploration of seasteading, the development of a floating city in international waters which could serve as a politically autonomous settlement.

Nurse dedicates life to helping hundreds beat drug addiction – NY … – New York Daily News

NEW YORK DAILY NEWS

Margherita was certain that her son was going to die.
It was an October afternoon, and the Staten Island mother had been summoned to the home of her opioid-addicted 29-year-old.
She found him in the basement, ranting and raving, his eyes a scary shade of gray.
I knew this was the last day of his life, Margherita recalled.
Alicia Palermo-Reddy shares stories of opioid addiction
Her familys first call was to 911. The second was to a Staten Island nurse named Alicia Palermo-Reddy.
Margheritas family had first reached out to Palermo-Reddy for advice just a few days earlier.
To Margheritas surprise, Palermo-Reddy showed up at the emergency room and coached her on how to get the struggling young man into treatment.
Three days later, Margheritas son, who had resisted intervention attempts for years, was on a plane to an inpatient drug program in Texas.
A health bill retreat from opioid crisis
That was eight years ago. Margheritas son, who has remained drug-free, now has a steady job, a wife and three children.
She saved our lives, Margherita said of Palermo-Reddy.
Since then, Palermo-Reddy has helped hundreds of Staten Island families like Margheritas.
Working in her spare time and free of charge, shes quietly become the unofficial coach, mentor and therapist to an ever-expanding network of parents and addicts touched by the citys opioid crisis.
NYPD says calling 911 during drug overdose won't lead to arrest
Shes responsible for my son and so many others, Margherita said. I dont know what her reasons are. I dont know what drives her. Thats why I say shes an angel.
Growing up in Staten Islands Huguenot neighborhood, Palermo-Reddy never imagined that she would become a one-woman addiction help line.
Palermo-Reddy was working as a dental assistant before she landed a job as a registered nurse at a Staten Island hospital 12 years ago.
The 47-year-old mother of two, now known as the addiction angel, was shocked by what she saw when she started picking up overtime shifts at the hospitals detox unit.
NYC doctor busted for writing unneeded painkiller meds
When I heard about heroin growing up, I thought about people in trailer parks with no teeth and black feet, Palermo-Reddy said. Seeing these young, beautiful kids with sores on them and heartbreaking stories was very disturbing to me.
The more and more that I saw it, I realized theres a big problem out here that nobodys talking about.
Word of her work with addicts spread quickly in the tight-knit South Shore.
Soon, Palermo-Reddys phone was lighting up with desperate phone calls and texts from friends and friends of friends who had relatives battling opioid addiction.

Many of the callers were in the same seemingly hopeless situation: an adult-aged son or daughter who was resisting intervention attempts.
These are mothers saying, Were at a loss. We dont know what to do, said Palermo-Reddy, whose three nephews suffered from addiction. How do you not help these people?
In those early days, Palermo-Reddy would guide the callers as best she could and urge them to attend local support groups.
Several parents told her they had tried meetings but were turned off by them. So Palermo-Reddy began organizing her own support groups in the backyard of her mothers home.
Doctors provide enough opioids to drug up all Americans for weeks
Demand was so great she moved them into a local school. Then she started a Scared Straight program for young people that regularly draws more than 100 people.
As her reputation grew, Palermo-Reddy realized she needed to arm herself with more information. She went to a local courthouse to learn about restraining orders. She talked with cops to understand the circumstances under which they will remove someone from a home. She went to detox centers to find out about admission policies and insurance issues.
Along the way, she honed her own tough-love approach.
Palermo-Reddy believes family members often enable the addicts drug use by setting red lines and then failing to act on them.
Family angry at dentist who gave addict painkillers
An addict doesnt want to be an addict. Hes allowed to be an addict, Palermo-Reddy said. I dont want you to bury your kid, so Im going to tell you like it is. With this disease, you dont have time to waste.
Palermo-Reddy has developed a reputation for being available at all hours of the day and dropping everything to help a family in need of counseling.
One Staten Island mother recalled reaching out to Palermo-Reddy on a Friday night last year.
My son had just called me and said he had relapsed, said the mother. (Palermo-Reddy) was out to dinner and still she said, Ill meet you in Staten Island. Ill meet you at the house.
U.S. to crack down on opioid treatment programs: Bloomberg
In that late-night meeting, Palermo-Reddy mapped out a plan to send the 26-year-old son to a 30-day drug-treatment program in Florida. Hes now 14 months sober.
Alicia was with us every step of the way, the mother said.
Among the many recovering addicts Palermo-Reddy has helped is a 46-year-old former Cond Nast business director.
If I failed, I would rather tell my parents, my girlfriend, anybody but Alicia, said the man, who has been sober since last May. I know how much she cares about me and she has no reason to.
Cops bust Staten Island heroin ring that sold deadly dose
Palermo-Reddys all-consuming role hasnt always been easy on her husband, Dennis, and children, Frank, 23, and Jacquelyn, 27.
Shes gotten better, said Jacquelyn. At my bridal shower, she was on the phone texting with parents. I had to tell her to put her phone away. Thats how bad it was.
On a recent Thursday night, about 30 people gathered in the auditorium of the Our Lady Star of the Sea Church for one of Palermo-Reddys monthly meetings.
There was a retired firefighter whose 30-year-old son was in the throes of opioid addiction, the parents of a 23-year-old who had been sober for three months and a burly recovering addict who had been clean since March.
Emotions were raw.
You get to the point where after 15, 20 years of this bulls---, you say, Wont you just die already, one father said.
Another father recalled having to threaten a doctor who kept prescribing his drug-addled son pain pills.
I told the doctor, You give him another pill, Im going to beat you to death, the man said.
Palermo-Reddy conducted the meeting like a hard-edged Dr. Phil, offering uplifting messages of personal empowerment and sharply worded pieces of advice.
As long as you remain weak, the addict is going to remain sick, she told one parent. You need to learn to stay two steps ahead of the addict and never allow him to manipulate you again.
At one point, Palermo-Reddy explained that one of her recovering nephews lives with her.
Hes 35 years old. I cannot prevent him from relapsing again, Palermo-Reddy said.
I support him. I encourage him. We love him. If he relapses, his bags would be packed before he would even have to tell me. He would know to pack his bags. Hes out.
The meeting ended after 9 p.m., and Palermo-Reddy walked out with a family she had never met.
The son had relapsed multiple times before finding out that he had cancerous brain tumors. He beat the cancer, then relapsed again, but was newly sober.
You have a powerful story. Get yourself clean, Palermo-Reddy told him. I want to see six months, and then Ill have you come speak with me.
The man nodded his head and smiled.
Whether he knew it or not, the odds were small that six months would pass before Palermo-Reddy would be seeing him again.

Three Things Great Leaders Do That Achieves Amazing Results – Inc.com
Posted: at 4:04 am
When it comes to leadership, it's good if you have great personal qualities such as authenticity, integrity, humility, etc., but at some point, you have to achieve results.
Results are the benchmark of success and to do that you have to be able to inspire your teams to achieve great things.
So how do great leaders achieve that?
Everything starts with engagement. If your teams are not engaged, then they are just turning up, taking the money and doing the bare minimum.
And when you look at the statistics for employee engagement that covers a very large percentage of the work force, as 68 percent of US employees are disengaged, and 65 percent of managers are disengaged.
Employee engagement is a contact sport. You cannot engage people from behind your desk or via emails. You can't engage them if you are not engaged.
You need to get out there showing your passion and enthusiasm, clarifying the objectives, explaining the purpose and aligning the goals and desires of the teams with the goals of the initiatives.
Companies with engaged employees perform 147 percent better than those with disengaged employees.
As the leader is your job to engage them, it's not their job to be engaged!
Once teams are engaged, the next step is to excite them. Everyone wants to work for a successful team and feel like they have done a great job, so if you can show them how they will be successful, this will get them fired up and ready to work hard towards the goals and objectives.
People are not afraid of hard work; they are afraid of failure. By showing them how success can be achieved will help increase their confidence and belief that they will be successful, which is a great inspiration.
An engaged and excited team is a powerful team that can achieve great things. To help ensure that this results in the success you need to empower them.
Empowered teams take ownership, and when things start to go awry, they will look for solutions to ensure that the desired outcomes are met.
Too often leaders want to retain a tight grip on the controls, but if that grip is too tight, then you need to be involved in everything, giving approval for even the smallest of changes.
You become a limitation on what can be achieved!
To empower your team, you need to give them the flexibility to make the necessary corrections if things start to slip. You need to delegate some of the control that you hold, but with clear boundaries, so that they understand when they can make decisions, and when they need to refer back to you for approval.
The more you can empower your teams the more committed they will become. Empowerment is a delicate balancing act, but it's one that you get better at with practice, and it will be appreciated by many of your staff.
When you can create engaged, excited and empowered teams not only will it help you achieve the goals and objectives, but it will make others want to come and work with you and for you. It will separate you from the other leaders in your organization, putting you in demand and presenting great opportunities to you.
How engaged, excited and empowered is your team and what are you going to do to help improve in these three areas?

In Argentina’s religious freedom row, politics makes strange bedfellows – Crux: Covering all things Catholic
Posted: at 4:04 am
ROME Argentina didnt exist as a nation when Shakespeare inspired the line politics make strange bedfellows, but if the Bard were around today, he might well look to the popes native country for proof, where the once leading conservative rival of the future pontiff and Amnesty International find themselves in an unlikely alliance over a proposed religious freedom law.
In the case of Archbishop Hctor Rubn Aguer of La Plata, seen as the countrys most fiercely traditional prelate on matters such as the legalization of abortion and contraception, he insists the law could threaten the Churchs protected status under the countrys constitution, while Amnesty International fears the law could deprive Argentine youth of their sexual rights.
To put the situation in American terms, its as if the late Jerry Falwell and the ACLU had found themselves on the same side of a church/state debate i.e., a head-scratcher, and one that helps illustrate the often-maddening political complexity out of which Pope Francis emerged.
The bill was presented to the Argentine senate in June, and it reflects a consensus among various religious groups in the country: The local Catholic bishops conference, the two largest Jewish institutions, an Islamic Center, and various federations of Evangelical churches and Orthodox Christians. It has the support of the national government, including President Mauricio Macri.
Among other issues, the proposed bill introduces a right to conscientious objection, both for individuals and institutions. If passed, the measure could be invoked for military deployments, providing medical procedures such as abortion, the right to have a holiday during religious festive days, and the right to rest on the days imposed by each religion.
In addition, registration of religious institutions would no longer be mandatory, although registering would provide benefits, including tax exemptions, to those who do. According to those promoting the bill, its intended to offer a deeper understanding of religious freedom as a human right.
The initiative was put together by the countrys Secretariat of Worship, which convoked different religious denominations to hear opinions. Its original scope was to replace legislation sanctioned by the military government in 1978.
According to the Argentine newspaper La Nacin, Santiago de Estrada, the man who leads the government office, said it was the religious institutions that called for the incorporation of a right to conscientious objection.
Estrada also underlined the harmony among religious denominations that exists in the country, leading to a healthy and fruitful coexistence promoted by Cardinal Jorge Mario Bergoglio, once Archbishop of Buenos Aires, today Pope Francis.
Aguer, considered a leading voice among conservatives in Argentina, is a man whos often clashed with Bergoglio, to the point that when Francis was elected to the papacy, according to news reports from the time, Aguer refused to ring the bells of the cathedral of his archdiocese, La Plata.
Aguer and Francis have known each other a long time. The two worked together in the 1980s, when Aguer was rector of San Miguel seminary and the future pope was the provincial superior of the Jesuits in Argentina. In the 1990s, the two were both auxiliary bishops of Buenos Aires.
Their relationship has never been ideal, and they have very different styles: Aguer tends to be confrontational, while Francis usually takes a more pastoral approach. However, Argentine journalist Mariano De Vedia reports that the two exchange hand-written letters often, and quotes fellow Argentine bishops as saying their differences are more about tone than content.
On Saturday, during his weekly TV program, Aguer spoke about the proposed bill, saying that its unnecessary and that it could have a negative effect on the Catholic Church, hence on Argentine society as a whole.
He also lambasted the Permanent Commission of the Argentine bishops, who went through the proposed bill and gave their green-light, or, at least, according to Aguer, their nihil obstat(a Latin phrase meaning, nothing stands in the way.)
Such a law, Aguer said, should have been debated by the conference as a whole during their plenary assembly, arguing that its too important for it not to be the case.
Aguer also warned that the law would allow an uncontrollable number of sects to grow wildly in the country.
According to the archbishop, the law is being considered because of the pressure of a number of pastors [quotation marks in the original] who dont belong to any specific church.
Never one to hold back a thought, Aguer also spoke about the number of baptized Catholics who join evangelical churches in Argentina, saying that he could come up with at least one reason: Evangelicals talk to people about Jesus, about prayer, penitence, eternal life, while were too busy trying to guarantee the temporal well-being of the Argentine society.
On the other hand, what can we do on these issues? How much do policy makers listen to us? It would be necessary, on our part, to do an examination of conscience, and probably, as a conclusion, a mea culpa.
Last but not least, Aguer also said that the proposed bill would be unconstitutional, and this is something he and Amnesty International have in common. However, their reasons are clearly divergent.
For the archbishop, the law contradicts Argentinas Constitution because making all religions equal is at odds with the constitutions second article, which says that the state sustains Roman Catholic apostolic worship.
Sustaining, Aguer added, doesnt mean that the government throws a few bucks to priests, but that it supports, favors and privileges the Catholic Church.
Mariela Belski, executive director of the Argentine branch of Amnesty International also argued that the proposed bill would be unconstitutional, but her argument is that it violates rights [that are] constitutionally protected.
Among them, she said, are the sexual and reproductive rights of young people and adults, since she claims a health-care provider could invoke the law to refuse to hand out contraceptives on religious grounds.
Belski also argued that a teacher could refuse to teach evolutionary theory, and that it leaves hanging on a thread the law of Integral Sexual Education, because any teacher could limit religious education to Christian sexual morality or the morality of any other religion.
Furthermore, Belski wrote, a judge could refuse to celebrate a marriage between people of the same sex on the basis of moral or religious principles, violating peoples right to equality and nondiscrimination.
In 2012, Argentina approved a law on gender identity regarded by observers as one of the most far-reaching in the world. The law states that a person can legally change gender by simply saying so, while most other countries that accept legal gender change have many requirements, ranging from an actual sex change to court orders.
The law had an impact on the educational system, with the government designing booklets teaching students to choose their gender, regardless of their sexual identity. Teachers were asked not to impose stereotypical ideas on children. Sexual education manuals reflecting those values were to be used in every school receiving public funds, including religious ones.
In the end, the manuals werent implemented because the drawings and images depicted were considered too explicit for five-year-olds. Nevertheless, according to the website of Argentinas Education Ministry, the de-naturalization of gender stereotypes began in 2010, when Pope Franciss home country legalized gay marriage, the first nation in Latin America to do so.
Belski argues that the proposed bill would represent a substantive recoil that would allow public employees to fulfill the task for which they were hired.
She also writes that conscience objection on health issues and especially sexual and reproductive health used in an abusive and arbitrary way has constituted an illegitimate barrier to access legal abortion.
To date, theres been no comment from Pope Francis regarding the law, but seeing that hes long advocated both religious pluralism and the right to conscientious objection, its not far-fetched that hed be among the Argentine bishops supporting it.
Theres a persecution of which not much is being said, Francis said last year during one of his daily Masses, cross-dressed as culture, cross-dressed as modernity, cross-dressed as progress.
The pope said this educated persecution occurs not when a person confesses the name of Christ, but for wanting to have and to manifest the values of a Son of God.
We see every day that the powerful countries create laws that force us to go through this path a nation that doesnt follow these modern laws, these cultures, or that at least doesnt want to have them in its laws, is accused, is politely persecuted, Francis said.
Its a persecution that robs man of his freedom, even from conscientious objection! he added.
