NSA brags about turning the tables on cyberwarfare hackers

How confident is the National Security Agency about its ability to wage cyberwarfare? Enough so that it's bragging about it. A new round of Edward Snowden leaks published by Der Spiegel reveal that the institution has not only been gearing up for a future of digital battles (it asked for $1 billion to improve its cyberattacks back in 2013), but boasts about what it can already do. For example, it touts that it can "drink your milkshake" (There Will Be Blood style) if you dare attack American government computers. When China hacked the Department of Defense in 2009, the NSA not only pinpointed the source of attack, but broke into China's intelligence network and monitored the country's spying efforts. This "fourth party collection," as the NSA calls it, lets the agency find out what's happening without doing all the hard work.

The NSA also makes it a point to use the tools and methods of their attackers against them, and to develop its own attacks against critical systems (like energy grids) in case they're needed. Its agents all that worried about getting caught, either. They regularly cover their tracks, such as by placing data on the servers of "scapegoat" targets to throw people off the scent.

It's not surprising that the NSA would turn the tables on its foes. However, it's willing to use "fourth party" techniques on any country that isn't part of the Five Eyes Alliance (Australia, Canada, New Zealand, the UK and the US), including its allies. And there's a concern that the US is shifting too much of its attention toward offensive capabilities, rather than focusing on defense -- it's hard to claim the moral high ground in cyberwarfare when you're willing and able to inflict serious damage.

Volokh Conspiracy: Raisin takings case returns to the Supreme Court

Although the news is likely to be buried in the understandable hoopla over the same-sex marriage case, the Supreme Court today also agreed to review Horne v. Department of Agriculture, a case where property owners argue that the federal governments demand that they turn over large quantities of raisins is a taking for which they are entitled to just compensation under the Fifth Amendment. The governments effort to seize the raisins is part of a program intended to increase the price of raisinsby creating an artificial scarcity on the market, thereby benefiting producers at the expense of consumers. The Ninth Circuit Court of Appeals rejected the owners claim in large part because it concluded that the just compensation requirement of the Takings Clause affords less protection to personal [property] such as the raisins, than to real property.

Will Baude has a good post explaining the case in greater detail here. As he notes, I joined an amicus brief co-authored with several other property and constitutional law scholars urging the Supreme Court to take the case and overrule the Ninth Circuit. The brief explains in some detail why the Takings Clause protects personal property on par with real property, and demonstrates that that understanding goes all the way back to the Founding.

Horne is now one of the rare cases that has gone to the Supreme Court twice. In 2013, the Court unanimously rejected the federal governments claim that the property owners should not even be allowed to present their Takings Clause argument in federal court without first paying some $483,000 in fines and pursuing various likely futile administrative remedies.

SC lawmaker fighting to bring gun education to classrooms

A South Carolina lawmaker is fighting to bring Second Amendment education to classrooms. Representative Alan Clemmons proposed the bill to change the zero tolerance gun policy in schools across the state.

The bill proposes that three weeks out of a school year schools will teach students gun rights and gun safety. Representative Clemmons said students will benefit from this curriculum.

They can learn about sex, so why can't they learn about guns? I think whenever it's appropriate they learn about that, they should be able to learn about guns," parent Iva Lands said.

Lands is on board with the Second Amendment Act of 2015.

If you teach a child how to use it properly, you're not going to have the accidents. If you educate them, you're going in the right direction," she said.

Others said it's not the school's responsibility to educate students on guns, nor teach them how to use it.

Those that do grow up around guns, the parent should be responsible enough to teach them up until old enough to understand. I really like my child taught that in school," parent Sandra Hodges said.

Rep. Clemmons said the purpose of the bill would allow students to express the second amendment at schools without fear of punishment.

If anything comes up in a school setting that has to do with firearms, then it's a suspendable offense and criminal charges can ensue," he said.

He believes if the state doesn't educate students on their right to bear arms, and teach them how to practice the amendment safely, there will be repercussions.
