Obama backs passing of NSA reform legislation by Senate

The administration of U.S. President Barack Obama urged the Senate to pass the USA Freedom Act, which would curb the bulk collection of telephone records by the National Security Agency in the wake of widespread concerns about potential violations of privacy.

The administration has asked the Senate to pass the legislation and for the House of Representatives, which earlier passed a weakened version of the bill, to act quickly so that Obama can sign the legislation into law this year, according to a statement Monday from the executive office of the president. The bill has to pass both in the Senate and the House before it can become law.

A procedural vote in the Senate on the legislation, which has got the backing of civil rights activists and other groups, could come on Tuesday, with a final vote on the bill in the days following.

The bill strengthens the FISAs privacy and civil liberties protections, while preserving essential authorities that our intelligence and law enforcement professionals need, according to the statement, which noted that the administration strongly supports Senate passage of the legislation. If the bill is not passed, critical national security authorizations that are reformed in the legislation could expire next summer, it added.

The administration is, however, hopeful that the legislation will resolve concerns from intelligence officials about a provision in the bill that allows an independent privacy advocate to argue before the FISA Court in support of individual privacy and civil liberties. The Foreign Intelligence Surveillance Act, better known as FISA, governs NSA surveillance.

Former NSA contractor Edward Snowden triggered strong privacy concerns in the U.S. and abroad after his disclosures last year that the government was collecting telephone metadata of Americans in bulk from Verizon and also intercepting Internet communications, placing technology companies in an embarrassing position with their users.

A number of countries are now demanding that cloud companies store data locally to avoid access to the information by U.S. law enforcement.

The Senate bill requires the NSA to use specific selection terms to limit its targets in the telephone records collection, and requires the government to issue reports on the number of people targeted in surveillance programs.

The bill introduced by Senator Patrick Leahy, a Democrat from Vermont, is a version of the bill passed in the House, which was criticized by privacy advocates for watering down key privacy provisions, including in the criteria for search terms to collect phone records.

Some critics of the bill, however, argue that the USA Freedom Act does not address surveillance and data collections under other provisions such as Section 702 of the amended FISA Act, which covers surveillance of non-U.S. persons located outside the U.S.

'Now Is the Time': Tech Giants Push NSA Reform

Google, Apple and other big names in consumer technology are imploring Congress to pass a bill to curb the surveillance powers of the National Security Agency. More than a year after former NSA contractor Edward Snowden leaked classified documents detailing the breadth of NSA spying powers, the U.S. Senate this week is expected to begin weighing the USA Freedom Act. The bill sponsored by Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., would set limits on the bulk collection of Americans Internet data. Google, Microsoft, Facebook, Apple, Twitter and other tech giants on Sunday sent an open letter to the Senate imploring it to reform government surveillance techniques. Since forming the Reform Government Surveillance coalition last year, our companies have continued to invest in strengthening the security of our services and increasing transparency, the letter said. Now, the Senate has the opportunity to send a strong message of change to the world and encourage other countries to adopt similar protections.

California Towns Unusual Gun Law to Get Federal Appeals Court Ruling

On Monday, the long-running debate over gun laws is moving to center stage, out in San Francisco.

A three-judge panel of the Ninth U.S. Circuit Court of Appeals will hear arguments concerning whether an unusual gun law passed by voters in Sunnyvale, Calif., late last year is constitutional.

A coalition of gun-rights groups, including the National Rifle Association, claims the law, which bans anyone from owning gun magazines capable of holding more than 10 rounds, violates the Second Amendment to the Constitution.

Sunnyvale, on the other hand, claims the law does not impinge on Sunnyvale residents Second Amendment rights to own a firearm within the home for self-defense because such large-capacity magazines are neither necessary nor even useful for self-defense because defenders seldom fire more than two shots. Restricting such magazines makes sense, Sunnyvale argues, because theyre frequently used in mass shootings, including the massacre at Newtown, Conn., at the end of 2012.

So who is right?

A U.S. District Judge in San Jose, Calif., in March upheld the law, finding that while the Sunnyvale law implicated the Second Amendment, the burden placed by the law on a Sunnyvale residents Second Amendment rights is relatively light.

Wrote Judge Ronald M. Whyte:

The Sunnyvale law passes intermediate scrutiny, as the courtwithout making a determination as to the laws likely efficacycredits Sunnyvales voluminous evidence that the ordinance is substantially tailored to the compelling government interest of public safety.

Still, the caselaw concerning firearm restrictions has been developing for a relatively short period of time. In June 2008, the U.S. Supreme Court, in a landmark case called District of Columbia v. Heller, ruled that the Second Amendment protects ones right to own a firearm in ones own home.

But the court left for another day (and, until then, lower courts) a variety of issues, including whether and to what degree firearms can be carried outside the home, and the degree to which semi-automatic weapons can be regulated as well. The law on these issues is not well settled, meaning the judges of the Ninth Circuit have leeway in the Sunnyvale case to chart their own path.
