DNA project ending for Colorado inmates

Posted: at 4:44 am

(Eds: Incorporates story slugged DNA Test Denied.)

GRAND JUNCTION, Colo. (AP) Colorado's Justice Review Project, which reviewed hundreds of old cases statewide over recent years to ensure justice was done, is coming to an end after just one recommendation for new DNA testing.

The program run by the Colorado Attorney General's Office contributed to Robert Dewey's exoneration and freedom following his conviction in Mesa County.

The program is being suspended after $2.6 million in funding from the National Institute of Justice ran out.

Colorado Attorney General spokeswoman Carolyn Tyler said there are no more recommendations for DNA testing.

To qualify, inmates had to be convicted at trial or by guilty plea in a violent felony, including murder, kidnapping, sexual assault, or aggravated robbery. The identity of the perpetrator had to be an issue in the case and physical evidence lending itself to DNA testing had to be available.

"Most of the applications did not qualify for DNA testing as they were not identity cases in which DNA testing would reveal the identity of the true culprit," Tyler said.

First Assistant Attorney General Julie Selsberg said last year that more than 2,000 Colorado inmates had expressed interest. At that time, 7,914 people were serving sentences in the Colorado Department of Corrections for violent crimes that were eligible for the review. A final report on the project is due out later this year, the Grand Junction Daily Sentinel reported Thursday (http://tinyurl.com/kk3mbmw ).

It was Selsberg and her team who recommended DNA tests after a review of Dewey's 1996 trial conviction in the murder of Jacie Taylor of Palisade. The results backed Dewey and indicated someone else committed the crime. Dewey was exonerated in 2012.

Dewey was awarded $1.2 million as the first Colorado resident compensated for wrongful imprisonment 17 years and 12 days in Dewey's case under a law inspired by Dewey and signed into law by Gov. John Hickenlooper.

DNA test results pin down Baguio massacre suspect

Posted: at 4:44 am

BAGUIO CITY Police said they have enough evidence to pin down the primary suspect in the April 6 slaughter of five people, including three children, here, following the release of the results of DNA testing on blood samples taken from the crime scene. Dr. Jaime Rodrigo Leal, medico legal officer of the Crime Laboratory in the Cordillera, confirmed that the blood samples lifted from the place of the killings an apartment on 3rd Kayang Street, here matched with the swab specimen obtained from suspect Philip Tolentino Avino.

According to Leal, the confirmation was based on the DNA test results released to Senior Inspector Angie Amangan, DNA analyst of the Cordillera Crime Laboratory and team leader in the investigation of the massacre.

Leal said the DNA profile matched with the blood lifted from the plastic cabinet, bag, toilet, and the suspects short pants that was left behind in the crime scene.

The blood obtained from the belt of the suspect also matched with the DNA profile of victim Jacqueline Nociete who sustained 18 stab wounds in the body.

The blood from the crime scene and the buccal (mouth) swabbing of the suspect were the specimen subjected to DNA, Leal added.

The presence of the suspect DNA profi le in the crime scene is very vital in the prosecution of the suspect. The DNA test brings the suspect to the scene of the crime, Leal explained.

It can be recalled that Avino, alias Michael Geronimo, was subjected to physical checkup after he was turned over to the Baguio City Police Office by Manila Vice Mayor Isko Moreno on April 9.

During the checkup, Leal found out that the suspect had physical injuries.

He has wounds on the hands four on the right hand and three on the left. These injuries are significant because there are also blood spots that were seen on the scene of the crime, Leal said.

Avino was also identified by two witnesses who saw him knocking on the door of the apartment where the five victims, three of them children, were killed, around 3:30 p.m. on April 6, 2014.

Nellie the dolphin dies at Marineland Dolphin Adventure

Posted: at 4:43 am

Beloved by young and old, Nellie the oldest dolphin in human care, has died at age 61, according to her caretakers at Marineland Dolphin Adventure.

We are saddened to announce that Nellie, the oldest Atlantic bottlenose dolphin in human care, has passed away. She lived to the incredible age of 61. Though we are saddened by her loss, her memory will live on in the lives she touched. She fostered a love of the ocean and promoted marine conservation to thousands throughout her lifetime. We will miss her dearly, the marine park announced on its Facebook page about 7 p.m. Thursday.

An Atlantic bottlenose dolphin, Nellie was born on Feb, 27, 1953 at Marineland. She was adopted as Jacksonville Universitys mascot in 1970. Last year, JU awarded Nellie an honorary doctorate degree in health sciences and longevity during her 60th birthday celebration.

Nellie brought such joy to so many, and was an inspiration to generations with her spirit and longevity, said JU President Tim Cost. We are honored to have had her as our mascot, and share our condolences with her caregivers at Marineland and with all those who shared such a special bond with her.

The certificate was Nellies third. The first was when she was proclaimed an honorary JU Dolphin when named its mascot. She then received an honorary masters degree in marine science in 2008.

She was also the oldest living college mascot in the country. A longtime star performer, she jumped through hoops and playfully interacted with trainers and spectators at Marinelands dolphin shows.

Nellies showmanship made her a national celebrity. She appeared in a Timex watch commercial, and a Frank Sinatra special.

She touched the lives of people who walked through the doors of Marineland. She gave them the gift of awareness, education and conservation while paving the way to help protect marine mammals in the worlds oceans. While an unfortunate loss for Marineland Dolphin Adventure and the Georgia Aquarium family, Nellies legacy continues through the memories created and inspiration she left behind, her human colleagues said on the Georgia Aquarium blog.
