Freedom Industries cited for Elk chemical spill

This is the Freedom Industries plant along the Elk River, just north of Charleston, where the "Crude MCHM" leak occurred Thursday.
CHARLESTON, W.Va. -- When West Virginia inspectors arrived at Freedom Industries late Thursday morning, they discovered that the company had taken "no spill containment measures" to combat the chemical spill that has put drinking water supplies off-limits for hundreds of thousands of residents.

The state Department of Environmental Protection said Freedom Industries violated the West Virginia's Air Pollution Control Act and the Water Pollution Control Act by allowing the chemical "Crude MCHM," consisting mostly of 4-methylcyclohexane methanol, to escape from its facility, just upstream from West Virginia American Water's regional intake in the Elk River.
DEP officials have said between 2,000 gallons and 5,000 gallons of the material leaked from a hole in a storage tank. A concrete-block dike, meant to serve as secondary containment, also leaked, allowing an undetermined amount of the chemical into the Elk.
"It's a bad situation," said Mike Dorsey, chief of the DEP's homeland security and emergency response division.
Dorsey said the tank contained about 30,000 gallons of material at the time of the leak, and that the company had pumped the rest of the material out and shipped it to another of its operations.
Dorsey has said DEP officials began an investigation after receiving odor complaints from nearby residents starting at about 8:15 a.m. The DEP and Kanawha County emergency officials traced the odors to Freedom Industries, which had not self-reported any sort of leak or accident, officials said.
In an air-quality enforcement order, the DEP said air-quality officials who arrived at the site at 11:10 a.m. "discovered that no spill containment measures had been initiated and that an accumulating MCHM leak pool was seeping thru a dike wall adjacent to the Elk River and a downstream oil sheen was observed."
DEP Secretary Randy Huffman said more information needs to be gathered, but that it seems possible the spill into the river might not have been as bad if Freedom Industries had acted more quickly.

CHARLESTON (WVVA) - Freedom Industries has issued its first statement on the che
mical spill the occurred at its plant along the Elk River near Charleston. Below is the full statement:
"Since the discovery of the leak, safety for residents in Kanawha and surrounding counties has been Freedom Industries' first priority. We have been working with local and federal regulatory, safety and environmental entities, including the DEP, Coast Guard, Army Corp of Engineers and Homeland Security, and are following all necessary steps to fix the issue. Our team has been working around the clock since the discovery to contain the leak to prevent further contamination. At this point, Freedom Industries is still working to determine the amount of 4-methylcyclohexanemethanol, or Crude MCHM, a chemical used in processing coal, that has been released, as the first priority was safety, containment and cleanup.
Freedom Industries is in the process of setting up an Incident Command Center on site. As more factual information is made available, we will keep you updated."

NEW YORK (TheStreet) - It's been about a week since Liberty Media (LMCA) unveiled its $3.68 a share takeover offer for a remaining stake in SiriusXM Holdings (SIRI), in an all-stock transaction that would give the combined company a $27 billion market cap at week-ago share prices.
SiriusXM shares are currently trading at $3.80, indicating that investors expect Liberty Media eventually to bump its all-stock offer price. Liberty Media, meanwhile, is trading at about $140 a share, 3% lower than when the offer was first announced, making the all-stock transaction even less amenable to SiriusXM's minority shareholders.
There are many steps left in this deal, including a recommendation by SiriusXM's special committee, shareholder votes and, most importantly, added information on Liberty Media's grand plans as it seeks to consolidate the satellite radio giant's earnings and cash flow. It is also important to note that Liberty Media already owns a controlling stake in SiriusXM.
Nevertheless, Carl Icahn's activist efforts in the takeover of Dell show that minority shareholders still deserve representation and a fair M&A process by SiriusXM's special committee. Courts also appear amenable to valuing appraisal rights, a potential lingering piece of the Dell transaction and something that could emerge as an issue in Liberty Media's efforts for SiriusXM.

Though Liberty led by as many as nine points in the fourth quarter, the Blue Jays found themselves clinging to a two-point lead Friday with 10.1 seconds on the clock after a pair of baskets by North Kansas City senior guard Aries Washington.
Despite missing two free throws on the next possession, the Liberty girls hung on for a 50-48 home victory against North Kansas City and improved to 5-2.
We didnt hit free throws, but we hustled and got the rebound to keep it in our possession the last minute of the game, Libertys Morgan Fleming said. Weve gotten a lot better at closing games, not turning it over and relying on our passes.
The Blue Jays, who shot just 13 for 24 from the line during the game, went six for 11 in the fourth quarter, while the Hornets went nine for 12 to fuel their comeback.
Liberty coach Noah Simpson said he doesnt think his team would have been able to close out the game even just a few weeks ago.
They are super-athletic and super-aggressive and we knew it would be tough, Simpson said. I thought our kids made mistakes, but bounced back from them, which is different from the beginning of the year because we would have put out head down and made another mistake. We made one and it wasnt a big deal. Our resilience is getting better.
Going into the game, Simpson wanted to shut down Washington and the Blue Jays were successful until the final minute, holding her to seven points. Instead, Kianna Lane and Selena Salas led the Hornets with 13 points apiece. Maggie Brooks added 10.
We know that (Washington) is their best player and, to me, one of the top players in the city so our focus was there, Simpson said. We said that if the other kids beat us, they beat us. They came close and hit some big shots, but I think our game plan worked well.
Fleming led all scorers with 20 points, including seven in the fourth quarter to help seal the victory. Chiarra Franklin was the only other Blue Jay to break double-figures finishing with 11.
