Correction: UN-Iran-Human Rights

Posted: October 12, 2012 at 11:10 pm

UNITED NATIONS (AP) In a story sent Oct 11 about a U.N. report on Iran's human rights situation, The Associated Press misidentified the number of Iranian journalists in prison in December 2011, as tallied by the Committee to Protect Journalists. The correct number is 42, not 179.

A corrected version of the story is below:

UN report finds Iran's crackdown expanding

UN report calls for probe into post-election violence; finds Internet crackdown expanding

By PETER JAMES SPIELMANN

Associated Press

UNITED NATIONS (AP) The U.N.'s human rights expert on Iran is condemning the Islamic Republic's reliance on stoning as a form of capital punishment, citing that as just one of a number of "deeply troubling" Iranian rights violations, many of which are "systemic in nature," according to a report circulating among U.N. delegations.

Ahmed Shaheed, the Geneva-based U.N. Human Rights Council's special rapporteur on Iran, also called for an "extensive, impartial and independent investigation into the violence in the weeks and months that followed the presidential election of 2009," when pro-democracy protesters surged into the streets to denounce the election of President Mahmoud Ahmadinejad as bogus and rigged.

Shaheed also "reiterates his call for the immediate release of all political prisoners and prisoners of conscience," according the report, which The Associated Press obtained Thursday.

The document will be the basis for a General Assembly resolution critical of Iran's human rights violations, which will probably be voted on in December.

Members of alleged espionage ring seek temporary freedom

Posted: at 10:18 pm

Federal agents picked through garbage, spied on phone calls and captured reams of email as they went after a Houston businessman now accused of leading a scheme to ship sensitive U.S. technology to Russia's military.

The 11-person ring, allegedly led by Alexander Fishenko, is not accused of espionage, as classified documents were not given to Russia, but of breaking U.S. law by sending loads of protected microelectronics that can be used for guiding anti-ship missiles or radars as well as have civilian-world uses.

One of the most damning yet simplest bits of evidence made public so far came from the mouths of one of the company's managers while being interviewed over the phone by an employee working on a college paper and seeking to understand how Fishenko's company, ARC Electronics, got around strict export laws and avoided suspicion.

The answer: "We're lying."

In another conversation, the manager, Alexander Posobilov, is asked by an employee in Russia, who is among three fugitives in the case, what would happen if word gets out about what is going on: "We will be f-----."

Those words were among thousands recorded by the FBI. The conversations leave little doubt at least some of the persons charged likely knew they were doing something dubious.

Three people charged, including Fishenko, appealed Wednesday to U.S. Magistrate Judge George C. Hanks Jr. to free them on bond pending trial. All appeared in court wearing green prisoner uniforms and shackled at the waists and ankles as about two dozen family members and friends looked on.

The hearing is to continue Thursday.

The eight defendants who have been arrested are Slavic country immigrants, several from Russia, who now live in Houston. Most if not all have no known criminal records. Several are U.S. citizens with extended family here, although they have been issued passports by both countries.

No aid from consulate

Does Liberty Global Miss theGrade?

Margins matter. The more Liberty Global (Nasdaq: LBTY.A) keeps of each buck it earns in revenue, the more money it has to invest in growth, fund new strategic plans, or (gasp!) distribute to shareholders. Healthy margins often separate pretenders from the best stocks in the market. That's why we check up on margins at least once a quarter in this series. I'm looking for the absolute numbers, so I can compare them to current and potential competitors, and any trend that may tell me how strong Liberty Global's competitive position could be.

Here's the current margin snapshot for Liberty Global over the trailing 12 months: Gross margin is 64.6%, while operating margin is 19.7% and net margin is -0.9%.

Unfortunately, a look at the most recent numbers doesn't tell us much about where Liberty Global has been, or where it's going. A company with rising gross and operating margins often fuels its growth by increasing demand for its products. If it sells more units while keeping costs in check, its profitability increases. Conversely, a company with gross margins that inch downward over time is often losing out to competition, and possibly engaging in a race to the bottom on prices. If it can't make up for this problem by cutting costs -- and most companies can't -- then both the business and its shares face a decidedly bleak outlook.

Of course, over the short term, the kind of economic shocks we recently experienced can drastically affect a company's profitability. That's why I like to look at five fiscal years' worth of margins, along with the results for the trailing 12 months, the last fiscal year, and last fiscal quarter (LFQ). You can't always reach a hard conclusion about your company's health, but you can better understand what to expect, and what to watch.

Here's the margin picture for Liberty Global over the past few years.

Source: S&P Capital IQ. Dollar amounts in millions. FY = fiscal year. TTM = trailing 12 months.

Because of seasonality in some businesses, the numbers for the last period on the right -- the TTM figures -- aren't always comparable to the FY results preceding them. To compare quarterly margins to their prior-year levels, consult this chart.

Source: S&P Capital IQ. Dollar amounts in millions. FQ = fiscal quarter.

Here's how the stats break down:

With recent TTM operating margins exceeding historical averages, but net margins still negative, Liberty Global still has some work to do.

Liberty shows her new face

Crowning glory ... the Statue of Liberty reopens to public later this month.

Public access to New York's attractions is increasing, with the city's iconic statue leading the way, writes Lance Richardson.

For many travellers, myriad events during the past decade can be reduced to a single fact: the US is increasingly closed. This is clear every time a person goes through the gauntlet of airport security, X-rayed by spreading their arms and legs in a star-jump manoeuvre. It's clear at the White House in Washington, DC: officials suggest visitors contact the Australian embassy to arrange a tour; the Australian embassy informs visitors that tours are currently "on hold".

An increase in public access is therefore an event. In September, the Museum of Modern Art, New York, announced its intention to stay open seven days a week from next May. The Metropolitan Museum is said to be considering a similar move. Downtown and across the bay, an even more iconic monument is opening its doors wider as well: the statue on Liberty Island.

Liberty Enlightening the World was designed by French sculptor Frederic Bartholdi, with iron framework by Gustave Eiffel, and presented to the US as a gift from France.

Initial reception was mixed. Living through a depression at the time, the US was required to pay for the pedestal; The New York Times complained "no true patriot can countenance any such expenditures for bronze females in the present state of our finances".

The public made it work through donations, though, and on October 28, 1886, Liberty was dedicated during an elaborate ceremony.

Coated in copper and standing 93 metres tall, its features are widely celebrated: the golden torch, originally a functioning lighthouse; the tablet bearing the date of American independence (July 4, 1776); the broken shackles at the statue's feet. After a few years, the exterior began to oxidise, turning green and sending Congress into a panic. New Yorkers thought Liberty looked better this way. The statue symbolises openness.

"Give me your tired, your poor, your huddled masses yearning to breathe free," begins Emma Lazarus's famous poem, mounted on a plaque inside the pedestal. This is what made the closure, after the events of September 11, 2001, so significant. Because of safety concerns, visitor access was restricted to the island's exterior for eight years.

Pa Woman Tries to Sue Casey Anthony

Posted: at 10:17 pm

A West Chester, Pa. woman filed a $3 billion lawsuit in Florida claiming Casey Anthony is part of the Illuminati who is trying to kill her.

Naomi Riches filed the civil suit in Orlando on Tuesday. She accuses Anthony of working with HLN host Nancy Grace to fill the media with propaganda so that American Citizens believe there is justice in the country.

Riches also claims Anthony called her home in August 2011 and told her that her life was being exploited and that Riches was hated nationwide.

Riches says Anthony told her the government was going to find a way to tap into her water pipes and poison her water supply. In the lawsuit, Riches claims she spent more than $600 on bottled water.

Anthony was able to become a part of the Illuminati because she was able to lie her way out of prison for the death of her daughter, according to the lawsuit. It also claims she is a valuable asset to the Illuminated ones.

Anthony was acquitted of her daughter Kaylee's murder in July, 2011.

Riches asked for $3 billion in compensation for the emotional and psychological terror she says Anthony has inflicted on her life.

United States Magistrate Judge David Baker dismissed the lawsuit, in his ruling he said it was "without arguable merit."

Reddit, freedom of speech and the dark side of community

Posted: at 7:18 am

Unless you spend a lot of time on Reddit, the discussion-forum community that more or less took over after Digg sank beneath the waves, you may have missed the latest storm of controversy over content posted on the sites various sub-Reddits or topic pages. Although Reddit has played host to some fascinating journalistic features recently including the reporting of a mass shooting in Colorado and an open question-and-answer session with President Barack Obama it is also well known for its less savory elements, such as a page devoted to creepy (but likely not illegal) photos of women. The way that this modern morality tale has played out over the past few days says some interesting things about free speech and the darker side of the open community that Reddit has become.

As Alex Hearn at New Statesman describes it, the issue exploded into public view after the moderators of a Reddit page called r/politics said they were banning the posting of any links from Nick Dentons Gawker Media network. Why? Because Gawker writer Adrian Chen was reportedly planning to expose the real identity of a moderator running a page devoted to creepy pictures of women called r/creepshots (the same person was also a moderator on another sub-Reddit called r/incest, which was deleted by Reddit last year, as part of an attempt to crack down on offensive and/or illegal content).

The moderator in question who went by the name violentacrez appears to have deleted the sub-Reddit and all of its posts, and has also deleted his Reddit account completely (Jessica Roy at Betabeat also has a good roundup of the story). And moderators of other pages, including r/politics, decided to block links from Gawker as a way of showing their displeasure at the attempts to force violentacrez to reveal his true identity. The moderators of r/politics posted a statement saying:

We feel that this type of behavior is completely intolerable. We volunteer our time on Reddit to make it a better place for the users, and should not be harassed and threatened for that. We should all be afraid of the threat of having our personal information investigated and spread around the internet.

As more than one person has pointed out, these comments are filled with unintentional irony on a number of levels, including the fact that a site which champions free speech is banning links to a specific news outlet for something it hasnt even reported yet, and the outrage that it is complaining about is the act of revealing information about a person in public a person who moderates a page where people post revealing photos of women without their consent. Even some Reddit defenders seemed to be taken aback by the hypocrisy of the r/politics moderators in this case.

To complicate the picture even further, a Reddit critic set up a Tumblr blog called Predditors, which posted photos and biographical information about the users who were active on the r/creepshots page, including photos from their Facebook pages, as well as racist and offensive comments made by them, details about their families, and so on. Some Reddit users responded to this attack with further outrage, saying their privacy was being invaded even though (as Choire Sicha at The Awl pointed out) all of the information was already publicly available on the internet, and was just aggregated by the Tumblr blogs author.

The Predditors blog was removed by Tumblr, apparently because the site was afraid the photos were not legal, and then it was later reinstated, but it now it requires a password to access. The Jezebel blog (which is part of Gawker Media) spoke to the creator of Predditors, a 25-year-old woman who said she is a Reddit member but was outraged by the content on r/creepshots and decided to do something about it:

Reddits defense of [CreepShots] is that its technically legal. So Im doing something thats technically legal, but will result in consequences for their actions.

If youre an optimist about the power of online communities like Reddit and its cousin 4chan (which has been home to even worse content, if thats possible), you could see this as a kind of self-regulating process at work. Given the ability to post anything whatsoever, with little or no oversight from any site editors apart from periodic attempts to remove illegal content its natural to assume that every dark element of human nature will be represented. And in some cases, moderators will actually trample on the principle of free speech even as they allegedly are trying to protect it.

At the same time, however, Reddit does self-regulate and even the appearance of the Predditors blog could be seen as part of that process. The site has taken action in the past to crack down on offensive behavior, and its worth remembering that the Reddit community can also be a powerful force for good in the world, by calling attention to worthwhile causes like the fundraising for young Caine Monroy, or engaging in random acts of kindness such as arranging for strangers to send birthday wishes to a retired Army vet in a small town. Or random acts of journalism.

Liberty's Maffei: SiriusXM Takeover Could Take 18 Months

Posted: at 7:18 am

October 11, 2012

Speaking to investors yesterday, Liberty Media CEO Greg Maffei said the company's takeover of SiriusXM could take up to 18 months to complete. Multichannel News reports that Maffei said any future transactions with the satcaster would depend on Liberty's ability to monetize high cost shares, but that could take up to a year and half to fully complete.

Liberty Media currently controls approximately 49.6 percent to SiriusXM stock and has made its intentions clear that it wants complete control over the satcaster. Liberty is expected touse a Wall Street maneuver known asReverse Morris Trust to acquire, then spin, off SiriusXM.

"We would want to get our capital out before we do a Reverse Morris Trust," Maffei said on Wednesday, adding that it is not the only possible option for Liberty Media. "If it takes 18 months, that would be sort of a minimum."

Yesterday, SiriusXM reported net subscriber additions were 445,921 in thethirdquarter of2012. SiriusXM ended Q3 on September 30with a record 23,365,383 subscribers.Additionally, the company announced that it is raising its net subscriber additions guidance to 1.8 million for 2012 from its previous guidance of 1.6 million.
