Dupuy: Everybody believes in some gun control
Posted: May 27, 2012 at 3:11 am
If you ask the typical hyper-political gun owner (and I have ... at Thanksgiving dinner), why its important to own a gun, theyll bark about the Constitution. Yes, the Second Amendment: The Right of the People to Keep and Bear Arms Shall Not Be Infringed!
This, of course, is the slogan the National Rifle Association adopted in the 1970s. It was then that owning a gun became an absolute right endowed by God and the Constitution. A blessing passed down by our forefathers to obliterate game and protect our property. The NRA was founded in 1870, and for its first hundred years, it was for gun control and didnt mention the Second Amendment as its cause.
In his delicious book, Gun Fight, Adam Winkler points out that what we call the Wild West had some of the strictest gun control laws weve seen as a nation. The shootout at the OK Corral took place, after all, because Wyatt Earp was trying to disarm the outlaw cowboys in accordance with a Tombstone ordinance. The KKK was, among other things, a gun control organization. They were trying to keep guns out of the hands of newly freed slaves ... but still, gun control.
The part of the Second Amendment omitted from the NRAs slogan is: A well regulated Militia, being necessary to the security of a free State ... . Yes, well regulated its in the Constitution!
Now, to some, guns are as sacred as Scripture. If you ask, again, this typical hyper-political gun owner why they need to stockpile assault rifles, youll get an answer much like Pat Flynns response. Flynn, a recent candidate for a Senate seat in Nebraska, said in a debate before the primary, Really, we have our guns to protect ourselves against the government, number one. Huntings number two. But protecting us against our government is number one. Remember, Flynn was trying to land a job in the government. (He didnt win his partys nomination, by the way).
The idea is that we have to be just as armed as our government in order to be safer or have more liberty (or something). The U.S. government has unmanned drones armed with supersonic laser-guided anti-armor Hellfire missiles, bunker busters and nuclear weapons. Are far-right politicians saying we need civilians to have shoulder-fired anti-aircraft missiles for protection? Of course theyre not. They actually do want limits on ownership.
And if you ask the most vehement gun-rights advocate why gun owners shouldnt have nuclear weapons, Id bet youd get the same answer as to why we dont want every country to have the capability: Because they could get into the wrong hands.
So weapons-grade plutonium should be limited. But the ever-handy semi-auto Glock pistol with a 30-round high-capacity magazine is an absolute right?
A recent gun buyback drive in Los Angeles resulted in someone turning in a rocket launcher. Comforting.
So were not actually talking about limited versus unlimited. We are talking about degrees of weapon ownership.

Internet Protection Act Criticized For Violating Free Speech
Posted: at 3:11 am
BUFFALO, NY- Cyberbullies who hide behind their anonymity online are the targets of a newly proposed bill in New York State. Many victims of online bullying and their families fully support the bill, but critics say it violates the right to free speech.
Under the newly proposed Internet Protection Act, when anyone complains about an anonymous comment, the Web site administrator must make the commenter attach their "real name" to the post or the anonymous comment would by law have to be taken down. Not only that but the commenter will also be required to verify that his or her "IP address, legal name and home address are accurate."
Supporters of the bill say it will address the problem of baseless political attacks, criticism of businesses, and mean-spirited slams by cyberbullies.
The bill was introduced earlier this month in both the Senate and the House and is co-sponsored there by local Assembly members Jane Corwin (R- Clarence) and John Ceretto (R- Lewiston). If the bill were to become law, however, it likely wouldn't stand to constitutional muster.
"I would be one of the first to step up and challenge this," said local attorney Paul Cambia.
Cambria, who's also a past president of the National First Amendment Trial Lawyers Association, says government cannot silence speech the way they are proposing.
"The government can't restrict these carriers from carrying speech unless it falls into the very narrow exceptions to thefirst amendment, such as obscenity, fighting words, and the so called 'fire in the theater,'" Cambria said.
Tim and Tracy Rodemeyer fully support the proposed law, and no one may know the dangers of cyberbullying better than them.
Their 14-year-old son Jamey took his own life last September in part because of the hurt he endured by nameless posts online. They say they wish the proposed bill would have been a law when Jamey was alive.
"It may have made a difference because then if there are people who are bold enough to do that you can go after them," said Tim Rodemeyer.

Faith Leaders Outline Religious Freedom Threats
Posted: May 26, 2012 at 7:17 am
Leaders from a variety of faith backgrounds, politicians and educators met Thursday in Washington, D.C., for the National Religious Freedom Conference: Rising Threats to Religious Freedom, an event that organizers say is part of a battle against the trampling of religious liberties in the public sphere.
"This debate is not just about contraceptives, but about coercion. It's not about Catholics it's about conscience," Richard Land, president of the Ethics & Religious Liberty Commission of the Southern Baptist Convention said during one of the panel discussions. He went on to say, "it's about principle, not pelvic politics."
Former Utah Gov. Michael Levitt, also a former Health and Human Services secretary, said of the conference, "This is the uniting of the faith community to declare that we're going to fight back to defend religious freedom."
The conference outlined three major threats to religious freedom: The first is the government mandate that religious institutions, such as hospitals and universities, act contrary to their conscience by offering birth control coverage to their employees. The second is what religious leaders say is a threat to the autonomy of religious organizations to choose their own leaders.
The third issue, a key one, is religious principles in in everyday life, like pharmacists who object for moral reasons to carrying what believers equate to abortion-causing drugsor religious student groups being marginalized on school campuses. One example of the latter is the fight at Vanderbilt University over its non-discrimination policy, requiring student religious groups be open to anyone, even those who don't hold to their beliefs.
Conference participants see a prejudice that affects all religions.
"We need to find a way to bridge not only the faith divide but also the political divide to try to find a way where everybody can enjoy religious liberty," Nathan Diament, director of public policy for the Union of Orthodox Jewish Congregations, said. "It doesn't have to be a zero sum game. Some people's rights do not have to come at the expense of other peoples rights. We can find a way to make it a win-win situation for everybody."
The conference comes in the wake of a federal lawsuit filed by more than 40 Catholic institutions over the health care law that mandates the church offer institutional employees contraceptive coverage and other benefits that go against Catholic teaching. Churches already are exempt from the mandate.
Cardinal Timothy Dolan said the church is pushing forward, looking at all options.
"We are not going to give up dialogue with them. Who knows, maybe the lawsuits will make some progress, but so far we haven't seen any mitigation. Mitigation that the administration offered us back in February didn't help us much, because we are self-insured and it didn't touch those straight-jacketing exemptions."

Liberty-Madera strikes quickly to win D-V softball title
Posted: at 7:17 am
MADERA -- Nothing was going to stop the Liberty-Madera Ranchos High softball team from a fourth consecutive Central Section Division V title.
After thunder cracked ominously in the distance during the national anthem, the Hawks' bats did some thundering of their own in a six-run first inning en route to a 10-0 win Friday over Selma (19-7).
Freshman Renee Ortega delivered the big blow with a bases-clearing double to right-center that put second-seeded Liberty (23-6-1) up 3-0 after four batters.
That relaxed the team and set the tone for the game.
"We've got some girls that had played in games like these, but we've got some that never played in one before so they were flat nervous," Liberty co-head coach Bob Barber said.
Ortega said patience played a role.
"I was waiting to see the right pitch to hit hard on the ground or a hard line drive," she said, "and I got it."
Randi Wallace and Caity McShane added run-scoring singles and the rout was on.
Junior ace Hannah Shevenell threw a two-hitter with 11 strikeouts.
Shevenell struck out the side in the first and fifth innings, and she did not give up a hit until Emery Green hit a bloop single down the left-field line in the fourth.

Liberty rallies for three runs in the seventh inning to win Maryland 2A softball title
Posted: at 7:17 am
Nobody called Sammy Bost out after she stole third and overslid the base, so the Liberty center fielder just kept running.
Suddenly, Bost found herself sliding across home plate without a throw, scoring the winning run that capped a shocking ending to the Maryland 2A championship softball game, and left McDonough feeling it was robbed of a chance at a state title.
I saw [a tag at third base], McDonough Coach Julie Snavely said. I told my girls [the umpire] missed the call, but youve got to move on. Its unfortunate that play ended the ballgame.
Bost stole two bases on the final play of the game, and the Lions scored three runs with nobody out in the bottom of the seventh inning to beat McDonough, 3-2, Friday night at Robert E. Taylor Stadium at the University of Maryland.
The win gives Liberty the first state title in school history; McDonough was denied what would have been its sixth state crown and second in four years.
I overslid the base and I was like Oh my god, Im not letting my team down right now, Bost said. I just got up and ... I was like Okay, Ill go home then.
The wild ending overshadowed a terrific performance by McDonough senior Jazzmyn Hayden, who took a two-hit shutout into the seventh inning and produced the Rams only runs with an RBI double in the first inning and a solo home run in the third.
The Lions opened the bottom of the seventh with two bunt singles and a walk before second baseman Rebecca Oneto hit a two-run single that tied the score and left runners on first and second with nobody out.
Catcher Natalie Gill missed a bunt attempt as Bost and Oneto attempted a double steal, and after the throw to third came in late, Bost slid past the base and appeared to be tagged out by McDonough third baseman Molly Simpson.
I didnt feel a tag, Bost said. I wasnt going to go back into a tag so I figured Id either get in a rundown or go to score.

IMF Warning on Oil Prices Shows Urgent Need for Alternative Fuel Sources, Fuel Freedom Foundation Says
Posted: May 25, 2012 at 5:16 pm
IRVINE, Calif.--(BUSINESS WIRE)--
The Fuel Freedom Foundation says that a new warning from the International Monetary Fund underscores the urgency of opening markets to competition from alternative fuels such as natural gas, ethanol, methanol and electricity. The IMF Working Paper, entitled The Future of Oil: Geology versus Technology, predicts that oil prices could permanently double in the next decade.
The IMF report warns that a doubling in oil prices will send the global economy into uncharted territory, which would spell disaster, said Joseph A. Cannon, President of the Fuel Freedom Foundation. Fortunately, disaster can be averted if we open our markets to competition from cheaper, cleaner, American-made alternative fuels to gasoline. This is the only way to bring down oil prices significantly and structurally, and ensure future economic growth.
The paper combines two opposing positions in the debate to arrive at a more accurate model for predicting oil prices. On the one hand, the peak oil argument holds that the consumption of finite resources will push prices ever higher. On the other, the technological argument says that higher prices will spur new methods for extracting oil, as well as substitutions for petroleum products. These advances, in turn, will lead to greater output and eventually lower prices.
The authorswho emphasized that their findings do not necessarily reflect IMF policyfound the peak oil argument too pessimistic. However, they concluded that geological constraints on production, plus demand shocks such as rapid growth in China and India, best explain the trend in oil prices. At the same time, the researchers found limits to the impact of technological advances in the long run. The result is a near doubling in oil prices, and a pain barrier beyond which there is lasting damage to economic growth.
About The Fuel Freedom Foundation
The Fuel Freedom Foundation is a nonpartisan, nonprofit organization based in Irvine, California, which is dedicated to breaking the U.S. economys oil addiction by removing barriers to competition to promote the development of cheaper, cleaner, American-made fuels. Fuel Freedom means that gasoline, diesel, methanol, natural gas, ethanol and electricity compete on equal footing both at the dealership and at the pump. Achieving Fuel Freedom will lower fuel prices, create jobs, spur economic growth, reduce pollution, and improve national and global security. Want Freedom from Vendor Lock-in? Survey Says: Choose Open Source
Posted: at 5:16 pm
It's no secret that open source software is playing an increasingly prominent role in businesses around the globe, but a recent survey has uncovered a few surprising findings about adopters' motivations for choosing it.
Specifically, freedom from vendor lock-in is now users' top reason for choosing open source software, according to the 451 Group.
While we had seen vendor lock-in fade as a factor and cost as paramount two or three years ago, today vendor lock-in has become much more of a factor for customers, explains 451 Group analyst Jay Lyman in a Tuesday blog post announcing the results.
We believe this has to do with cloud computing and customers desire to maintain flexibility as they figure out how to best leverage cloud resources, Lyman added.
451 Group participated on the Future of Open Source Survey 2012 with North Bridge Venture Partners and Black Duck Software, garnering 740 responses from a variety of vendors and non-vendors in the industry.
Among the key results of that study was the finding that more than 50 percent of software acquired in the next five years will be open source software. Last year, in fact, was already a record year for open source investment, which increased by 49 percent to $675 million, the study found.
Survey respondents also said that open source is leading rather than following the pack when it comes to the cloud, big data, mobile apps, and enterprise mobility, in particular.
Perhaps most interesting of all, though, is that, when asked what are the top factors that make open source software attractive, a full 60 percent of respondents identified freedom from vendor lock-in as the top motivating factor.
Lower acquisition and maintenance costs (51 percent), better quality (43 percent), and access to source code (42 percent) were also among the top motivators mentioned.
The survey also showed that cost, which we also equate to time and efficiency, is always a strong factor, with 62 percent of respondents identifying reduced cost of development and maintenance as the main reason they use open source or initiate projects, Lyman added.

The effort for Memorial Day 2012 -- called "Freedom Is Not Free" -- gained immediate attention and support across the country.
"On Memorial Day, families across the country will remember loved ones and relatives who made the ultimate sacrifice to defend our freedoms. Sharing in that remembrance will be many, many young Americans who honor and deeply respect those from their own generation and previous generations who gave everything for Americans to remain free. We are grateful to those who have taken the time to join our efforts to reaffirm the significance of this day through our 'Freedom Is Not Free' scroll, and we encourage every American, in any way they can, to remember the true meaning of Memorial Day," said Paul T. Conway, president of Generation Opportunity and a former Chief of Staff to Major General Douglas O'Dell, USMC (Ret.) at the United States Department of Homeland Security.
Earlier this year, Generation Opportunity successfully conducted an online initiative entitled "Valentines for Vets" that provided all Americans an opportunity to send a note of appreciation and encouragement to veterans receiving care and or treatment at veterans hospitals and Armed Forces retirement homes across the country.
