‘Liberty Walk’ to showcase Charlotte’s Revolutionary past

Posted: at 5:12 am

Its not Bostons Freedom Trail, but its a start for Charlotte and its proud Revolutionary War history.

After all, it was here that the flames of revolution were fanned by the 560-mile ride of Capt. James Jack. He was Charlottes most recognizable Revolutionary War figure who, in the summer of 1775, rode horseback to deliver seditious papers to the Continental Congress in Philadelphia.

Many believe those papers signed by Charlotte leaders on May 20, 1775 declared Mecklenburg Countys liberty from England rule, a year before the newly declared country severed ties to the crown.

Five years later, in September 1780, a local militia 150 strong fought at Trade and Tryon streets to hold back 4,000 British troops in what became known as the Battle of Charlotte.

Now workers are finishing Charlottes new Liberty Walk, placing 104 red granite pavers with a likeness of Capt. Jack and his horse along a three-quarter-mile urban path. The pavers are 20 to 30 feet apart, starting at South Tryon Street and The Square. The walk loops onto West Trade Street and then North Church Street, before turning right onto West Fifth Street. After crossing North Tryon, it takes another right onto North College Street and then another onto East Trade back to The Square.

In all, there are 15 sites, 12 of which have been there for years in the form of plaques and markers that have largely gone unnoticed and unconnected.

Charlotte has all these Revolutionary War sites, but no one notices them, said Scott Syfert, a Charlotte lawyer who is vice chair of the May 20th Society, the group that promotes Charlottes role in the revolution. Were just trying to refocus attention to these sites by linking them together and bringing in a graphic arts component.

Many sites long gone

The society is spearheading the Liberty Walk with the Arts & Science Council, the Charlotte Regional Visitors Authority, Charlotte Center City Partners and Central Piedmont Community College. The society and CPCC also were responsible for the bronzed statue of Capt. Jack galloping on his horse, unveiled at Kings Drive and 4th Street near the college two years ago.

Since most of Charlottes sites are long gone, the society hired historical artist Dan Nance to paint depictions of the sites and tell their stories using bar codes that allow walkers to watch video clips on mobile phones or tablets.

In firearms-friendly state, gun lobby finds limit in advocating Second Amendment rights

Posted: at 5:11 am

By Steven Hale

Lt. Gov. Ron Ramsey (File)

The final reference on the floor of the state legislature to one of the most contentious issues of the session was met with bipartisan support.

Less than an hour before the General Assembly adjourned for the year, Rep. Eddie Bass (D-Prospect) rose and faked a motion to call up the so-called guns-in-parking-lots legislation.

He had sponsored two related bills on the matter. One prohibited businesses from banning the storage of firearms by employees in their cars parked on company lots. The other established protections against workplace discrimination for employees based on their ownership, storage or transportation of a firearm. Until the legislatures final day, the fate of both bills was not completely certain.

Madam Speaker, he deadpanned, with a sheet of paper in his hand. I move to suspend the necessary rules for the immediate consideration ... oh, wait a minute, thats the wrong one.

The members burst into laughter and applauded.

There was likely relief in the laughter, at least for the leadership of both parties. The states top Republicans had exerted plenty of energy in an ultimately successful effort to keep the issue from getting to the floor of either chamber. Knowing that, and hoping to foster Republican infighting, leading Democrats had tried to force a floor vote on legislation they had no intention of supporting.

For the states gun lobby, however, which spent the session aggressively working the issue, things did not end on a cheerful note. They left the Hill feeling stiffed.

An absurd attack on free speech

Posted: at 5:10 am

Controversies can be wonderfully clarified when people follow the logic of illogical premises to perverse conclusions.

For example, Rep. Jim McGovern (D-Mass.), joined by Minority Leader Nancy Pelosi, 26 other Democrats and one Republican, proposes a constitutional amendment to radically contract First Amendment protections.

His purpose is to vastly expand governments power i.e., the power of incumbent legislators to write laws regulating, rationing or even proscribing speech in elections for the Legislature and the rest of the government. McGoverns proposal vindicates those who say most campaign-finance reforms are incompatible with the First Amendment.

Ron Sachs - CNP

Jim McGovern

His Peoples Rights Amendment declares that the Constitution protects only the rights of natural persons, not such persons organized in corporations, and that Congress can impose on corporations whatever restrictions Congress deems reasonable. His amendment says it shall not be construed to limit the peoples rights of freedom of speech, freedom of the press, free exercise of religion, freedom of association and all such other rights of the people, which rights are inalienable. But the amendment is designed to deny such rights to natural persons who, exercising their First Amendment right to freedom of association, come together in corporate entities to speak in concert.

McGovern stresses that his amendment decrees that all corporate entities for-profit and nonprofit alike have no constitutional rights. So Congress and state legislatures and local governments could regulate to the point of proscription political speech, or any other speech, by the Sierra Club, the National Rifle Association, NARAL Pro-Choice America, or any of the other tens of thousands of nonprofit advocacy groups, including political parties and campaign committees.

Newspapers, magazines, broadcasters, online journalism and most religious institutions are corporate entities. McGoverns amendment would strip them of all constitutional rights. By doing so, the amendment would empower the government to do much more than proscribe speech.

Ilya Somin, of George Mason University Law School, writing for the Volokh Conspiracy blog, notes that government, unleashed by McGoverns amendment, could regulate religious practices at most houses of worship, conduct whatever searches it wants, reasonable or not, of corporate entities, and seize corporate property for whatever it deems public uses without paying compensation. Yes, McGoverns scythe would mow down the Fourth and Fifth Amendments, as well as the First.

The proposed amendment is intended to reverse the Supreme Courts Citizens United decision, which affirmed the right of persons to associate in corporate entities for the purpose of unrestricted collective speech independent of candidates campaigns. The decision was foreshadowed when, in oral argument, the governments lawyer insisted the government could ban a 500-page book that contained one sentence that said vote for a particular candidate.

Mikati vows to protect free speech

Posted: at 5:10 am

BEIRUT: Former Prime Minister Najib Mikati vowed Sunday to protect free speech on the occasion of Lebanon's Martyrs Press Day and saluted journalists who died in the line of duty.

I, stemming from my belief in free speech, promise the Lebanese press and the rest of media outlets to preserve press freedom, Mikati said in a statement.

He also expressed his readiness to cooperate with the press and media institutions to develop laws that regulate their affairs and preserve free speech.

The press has embodied and still embodies the pillar of free speech in Lebanon and the essence of democracy that characterizes it, Mikati said.

Lebanese Forces leader Samir Geagea also saluted the efforts of slain journalists.

In a statement, he also vowed to continue the struggle toward a civilized and free society.

I raise my right hand to greet them and pray for them and vow in their name to always fight for the sake of a civilized life and the principles of the free, Geagea said.

The most recent victim of violence that targeted a journalist in the country was the killing of Ali Shaaban, the Al-Jadeed cameraman who was shot at the Lebanon-Syria border in April.

Shaaban, 30, was killed when the car he was traveling in was hit by a volley of machine gunfire in the northern area of Wadi Khaled near the border with Syria.

Al-Jadeed blamed the Syrian Army for Shaabans killing.

An assault on free speech

Posted: at 5:10 am

The First Amendment leads off the Bill of Rights for a reason: It is the foundation of all our freedoms. The First Amendment can be exploited by the rich and powerful, but it also provides the means to challenge authority and fight the worst abuses in our society. More than two centuries of experience have abundantly demonstrated the value of unfettered speech.

Which is why it should not be tampered with certainly not as recklessly as "The People's Rights Amendment" would.

Pushed by House Democratic leader Nancy Pelosi of California and others, the People's Rights Amendment would deny speech and other constitutional rights to groups of people, limiting such rights to "natural persons" individuals, who have far less power to challenge politicians.

"Nothing contained herein shall be construed to limit the people's rights of freedom of speech, freedom of the press, free exercise of religion and such other rights of the people," their amendment to blunt the First Amendment soothingly reassures us.

That may be deceptive, because the amendment takes away the free-speech rights of corporations. Virtually all significant newspapers, magazines and broadcasting outlets in America are organized under a corporate structure, because mass communications tend to require more funding than any one individual has. If individuals "the people" are the only ones who have constitutional rights, how can we possibly safeguard our free press?

Churches, nonprofits and other groups might also be denied free-speech rights.

Rep. Jim McGovern, D-Mass., chief sponsor of the amendment, says this:

"My 'People's Rights Amendment' is simple and straightforward. It would make clear that all corporate entities for-profit and nonprofit alike are not people with constitutional rights. It treats all corporations, including incorporated unions and nonprofits, in the same way: as artificial creatures of the state that we the people govern, not the other way around."

But our Founders had a profoundly different philosophy. They did not think that government essentially controls Americans, but that Americans control government, through elections, a free press, constitutional limits on power and a Supreme Court charged with defending those limits.

I think that McGovern, Pelosi and their allies, in pushing this shockingly bad idea, are seeking to blunt what they see as the pernicious effects of the Supreme Court's Citizens United ruling. It protected the rights of corporations and other entities under the First Amendment to engage in political speech, including during election season.

World Press Freedom Day 2012 – Asia and the Pacific

Posted: May 3, 2012 at 8:13 pm

Posted by Marlon Magtira - Thu. May 03, 2012 3:50 pm

World Press Freedom Day came about twenty years ago in response to a vision of a group of journalists that gathered together at Windhoek, in Namibia.

The Windhoek Declaration was a call to arms to protect the fundamental principles of the freedom of expression that is enshrined in Article 19 of the Universal Declaration of Human Rights.

On May 3 each year, World Press Freedom Day (WPFD) is an opportunity to commemorate the fundamental principles of press freedom, to celebrate the press and to honour journalists who have demonstrated courage in standing up for media ethics and free expression around the world.

The theme for WPFD 2012 is New Voices: Media Freedom Helping to Transform Societies.

Throughout the region, IFJ affiliates are undertaking a number of activities during the week of May 3.

Australia The Media, Entertainment & Arts Alliance and its professional development arm, the Walkley Foundation, will host the 2012 Press Freedom Media Dinner in Sydney on Friday, May 4.

The dinner is the media industrys major fundraising event and recognises that free speech and a free and unfettered press that serves the public good, are the most important guarantors of democracy.

Each year, media and business unite to recognise the importance of press freedom and support the many journalists and media workers under pressure in the Asia-Pacific region.
