Europe’s Mess Continues to Bear Down on the Market
Posted: at 7:16 am
By Paul Vigna
So much for that bounce.
Were still scratching our heads over that bounce in the wee hours of Monday morning, the one that saw the euro hold the line at $1.30, and stocks recover enough to push the S&P 500 and Nasdaq Composite every so slightly into the green yesterday.
For whatever reason, and it appears theres a number of them, the euro is managing to hold that $1.30 mark (under much duress; this mornings low is $1.2990.) Stock futures, too, were down sharply, winnowed away the losses and are dropping again.
Theres support in the market, whether its coming from the Fed, the Chinese, the banks, the Arabs, the Plunge Protection Team or the Illuminati. There are buyers at these levels.
How long they remain, and how much they buy, is the question now. Europe is very unsettled. Greece is having trouble forming a government, the uneasy Hollande-Merkel courtship has already begun, Spain is talking about bailing out its banks. Underlying it all is talk of bailouts, exits, and alliances splintering apart.
The bears are going to push this issue.Indeed, theyve been pushing with ever greater force for a month now. This is the way the market works. Downward pressure is exerted, support levels are hit, they hold, pressures applied again, supports hit. Themaneuveris repeated until somebody wins.
Dennis Gartman had this to say this morning in his daily The Gartman Letter:
As we have said countless times in the past regarding any and all of the markets we cover in TGL, confusion breed contempt. Markets can accept almost any sort of reality, malign or benign as it may. They can even rally if the previous malign status is either finalized and/or is moderated; but they abhor confusion and at the moment things in Greece are more confused than they were even in the run-up to the election.
Gartman made the point that moneys flowing out of the euro and into the Canada dollar, a safer haven. We add to keep an eye on the U.S. 10-year Treasury, which was yielding 1.85% this morning.

N. Carolina Lets Emergency Powers Ruling Stand, Adding Another SAF 2A Victory
Posted: at 7:15 am
BELLEVUE, Wash., May 8, 2012 /PRNewswire-USNewswire/ --North Carolina's failure to appeal a federal judge's ruling that struck down the state's emergency power to ban firearms and ammunition outside the home during a declared emergency adds one more Second Amendment victory to the court record being established by the Second Amendment Foundation.
"When the anti-gun lobby claims that courts have not struck down any laws on Second Amendment grounds," noted SAF founder and Executive Vice President Alan Gottlieb, "they deliberately ignore the fact that the District of Columbia's handgun ban was overturned. Likewise, Chicago's ban was stricken by McDonald v. City of Chicago, as was the city's ban on gun ranges. Maryland's draconian regulations on concealed carry were struck down, and so was the Massachusetts ban on firearms ownership by legal alien residents. Part of Omaha's registration law was overturned, and now North Carolina's emergency powers gun ban has fallen.
"All but one of those cases," he added, "were filed by SAF, and in the Heller case against Washington, D.C.s ban, SAF filed an important amicus brief."
Gottlieb said North Carolina's decision not to appeal their loss, "frees the foundation to file more legal actions against cities and states that still have laws on the books that violate our constitutional rights." There are now at least six federal court victories to SAF's credit, knocking down laws that infringed on Second Amendment rights, and Gottlieb is confident more are coming.
"The North Carolina case should send a message to other states and municipalities with similar emergency powers laws that violate civil rights that they should remove those restrictions immediately," he stated.
"I want to thank our plaintiffs, our legal team, our staff and in particular, our members and donors who have made all of these victories possible," Gottlieb said. "Three of these victories, including Bateman v. Purdue in North Carolina, affirm that the Second Amendment doesn't stop at your front door, like the gun prohibition lobby claims.
"Winning firearms freedom one lawsuit at a time is a long, slow and expensive process, but SAF is committed to it," he concluded.
The Second Amendment Foundation (www.saf.org) is the nation's oldest and largest tax-exempt education, research, publishing and legal action group focusing on the Constitutional right and heritage to privately own and possess firearms. Founded in 1974, The Foundation has grown to more than 650,000 members and supporters and conducts many programs designed to better inform the public about the consequences of gun control.

Twitter: We’re still the free-speech wing of the free-speech party
Posted: at 7:14 am
As various levels of government both in the U.S. and around the world have stepped up their attempts to track down dissidents through social networks, the pressure has intensified on companies like Twitter and Facebook to comply with these demands even at the expense of their users privacy. Despite that pressure, Twitter at least seems determined to fight these incursions wherever possible. As a case in point, the company has filed a motion in New York state court to quash a court order compelling it to hand over information about a user involved in the Occupy Wall Street protests, arguing that the order violates that individuals rights.
The case in question involves a protester by the name of Malcolm Harris, whose Twitter handle was @destructuremal, and who was involved in a protest against Wall Street financial mismanagement in October of 2011 that saw more than 700 people arrested for a variety of charges, including destruction of public property and resisting arrest. Earlier this year, the New York district attorneys office sent Twitter a subpoena for information relating to Harris use of the network during the protest including personal details about him, and also specific messages that he sent.
As my PaidContent colleague Jeff John Roberts reported last month, Harris attempt to have this court order struck down failed for a somewhat unusual reason: namely, the judge hearing the case decided that Harris did not have any legal interest in the tweets he sent, because such rights only apply to things a user actually owns and users do not own their tweets for the purposes of the U.S. Constitution. According to the judge:
While the Fourth Amendment provides protection for our physical homes, we do not have a physical home on the Internet some of our most private information is sent to third parties and held far away on remote network servers.
Now Twitter has stepped in to try and force the court to quash the order, as reported first by the American Civil Liberties Union blog. According to Twitters motion (embedded below) the judges decision that Harris doesnt own his tweets contradicts both Twitters terms of use which specifically state that a users retain [their] rights to any Content [they] submit, post or display on or through the service as well as the federal Stored Communications Act, which the Twitter motion says expressly permits users to challenge demands for their account records.
Twitter seems to be stepping up its opposition to these kinds of cases: in an earlier case related to the Boston version of the Occupy protests, Twitter handed over a users data to Boston police after they submitted a court order alleging that the user in question who went by the names @@pOisAnON and Guido Fawkes was involved in a hacking attempt on the police department. But the company said that it only handed over the minimum amount of information required by the police investigation.
And while the company ultimately gave this user data to the Boston police, it defied a request not to make the police departments court order public, something it has also done in the past in more serious cases, such as the Justice Departments attempts to get details about the Twitter activity of WikiLeaks supporters such as Jacob Appelbaum and Icelandic MP Birgitta Jonsdottir. In that case, Twitter fought for the right to tell users that authorities were seeking the information unlike a number of other companies who likely also got similar requests although the company was eventually ordered to provide the data.
As it has evolved from being just a social toy into a real-time information network used by Arab Spring dissidents in countries such as Egypt and Tunisia, Twitter has repeatedly affirmed its commitment to free speech by its users both in blog posts about how the tweets must flow despite attempts by governments to stop them, and in comments by CEO Dick Costolo and general counsel Alex Macgillivray that the company is the free-speech wing of the free-speech party.
That commitment was questioned by some when the company announced late last year that it had developed the capacity to selectively censor content from the network within specific countries, but Twitter stressed that it would only do this if required by law, and that it would publicize these requests at the Chilling Effects website. The latest moves in the Harris case suggest that Twitter plans to continue fighting for the rights of its users, and also that it intends to make these battles as public as possible. And Harris, who now tweets under the name @BigMeanInternet, seems pretty thankful.

Freedom to be silent
Posted: May 8, 2012 at 5:12 am
Contrary to everybodys hopes to see the fruits of reform within the National Police, last Fridays dispersal of a discussion at Salihara Cultural Centre in South Jakarta suggests that the police have instead turned back the clock to the authoritarianism of the New Order.
Rather than taking action against vigilantes who intimidated those attending the free-speech forum, the police scrambled for legitimacy to force an end to the event, which they alleged lacked a permit to feature a foreign speaker.
The police were cracking down on Canadian activist Irshad Manji, whose latest book, "Allah, Liberty and Love", was the highlight of the day.
That the police considered the discussion illegal due to the absence of their prior approval amounts to an infringement of the Constitution, which protects individual freedom of speech. Nowhere in the countrys existing laws can we find a state institution or individual that has been granted the authority to silence others merely because of dissenting views.
The Reform movement, whose anniversary we will celebrate later this month, has given birth to a series of laws that confirm the nations commitment to individual freedom, including the freedom of speech and expression. Enforcement of those laws has been a different story, however.
The polices contempt of freedom of speech on Friday came just after members of the hard-line Muslim group the Islam Defenders Front (FPI), picketed outside Salihara Cultural Centre in a show of protest against reform-minded Manji, citing her liberal views, including the conformity between Islam and homosexuality, which they feared could undermine Islam.
In her book, Manji calls for separation between Islam and culture and a reinterpretation of Islam itself progressive thoughts that conservative groups such as the FPI apparently cannot tolerate.
It goes without saying that the Salihara incident sends the wrong message that the police would listen to the cause of a group that has no hesitation to resort to violence in the name of God, no less to settle differences, more than they do to people who fall prey to acts of thuggery and are therefore are in need of protection.
This has long raised suspicion of a link between the police and the group, which critics say is no different from thugs who seek income from protection rackets. Police have frequently denied allegations that the force was behind the rise of radicalism that ironically supported the flourishing democratisation in the country.
The police might argue they stepped out to prevent the FPI members from going on a rampage, but, as often happened in the past, the failure to act against radicals will further encourage them to repeat the same display of brutality. Not to mention the lenient punishment handed down on members of the hard-line groups even for violence that resulted in deaths.

Freedom from debt is possible – with a plan
Posted: at 5:12 am
Constructing a debt repayment plan is the single strongest step to take to achieve freedom from debt, according to Hamm.
In my opinion, if youre in a financial hole, constructing a debt repayment plan is the single strongest step you can take. It creates a clear picture of your debt situation, tells you the most efficient way of paying them off, offers you clear steps on what to do next, and can also be a useful tool when looking for additional help.
The Simple Dollar is a blog for those of us who need both cents and sense: people fighting debt and bad spending habits while building a financially secure future and still affording a latte or two. Our busy lives are crazy enough without having to compare five hundred mutual funds we just want simple ways to manage our finances and save a little money.
Constructing Your Plan Its pretty easy to put such a plan together. Put aside an hour and follow these steps.
First, collect all of your debt information in one place. Youre going to want your current balances, your interest rates, and your minimum monthly payments for each of these debts.
Then, simply make a list of those debts, ordering them by interest rate. Make four columns debt name, balance, interest rate, and minimum payment. Put the debt with the highest interest rate at the top of the list and add others below that in order of interest rate, with the higher ones near the top.
Once you have that, total up your minimum payments. Add them up to see how much youre putting toward your debts each month.
Then, add some amount to that total minimum payment. It needs to be an amount you can consistently afford. Maybe its only $25 a month. Maybe its $500. Were all in different situations with different financial requirements.
That new amount, the total minimum payment plus the additional amount, is going to be how much you put toward debt each month until these debts are all gone.
Using Your Plan
