WICHITA, Kan. The focus of a federal investigation in Wichita is unknown, but a Wichita attorney says one of the names that has surfaced is involved in high-level gambling. <\/p>\n
Tuesday, prominent Wichita businessman Brandon Steven confirmed to the Wichita Eagle that he is the target of an FBI investigation. <\/p>\n
Steven told the newspaper he believes federal investigators are looking into his poker playing and his involvement trying to build a casino in southeast Kansas. <\/p>\n
The investigation has raised questions about what's considered gambling in Kansas, like Poker and why it's illegal in our state. <\/p>\n
Kansas law is clear on this, and yes, most Poker games played for money or a prize are illegal. In Kansas, it doesn't matter if you're playing for a few dollars or a few thousand dollars. <\/p>\n
There are three elements that constitute gambling. <\/p>\n
First is consideration. That's the money you put in. The state says that includes money to play the game, money to get a seat at the table, even cover charge money to get into the event. <\/p>\n
Second is the prize. This can include money, tickets, or even a trip. <\/p>\n
The final element is chance. This part of the equation has been argued, even in court in the state about whether Poker is more a game of chance or skill. So far, the court says it's mostly chance. <\/p>\n
If you have the three elements, the state says it is gambling and it is illegal. Remove any one of the elements and your game is legal in Kansas. <\/p>\n
