{"id":1063503,"date":"2013-07-03T16:10:00","date_gmt":"2013-07-03T20:10:00","guid":{"rendered":"http:\/\/www.immortalitymedicine.tv\/stem-cell-therapy\/challenge-to-warf-hesc-patents-cites-recent-u-s-supreme-court-decision.php"},"modified":"2024-08-17T20:30:00","modified_gmt":"2024-08-18T00:30:00","slug":"challenge-to-warf-hesc-patents-cites-recent-u-s-supreme-court-decision","status":"publish","type":"post","link":"https:\/\/www.euvolution.com\/futurist-transhuman-news-blog\/stem-cell-therapy\/challenge-to-warf-hesc-patents-cites-recent-u-s-supreme-court-decision.php","title":{"rendered":"Challenge to WARF hESC Patents Cites Recent U.S. Supreme Court Decision"},"content":{"rendered":"<div>Patents on human embryonic stem cells<br>are being challenged in a new legal filing that cites the recent <b>U.S.<br>Supreme Court<\/b> decision that barred the patenting of human genes.<\/div><div><\/div><div>The stem cell case involves the<br><b>Wisconsin Alumni Research Foundation (WARF)<\/b>, which holds the patents on the<br>much-heralded work performed by <b>Jamie Thomson &nbsp;<\/b>at the <b>University of Wisconsin<\/b>.&nbsp;The lawsuit was filed<br>by the <b>Public Patent Foundation <\/b>of New York City on behalf of<br><b>Consumer Watchdog<\/b>, a nonprofit group in Santa Monica, Ca.  <b>Jeanne<br>Loring<\/b>, director of the <b>Center for Regenerative Medicine<\/b> at the<br><b>Scripps Research Institute<\/b>, is also involved along with <b>Alan<br>Trounson<\/b>, president of the California stem cell agency. The agency<br>itself is not a party.<\/div><div><\/div><div>This week's filing follows the<br>so-called <b>Myriad<\/b> decision last month by the nation's highest court&nbsp;<a href=\"http:\/\/www.nytimes.com\/2013\/06\/14\/us\/supreme-court-rules-human-genes-may-not-be-patented.html?_r=0\" target=\"_blank\" rel=\"noopener\">which said, <\/a><\/div><blockquote><p>&ldquo;Myriad did not create anything. To<br>be sure, it found an important and useful gene, but separating that<br>gene from its surrounding genetic material is not an act of<br>invention.&rdquo;<\/p><\/blockquote><div><a href=\"http:\/\/www.consumerwatchdog.org\/resources\/cwdvswarfbrief.pdf\" target=\"_blank\" rel=\"noopener\">This week's stem cell suit said<\/a>,<\/div><blockquote><p>\"WARF did not create or alter the<br>properties inherent in stem cells any more than Myriad created or<br>altered the genetic information encoded in the DNA it claimed.&rdquo;&nbsp;<\/p><\/blockquote><div>The legal filing came in an appeal of<br>an earlier decision by the <b>U.S. Patent Office<\/b>. The Public Patent<br>Foundation, which was a successful party in the Myriad case, did <a href=\"http:\/\/www.pubpat.org\/brca.htm\" target=\"_blank\" rel=\"noopener\">the earlier legal work<\/a> on the challenge to the WARF patents as well as this<br>week's appeal.<\/div><div><\/div><div><\/div><div>The appeal, prepared by <b>Dan Ravicher<\/b>,<br>said the WARF patents have \"put a severe burden on taxpayer-funded<br>research in California.&rdquo;<\/div><div><\/div><div>Trounson released a statement saying,<\/div><blockquote><p>&ldquo;We don't want to do anything that<br>gets in the way of finding treatments for some of the biggest killers<br>today, so we feel that all patients with all kinds of diseases<br>deserve to have access to these kinds of cells.&rdquo;<\/p><\/blockquote><div>Loring was quoted in <a href=\"http:\/\/www.consumerwatchdog.org\/newsrelease\/consumer-watchdog-public-patent-foundation-ask-appeals-court-reject-key-human-embryonic-\" target=\"_blank\" rel=\"noopener\">a Consumer Watchdog press release<\/a> as saying,<\/div><blockquote><p>\"Human embryonic stem cells hold<br>great promise for advancing human health, and no one has the ethical<br>right to own them.&rdquo;<\/p><\/blockquote><div><b>John M.
